Another Video of NYPD Cop Brutality Surfaces

The day after a video emerged of a cop knocking a cyclist to the ground, a second video alleging police brutality surfaced today in which an NYPD officer is seen whaling away at a man’s legs with a baton.
The footage – shot on July 4 on the Lower East Side – shows Officer Maurice Harrington repeatedly hitting Michael Cephus, 46, on his legs with a collapsible metal baton as he struggles with officers trying to cuff him.
Harrington – a four-year veteran working out of the 52nd Precinct in The Bronx – had his badge and gun taken away and was placed on modified duty when the tape was turned over to the department’s Internal Affairs Bureau.
The video does not show how the confrontation began. According to the criminal complaint, Harrington and fellow Officer Joel Medina said they encountered Cephus – who they thought was drunk – around 8 p.m. on Delancey Street under the Williamsburg Bridge.
When they stopped him from entering a nearby park, they said he swung an umbrella at them and struck both officers “with closed fists about the body.”
Cephus says he wasn’t drinking that day and denies having gotten physical with the officers.
“I was with some friends at a cookout,” he said. “I stepped out of the park to get some ice. The officers told me I couldn’t return because they said I had alcohol. I told them it was only ice.
“They thought I was drunk and they just came at me. They started swinging and hitting me with the batons.”
Cephus was charged with assault, criminal possession of a weapon, menacing and resisting arrest.
His attorney, Adam Orlow, said that even if his client did what he is accused of, Harrington used “excessive force.”
“Let me be clear – he is maintaining that he absolutely did not do anything they say he did,” Orlow said. “He never took a swing at them. He never was aggressive to them.” Patrolmen’s Benevolent Association president Patrick Lynch called the use of force “necessary.”
Cephus – a truck driver from Brooklyn – said that when he arrived at the police station following a trip to the emergency room, he saw the two men who shot the video. They said they had been busted for disorderly conduct. But earlier, they had managed to slip the tape to one of Cephus’ friends..

Even if the guy was drunk, the police officers had him subdued, and outnumbered. The situation was under control, and still the police officer decided to repeated strike the poor guy about the legs repeatedly for no other reason than to be cruel and sadistic.
Well, all I can say is get used to it. Do we expect police officers to be held accountable for their actions?

Hmm. Tuff call. Looks like he was resisting to me. The cops were trying to get his arms behind him so he could be cuffed. He was not cooperating. You can also hear the cop saying give me your hands and he kept resisting. Also, what happen prior to this event? I’m not trying to defend the cops, I just don’t like to see a small part of the video.
C’mon people. Don’t post half ass footage to make cops look bad. We already know most of them suck. This just looks like a desperate attempt to post an incriminating news story.

It’s sad to watch the cops do this to the people that they are suppose to be protecting. But what is even worse is all of the people that just walk on by. If everyone there just bum rushed the cops, made a citizens arrest, and then drug those piece of shits to the nearest Police HQ and demand that they be charged with assault with a deadly weapon.

He was barely resisting. They could have easily put him on his stomach and got the cuffs on without whipping him mercilessly. I mean he takes at least 10 extremely violent swings at his legs. It’s blatently clear evidence of assault with a deadly weapon. He actually drops the baton at one point, walks over, picks it up and starts thrashing again.
But according to the protectors, their actions were clearly necessary. The slave terrorist was not obeying their orders and they had to show him who his masters are. I’m surprised they didn’t taser him and beat him for his criminal actions.

As a law enforcement officer, I have mixed feelings about the video. But the comments prove the ingorance of the general public in the use of batons, and ignorance of the police about how to use them. Police use to carry a PR-24 sidehandle baton. These were great tools for control. You first deflated the opponents, usually a strike, then proceeded to use the baton for a control hold. In the 90’s most departments went to the straight baton because the cops were too fat to carry the sidehandle baton. Unfortunatley, the also eliminated the training. Monadnock, the primary producer of sidehandle batons require 16 hours before it can be used and required yearly training. But that training was certified though the company and not the agency. THis ensured that the training and usage complied with the manner in which it was designed. As the agencies went to the collapsible straight baton they fell back upon internal training with the old 30 inch wooden stick: beat them until they give up. Bad, Bad idea. Only monadnock still teaches how to use the straight baton for controlling a subject. If the public knew how poorly trained the cops were then they would demand better training.
Finally, the public doesn’t know how cops are hired. You think that they go through rigorous background checks? What a joke. They go through all the checks but then ultimately some personel administrator will make a decision. So if a great guy comes along but one thing in the background is not liked, they’ll get the boot. What happens more often than not is that idiots will apply with a friend in the department and they’ll call the personel admin. and he’ll pass them through to the hiring phase. All those test are optional and don’t mean a thing.

