Bloggers are not journalists, according to Senate bill

The question of what makes a journalist is due for yet another round of debate, now that Congress is weighing two competing versions of a federal shield law for reporters.
Last Friday, the Senate introduced its own version of the Free Flow of Information Act, a follow-up to the House’s action two days before. Both versions would provide new — if limited — protection against subpoenas for journalists, and both version contain a range of exceptions. Both bills were introduced in 2007 as well, with the House version passing overwhelmingly despite a veto threat. The Senate bill was passed easily out of committee only to die without a vote of the full chamber as the session ran out of time. Again, the 2009 bills differ in a key respect, namely in how they define journalists. The Senate bill is fairly straightforward and generous in this regard. It covers a person "who is engaged in journalism," and defines the latter by:
the regular gathering, preparing, collecting, photographing, recording, writing, editing, reporting, or publishing of news or information that concerns local, national, or international events or other matters of public interest for dissemination to the public.
The House version, on the other hand, puts limits on who is covered in a way that potentially leaves most bloggers and many others outside the protective zone of the shield. From the bill:
The term "covered person" means a person who regularly gathers, prepares, collects, photographs, records, writes, edits, reports, or publishes news or information that concerns local, national, or international events or other matters of public interest for dissemination to the public for a substantial portion of the person’s livelihood or for substantial financial gain and includes a supervisor, employer, parent, subsidiary, or affiliate of such covered person.

"Substantial" isn’t defined, but one would assume that many bloggers, student journalists and even those who freelance for magazines or papers that pay poorly, could have a hard time utilizing the protections afforded by the bill, should this version become law.
It’s an old question, this issue of who qualifies as a journalist. And it has been part of the debate over the so-called reporter’s privilege for decades, at least since Branzburg v. Hayes, 408 U.S. 665 (1972), the 5-4 Supreme Court decision that ruled against press protections in 1972. The Louisville Courier-Journalreporter Paul Branzburg lost the case, but the fifth vote came from a sympathetic corner. Justice Powell voted with the majority to compel Branzburg’s testimony, but penned an enigmatic concurrence that has been cited by many federal courts to bolster the idea that there is some protection, no matter how ill defined, stemming from the First Amendment:
The Court does not hold that newsmen, subpoenaed to testify before a grand jury, are without constitutional rights with respect to the gathering of news or in safeguarding their sources.
Branzburg, 408 U.S. at 709 (Powell, J., concurring). A federal statute establishing a qualified journalists’ privilege would bring much-needed clarity and uniformity to this area of law, and it would also represent a historic step forward in vindicating the public’s right to know. It’ll be a shame, though, if a shield law passes with the House language that effectively shuts out most bloggers and other independent journalists. It will be journalism history, but with an asterisk.

Sounds like congress is trying to pass a law abridging the freedom of the press to me. This is a clear cut case of them attempting to define who DOES and who DOESN’T get “their” coveted protection.
And their protection of course is being given only to the owned and controlled mainstream media. These people would be a joke, if they didn’t control the military. We need a new stronger Constitution, and a new form of government, after we remove them from power, so they may never return.

This is the camels nose under the tent. This about establishing by sophistry in law that those who are journalist and only journalist have a right to free speech. Reducing the individual Citizen to silence destroying the internet and the threat it poses to them. The media is controlled by five major Corporations that are the mouth pieces for big government and big business and serve their interest to control the peoples and the economy and political trends. This about redefining what a journalist is and whom can be one and only they have freedom of speech.
This is it in a nuttshell. They want to redefine a journalist as someone that works for a approved media corp.. That that person must then be certified and licensed by the Fed. and or State to work as a journalist. That anyone who publishes or places in public view any printed, written (blog or comment), audio or video broadcast, or publication, without said license will be charged and tried with sedition. They establish a income scale that must be met by licensed journalist to retain their license. Taking a license converts a right into a privilege. The consolidation of the media complex into a few hands reduces the required need for journalist as it will be the same articles written by the same authors in all forms of media. Shrinking the possible field of employment opportunities further restricting and nearly eliminating the First Amendment right. Proving what I have said many times in the passed. Those that own the presses have freedom of the press.
This is a very very serious challenge to the Constitution and proves that those who seek the destruction of this great Nation are conspiring to destroy our rights systematically one by one using the power of a democratic controlled Congress to remove them from us by legislation. It is treason. The democratic Congress and Administration now in office illegally are promoting a agenda of facsism on America and usingour legislative means to mock us, telling the whole world who controls this country. We had better step up and do it soon or we shall find ourselves enclosed in such a tangle of laws and treaties that we will not be able to extricate ourselves without the use of a bayonet and a rifle and that is not to very far away.

