A 72-year-old woman is pulled over for speeding, then tasered and sent to jail. Kathryn Winkfein says she drives to Austin about twice a month to do her shopping. But on a Monday afternoon, a Travis County Constable deputy pulled her over, on her way back to Granite Schoals.

Winkfein admits she was speeding in the dangerous strip of Highway 71 and Bee Creek.
“He explained to her,” Constable McCain said, “sign the ticket stub, it’s not an admission of guilt. It’s a promise to appear in court. She didn’t want to. She said take me to jail.”
That’s when the officer says Winkfein exited her vehicle and didn’t cooperate.

I don’t know what it is with cops these days, but if they don’t start watching how they treat ordinary citizens, there going to be some real problems. The cops know what we civilians done, but we are learning it every day now. Our 4th Amendment rights and many others have gone with the wind with Bush’s signing of the Patriot Act and the Homeland Security Act. Go read these two documents and see for yourself. These two Acts suspend our rights and that is what the cops know. That is why they think they can get away with anything at all. Both these Acts are unConstitutional and should be repealed fast.

We can do our part by talking to the family members of these cops, and have them remind their law enforcement family members over and over again of the Oath of Office they took to defend the Constitution and the people. Their actions are violating those oaths and their badges. One day there will be a reckoning from the people on all the violations of our Constitution, and Bill of Rights, against the violators. These people will face Treason and criminal charges for those actions they take today against the people of America. There will come a day, they must answer to their actions of today. Just like the Nazi’s had to answer for their actions from World War II. We still have some elite out there that have never answered for their actions yet, but one day, it will come. If not on this earth, then the next existence when they have to stand in from of Christ and God, and answer those questions before they are condemned to Hell.
Law Enforcement must be made to realize we are all humans, we all have faults. Most people run from the police today because they have become brutal and we know it. Whatever happened to the Beat cop, the neighborhood friendly one-of-us cops, I miss those days. You felt safe and protected by cops, now we feel only threatened by them. You don’t even want to call them anymore unless someone is in grave danger. You learn to depend on yourself and your family now.

If i was that cop, an I found that i couldn’t handle a 72 year old great grandmother I would release the tape myself to prove I wasn’t a ball less prick! I’d hate to be that guys partner if i had to chase down a 260 pound meth head. What is it with these guys and there tazers? There’s been a lot in the news lately. I haven’t seen a decent cop in years,don’t expect to ever see one now. By now you’ve seen the tape, she was not a threat!! The only way anyone should be tased is if they have weapon at a distance and they refuse to drop it. That is what a taser was made for, not pain compliance, “which is torture by the way”. And in my opion any cop that uses a taser in any other way should be fired and charged with a offense.

The fact is that more and more I keep seeing these tazers used to MAKE people comply and it has nothing to DO with whether the officer feels threatened or not. Incidentally, the reason why this even escalated is because the lady refused to sign the ticket. She was absolutely right to refuse to accept through signature, a commercial offer of contract that she would show up at their place of business (admiralty court) and be subjected to whatever they chose to do to her. She had not commited a crime (as explained earlier – there would have been a victim if she had) so why should a free American woman be stopped against her will and savagely attacked by a corporate enforcer?
The only way you can explain that is that this is a fascist state pretending to be the “land of the free”.