These things go on every day, all day in the United States. And if the police catch you trying to record their crime they “confiscate” your videos because they don’t want any of this to go beyond the neighborhood level. There’s something terribly, terribly wrong with a country that allows this kind of behavior. The people at the top of the food chain in American society KNOW this is going on and ENCOURAGE it because they don’t give one big damn about the “little guys.” They use these hireling thugs—cops—to brutalize and terrorize the populace to keep them under control. If the victims of these tactics try to do something about the way they are treated—going to court—they are again brutalized by a corrupt judicial system and told they should roll over and “obey.” This society may collapse in on itself before that Hitler wannabe—George Bush—gets his chance to lock us all away in his detention camps.

This kind of stuff is hard for me to watch my mother and father were both victims of police brutality and so have I. Call it a family affair. I haven’t liked them since about age thirteen, when they tried to shoot my dog and they actually tried to shoot my father when I got in front of the dog and they pointed their guns at me. They drove me picked me up for smoking in the park, and they were on a little fishing expedition for my father. (they stalked him because his ex wife was cheating on him with a local cop and there was bad blood) They don’t mean well, and yes I have issues with them because of it. They make me nervous, and it’ s caused me problems with them even now. They can see my blood pressure and temperament changes around them. I fucking hate cops. I should sue them for giving me PTSD.

It is very hard to imagine how someone could defend these thugs and criminals that they call officers of the law. There is no way that man did anything wrong to deserve what the criminals in the video had done to him. And if this man was guilty, and resisting arrest these so called cops went so far over the line that i hate admitting that i even live on the same planet as them. Well from the evidence on this video I would defend the police officers actions. From what was taped, the officer only hit the suspect 10 ten times not in rapid sucession. From what I observed the officer was not in a rage or being out of control. if the suspect had just put his arms behind his back he would not have ben hit.
Reading the description of the incident is where it gets fuzzy for me. Who should I believe? This officer should not have any punishment for this altercation.

I believe the intent of the cops is to cause people to respond with violence. They will use this as an excuse to further take our freedoms away. The best thing to do is sue them for millions… Flood the courts with lawsuits against the city and police force as well as try to change the laws so you can bring criminal charges and lawsuits against the cops themselves. Right now a cop has nothing to worry about since they are personally protected.

The video doesn’t show what happenned at the beginning to provoke these officers into a violent rage, but it is obvious that this man was doing nothing to deserve this type of beating. These cops must have the new “JJE” position – “Judge, Jury & Executioner”. It’s a good thing that I wasn’t there, because I would either be dead or in jail right now. Wrong is wrong no matter who these thugs are or what amount of training (or lack there of) theyv’e had!
Quick story. When I first got back from Iraq, I moved back to my hometown and took a part time job as a cemetary caretaker. I needed the slow pace for awhile to get my shit back together. Every night I would drive around till midnight or so and listen to my radio and just try and clear my head. For two nights in a row I had this small town cop pull me over for no reason, just to see if I was drinking and driving. He even admitted it! On the third night he pulled me over again and ordered me out of my car and searched it! I told him that what he was doing was illegal and he did not have probable cause to search me or my vehicle. This really pissed him off and he told me that if I didn’t “get my lazy ass out of town” he was going to place me under arrest and take me to jail. After he drove away I noticed he pulled into this parking lot about two blocks away where he could get a good view of passing motorists. So, I did what any good patriot would do. I put my car in drive and gave it the gas. I drove down the street where the cop was parked, steered to the right and T-BONED this F**CKER doing about 45-50 mph! No shit! It broke both his legs and his left wrist. Needless to say, I did in fact go to jail that night. They charged me with felonious assault, but lucky for me I had a damn good lawyer and we plea bargained it down to a misdemeanor. I spent 45 days in jail with a smile on my face the whole time.
The point of the whole story is that people have to stand up for themselves and learn to push back. They may have the “law” on their side, but we have the numbers!

