Bureaucrats Will Carry Out Mandatory Home Inspections Under Climate Bill

The controversial climate bill that is set to be taken up by the Senate on Monday after its passage in the House will legislate home inspections by government regulators who will demand to audit every aspect of your property under the threat of substantial and repeated fines if their visits are denied or their demands not satisfied.

The climate legislation is written in a manner that automatically assumes that global warming is taking place and that it is attributed to rising CO2 levels, despite the fact that this is a highly contentious question and is being rejected by more and more scientists as time goes by.
As Tony Pacheco writes in his excellent article today, the bill will “audit every aspect of your home and life”.
The bill states every home owner will receive an energy audit. What is a home energy audit? It is an intrusive visit made by the bureaucrats at the Home Energy Team or a similar group. They will examine and report the way you live your life directly to RESNET (Residential Energy Services Network) . Light fixtures, socket types, spas, hot tubs, windows, appliances, walls and roofs will all be under review. Energy tests will be conducted throughout your house. At the end of the visit you will receive a report and a rating. The report will focus on the changes you need to make and the rating is called a HERS rating (Home Energy Rating System). RESNET will perform the audits through authorized contractors. RESNET has adopted the Mortgage Industry National Home Energy Rating Standards. The standards set the national procedures for home energy ratings.
According to RESNET, an audit consists of:
Comprehensive Home Energy Audit – A level of the RESNET Home Energy Audit process defined by this standard to include the evaluation, diagnosis and proposed treatment of an existing home. The Comprehensive Home Energy Audit may be based on a Home Performance Assessment (“Comprehensive Home Performance Energy Audit”) or Home Energy Rating (“Comprehensive HERS Audit”), in accordance with the criteria established by this Standard. A homeowner may elect to go through this process with or without a prior Home Energy Survey or Diagnostic Home Energy Survey.
Regulations already in place in some cities for non-residential buildings already carry fines of $2000 a time for preventing bureaucrats from carrying out inspections. These will simply be expanded to cover all premises under the new climate bill.
Under the RESNET standards for a home audit, the following procedures will become law under the climate bill.
704.1.2.3 The Home Energy Survey Professional shall request copies of utility bills or
written permission to obtain the energy use information from the utility company, and use
them to produce an estimate of generalized end-uses (base, heating, and cooling).
704.1.2.5. Minimum Procedures for an In-Home Energy Survey:
704.1.2.5.1.1 R-values of wall/ceiling/floor insulation
704.1.2.5.1.2 Square footage and approximate age of home
704.1.2.5.1.3 Type of windows: glazing type(s) and frame material(s)
704.1.2.5.1.4 Type, model number, and location of heating/cooling system(s)
704.1.2.5.1.5 Type of ductwork, location and R-value of duct insulation, and any
indications of previous duct sealing
704.1.2.5.1.6 Type of foundation is crawl, basement, or slab
704.1.2.5.1.7 Checklist of common air-leakage sites indicating likely opportunities
for leakage reduction
704.1.2.5.1.8 Estimated age and efficiency of major appliances such as
dishwashers, refrigerators, freezers, washing machines and dryers
704.1.2.5.1.9 Number and type of hardwired light fixtures and screw-in bulbs in
portable lamps suitable for energy efficient re-lamping
704.1.2.5.1.10 Visual indications of condensation
704.1.2.5.1.11 Presence and location of exhaust fans, and determination of whether
they are vented outdoors
704.1.2.5.1.12 Number and type of water fixtures (e.g. faucets, showerheads)
704.1.2.5.1.13 Presence and type(s) of combustion equipment; identification of
visually identifiable evidence of flame rollout, blocked chimney, and corroded or
missing vent connector.
As we have warned, the climate bill is nothing more than a feast for bloodthirsty government vampires, who are ready and waiting to suck off the fat hog of the American taxpayer once more.
Ohio Republican Senator George Voinovich says it will take a “miracle” for the Senate to pass the controversial climate bill next week, meaning that the legislation won’t be in place before United Nations climate talks in Copenhagen in December.
The Senator told Bloomberg News that the bill contains “a lot of crap” and that cutting CO2 emissions by 17 per cent before 2020 was an unobtainable goal.
Voinovich’s prediction that the bill will fail is echoed by Senator James Inhofe of Oklahoma, who said that the “razor-thin vote in the House spells doom in the Senate.”
However, Senator John Kerry claims that the bill will pass the Senate next week but that there won’t be enough sway to approve a global treaty that commits other nations to follow the same regulations.