Since bills originate in the House and migrate to the Senate before going to the President for final approval, doesn’t that mean the House bill has been overwritten by the Senate, who interpret the definition more fairly? If so, then there is no chance of the House bill being passed as written.

What do you mean by a ’sin of pride’? I have heard of ‘pride’, which is thinking of oneself as being better than anyone else and more deserving than other people, but I have not heard of any such statement as yours. It is good to witness Jesus Christ to people.
However, I tend to believe that Jesus is going to use all of these events, and those in the future, to start His ‘Second Coming’ and ‘the events of the last 7-years’, known as the Tribulation.
I can speak of these things because I have been taught and attained some understanding, by God’s Spirit, that indwells me, through reading His Word, the Bible, and I have attained understanding through my theological studies at ’seminary’, for my ‘Master of Divinity’ (2005).

It’s not simply a matter of titles and definitions, Eric. They are manipulating the law in order to silence opposition and prevent the public from awakening to what is happening. If they can use “legal” means to gag those of us who are writers and bloggers, they can effectively silence dissent. They can’t come right out and say that only government-approved writers are journalists, as that would be too obvious, so they are trying to build a case for limiting “journalists” to only those who work for the banker-owned mainstream media by insisting that “real” journalists are those who are being paid by an employer for what they do – which would weed out those of us who write to expose these bastards, as opposed to writing for a mere paycheck.

I am going to be very blunt here. Several years ago 2003, Texas A&M University, the apple of the Bush family’s eye (Poppy Bush’s library there ..) and Robert Gates is former president of Texas A&M. Gate is now Obama’s war chief, US Sec of Defense.
Like I started out, Texas A&M had a very successful Journalism department. The best in the state.
Students were in line to sign on. Paying big bucks. During Jr. GW Bush’s term … all of a sudden one of the most profitable departments was shut down. The powers that be axed it dead … a 50 year old program shut down by criminals that do not want to be exposed.
You can’t have young aggressive, curious, bright American/Texans discovering the truth!
Google this sh*t for yourself. The Bush family and the elite are a disgrace to Texas.
In the end we will remove every last vistage that these scum ever claimed to be Texans.

There is already a call for a continental congress by an organization called “We the People Foundation” They have been following all legal means to petition the congress for redress as provided for in the constitution. From the original continental congress: “if money is wanted by Rulers who have in any manner oppressed the People, they may retain it until their grievances are redressed, and thus peacefully procure relief,” We the people have been petitioning since 1997 with no response except legal rulings that we have “no standing”. We the People have called for a continental congress made up of citizens from each state to get together and declare the next step. It is all very much like what was happening in the time of Sam Adams and the tea party. Do a web search and get on board, no need to remake the wheel.