I live in Travis county and I was rather upset by this particular artical so I decided to call the offices of Mr. McCain and file a formal complaint with his office. The officer notified her that she needed to return to her vehical and she continued to walk into the highway. He tasered her in the shoulder(I dont endorse this on anyone but lets at least tell the whole story) didnt even bring her to the ground because the prongs hadnt been dispered 14 inches and because he tased her in an area that didnt have much muscle mass.She was admittedly not injured. Watch the film carefully. They ask questions to get the answers they want. Perhaps Infowars should not rely on FOX NEWS FOR THEIR STORIES! Mr. McCain is one of the few law enforcement officials that Stands for civil liberties and now fox news has demonized him. Perhaps instead of calling his office and making death threats we should call fox news. Let me make it clear that I am certainly not a nut hugger for the police. I dont trust cops i dont like them and i believe they are being used for the preperation of a police state. uhhh… have you seen the dashcam video yet??? She very clearly DID fall to the ground when she was tased. Besides, I think your comment ignores the basic question of whether the level of forced the “officer” used was justified, or excessive. How is it that this very large man allowed it to escalate to the point that a 72-year-old granny was lying in the ditch by the side of the road, screaming in pain? Sure, she was belligerent. Yeah, she challenged him. MAYBE if he was a qualified peace officer he would have called for backup if he felt that he couldn’t “handle” this elderly woman. He clearly shoves her in the dashcam viddeo. He says that it was to get her out of the road, but watch the video, and then tell me whether he doesn’t look agressive when he shoves her… He tells her at one point that she’s going to be tased, and she says, “I dare you,” so he does??? Sorry folks, but “the demented old lady dared me to do it” is not a defense. I was in Austin over the weekend. Still the most wonderful town in Texas.
Most of the cops on 6th street are pretty mellow and ride bicycles when the

Actually, yes it is quite possible. I was watching the Today show this morning. The head of the Travis County law enforcement Sgt Mgr Gary Griffin said he doesn’t have a policy on the use of force factoring age. He specifically said he doesn’t teach his people to use judgement between a 72 year old or a 16 year old.
Apparently the citizens of Travis County tolerate their cops treating old ladies like this. What happened to common sense and decency coming out of Texas? Oh yeah… I remember Texan’s values. Judgment is not a Texan value apparently.

That must have really been fun to watch; granny thrashing around during that sound tasering. The officer must have been really tickled pink to see the effect his recently issued, brand new, state of the art, fully charged taser had on her. I can just imagine the good officer trying to hide the bulge in his pants after this whole episode. Maybe next time he should throw some water on the prospect to sort of give the taser a healthier charge. Several of the officers can even get together and bring popcorn and pizza to the next tasering. It’ll be posted on the bulletin board. Maybe they’ll even find a way to toast marshmallows and fry the suspect with the same taser at the same time. Hell, maybe they can even abandon the tasers altogether and just use cattle prods on their next victims. That would be fantastic! Yessir, big, strong, strapping young officers getting their jollies off with defenseless old great grandmothers must be some sight to see. This just might start a fad!!! Officer: 1 – Granny: 0.

She was tasered because the constable was irresponsible. From an online legal dictionary: “An assault is carried out by a threat of bodily harm coupled with an apparent, present ability to cause the harm.” A verbal harangue alone is not assault. Besides, from her photo, it would be very difficult to believe that any constable would seriously consider grammy a physical threat.
But let’s get to the most important point. It has been proven too many times that tasers can be lethal weapons. They should be categorized and used as such.

Exactly. The behavior of this officer makes it LESS likely that other police will be treated with the respect that most of them deserve. Some of them seem to have forgotten that their job is to protect and serve, not get their egos fed.
Some people get upset when they deal with the police, others are DWN (driving while nuts). I would hate to think what this woman would do if I cut her off. She does have some anger issues. And had he handled it better, she might be getting an evaluation of her ability to control her temper behind the wheel rather than filing a law suit.

having lived in austin for several years I can attest that the pigs there are a particularly vicious bunch of bootheels. I am a grandmother of 58 and I rescue cats. I don’t use foul language when I found out that a cat that I had rescued and took to the vets for care and to be fixed was euthenized by a mean neighbor who would not listen to a neighbor friend of ours that I had been caring for it. I was so upset and I don’t use foul language. I told the neighbor that she was a “fat american sow and that I should kick her ass”. Anyhow, I had never spoken to them before and was arrested for “harassment” and before I was handcuffed I was threatned by the cop who told me if that cat came into his yard, he would have shot it with a 22. The cat by the way was not a mean cat that caused trouble. It had been too sick. I had also had a masectomy and when the cop got impatient with the other policeman in handcuffing me, he pushed the other policeman away and grabbed by wrists and pulled up high in the back pulling my chest area where I had the operation and it was not feeling nice. On the way to jail I asked the cop how the crystal meth problem in our city was going and he said “we’re fighting a loosing battle”, to which I replied, that is because you cannot do your job good and instead of fighting real crime, you harrass grandmothers who rescue kitties. Also, our police station was bombarded with emails from all over the world from a cat group that I am a member of that shamed and humiliated the police. I thankedthem for all the support. One member wanted to send them a box from the U.K of their cat poop. I told them they had better not because it would maybe give our cat group a bad name and I didn’t want that, but, I truly thought it a great idea. Later on, the charges were dismissed. I did not have a record either. I hope that they get that tape out of what happened with how that policeman treated her. I bet they are lying because that is what they do best is lie, lie lie.