I saw one cop turning his arm in an unnatural way and the other trying to pull him in a different way. The man couldn’t turn over if he tried. Busting the mans knee cap and shin was not necessary. All the cop that beat him had to do is let his arm go so the other cop could roll him over.
I guess cracked bones are better than another taser death. I wonder if the man can work a job that requires him to stand or carry weight? If not the tax payers may have to pay for disability payment.
I wish we could have seen the whole incident so we could get a better idea of what really happened.

What is even more crazy is the people who shot the video of the person getting beat where also arrested of “disorderly conduct”. They saw someone had footage and they basically took their camera and arrested them on a trumped up charge. That also tells me that the cop is lying when saying that the person they beat was violent to them. Its getting down right scary folks, I’m afraid of police because they can basically do whatever they want and charge you with whatever they want if you even give them a hint of lip…aka telling them you have rights or just asking basic questions as to why you are being stopped (harrased). Poster #57, when people refer to the “death camps,” they are most likely referring to the very numerous FEMA camps around the US. They seem to have no purpose currently, and yet there are quite a few, and more are on the way. They are mostly located next to railroads, and the trains on these railroads have benches inside and shackles to keep people in place. The fencing around these camps also have barbed wire angled inward, designed to keep people in rather than out. For more information, look at direct video footage.

The vicious cops that beat Rodney King probably would have stopped whaling on him if they knew there was a camera on them. Remember, we were expecting some of them to do time and very definitely be fired from L.A.P.D. The results were a lousy cop out on justice and the people reacted with some serious smashin’ and burnin’ that week. I can’t believe how far we’ve fallen! Look at these fuckers just beatin’ the crap out of the weak and the drunk and the injured…sometimes for just standing still and asking questions. They’ve smacked and tazed and hogtied women, too. All because they’ve recently been given “license to grill” and issued new little semi-lethal compliance “tools” like tazers, along with department policy training to use them as often as they see fit if they “feel threatened or get frustrated”. HOW PATHETIC !!! And the bastards are doing it right in front of running cameras and then arresting the cameramen for “disorderly conduct.” Real mature gentlemen police used to go ahead and physically stop any flailing from the suspect and get the cuffs on him/her and put them in the car and get going with the arrest. They watched and checked each other on procedure because our civil rights used to matter to them. They used to work out to stay in shape for lifting uncooperative people and subduing them when they had to. Now, so many are just resorting to such inhumane tactics as pile-ons, body slams, taze fests, breaking bones, batoning human beings like they were pinatas, and sometimes just pumpin’ them full of lead like old brother Diallo got. Needless to say Jack Webb would have damn well been ashamed and probably wondered if he was watching the Twilight Zone. Sure, we got the good cops with noble consciences, too. But where are they when these outrageous infractions are happening? Can you believe how the other Policemen walk onto the scene without warning the assaulting cop to stand down or cease the beating…especially when they all see the cameras. Where the hell are the good ones in this scenario? Are they all complicit in these cases? That’s nothing short of thuggery. At any rate, law enforcement needs to re-evaluate their state and federal protocols issued from HS. and above all else, enact more selective standards in hiring law enforcement such as mandatory psycho-analytic testing. I am responding to post 98 and any similar comments about how the police in the video were justified , even though he appears to resist. It is not a matter of him resisting , it is the excessive force and how they are treating a human being to which , this man said he did not provoke this action. This thug cop has general mental problems that some police have, it was like a roid rage, a unstoppable criminal conduct that no police officer should ever think of using. The officer was beating him and dehumanizing him. How do you think a person who is getting beat that bad should act ? How can they physically act ? Just because a cop does the beating does not make it ok and just because a cop beats the hell out of someone, does not mean they can just say ok like nothing happened after the trauma that cop caused that man. How can you just comply after getting the hell beat out of you. I think those who cant see what is wrong with that kind of police misconduct , have never dealt with the cops but have only seen them on t.v. The new type of police that are being trained ,do not act like boyscouts, they are not your friends. They see it as a job and a paycheck and think that violence is ok, except for the rare few cops that can keep a pure kind heart, even at the expense of being laughed at by their own peers. So , this is the new world we live in. Officer friendly of the past is gone. Now it is officer unfriendly/ officer to beaware of the danger of. Prosecute the cop and press charges. Give me a break, Law Enforcement are trained in subduing suspects and it is quite obvious that these cops didn’t know how it is done. How do you turn someone on his back when one cop is pulling in one direction and the other cop is pulling the other way? They could have physically sat him up and rolled him over, instead the took a metal baton and AIMED FOR HIS KNEE AND HIS SHIN. If you take a look at the video closely when they focused in on the legs the VICTIM was bleeding from the various strikes.
I am a firm believer in PROPER LAW ENFORCEMENT. aka protect the peace and citizenry FIRST.

