Seven newly released memos from the Bush Justice Department reveal a concerted strategy to cloak the President with power to override the Constitution. The memos provide “legal” rationales for the President to suspend freedom of speech and press; order warrantless searches and seizures, including wiretaps of U.S. citizens; lock up U.S. citizens indefinitely in the United States without criminal charges; send suspected terrorists to other countries where they will likely be tortured; and unilaterally abrogate treaties. According to the reasoning in the memos, Congress has no role to check and balance the executive. That is the definition of a police state.

Who wrote these memos? All but one were crafted in whole or in part by the infamous John Yoo and Jay Bybee, authors of the so-called “torture memos” that redefined torture much more narrowly than the U.S. definition of torture, and counseled the President how to torture and get away with it. In one memo, Yoo said the Justice Department would not enforce U.S. laws against torture, assault, maiming and stalking, in the detention and interrogation of enemy combatants.

What does the federal maiming statute prohibit? It makes it a crime for someone “with the intent to torture, maim, or disfigure” to “cut, bite, or slit the nose, ear or lip, or cut out or disable the tongue, or put out or destroy an eye, or cut off or disable a limb or any member of another person.” It further prohibits individuals from “throwing or pouring upon another person any scalding water, corrosive acid, or caustic substance” with like intent.

The two torture memos were later withdrawn after they became public because their legal reasoning was clearly defective. But they remained in effect long enough to authorize the torture and abuse of many prisoners in U.S. custody.

The seven memos just made public were also eventually disavowed, several years after they were written. Steven Bradbury, the Principal Deputy Assistant Attorney General in Bush’s Department of Justice, issued two disclaimer memos – on October 6, 2008 and January 15, 2009 – that said the assertions in those seven memos did “not reflect the current views of this Office.” Why Bradbury waited until Bush was almost out of office to issue the disclaimers remains a mystery. Some speculate that Bradbury, knowing the new administration would likely release the memos, was trying to cover his backside.

Indeed, Yoo, Bybee and Bradbury are the three former Justice Department lawyers that the Office of Professional Responsibility singled out for criticism in its still unreleased report. The OPR could refer these lawyers for state bar discipline or even recommend criminal charges against them.

In his memos, Yoo justified giving unchecked authority to the President because the United States was in a “state of armed conflict.” Yoo wrote, “First Amendment speech and press rights may also be subordinated to the overriding need to wage war successfully.” Yoo made the preposterous argument that since deadly force could legitimately be used in self-defense in criminal cases, the President could suspend the Fourth Amendment because privacy rights are less serious than protection from the use of deadly force.

Bybee wrote in one of the memos that nothing can stop the President from sending al Qaeda and Taliban prisoners captured overseas to third countries, as long as he doesn’t intend for them to be tortured. But the Convention Against Torture, to which the United States is a party, says that no country can expel, return or extradite a person to another country “where there are substantial grounds for believing that he would be in danger of being subjected to torture.” Bybee claimed the Torture Convention didn’t apply extraterritorially, a proposition roundly debunked by reputable scholars. The Bush administration reportedly engaged in this practice of extraordinary rendition 100 to 150 times as of March 2005.

The same day that Attorney General Eric Holder released the memos, the government revealed that the CIA had destroyed 92 videotapes of harsh interrogations of Abu Zubaida and Abd al Rahim al Nashiri, both of whom were subjected to waterboarding. The memo that authorized the CIA to waterboard, written the same day as one of Yoo/Bybee’s torture memos, has not yet been released.

Bush insisted that Zubaida was a dangerous terrorist, in spite of the contention of one of the FBI’s leading al Qaeda experts that Zubaida was schizophrenic, a bit player in the organization. Under torture, Zubaida admitted to everything under the sun – his information was virtually worthless.

There are more memos yet to be released. They will invariably implicate Bush officials and lawyers in the commission of torture, illegal surveillance, extraordinary rendition, and other violations of the law.

Meanwhile, John Yoo remains on the faculty of Berkeley Law School and Jay Bybee is a federal judge on the Ninth Circuit Court of Appeals. These men, who advised Bush on how to create a police state, should be investigated, prosecuted, and disbarred. Yoo should be fired and Bybee impeached.

My intension was to help find an answer to our conmen problems. How I became a spy, and a enemy troll for a few, is unclear. I’m even being graded on spelling, not accuracy or the merit of my ideas. I never post here, there is such a readiness to violence it really turns me off. I see Guns as a RIGHT to Bare, but as a last method of defense, a mans survival and right to exist. Not an excuse to insight death and violence and cause loss and harm to others. If our people desire self governing, then the ability to self govern starts there, demonstrating self control and the ability to shape and live out our lives in peace with respect and equality for all others.