I have been reading all of these comments and one thing stands out. you all saying all cops are bad cops. There are hundreds of thousands of cops in this great country. it is the same as any other profession. there are those that do the job well and those that don’t. cops are always in the spot light and anytime one of them makes the wrong decision you automatically saw that they are all worthless. I am sure that everyone of you do your job everyday without making any mistakes or without using bad judgment. i think you should reconsider putting all cops into the same bracket.

I haven’t read every response, but so far nobody has mentioned that she was smart for not signing. It should be optional to sign. She should be able to seek counsel before she signs anything. It’s a set up for a confrontation to require a signature.
What I would have done as the cop? “OK lady your infraction has been recorded, here is your paperwork, have a nice day and be safe out there.” The results? She would have stayed in her car and driven away. She’s registered, licensed, insured. The cop can know everything about her. Her ticket is logged into the computer. What more do they want?
Being “old” she might have remembered back when people didn’t just sign their name to things because someone said they had to.

Recently I was stopped by a cop and plainclothesman detective in our small town. He didn’t ask me if I knew why he was stopping until I asked him. My dog was locked in the car and he said, “Secure your dog so I don’t have to shoot her.” They were investigating something.
At my last appointment at a gynecologist’s office, in the preliminary interview, I was taken aback when asked, “Any guns in the house?” Wow. Real quickly, like, so it was hard to even imagine a question like that in context. They’re looking for the big gun owners. But the borders? Still open to dope up American citizens to dummy down on their rights if they ever knew they had any. If you went to high school after 1963, I bet American History was a horse of a different color.
I complained to our first selectman, and the deputy policy about the unecessaryily harsh and intimidating language to me about my dog. He promised an answer after an investigation, never got one, duh! This reminds me to write again; with a copy to a senator.
As long as civil servants pick up their pay checks, they’ll do anything they are told; which is scary considering they don’t serve the people anymore; but we pay their salaries with out taxes. Imagine that. Paying for abuse. It’s happening more and more and aI know it’s not because I’m more informed; just more aware that true justice is vanishing from America. I really hope and pray the 9/11 lawsuits representing the families as plaintiffs reveal real evidence. The truth will come out; we know it just takes time…like the NY times pulled out of one of the steel girders…hidden in steel for some 30 years.
Why isn’t there just one honest person who knows the truth from within the fed to come forward?

I recently watched a video on the internet that showed a young man making the very big mistake of running onto a soccer field during a break in the game to cheer his team. The police immediately grabbedhim, threw him down and started to pummel him mercilessly. All of a sudden the crowd erupted with many jumping down out tof the stands to beat the heck out of the several police officers. They barely got out of there with their lives. Now true this happended in Europe so the men there don’t agree to allow themselves to be treated like dirt by the police but wouldn’t it be nice is just someone somewhere in the US would fight back against the fascists?

A taser is a less than lethal weapon that was designed to replace a pistol. It was never, ever intended as a compliance tool and when it is used for this purpose, it is being misused. Many people have been killed by tasers simply for failing to comply. Failing to move fast enough or to control you emotions when you are upset is not grounds for summary execution.
We don’t live in a police state. This is not the soviet union. This is a free country where my freedom of speak is protected by the us constitution. If I disagree with a police officer, that is my right. This officer abused his power.

