So much for English common law and Sir Edward Coke’s dictum that a man’s home is his refuge and castle. “For a man’s house is his castle, et domus sua cuique est tutissimum refugium [and each man's home is his safest refuge],” Coke wrote in 1628.

William Blackstone, in his Commentaries on the Laws of England, said “no doors can in general be broken open to execute any civil process,” except in the case of criminal causes.
In the United States, the Castle Doctrine, arising from English common law, designates one’s place of residence as a refuge not only against violent attacks, but unwarranted trespassing by the state.
In Texas, the authorities have put an end to this idea, which ultimately found its way into Fourth Amendment of the Bill of Rights guarding against unreasonable searches and seizures. Property rights are integral to the Constitution.
“Police can arrest people who don’t leave town under mandatory evacuation orders under a new state law that goes into effect in the heart of Texas’ hurricane season,” reports the Associated Press. “As it stands, officials cannot compel people to evacuate, only warn that those who stay behind won’t have any emergency services at their disposal.” The new law gives county judges and mayors the power to authorize use of “reasonable force” to remove people from the area.

The Supreme Court has ruled “the Fourth Amendment protects other interests in addition to privacy interests, such as possessory interests.” In other words, the court ruled that the state cannot evict without cause.
Jonathan Jorissen, writing for the Ave Maria Law Review in 2007, noted that “forcible removal of victims of natural disasters [in this instance, Katrina] seemingly constitutes seizures. Applying the requisite standard of reasonableness, it must be asked whether the actions were, in fact, reasonable. Given the nature of the situation, it is evident that they were not. The affected citizens were not guilty of any crime. Additionally, their property was in no way necessary for the government to carry out its duties. Instead, these hurricane victims were further victimized by their government, which removed them from their homes based on the suspicion that they might contract some disease. Without a more compelling interest, the government’s actions were unreasonable.”
As Supreme Court Justice William Patterson observed, property rights are the foundation of any social compact. “Men have a sense of property: Property is necessary to their subsistence, and correspondent to their natural wants and desires; its security was one of the objects, that induced them to unite in society.”
In Texas, the state has destroyed that compact and the very concept of natural law.

“Nearly 2,000 people crowded onto a southwest Virginia fairgrounds Friday and waited hours to receive free dental care, eyeglasses and medical procedures.
Remote Area Medical founder Stan Brock said the daily limit of 1,600 patients for the three-day clinic in Wise County was reached by 5:30 a.m. Friday. Another 200 people were admitted to the treatment area later in the morning, but several hundred more had to be turned away.
“If there’s an event that more dramatically displays the need for health care, I don’t know what it is,” said Gov. Timothy M. Kaine, who spent an hour volunteering at a registration table Friday.
Brock said the number of people showing up for free care because they have either no jobs or no health insurance demonstrates a need to revamp the American health care system.
“It’s outrageous that we’ve got all these people waiting all day,” Brock said.
Brock started his organization with the goal of using volunteer medical professionals to serve underdeveloped nations, but it now devotes 64 percent of its efforts to care in the U.S. because the need is so great.
As a result, he said, the volunteer corps has cut services in countries such as Haiti and Guatemala as well as African nations.
Patients began camping out on the grassy southwest Virginia field Wednesday from as far away as Florida, although most of those seeking treatment were from the depressed coal-mining region.
Stella Barr of Glade Spring drove an hour and a half to register at 7:30 a.m. Thursday, so she was the fifth person admitted when the clinic gates opened at 5:30 a.m. Friday. She was happy that by 11 a.m. she had had her teeth cleaned, gotten three fillings, and picked out new glasses after receiving an eye exam.
She had to wait for her husband, though, who only registered Friday and had 931 people ahead of him.
Tammie Mullins of Clintwood has been one of the clinic’s 1,500 or so volunteers for the past seven or eight years. She said it seemed busier this year as the economy has declined.
The waiting area for dental work was jammed.
“I really can’t eat,” said Christine Garrett of Nickelsville in southwest Virginia, who was hoping a dentist could do something about several missing teeth on both sides of her mouth.
Debbie Kilbourne of Castlewood was having trouble walking with three planter’s warts on one foot. She was directed to the tent where Dr. Vincent Voci, a plastic surgeon, was working.
Many people have more than one type of procedure, and most were seeking dental work and eye examinations. Those areas were far busier than the canvas tents where patients could receive cancer screenings and tests for diabetes and cholesterol.
“We have to encourage people to see the doctors,” said Amanda Wilson, a RAM employee.
Brock said many people would wait all day, only to be told by evening that they had to return Saturday because doctors and dentists could fit in no more patients.”

