    Mark Klein, the retired AT&T engineer who stepped forward with the technical documents at the heart of the anti-wiretapping case against AT&T, is furious at the Senate’s vote on Wednesday night to hold a vote on a bill intended to put an end to that lawsuit and more than 30 others.[Wednesday]’s vote by Congress effectively gives retroactive immunity to the telecom companies and endorses an all-powerful president. It’s a Congressional coup against the Constitution.

    The Democratic leadership is touting the deal as a “compromise,” but in fact they have endorsed the infamous Nuremberg defense: “Just following orders.” The judge can only check their paperwork. This cynical deal is a Democratic exercise in deceit and cowardice.

    Klein saw a network monitoring room being built in AT&T’s internet switching center that only NSA-approved techs had access to. He squirreled away documents and then presented them to the press and the Electronic Frontier Foundation after news of the government’s warrantless wiretapping program broke.

    Wired.com independently acquired a copy of the documents (.pdf) — which were under court seal — and published the wiring documents in May 2006 so that they could be evaluated.

    The lawsuit that resulted from his documents is now waiting on the 9th U.S. Appeals Court to rule on whether it can proceed despite the government saying the whole matter is a state secret. A lower court judge ruled that it could, because the government admitted the program existed and that the courts could handle evidence safely and in secret.

    But the appeals court ruling will likely never see the light of day, since the Senate is set to vote on July 8 on the FISA Amendments Act of 2008, which also largely legalizes Bush’s warrantless wiretapping program by expanding how the government can wiretap from inside the United States without getting individualized court orders.

    Klein continues:

    Congress has made the FISA law a dead letter–such a law is useless if the president can break it with impunity. Thus the Democrats have surreptitiously repudiated the main reform of the post-Watergate era and adopted Nixon’s line: “When the president does it that means that it is not illegal.” This is the judicial logic of a dictatorship.

    The surveillance system now approved by Congress provides the physical apparatus for the government to collect and store a huge database on virtually the entire population, available for data mining whenever the government wants to target its political opponents at any given moment-all in the hands of an unrestrained executive power. It is the infrastructure for a police state.

    Neither the House nor the Senate has had Klein testify, nor have telecom executives testified in open session about their participation.

    The bill forces the district court judge handling the consolidated cases against telecoms to dismiss the suits if the Attorney General certifies that a government official sent a written request to a phone or internet provider, saying that the President approved the program and his lawyers deemed it legal. Judge Vaughn Walker of the California Northern District can ask to see the paperwork, but would not be given leeway to decide if the program was legal.

      No law can be made retroactive Im sorry but it just doesn’t work like that. This just proves that the government entities are desperate to crawl out of the hole that they have dug for themselves.
      Suicide is the only way out for our law makers and judges. When you take an oath to uphold a standard of humanity, and you violate those oaths the richter of justice comes down on the head of the one that violates. There’s no where to run and no where to hide from your self. Watching evil implode upon itself is just great. Just keep on violating your charter, president Bush and Congress, your pawns are your worst enemies and it will be for our enjoyment to watch you all kill yourselves one by one. People come with a built in system called “the guilt will kill you”.       If all of us try to come up with solution’s instesd of just bitching and complaining and getting absolutly nowhere we might be able to turn this thing around. it is my belief that we can take back America and do it very easily by voting out all incumbent’s. Can you imagine the fear we can send up their yellow bellied sap sucking spineless back’s once they see that the people are united behind this cause?       One good thing about this country we can sit here and lampoon the government! Im new to the computer and it just blows my mind what’s happening on this thing. Im in Hawaii on the Big Island where nothing is happening but the volcano. The government is so primitive and so corrupt and so ignorant. And everything is pretty slow and pretty cool. I have my complaints but I really am not feeling the same martial law pressures all are feeling. Marijuana is the big prohibition here. All the growers are going to jail and getting their properties seized. And the government continues to chip away at civil rights here.       Honestly, are you serious? Vote these people out of office? Easy to say but hard to do. Even if people tried to I wouldn’t find it far fetched to think they will get vastly miscounted and spun. People are willfully ignorant in this country and things have to ultimately affect their bubble lifestyles for them to give a crap. It has to affect them in a tremendous way to where their balled up in the corner and pissing themselves. I’m totally not kidding, I talk about this stuff everyday to people and even if they acknowledge a lot of the facts, they still feel powerless and ultimately uncaring.

      As long as you have the type of media that we have today, voting doesn’t matter. It’s a psychological battle, hence Alex Jones calling his show/website “INFOWARS”. I say taking care of the media comes first, then you can start thinking about voting people out of office. People are sheep, the politicians are the sheep dogs, and the media is the shephard. Marketing is king these days, in almost everything really. I mean, take apple products for example, cool product but an absolute rip off. However, people can be convinced to pay the money as long as they feel it’s “popular” and “cool”. Doesn’t matter wtf the product is, all that matters is the packaging and advertising behind it (aka The Hype).