They will have no choice but to set up your appointment this way if they call their agent has already been advised notice to one implies notice to all tell them you will be waiting for it when it comes in the mail . You can refuse entry to your home and i would highly recommend doing so . You have committed no crime and they have no reason to suspect you have .

Just a warning about “public access” The pathway to your door is considered public access, so they will have some legal grounds to get to your front door but you don’t have to answer.
If they are loitering at your house, you can call cops and file a complaint. Unless they have a search warrant, they have no legal reason to enter your home if nobody is in imminant danger or they can’t claim “exigent circumstances” to justify entry.

If the Bill passes the Senate we will need to reinvigorate the 10th Amendment: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”
We need to be on the look out for three possible (probable) attempts to circumvent the 10th: The Commerce Clause (Somehow this will be tied to commerce between the States), Bribery of the States (the Fed’s will attach $$ if the States will follow), or the Necessary and Proper Clause (The Feds have to institute these laws in order to carry out their Commerce responsibilities or some other such nonsense).
The Federal Government clearly does not have the Constitutional Authority to make these laws.
I have been researching the history of how the Federal Government gets around their “Constitutional Shackles” and with the help of the U.S. Supreme Court these are the most “used” methods. I hope to have my research compiled into an on-line movie by early next week and posted to my site (Click my name). I never knew how corrupt the U.S. Supreme Court was until I started doing this research…. Now, I can’t believe everyone doesn’t know, they have been throwing it our faces for generations.

You can thank the “highly esteemed” FDR, he tried to expand the court to get his unconstitutuinal policies passed, that did not work – so he waited it out.
Tragically, by being the president all those years – it was enough to pack the court with his type of judge. They did the unconstitutional and have been doing it ever since.
I am sure to some extent it happened before then, that just opened the floodgates to “reinterpreting” the constitution out of it’s original context.
Tragically – most people do not realize – that piece of paper is the only thing that protect us from government tyranny.
The founding fathers had lived under tyrants and were no fools, they understood how they worked and were protecting us from that. I can’t believe people are ready to throw away so easily what other men were willing to die for. Tragic. They will not know what they gave up until it has happened.

Lefick — Your understanding is common but not quite accurate. See the Colorado Constitution Article 16 Section 6:
Section 6. Diverting unappropriated water – priority preferred uses.
The right to divert the unappropriated waters of any natural stream to beneficial uses shall never be denied. Priority of appropriation shall give the better right as between those using the water for the same purpose; but when the waters of any natural stream are not sufficient for the service of all those desiring the use of the same, those using the water for domestic purposes shall have the preference over those claiming for any other purpose, and those using the water for agricultural purposes shall have preference over those using the same for manufacturing purposes.
We are not able to assert rights we do not know we have. If you are using your rain water (even before it becomes a stream) for domestic or agricultural purposes you are covered. Of course, that does not imply you won’t have to fight for the Colorado Constitution.
Colorado may have one of the most screwed systems for water law but in some respects, if we stuck to our Constitution, we have strong protections for the People to access water first.

The history channel is running a program on national infrastructure deterioration, and cites as an example, that most states have 1, 2 or 3 bridge and/or dam inspectors, for thousands of bridges and dams. Unfortunitaly no one cares. That is the problem. It seems that the generations ahead of me are the ones whom are more concerned with this than my and earlier generations and I’m 35. They type in your name and know exactly what appliances you have in your house, real-time information about how much you use them (the “smart-meters”) so they can conclude and chronicle when you leave your house, when you come back, tie that in with GPS coordinates, cellphone locating… a total police state under the pretense of the “climate” and “saving energy”.

A home energy audit is an opportunity for people to learn how to save some serious money. I am a mechanical engineer, and let me tell you people are ignorant about energy. If all that is done is inspect the building envelope (doors, windows, walls, attic, crawlspace ect), and the HVAC equipment it will be nothing but good. There are folks that don’t know enough to change the filters in their equipment, and who can’t tell when stuff is malfunctioning.