Did anyone ever stop to think that the cop was only following procedure? No cop ever knows when anyone they pull over, from a 16 yr old new driver to a 72 yr old lady, what could happen. Even old ladies have been known to pull guns and other weapons on cops in similar situations. By tasering the uncooperative woman (just watched the tape on Fox news), he protected himself and kept the situation under control. Maybe someone should tell the old lady she has no right to treat a cop like that. I agree that some cops go overboard with the tasering, but I, for one, would rather be tasered than shot at. Jeesh, people, don’t you care about the people who bust their asses trying to protect us? Think about!

As a 69-year-old granny, I would like to say that I am with the officer. I saw the video from the police vehicle, and the lady was definitely combative, arrogant, and defiant, telling the officer, “Tase me” even after he warned her FIVE times that he might. She also said, “Arrest me!”. Just because you are 72 years old doesn’t mean you have the right to verbally abuse an officer and fail to comply with his request to sign a ticket. Lots of 72-year-old grannies break the law. You read about them running meth labs, engineering scams, etc. The granny in question also lied blatantly about her behavior. The police video exposed her lies. The officer was firm in dealing with her, and she repeatedly goaded him into going to the limit.

I’ve never seen anyone have a problem with a cop if they just shut up and obey the officers commands. Shit happens because people always think they can out-argue, out-fight, out-whatever, a cop. Cops have authority over you when ticketing you, because a ticket is in lieu of being arrested. They don’t have to ticket you. If you ask to be taken to jail, then you are submitting yourself to the custody of the officer, and from that moment on, you are “in custody.” If you try to do anything other than what the cop tells you, you are resisting arrest, and you pretty much have asked for whatever treatment you get. Just shut your mouth, do what you’re told, and then call your attorney. It’s so freaking simple people.

She was speeding in a work zone… She was issued a ticket, refused to sign it. She demanded to be arrested. She refused to stay in her vehicle. She refused to back away from a high traffic area (including, from the video herding the officer into said traffic). The officer warned her that if she did not stop resisting she would be tased, she still kept going…. So he tased her…. She was arrested for the speeding, and resisting arrest. About the only valid pleas left to her are guilty, or insanity..
What she SHOULD have done, was sign the ticket, and if she wants to contest it, do it in court.. like every reasonable person on the planet would do… instead she’s likely to have an extended stay in the local detention facilities.
What I am sick of is morons who are conceited and publically defend lawbreakers… mostly because they must feel that it is ok to violate laws, and should be allowed to get away with it. I suppose most of the people berating this officer are as demented as this lady appears to be.

That he can now dress himself and tase around is proof that there was a constant presence of a woman in his life. Or is this guy just another clone without a mother or grandmother.

God i cant believe the ignorance im reading here. Stupidity. All these people talking crap on cops like they are the worst thing society has going for it. That is ludicrous. Maybe he could’ve taken another course of action, but reckless driving in a construction zone constitutes a CRIME (despite the lack of a victim, the potential victim is still a factor). She wanted to be placed under arrest, then she resisted when he attempted to provide that to her.
His options are:
-Forcing her (most old women are frail, if he forced her, there was a good chance he would break her)
-Spraying her (Which hurts worse and longer then a tazer, ive experiences both)
-Tazing her. Hmmm. Besides for little burns, she alive and bitching (and lying). Ive seen the video, she pulls away, she fails to comply 9 times, she asks to be arrest, and she attempts to leave. What would you do? oh right, it doesnt matter, YOU WEREN’T THERE.
Laws are enforced no matter who the individual is. I dont care if some cops suck, im not going to jump on the bandwagon and hate on cops as a collective.

Pulling the grandma card– only going to sue based on her age. Yes the officer could have apprehended her without the use of the stun gun, but at no point in that womans life no matter how old, will she ever be exempt from the law. Being 72 is no excuse to endanger others and defy traffic laws. I would be embarrased of her if she were my grandmother.
Have you all forgot she was being beligerant and totally undermining law enforcement. Not to mention she was going 15 miles faster than posted in a work zone. He told her many times he would stun her and she persisted. She put other drivers and worst of all, unprotected workers in dange because of her reckless driving.

