The government has been accused of trampling on individual liberties by proposing wide-ranging new powers for bailiffs to break into homes and to use “reasonable force” against householders who try to protect their valuables.
Under the regulations, bailiffs for private firms would for the first time be given permission to restrain or pin down householders. They would also be able to force their way into homes to seize property to pay off debts, such as unpaid credit card bills and loans.
The government, which wants to crack down on people who evade debts, says the new powers would be overseen by a robust industry watchdog. However, the laws are being criticised as the latest erosion of the rights of the householder in his own home.
“These laws strip away tried and tested protections that make a person’s home his castle, and which have stood for centuries,” said Paul Nicolson, chairman of the Zacchaeus 2000 Trust, a London-based welfare charity. “They could clearly lead to violent confrontations and undermine fundamental liberties.”
Bailiffs have for hundreds of years been denied powers to break into homes for civil debt or to use force against debtors, except in self-defence. In a famous declaration, William Pitt the Elder, the 18th-century prime minister, said: “The poorest man may in his cottage bid defiance to all the forces of the crown.” Ministers have now proposed bailiffs be given powers to physically remove debtors who try to defend their property, for example by draping themselves over a car or blocking the door of their home. Lord Bach, a junior justice minister, has assured the House of Lords that any new powers will be implemented only after a consultation and will not be used to search debtors’ pockets or to remove jewellery.
It emerged last week that Her Majesty’s Courts Service has already handed out guidance to privately employed bailiffs, pointing out that under legislation passed in 2004 they can already break down doors as a last resort to collect court fines.
Some restraint should be exercised, according to the “search and entry powers” guidelines. “If a person locks himself in their home, it might be reasonable to break open the door, but probably not to smash a hole in the wall,” it advises.

Read this article and my jaw dropped in utter shock. They would bring this to the USA in a heartbeat except that there are a LOT of armed Americans. And in the rural parts of America, in which I live in, I can promise you that the good old boys would be burying any baliff or any other armed officer who tried such a thing. This is insane and then some!!! That’s why our “government” is so desparate to abolish the 2nd Ammendment. There is a big battle heating up over that one and over the militarization of the CHP that is happening out in California.

Guess what? This is already happening, and had been going on for years right here in the USA. If you buy something that is a secured debt on credit, and, if you fail to make your payments, they can come and get that property. Cars are always a secured debt, but furniture and appliances from local stores can also be secured debt and in some cases if you fail to make the payments the sheriff can show up and take the stuff away.
Right now all credit cards are “unsecured debt” meaning that if you fail to pay, the credit card companies are not going to want what you bought back again, although I am sure they could pass a law to change that too.
If the credit companies want a gov bail out because no one is paying up on their cards….you can bet that they are going to get a law passed that would make unsecured credit card debt into secured debt, and that’s when things are going to get ugly.
All those credit card offers in the mail suddenly make perfect sense…..scary!

To all you guys on here with the loaded guns…. I was brought up with a gun sitting in the kitchen corner, so I am not anti gun, however, I am anti murder and maim.
When you guys get your guns loaded to go, do you ever stop and think about what you might be doing? Do you really want to kill someone? Sure, many times people have a right to be angry, but is violence really the way?
How would you really feel if you shot someone? Think about ending a life and all that entails. What about the family? The mother and wife? What about the children who would no longer have a father?
I believe in defending yourself, but you have to keep a cool head. Is material stuff really worth killing someone? So what if the sheriff came and wanted to take some junk away that you bought on credit. Hey, then you would no longer owe on it.
There is more than one way to approach and solve a problem, think first, then think again before you act.

Guys I live in the UK. Nothing will happen. There will be no dead bailifs and there will be hardly any confrontation worth reporting. This will only effect the lowbrows and overstretched pencil kneckers who will bend over and take it whatever happens.
The point here isn’t to cause a confrontation, the point here is to set a president. Get people used to seeing this type of thing happen. The real violence and confrontation won’t come until society has become completely used to this type of thing happening. By which time people will care even less and may even agree with heavy handed treatment of these individuals.

Let it be a lesson; when you borrow against your property; you take a huge risk. When you have people that have never held 10k in an account suddenly taking on 150k debts with no collateral except their payments; you run a huge risk.
And, just as those people took big risks to get those homes; the banks should take the same risks to recover them. The police should be solely able to remove you. If banks are concerned about funds lost; they shouldn’t be able to receive tax payer money; and they shouldn’t be to do more than prosecute for debts.