I have always had the greatest respect for policemen — my brother was one until he passed away with cancer. But officers like this should be sent to prison. I was infuriated at the bicycle video but this one is a tad different. That cop was still pretty brutal but at LEAST it shows the cops for a few minutes trying to get the guys hands and he just wouldn’t comply. Its hard to just outright say “OMG LOOK WHAT THEY ARE DOING!!” When all the guy on the ground had to do was let them cuff him instead of fighting with them the whole time. “Take the picture his leg, take the picture his leg!” Learn some english…..

Never take a 1:43 minute video and make determination of what happened which led to the incident.
None of us were there to witness anything except the offense. I have seen numerous occasions where all could have been avoided if the person suspected of a crime would just put their hands behind their back and take it up in the courts, a much easier won battle.
When an officer gives you a lawful order, such as “put your hands behind your back you are under arrest, you must comply, it’s the law. If he issues you an unlawful order, put your hands behind your back, go to court, and in 85% of the cases, your case will be dismissed. Even judges know when someone is full of crap in their reports.
But to argue, fight, move around, try and talk your way out, or ask the cop to explain the legal aspects and ramifications to the arrest, is futile on your part.
So quick to judge with nothing but a 1:43 video. What caused the arrest to take place, and what happened before the camera was turned on. I’m not condoning the actions of bad police, but I’ve witnessed too many thugs, and criminals that just will not comply out of sheer ignorance that sometimes you have to PUT them in handcuffs.
One word of advice, STOP BREAKING THE LAW ASSHOLE !

Don’t Care a Bit that’s absurd to comply and take it up with the court. With the police state today you might not make it to the court. You could be murdered and have the official story say you “accidentally” strangled yourself with your handcuffs (and if you don’t know what I’m referring to I’m not surprised as your response to the video hints to ignorance of the corrupt reality we live in).
Or better yet since Habeas Corpus is bye-bye, they can just detain you indefinitely without ever pressing charges.
I agree that people shouldn’t break laws but only if they don’t go against your rights protected by the constitution (notice I didn’t say “constitutional rights”. I hate that term! it implies that your rights come from the constitution when in fact they come from our creator…the constitution is simply supposed to protect them).
Have you seen the movie Crash where the officer is basically molesting the man’s wife right in front of him? Did he do right by “complying”? If it were my wife I would have exercised my right to bear arms and sent a piece of hot led straight at his skull and then we can “take it up in court” if they’d like.
Bottom line if a police officer goes against his oath to protect and defend the constitution against all enemies foreign and domestic, and he UNLAWFULLY decides he’s going to be an on the spot legislator, judge and executer of what ever punishment he deems necessary, then he is no longer acting as a protector but he is a criminal. Thus we should defend ourselves in the same manner in which we would against any other criminal.