The Death Program…And How To Stop It!
Ages 0-9
You are told the average life span of a human.. This imprints your conscious mind with a “Death Program” for (literally) the rest of your life.
Ages 10-19
This is the decade of New Beginnings. These are your teen years when you are out exploring the world, never giving much thought to the Death Program that is now running through your subconscious mind. You may have to answer a question or two about this is your science class from time to time.
Ages 20- 29
This is the decade of Duality. You learn the positive and negatives of life as you enter into adulthood. The Death Program is running but you tend to block it out of your conscious mind until you approach the end of your 20s. Then you start thinking about what you haven’t accomplished, realizing that “the rest of your life” isn’t that long!
Ages 30-39
This is the decade of Perfection of earlier learning. The Death Program speeds up. It tells you that your life is most likely half-over. You worry about your health (worry creates dis-ease) and start to notice how others are “aging” compared to you. You may help contribute to a worthy health cause—walking for cancer awareness, raising money for MS, donating blood, etc. because you realize that “some day this may be you.” Women reach the end of their child-bearing years. They are now “old.”
Ages 40-49
This is the decade of Physical Reality. Often your financial picture improves or the direction you need to go in life becomes clearer. In the meantime, the Death Program creates mid-life crises, saying that you are officially in middle age. You decide you better take better care of your health so you don’t wind up like everyone else you know. You read the health articles wherever you see them to make sure you don’t have the symptoms of some dreaded disease. These articles often promote fear, and fear creates dis-ease.
Ages 50-59
This is the decade of self-healing. You have now lived long enough that you consider yourself “wiser” than those with less life experience. You no longer care as much about what others think. You speak out easier for yourself. You may have more time for yourself as you settle into your career. You feel more confident and competent—until the AARP mailings and retirement brochures start rolling in, depicting little old bent over people with canes. The Death Program goes visual and you fight you response.
Ages 60-69
This is the decade to end the series of cycles that may be running your life. This is the opportunity to end the old—which some people manifest as the end of good health, the end of viable relationships, the end of careers, and the Death Program says you are getting closer to the end of your life—better get prepared. People reach retirement age—they are now cast aside and are “old.”
Ages 70-79
This is the decade of Completion. According to the Death Program now becoming increasingly active, what you learned as a child is about to come true. You are reaching the end of the life span of the average human. You either give in or do your best to beat the odds. Most people forget that Completion means one door closing and another opening—unless it is the door to Heaven.
Ages 80-89
This is the decade of your Oversoul. Your Oversoul is your point of origin out of the Mind of God (or your Higher Power, if you prefer that verbiage). This is the decade when you most naturally consciously connect to your power Source. Rather than stay here and utilize this powerful and natural connection, what a great time for the Death Program to kick in, telling you its time to connect in another reality.
Ages 90-99
This is the decade that ends all cycles since birth. If you haven’t left yet, it’s time for the “big heave-ho” to get out the door. Otherwise, what a wealth of information and history you contain! If you are still healthy and of sound mind, what an influence you could be to the “new crop” of worker bees arriving into this reality, now ages 0-9. The Death Program is running full speed ahead now, pushing you right through Heaven’s Gate.
Ages 100 Plus
New beginnings –but the Death Program has already shown you that you do not want to live this long. You will be alone, ill, and with no one to take care of you. They do NOT want you to be a LIVING STOREHOUSE OF KNOWLEDGE that can influence generations. The Death Program is designed so that you absolutely DO NOT follow through on this path of New Beginnings—if you make it this far.
…AND HOW TO STOP IT!
Refuse to participate in the DEATH PROGRAM!
Ancient peoples, from the Bible to Atlantis and Lemuria were rumored to have lived for hundreds of years—what happened??
Develop your awareness that the Death Program exists for a reason. Refuse to participate and learn to reverse the process. Ancient peoples, from Biblical Times to Atlantis and Lemuria were rumored to have lived for hundreds of year –is this a possibility for you, too?
Release your experiences as they occur up to their point of origin –your Oversoul, God-Mind, or whatever you call your Higher Power. Carrying the experiences of your past fills you up, creates weight, changes relationships, redirects career paths, affects financial pictures, distorts the mind and body, and recreates the beautiful body into which you were born into something else.
If you don’t empty out while you are here so you are ready for year 100, then you need to go out of the body to do this—and the Death Program wins again.
Your mind is the most effective tool you have for building yourself up or tearing yourself down. You have the tool. You already own it. It is FREE. Use it appropriately and the Death Program turns on Itself, killing IT instead of YOU!

We need the Constitution to be taken seriously again. Everything we would like to see upheld, everything that empowers us and protects us and our rights, liberties and freedoms is all right there, written a couple hundred years ago. The parched, cracked skin of the Constitution has been ripped and picked at by the vulture-beaked pens of politicians until all the sound, flesh parts of it have been devoured and the sun-bleached ribcage of America protrudes from the diamond deserts of her heartland like some idyllic picket fence.

This is a direct kick in the teeth to bloggers and an indirect tool to weed out small time competition. It’s one of the signs of totalitarian government being formed that you now have to be a “licensed” journalist at all. This should not and will not stand. Close more people’s eyes, ears and minds is all this will accomplish if allowed to stand, and that’s the worst thing for all of us right now.