      This is an extreme analogy, but bear with me. You could almost sell an American a piece of shit as long as the package looks nice and Britney Spears promotes it and you have flashy or sexy ads. So you take away the media and the rest of America can just see the shit for what it is and realize that they’ve been conned. However, as long as you have the media that we have today, any piece of shit can look like a bowl of roses at face value to most willfully ignorant Americans.

      Media is one avenue, mass effect is another….multiplied numbers in a public forum does show Shit for what it really is Shit…if millions marched, like the million man march does in DC then we could make a Media impact, much bigger then one site and one man Alex Jones. I love Alex, but one man and one site serving a group of people isn’t enough. We need a multi-million person vision….and the time is right, we could even combine with other groups including the NRA…but to think this group will solve the media problem is simply obserd. Alex getting the info out is AWESOME, but is anyone truly acting on the info in a positive and legal way…..some yes…but most NO…..Most are reading it, ranting and raving on chat lines and forums, but no real concrete action. Alex makes action all the time, but is one person going to change this…NO…we need a nation of people…..just my 2 cents….not saying changing the media isn’t important, but since we know they are in bed with the neocons, its unlikely to change…but get a million people in DC and 30 news agencies covering it, and for sure that attention will raise some americans eyebrows….

      #18 Peter… we are in agreement. I’m not saying go put CNN out of business and start our own news networks, sorry if I was unclear. What you suggested is exactly what I am suggesting. You have to get out there and contest what is the “popular” view suggested by mainstream media. The best outlet we have for this is not just doing posts online but getting outside and talking to people and making them feel like “Wow, the way I feel doesn’t have to make me feel alone, there are people all over that can stand by me”.

      There’s a lot of Americans that don’t know the true facts and that’s because the mainstream media has them in a bubble. Even people that have their doubts but not all the facts are willfully ignorant because it feels like the “safe” way to be without being ostracized from society. But, if people start hearing this word on the street and hear facts that make more sense from real people, they can start to break their subconscious ignorance and start critically thinking for themselves. People live in a bubble and you have to burst a lot of bubbles created by the mainstream media and have a movement before our votes start to count.

      It’s easy to make posts online, but it’s harder to share these views with real people. Even though I get through to people and make sense to them, they still feel like they can’t make a difference. But, if they hear it from me, then a friend, then a family member, and other strangers they will start to feel more confident and “safer” to start sharing in the movement themselves.

      With that said, I think we are on the same page, are we not?

      I see a lot of comments here that, while I find interesting and well placed, don’t really seem to be anything other than people ‘blowing off steam’. How about we put this blog to good use and start trying to make a difference before this whole thing becomes a full scale civil war. That Congress is not entirely complacent in the Bush regimes war on American is obvious, or should be, by the fact that he (Bush) has taken so many steps to keep Congress even from knowing what hes doing. Now is the time to make use of this fact. Write (email) your Congressman en masse, tell them to impeach and encourage everybody you know to do the same. The time is now to make your voice heard make your opinion known, now while he’s still in office. Think about this, a federal judge has said that Bush has committed crimes, a federal prosecutor wants to prosecute him, the UN has questioned his actions, the Red Cross says Bush and Cheney have both committed war crimes, the leaders of several other nations have stated that Bush threatened and bullied them, as soon as he looses the protection that his position as President of the United States affords him his ass is fucked and he must know that. His only option is to find a way to maintain that power. We have to start the proceedings while he is still in office to hinder what ever plan he has to keep power and to assure that his office will not continue to protect him.       A civil war would not be a pretty sight, through mass activism we need to wrestle the controls of the nation away from the NWO. I believe they would try to take the system down with them, but we really can create a good government with many of the nation’s congressmen and Judges. Executive power must be curtailed immediately. The Army & Police must be informed so martial law cannot be fully implemented. Canada must be awakened simultaneously with the USA. Legislation must be passed that strictly prohibits the Mexican national army from supporting the NWO military in the USA. We must immediately take economic control from the Federal Reserve and follow a sensible monetary policy. We must stop an attack on Iran! We need support from the British people, pressuring their government to support a restructuring of government!

      We need people on street corners, in market places, in shopping malls. People talking about the NWO, talking about freedom. The internet buzzing, chatrooms, IRC, message boards. Send news items to local papers. Write to your congress man. Stage meetings, go into bars and hand our DVDS, leaflets, music, pictures with captions, slogans on t-shirts. We need a full media blitz on all the channels available to us – BROADCAST YOUR SIGNAL!

      Be creative, be exciting, be truthful, be loving. It’s time to test the democratic process, it’s time to be good citizens, it’s time to be good people. Open your eyes, seize your power and your individuality – become the change that you want to see.