This is very common in NYC. Prices over there are outragous for groceries and part of the economy is really screwed up over there. I bet the Police brutality rate is so high there that tourism is really slumping down real bad. This also happens in LA and major cities. Stress levels are very high there and people are very hungry there. When I used to go to Staten Island NY, going out to eat there was extremely expensive and I was always hungry there and this was 10 years ago. I read the first twelve pages and comments and the general ingorance by the “anitpolice” crowd is amazing. First, I bet you all a bunch of punks that talk a lot but run when confronted. Does that offend you? Good, it should. Cowards. Second, I didn’t read any replies to may original post. I discussed training and hiring practices, which is may or may not lead to incidents like this. It seems like nearly everyone else merely wanted to berate (if you don’t understand that word, get a dictionary morons) the officers and not address the real causes. As long as the system can divert your attention away from the real cause, they have won. It does not matter what the cops do if they are all you focus upon. As long as the systems hires the wrong people and trains them improperly it will continue. You must take the issue up not with the cop, but the training director, police chiefs, etc.
A perfect example: Seattle, WA several years ago. Remember the golden boy chief of police whose wife divorced him then he went nuts and shot her in the parking lot of some store infront of his two children. Did anyone ever wonder how he got promoted that high? No. Why? Because you jerks focused upon the person and not the process. Don’t you think his behavior/personality wasn’t known before the incident? Of course it was, but those that knew were probably scared to say anything. Hell, he probably threatened them with murder if they spoke. Remember what I said about the hiring process? Another example: the Chief of POlice in San Fran hasn’t qualified with her own weapon in two years. She was ratted out, thankfully, by a subordinate officer. Policy there states that ALL officers shall qualify every six months. Failure to do so shall result in a suspension without pay until qualification. After two incidents the person will be fired. Why did she remain on the job? It’s politics. It’s the process.

im grateful that somebody was able to document this. even if the police report is true, how can it possibly mitigate or even attempt to explain the unnecessary use of a weapon while remaining rational. is this really what youre trained to do, joe? where is the humanity in all of this…

Beating the guy with a stick in an attempt to force him to comply with commands aimed at getting him in a position to be handcuffed is inhumane, brutal and inefficient. If these cops are so goddamned unskilled and helpless, they need to get someone there who understands how to deal with people. Yes, the guy was resisting arrest. However, under the common law a citizen has the right to resist arrest if the arrest is unlawful. I do not know if that is the case here, but it is a fact, codified in most states, that is ignored by law enforcement, judges and most juries in this country.
Forced compliance with repeated pain and injury is not the answer. What’s the hurry? Give the citizen a little time. He will eventually agree to get up. Brutality is unacceptable in a free society.

i am by no means an expert but i’m sure there’s something in the bill of rights about cruel and unusual punishment . i don’t care what the guy is supposed to have done , that was clearly an unprovoked assault . if it went down the way the guy said then the arrest was illegal from the very start , unless prohibition has made a comeback in the states . that was just outright torture . you can dress it up any way you like and call it ” pain compliance ” or whatever , torture is torture . what i found most disturbing about the whole thing was that not one of the people watching did a thing to help the poor guy ! oh well , guess that’s just the way it goes .

#178…..I’m a criminology major with a year and a half to go before graduating. I take classes part time while I work full time. I also plan on joining my county’s Sheriff’s department as a uniformed reserve deputy within the next few months.
While at school, an instructor once told the class that we should view everything with the critical eye, even if it’s coming from a professor, a peer reviewed and approved journal, etc. Point is, very few have watched this video and not jumped to conclusion. Most people who have commented on this video lack the ability to, or are unwilling of viewing this video with the critical eye. Why? Because it means that they’d actually have to do a little “footwork” in the research of the case as opposed to just listening to Alex rant about jack boot. This is a component of laziness.
I don’t really care what anyone says or thinks about me on this site. I enjoy Alex’s websites and his show because I find the conspiracy enjoyable and entertaining. Yes, I admit that Alex does get somethings right. Hey, everyone wins an occasional hand at the black jack table.

At no point in time did one of the officers say If you don’t stop resisting I’m going to have to strike you with this club! Please stop resisting! Please stop resisting! And why were the people that filmed the incident arrested too? No. that S.O.B. just got pissed off and started getting off on poping him with that club. Shortstride – post 209 – is it fair to assume then that you have no explanation for the police officers conduct ? i must , therefore , conclude that you , assuming you are neither evil nor suffering from some sort of mental ipediment , agree that the actions of the police officers concerned were wrong in the extreme and that they should immediately be stripped of their status as police oficers and be subject to prosecution for the criminal behaviour they are clearly engaging in . have a nice critical eyed day .