I am 73 years old. I can’t afford these illegal fines. I can’;t afford all of the upgrades that they will demand. I can’t afford to change my lifestyle of self sufficiency to satisfy this beast. I can’t afford to allow them to remove any security that I have in place for my household protection. All that is left for me to do is face them down and say no. The end result of this being their choice. Perhaps if we trade them out one or two of them for one of us they will eventually go play somewhere else. I think that we are so far gone now that there is no point in worrying the legal points. The illegality of doing these inspections is far beyond anything that we as individuals would consider. I have dealt with ignorant bureaucratic servants before and I have found the best way if possible is ignore them and do what you need to do.

Hey you all, out there in the world. I live in an RV full time. Think they will be able to “visit” me? Hahaha, not a chance, going to be moving from local to another, will freak them out. By the way, my 2008 RV is more “greener” than I bet they can deal with. They won’t have a chance to “find” anything, because this rig is new and up to date. 12 volt, 4 season ready, mostly sealed (except for the pull outs) and Earth Quake proof, Metal “cage” for the frame work, ducked from one in to the other, 40 gal fresh water. Even has plenty of room for a family of 3 to 4. Also, like I said, they got to find me first!!!!!

the burden this will put on landlords is redicioulis they will have to remodel all their propertys before they can even rent them out. thus raising the rent to try to cover this.
or if they are slumlords they will just demo the propertys because its not cost effective to remodel low income housing. all low income propertys will torn down i believe and the propertys that are still left the rent will be outrageous.

its already here in dell city oklahoma . as of feb.2009 the city requires anyone buying or selling and or renting in this castopo town to be inspected if you do not comply they will condemned the home and you will be fined 750 dollarsAND 60 days in jail. and all utility service will dicontinued. iknow for a fact .i own 2 rent houses there. and probably will be put in jail and labled a crimnal for not complying. this country as i know it is gone .please for give my spelling. i am pissed off. and if you think your dogs guns and signs and threats will work. well your in for a rudd awakining. people you better wake the fin up now because this is headed your way.i am 61 years old and have fought these basters in the past alone.i will fight these whores alone and you will to if you dont UNITE now.making the stand……….

folks turn air/heat off? Folks quit driving to work, so they can save on gas and emissions? Folks can’t eat too much or be taxed w/health care costs. Folks won’t drink sodas or smoke ciggs., won’t drive, eat less, can’t turn on air/heat, if own a home it will be inspected, folks can’t afford repairs. Folks that work will have to pay higher sales, property, federal taxes (where else will governments get their money when so few will be working at this rate?) Folks I suppose will just be bled dry until everyones flat out BROKE. I don’t know what I will do if these inspectors come to my home. I will take your advice and post no trespassing signs, although I don’t know that it will do much good. I am very energy efficient, although I’m sure there is always room for improvement, so I do not object on the grounds that I will have to make a lot of changes. I do object to the infringement of the rights I thought I held as an American citizen.
I feel ashamed to be an American at this point. When I was younger I thought the Soviet citizens were stupid to think that they had any rights or constitution. It is we who are stupid. We have allowed the disintegration of our liberties. At times, we even insisted on it.
It has gone too far now. There will be strong repercussions if this bill passes. They have crossed a line. Hopefully we can still fight them. Regardless, there are many who will proudly die in defense of the principles on which our nation has been founded. I believe I am one of them. I wish I could do more to regain our freedom than just die, but I will do whatever I can. I swear to that.

I hate to rain on the parade, but no ‘citizens revolution’ will be successful against today’s US Marines. No doubt we are all very skilled with our glocks, our smith & wessons…but how do we stop an Apache helicopter? How do we stop a Humvee with .50 cal turrent mount, or a tank?
We can’t. Our only hope is to educate our military members to the point that they will refuse to shoot at their own countrymen. This is not impossible…who serves in our military but our husbands and wives, our brothers and sisters, our friends?
No call-to-arms has any merit unless it includes a plan to wake up our military brethren, that many of them may wake up to the real world just as we ourselves had to.

They will not follow illegal orders, they will obey their oaths and be ruled by conscience and values. The same applies to Law Enforcement. Not to worry when things break bad (and they will) we will be on the side of truth and justice. Those responsible for the rape and distruction of The United States of America, the United States Constitution, and the attempted enslavement of the American people, these are the ones who need to be afraid. We can’t beat the Marines if they all follow unlawful orders. However, there are service members and law enforcement officers who will not follow these unlawful orders. Check out oathkeepers.org. Many service members and law enforcement officers have and are signing up. I hate to point this out, but government has been going this way since the War of Secession which was all about defeating individual and states’ rights and giving total power to the federal government.