All I have to say is I’m an unarmed self defense instructor for the Department of Corrections and if this Officer what ever his name is can’t handle this 72 yr old women than by all means please come see me and I will give you FREE lessons. I’m not allowed to treat the convicted criminals in this manner without being fired so what maked him any better than me? We have a Use of Force policy that we have to follow and part of it is ability, size, ect. I really don’t think with the size of the officer that Grandma had the ability to cause him harm enough to justify the amount of force used. Had I use that amount of force on a CONVICTED CRIMINAL (Oh Wait we don’t have tazers or guns maybe pepper spray if we’re lucky) I would have been fired. All I can say to the elderly and ladies in that neck of the woods please be careful and if pulled over stay in your car , if you are asked to get out, as soon as you exit your vehical for your own safty PLEASE lay flat on the ground in a prone position. I know my Mother, Daughter or Wife will not be going any where close to that part of our (free) country alone!!!!!!! Shame on this Police Department

Just watched NBC Today show where Sgt Mgr Gary Griffin says there was nothing wrong with the tazing; in fact it’s department policy as the cop who tazed the Grandmother is the tazer training officer. Sgt Mgr Gary Griffin says he’s trained his department not to factor in whether they are dealing with a 72 year old or a 16 year old or …… age is not a factor in how to handle a citizen he says.
Apparently judgement and intellectual ability is not required of the police officers in Austin. Apparently the mayor is ok with it; the city council is ok with it; and of course the citizens of Austin approve of it because the cop is still employed.
Who’s next???? Maybe your grandmother needs to be tazed. Between Oklahoma State Troopers out of control, the prison guards who allowed the woman in an outdoor jail cell to die of exposure,
the cops who arrested the woman at the airport in Phoenix and let her die… these people are responsible for the people they serve… if someone dies under their watch; it’s murder. If someone is assaulted under their watch, it’s assault. Only a totalitarian State allows their law enforcement to treat citizens like this without consequence.
The cop didn’t taze her to control her; he was angry, listen to him yelling at her!!! Cops aren’t supposed to try and punish people on the spot… except in Texas and Oklahoma and Arizona and………
Finally, guess who’s going to investigate the cop’s behavior? What a good deal to be judged by your buddies.

i think that the old lady deserved it. the man told her not once…..but NINE time to calm down or he was going to tazer her and the bitch keep runnin her mouth. she deserved it and had it coming. no cops are not always right for ths stuff that they do but she didnt have to keep being the way she was. she probaly thought just cause she was 72 she could get away with it…..well just cause she is an old lady dont mean that she should be able to get away with shit….sorry

True enough there was excessive force used but have any of you seen the actual video? This so called “Granny” was about as beligerent as she could get with a cop. Police deal with monsters of all ages, sizes, and genders daily. this “Granny” asked to be tasered. Would everyone have been okay with the cop kicking her ass and shoving her in the squad car? I’m quite sure that would not have been okay either. No one asked her to get out of her car and challenge an officer, curse at him and pull away from him like she was invincible. Now that the damage has been done she wants to portray a hurt “old lady”. I say it is what it is. I believe he showed mercy because he let her walk up on him. You and I could not have gotten out of the car without being tasered or maybe even shot depending on what the hell u looked like. It’s all bullshit! The “Granny” got one to grow on!

While I think the cop needs to learn to be a PROFESSIONAL and properly deal with unruly people, the old lady was being a complete ass to a figure of authority. She definitely was being unreasonable and asking for an additional punishment beyond her speeding ticket.
And please, those of you who think the grandma is not at fault and that people are taking advantage of her because of her age, wake up and take a whiff of reality. Elders should be treated like everyone else and shouldn’t get away with disrespectful behavior. If it was a punk 20 year old kid with piercings all over im sure most of you would judge him and feel differently.
Have you people been reading the news? What about that 88 year old white supremacist who shot up that museum and killed a security guard? Should he be “treated with respect” because he’s an elder? Should he not be charged with murder because he’s old? Seriously.