Shoot for the head, the groin, the knees and the throat… body armor doesn’t really protect those areas, and if you get hit with a 12 gauge slug in the balls, I doubt most men are going to run around swinging their gun in your face, they will be at least, on their knees or back, screaming in pain, coughing up blood, and sterilized.

You know, the ammo isn’t really meant to be shot inside, but if people are already inside my house, with guns drawn, I’ll probably be more concerned about taking fire, than catching things on fire.
If SHTF I doubt i’ll be worried about the drapes, if catching the bastards on fire keeps me from getting my ass shot.
Besides, I don’t think resell value would matter much if 12 jackbooted thugs ended up being toasty critters, or if the place had 12 gauge holes in all the walls, either way, resell would go way down.
If you are planning in doing indoor shooting, you have to scale the ammo back to #4 buck shot, everything else will fly through the walls.

With two cops living in my street makes me nervous to go out and talk to the neighbors about this situation. I don’t want to put myself and my family in danger by talking to my neighbors about their rights, I don’t trust cops at all. I live in a rural area and the best I can think of is arming my wife myself and hiding out in the nearby forest and try and keep an eye on the house and neighbors properties if such an emergency were to happen this year.

They are ppl too and most do care about thier families, constituents and the constitution. I have an odd suggestion. Go to the two policeman on your street, say hello, and get to know them. Drop them some dvd’s to watch *no 9/11 was an inside job stuff at first, just something palatable to them, like something about the economy* and slowly wake them up if you can. You start screaming 9/11 was an inside job, and you’ll lose your chance, and be considered a nut job. You start a conversation, and show them how money is debt on youtube, and you might slowly wake them out of sweet sheep sleep. If you can befriend the police, instead of living in fear of them, you stand a better chance than just being the asshole down the road who must be hiding something.

My husband is a cop and I talk to him about this stuff all the time along with my neighbors. Hell, he even reads and supports this site!! I’ve worked with them and had several investigated for selling drugs, shortly after I was told to get out of town because they were going to kill me. Cops stick together even when the “good ones” know what is going on and they won’t help you, spare me that crap about there are some good cops. I am extremely careful about them and if I can stay under the radar I will. Look at all those national guard who felt “sick” about what they were doing but they did it anyway during Katrina. There is one video were the dips--- soldier says he would fire on Americans. How many cops went kicking down doors and stealing citizens weapons? How many do you think stood up for the constitution? don’t listen to these people, you’re right not one are gonna come help you. Who cares if those cops are “educated” anyway, they have an EXTREMELY high probability of outright disregarding what you say (at best) and full-blown persecution at worst. It just isn’t worth the risk.

Somehow I see this being tied into another false-flag attack in the next few months. Let’s see, either a staged “terrorist” attack (nuke, biological, etc.), an anomalous weather-related disaster (weather mod tech), or widespread riots sparked off by some economic or financial debacle. FEMA issues a mandate saying citizens should be “escorted” to safe havens or FEMA centers for relocation or emergency assistance measures. Anybody that decides they’re gonna stick out the disaster or emergency gets treated to the sight of jackboot thugs rolling down the street in tanks with guns pointed at them. I am here in Texas, on the coast. I REFUSED to evacate during Hurricanne Katrina, Rita, Ike and Gustahe. I stayed and RODE OUT every Hurricane.
During Hurricane Rita, Law Enforncement PULLED OUT of Nederland, Texas. My area was WIDE OPEN for Looters, were I shot and KILLED 5 people. When the dust settled, current Texas state law EXONERATED me from KILLING those individuals.
When the next storm hits my A/O, once again, I WILL NEVER LEAVE!
I have put my local LE on NOTICE, that I will NOT leave and IF they want to “force me”, the FIGHT is on!
I am SO READY!
AND …. LE knows it! Plus, they “know” my background and “know” the body count. It is up to them.

