ACLU Prepares Lawsuit Against Denver DNC Plans for ‘Free Speech Zone’

The infamous “free speech zone,” set to make a comeback at Denver’s upcoming Democratic National Convention, needs to be within earshot of delegates, a coalition of civil liberties advocates backed by the ACLU said Monday.
Chain link fencing or chicken wire at the end of the parade route, about 700 feet away from the Pepsi Center under the current plan, would separate demonstrators and protesters from other convention attendees, the Rocky Mountain News reported. The coalition have amended their pending lawsuit against the United States Secret Service and the City and County of Denver, filed in May, saying that the plan could violate the visitors’ First Amendment rights, echoing the corralling and effective silencing of protesters at the 2004 gala in Boston. A judge in that case had ruled the “free speech zones” unconstitutional, but said that the suit was filed too late to order that plans be changed.

“No human voice, or any other sound,” ACLU counsel said in Monday’s amended complaint, “can ever hope to reach a person at the entrance.”
The case will go to trial on July 29.
Preparations for the upcoming convention, for which Denver has been federally granted $50 million, may include military choppers, as seen during a mid-June Department of Justice drill, details of which could not be revealed by the Denver Police Department. Lt. Nathan Potter, a military spokesperson with Special Operations Command, called the exercise “routine preparation for the global war on terrorism,” completely unrelated to the upcoming convention.
Denver Sheriff division chief Marie Kielar also told Colorado Confidential in May that her department is preparing for convention-related arrests to top 1,200. The City and County of Denver will not make publicly available detention plans, such as where those arrested will be held, before the convention. In addition to the May suit, the ACLU has demanded that the City and County make publicly available the procedures it plans to follow in processing those arrested at its downtown jail.
The Monday complaint called not only for a protest zone closer to the Pepsi Center, but also that it large enough to host all demonstrators, and for searches to be conducted only when there is probable cause.
“Simply put, we are going to abide by the Constitution,” Denver city attorney David Fine said Monday.

Another example of double-think here. The ACLU is not asking for the abolition of the free speech zone, they are just haggling over the size and location of it, thus asking the court to legitimize free speech zones. They should have asked the court to rule it unconstitutional and thus allow the protestors to demonstrate wherever they like on public property.
Also, they are asking for arrest plans? They are basically saying that arresting protesters is expected and a normal course of action, when in fact arresting someone for exercising the right to free speech is totally unconstitutional.
And if the city of Denver says they are following the Constitution, why are they setting up free speech zones? They are obviously NOT following it.

All states and territories within the United States are free speech zones. All public property is a free speech zone. The United States Constitution is the Supreme Law of the Land and cannot be overridden by any law or decree, it can only be amended. There is no compromise, there is nothing to discuss or deliberate. There will be no concessions – what is right is right, and cannot be infringed upon by any government.

It seems as though the ACLU always files first as if they are really being the people’s champion. I don’t like the ACLU speaking on my behalf in court. More of the “GOOD COP” in the good cop bad cop sting. They go to court and file on weak objection not really declaring the absolute Freedom of the constitution and its declarations. Then there is a ruling by the courts that becomes binding and WE the people become more enslaved to these verdicts of compromised liberty. Freedom becomes slavery in such a manner.

Free speech zones are a form of incarseration, if you ask me. And anyone who goes into one is seriously messed up in the head. With agent provocateurs running around freely, how do you know they won’t start slinging rocks and poop, and cutting the chain links? Next thing you know, you’re trapped in a cage surrounded by angry, armed cops. Even a pig wouldn’t wander into such a trap so easily!

Free Speech Zone? I’m glad I live out in the country. My big mouth would of gotten me a jaw wired shut and a long incarceration. Arrest me for speaking my mind, and when I provoke you into hitting me, it’s on. Go for the eyes. Scoop them out like soggy, melon balls, and speaking of balls, you better not swing them close to my mouth, I’ll clamp down on those bad boys like a pit bull. Four fingers behind the collar bone works too. Yank it down and snap that bitch like a wishbone. If they have armor on, kick and punch soft tissue. Bring a socket wrench and unbolt garbage cans and light posts from the ground, and use them as battering rams or to block streets. They throw down shields and batons and form a Phalanx, so must the unspecified group. Lock arms and hold on tight brothers and sisters, the blood and screaming is about to start. Also if your in a free speech zone, you won’t be able to carry a gas mask. A rag with your own urine will keep the irritant out of your nose and throat temporarily. Your eyes are harder to protect. Paint or oily substances thrown on their visors will drastically decrease vision, they might have protection, but their running blind. Cow bells and air horns can help break down their communications. Be resourceful. The black flag anarchists just don’t give a shit about collateral, peaceful protests won’t put fear in them. Throw yourself on the gears of this fucking monster. The time is coming soon to fight back.

Well actually Robodoon, if you dress in an officers uniform…then you will be carted away for impersenating an officer…which is a very severe offense akin to impersonating a soldier. What they really need to do is gather a few thousand protestors and not obey the free speech zone. The police may arrest a few people…but trust me, they won’t arrest everybody. One time in my highschool we had a mass demonstration for our rights and the SRO’s couldn’t do anything about it…and the rules changed lol

meisen ya gave me some hope. im in high school right now.as a matter of fact im enjoyin my summer right now and i got one year to go in that prison. i havent been happy on what ive been seeing and experiencin in florida school systems.there needs a change, i could be the one to do it. jus need the motivation, plannin, and speech to wake these stupid, apathetic motherfuckers to rise from thier sleep of ignorance rto make our voices be wherever we are, mike in austin your totally correct on that by the way.

The final outcome will be the same regardless of whether the ACLU wins the lawsuit or not. Even if the ACLU wins the suit, a precedent will be set implicating that free speech is still permitted, as long as you do it where you’re told, where it doesn’t matter – that is no longer free speech – and that protestors may be legitimately arrested for trivial reasons, if any reason at all – just as long as we know where they’ll be detained. So it’s purpoted that we still have the right to free speech and the right to protest, but in reality we do not.

So what if we practice free speech outside of the zone? How on earth do you “nickel and dime” people into such a thing? If that is the only free speech zone is the rest of the area not under the protection of the constitution? Why not just block the entrance as a protest? You do not need permission to protest THAT IS THE POINT OF A PROTEST !!!!!