If “we the people “want a change of Gov. and its policies, we have that guaranteed right, it must be done collectively and in a sensible peaceful manor for it to have credibility and not cause it to escalate into a disorderly violent destructive mistake, that brings harm and loss to all those you love. I don’t understand why “lock n load” seems to be the 1st choice? Our forefathers were intelligent, bold men, not savages.

These are your God given rights, undeniable by any man, Gov. or religion. It was the principal reason the country was formed. The law requires you to ; form collectively as 1 and give notice.. As a constitutionalist I understand my agreement as a citizen of this republic.
When our gov. became a” legal corporation for profit” My consent was never given, there must be consent for it to be legal. To think we must undergo some type of revolution and violence is totally ludicrous. Stand Up collectively and give notice. Violence should be reserved as a last line of defense, not to have our demands be herd. The privatization for profit of prisons and gov. was not the deal, I totally agree you. So if Lock n Load is your only solution ,perhaps I’m in the wrong place. I ‘m looking for less madness then we have now ,not more.

OMG, OMG, OMG! What an important article. The US Department of Justice (sic) is at the epicenter of heinous (are there any other kind?) war crimes. John Yoo is mastermind of regression to medieval torture. Jay Bybee was elavated to the US Court of Appeals, second only to the US Supreme Court, in power, as a reward. John Yoo’s name had been widely touted as a likely Bush appointee to the US Supreme Court at one point. What does that tell us about those kind of people generally, appointed as federal judges?

Those 7 memos are prima facea evidence of incompetence and the willingness for the last administration to go to whatever means it deemed necessary to secure an excuse for violating US and International laws. It is time to be heard. All people who want to save this country and restore it properly must call for this administration to take action. If the Senate wants to prove itself worthy of office, there must be hearings and indictments covering every abuse perpetrated against our civil rights, our citizens and the constitution; starting with the 2000 election, 9/11, MWD’s, the Gulf War II, Afghanistan and the Bin Laden /Saudi connection. All treaties signed by GWB including NAFTA and NAU must be repealed and every other bill he signed into law, especially the Patriot Act must be put through a constitutional litmus test. The time for action is now. GWB and his entire administrations must be held accountable for their actions and for making a mockery of their solemn oaths of office and appointments. If Obama does not have the fortitude to meet the American people with honesty and transparency then his motives should be called into question. I call upon each and every one of you reading this post to write, e-mail or call your representatives. Make petitions and let your senators know that if they cannot abide by the will of the people, and call for honest answers, that they had better start looking for a new job. Tricked? Two of my comments were censored here an hour ago. Day before yesterday the same thing happened and another Alex Jones supporter helped me prove I was telling the truth by retyping my words themsdelves. It was again deleted. It doesn’t matter who is doing it, it is censorship and supported by the Alex Jones program. You all are being kept blind to certain comments. Check this out, my post 27 from the top, was a response to a comment. I had made mention of his motive of always replying to post but rarely leaving his own. And when he did they were always in the form of a guestion. I could really give a rats ass who he is. His name in “numbers” had been on many post today. Again, always replies and never writes his own post.
Well, after looking back through the site, his replies are gone, along with the one above my 27 response.
What the fuck is up with that? He’s comments were never rude or off color, just strange.
Is there away other than the web master to delete comments? I could care less and frankly I wouldn’t hestitate to tell him to blow me. Just something to think about!

The fact that the contents of these memo’s were made public, proves beyond reasonable doubt that no “Police State” is in existance in the USA. A police state excercises complete control over the media. Did anyone living in Nazi Germany ever read Himmler’s letters on the gas chambers in the local papers? No.

I have an urgent message for infowars, more important than any message you can

John 3:16. Jesus suffered a horrible death and rose again 3 days later to take

the penalty of YOUR sins! He loved you so much that He provided a way for man

to escape the lake of fire! All you must do to be saved is BELIEVE in Him(trust

in Him to save you). That is it! No works or anything you do can save you! May

God open your eyes, that one day I may see you in heaven. Read the Word of

God(I recommend the King James version) before rejecting it! Death is fleeting.

You may NOT have tomorrow! For death comes when we least expect it! Make sure

you are saved TODAY! The Bible condemns the rich, the wealthy, those who take

advantage of the poor, so it CANNOT have been made up by the elite. Because the

Word clearly CONDEMNS people such as those! Read the Word for yourself and see

that the claims are true!!!

I am a Christian, and STILL struggle with sin. Many so called Christians are

arrogant and hypocritical and think they have it all together. It is my desire

to do RIGHT as a Christian but will falter just like anyone else.