I was REALLY DRUNK when I did this posting and as soon as I hit the send button, I knew I screwed up. In my drunken stupor, I should have explained how I confronted 5 individuals in my backyard at 0730 hours. The eye of Rita passed over mid-county at 0415 hours. I was armed and drew down on them. They left my property, where I followed them over to the Sonic on NederLand Ave. They tried to enter via the back door, where I confronted them again. They then walked over to the gas station that had the windows blown out. They went inside and grabbed cartons of cigearettes and beer, I confronted them again. The “Leader of the Pack” now bowed up and said how he was tried of me pointing a shotgun at him and that I would not shoot him. He took a step towards me and I fired 1 rubber bullet from my 12 gauge, striking him in the chest. The distance was approx 4 to 5 feet, which sent him falling back inside the store. I raked another round into the chamber and announced the next shots would be 00buckshot. The other individuals dropped their stolen goods and dragged their comrade out of the store. I watched them walk east on Nederland Ave, where they met up with MORE people, who where running in and out of the Auto Zone. I was NOT going to confront this large group and returned to my neighborhood.
Law enforcement came back into the area around 1330 hours. A patrol unit came by my house and I advised them of what had happened. As you know, a Dusk to Dawn cerfew was imposed and LE did an outstanding job in trying to curb the looters.
Smooth …. I would like to thank you for your posting, in calling me out. The next morning when I woke up and saw what I had posted, I was really embrassed. Thank you for allowing me to correct my posting, even though I feel I have lost all credibillty here.

I live in Texas right on the Gulf and saw Hurricane Dolly at ground zero, not the worst hurricane, but bad enough to make you notice. A town of only five thousand people looked strange afterwards with so many lining up for food, water etc. During the storm, police here were riding through the heart of the storm and shuttling people back to the fire and police stations where they could ride out the rest of the storm. If this law were only used in a situation like this, I might agree with it. The trouble is, when does government and especially law enforcement NOT take advantage of a law. This will be used to thin the herd and identify “trouble makers” when the time comes. What an example it would be to other states if they pull this off in Texas!

I ‘ve been thinking the same thoughts as 1 shot1kill. There will some sort of “emergency ” in the not so distant future(after any hurricane etc.) and the evac or else law will already be conveniently in place. There is a youtube video that purportedly shows the ECHELON watch words and one of them is infowars. The local news here in Houston said Sheriffs will most likely patrol the streets in school buses rounding up those who refuse to leave. Infowarriors may be the first to go. I grew up in Homestead Fla. and saw what happened after hurricane Andrew. They built a “tent city” in a couple of days and condemned our houses with a bright orange X in the road in front of EVERY house. I scrubbed the x’s off the street and we stayed. I weep for my nation when I watch the “man on the street” news poles featuring clueless sheep praising this law as an economic necessity. Our hospitals and healthcare system are collapsing from the economic hardships being placed upon them by an ungrateful southern foreign invader and we worry about picking an american tax payer from a roof after a storm. My freedom is worth less than the cost of a ferry boat ride.

Just wondering who would carry out enforcing such an order. If my area was faced with imminent disaster , all the cops I know are probably the first ones out of town (see NOLA and how many cops went AWOL). They ain’t stupid , and they’re going to protect their own family/property. The National Guard? Could be wrong , but I don’t see it. From NOLA friends I know , they told me they were not involved in the gun confiscations. My guess……the BLUE HELMETS of the UN.
I’ll just board up the house (if necessary) , take family , dogs and GUNS with me. If some asshole gets into my house during a MANDATORY evac he/they aren’t getting what’s most important to me.

America is messed up. I couldn’t live there another day longer. I literally feel suffocated when I am in that country. The nanny state, big brother, security check points, liability fears prompting warnings and safety stickers on EVERYTHING. You people have turned into a nation of fat, ignorant, cowards. The very sight of an American turns my stomach. You have lost your humanity and become walking talking livestock. You question nothing, stir for nothing, you waddle through the aisles of Walmart like bovine in a pasture of grass.
America is lost already, the deal is sealed. 1% cannot save 99% this far gone. This is not like the Revolution – 99% of America literally could not live without the government and big business. The only real hope is for the rest of the world to hold out long enough, develop themselves along a different model and head this cancer off at the pass.
Smart, dedicated, diligent Americans should realize that freedom is not confined within borders but is endemic to all of humanity. They should find the right environment in which to plant their seeds of freedom, tend them carefully and cultivate them – in America, the land is scorched and sown with salt. Freedom will never take root. The people will kill these good men and women long before the government even needs to lift a finger.

Texas supreme court has not followed Constitutional law and their decision is in error. This decision needs to be remedied right away. It is a particularly dangerous decision when viewed in the context of a government military with the capability to create weather devastation such as hurricanes, etc.
This situation seems to be putting all power in the hands of a government that is becoming less and less mindful of its inherent checks and balances.
