Border Patrol Agent Will Not be Prosecuted in Shooting Death of Juárez Boy

Border Patrol agent Jesus Mesa Jr., who in June 2010 shot and killed a Juárez boy on the Rio Grande, will not be charged after a federal investigation of the case ended, the Justice Department and the U.S. Attorney’s Office for the Western District of Texas announced today.
Federal officials investigated Mesa’s actions as possibly violating U.S. criminal civil rights laws and federal homicide statutes, but concluded there was not enough evidence to charge Mesa in connection with the shooting death of Sergio Adrián Hernández Güereca, 15.
“The U.S. government regrets the loss of life in this matter, and the Civil Rights Division, the U.S. Attorney’s Office for the Western District of Texas, the FBI and the Department of Homeland Security devoted significant time and resources into conducting a thorough and complete investigation,” Justice Department officials said in a press release. “The U.S. government commits to continue to work with the Mexican government within existing mechanisms and agreements to prevent future incidents.”