My brother has been threatened with bailiffs.He is in court next wednesday to answer why he won`t pay the CSA [child support Agency]the money they demand wrongly off him.He knows they couldn`t enter his property and to keep all doors and windows locked.If this law gets passed,he might as well make them a coffee and welcome them in……..they would bring police with them if they expect trouble,no point in losing all your goods and going to jail for assault as well eh?

I can see where it’s not so good to break into a persons home that they own outright because they are past due on their DirecTV bill, but I have less sympathy for a person who got a 0% down loan on both a home and car he can’t afford, has several credit cards maxed out, and isn’t paying child support. Sure, creditors are at least 1/2 at fault, but the individual has some obligation to restrain himself and live within his budget.

Property is more important then humanity. With all the gun owners in the US, won’t be long at all before some repo man is killed while legally breaking into someones home and legally assaulting them.

They are already doing this in Germany! And the government there can also forcibly enter your home to see how many TV’s and radio’s you own because they charge a monthly tax for having the ability to listen to broadcasts over the airways. Rediculous, right? It will be here before we know it!

thus what our God told us that the borrower is subservient to the lender. you are not to live so deep in debt, wow, ……………..now, instead of learning this fact and sacrificing the coveted “competing with the jones” way of life, you are now reaping the consequences of your actions. i have very mixed feelings on this, its hard to feel sorry for the people who’s God given rights are being violated, when you know the story most of the time. had to have the new car and the 4000 sf house and credit cards and all the while have not a dime in savings. they are getting what they deserve NOT FOR BEING IN DEBT but for not listening to what our God had to say. it was only a warning, not a command. HE gave us free will to choose, unlike the almighty government we think is so honest and would never do that. WAKE UP PEOPLE, OR SUFFER WHAT COMES OF YOUR LACK OF UNDERSTANDING OF THE TRUTH.

I feel bad for my friends on the ISLE and hope they can see the light before we have a second HITLER. America, DONT BE FOOLS, take a stand and do whats right.

I think you are always better off cooperating with the police. If you point a gun at them, they are going to shoot to kill. I am sorry it is that way, but that is the society we live in. Think about it, if it was YOUR job to go in a home and take stuff away, what would YOU do if someone was waving a gun around.
You can change things in a different way, in an intelligent way. If you shoot at them all you will do is end up in prison, probably for the rest of your life, now is that worth it? Heck, welcome the baliff in, tell him THANKs for helping get rid of some of this clutter, let him have the stuff, forget it and get on with your life, its a lot better than being in prison for the rest of your days.

I’m not sure that alot of the comments here are justified..
Killing someone who is doing their job, for all you know, could be in the same situation does not sound right to me.
What does sound right though is people accepting responsibility for their actions. For example, if you are about to sign a contract for a credit card or purchasing product/s you should know every detail in that contract before you sign. You should also make sure you will be able to fulfill your obligations to that contract until it has ended.
I am sure you would be able to reach an agreement over the phone before it would result in repo?
I would like to be proven wrong, but at the same time this is the only fair argument I can see at the moment.

Hi, Im new to this site and it sounds like there are some interesting people on here, on the subject of bailiffs there are a few things to clear up, first no bailiff can force entry to your home unless they are collecting for inland tax or revenue AND they have obtained a warrant to force entry which if they do in most cases they will be accompanied by the bobbie`s ( cops if your an american)
second they CAN gain entry by peacable means, this means through an UNLOCKED door or window, front or rear to the property, this uncludes out houses and garden sheds, although anything in the garden NOT secured is fair game, also they can climb over fences and over gates but they must not damage said fences or gates.
Third, YOU DO NOT HAVE TO LET THEM ENTER, even if you open the door to them, by law they are not allowed to push passed or to put a foot in the door to prevent you from closing it, this is classed as forced entry, however they can gain entry to your property through tricking you, i.e. saying they need to use the toilet, phone or saying they wish to discuss matters inside, this is classed as peacable entry.
This is the law as it stands in the uk, so i would say to all those who are saying they would shoot, hurt injure any bailiff coming to their house, use the law use your brain, KEEP ALL DOORS / WINDOWS LOCKED, DO NOT LET ANYONE INTO YOUR HOUSE UNLESS YOU KNOW THEM, KEEP SHEDS AND GARAGES LOCKED, oh and if you still feel you need some more basic protection, a bassball bat by the front and rear door.
Just thought i would clarify what they can and cant do as it stands now…
