Cop Kicks Suspect in Head for Not Resisting Arrest

Despite lying on the ground with his arms and legs spread, a suspect got a face full of police boot on Wednesday. The kicking cop added insult to injury by giving a post-beating high five. The brutality was the final chapter of a pursuit that began about 1:30 p.m. at an attempted traffic stop in El Monte, Calif. Police tried to stop the motorist for a traffic violation, said California Highway Patrol Officer Jose Nunez.

Regardless if the suspect was guilty of driving like a maniac and fleeing from police the officer had no right whatsoever to kick him in the head! Sure, a lot of people would be angry and would want to kick the guy…but wanting to kick someone in the head and kicking someone in the head are two very different things.
A police officer is supposed to control himself, rise above personal anger and uphold the constitution, not beat the shit out of suspects, regardless of the crime they have committed!
This cop should be fired. Every police officer that assaults a suspect should immediately lose their job and be prosecuted like any other citizen. The police have been vaulted into a new category of citizenship, separate and superior from us common folk. Their dead are worth more than our dead and the media makes them into heroes instead of accurately reporting what is actually going on.
We are their enemies, the citizens of America, the home grown terrorists and right wing extremists, tax protesters and End the Federal Reserve protesters, and most importantly… Defenders of the Constitution of the United States of America and patriots willing to fight and die for our second amendment rights.

This is the best video EVER and here’s my reasons.
-Dirt bag gets kicked in the head, he had it coming.
-Truth of police brutality exposed for sheeple to see.
-This cop was exposed, will end up fired, sued civilly, and possibly jailed.
-The internal investigators should end up putting more restrictions on cops.
-The local Gov will have to pay for violating the Constitution.

Except the police officer is not that man’s dad and, in the United States, a police may only use whatever force is necessary to subdue a suspect. If the suspect has already subdued him/herself, there is no justification for force.
The Police Officer was in the wrong and had no reason to kick the man in the face. It is clear he was taking his anger out on the suspect and had no idea he was being watched. I’m willing to bet he told his coworkers that they guy “resisted” and he had to “use force to subdue him” without realizing the truth was captured on live television.
Yes, the suspect endangered lives. But the way the system here works is the police capture the suspect, and the punishment is carried out by the court system. That’s how mature, civilized societies operate.

Well, I’m sorry, but that’s just not how the American justice system is supposed to work. Jails and fines are what we have decided on, so it seems only reasonable that we should stick to that. If we are to overhaul this system and adopt caning or beatings instead, I await a proposal to run the course of the legal system, if it is approved, so be it, we will implement cruel and unusual punishments; however, until that bill legalizes such things, we will remain ambivalent toward police officers who severely physically punish suspects who are not resisting. By the way, according to the American Psychological Association, “corporal punishment on its own does not teach children right from wrong. Although it makes children afraid to disobey when parents are present, when parents are not present to administer the punishment those same children will misbehave,” it also states, “The more often or more harshly a child was hit, the more likely they are to be aggressive or have mental health problems.” It’s much more advisable to try to confer and communicate with your children to make them understand right from wrong on an intrinsic, morally educated standpoint, and to use their judgement at all times, make them think about the consequences of actions on the well-being of other people, others’ belongings, animals or the lawful consequences, rather than to make them fear brutal punishment for behaviors that they may not even fully understand. If a kid knows why something is wrong, they’re more likely to avoid it than if they merely know that it is wrong. “Because I said so” doesn’t fly in the real world, so why do people expect kids to obey it?

As the mother of a police officer who works in California, I am appalled at your attitude. I am also appalled at the police officer that kicked a suspect when he was down and not resisting. I can safely say that if my son ever did this, I’d smack him right upside his head, and make a special trip to California to do it. I’m trying hard to convince him that he needs to question everything he’s told, and he IS listening, now that he’s seen a FEMA camp I told him about right in his jurisdiction. It was so hard to convince him, and he isn’t totally convinced yet, but he is beginning to see the light, so to speak. It is a hard thing to convince them that they are being lied to, but not every “pig” is a pig, and most of them don’t deserve to be used as target practice when the shooting starts. I hope you all will remember that. It’s bad enough that the real criminals take pot shots at them, but I hope and pray that decent patriots will question whether that bullet will hit someone who doesn’t deserve it.

Camels- I tried that approach! Got a simple speeding ticket that the cop gave me for going 28 in a 35MPH zone. (cop was pissed that I asked to see his radar gun). Fought it in court, the cop lied his ass off, I beat him senseless in the argument, but yet the 75 year old judge ruled with the cop. The system is stacked against you in court, unless you hire a great lawyer. Didn’t make sense to me as the ticket was for 50.00. Bottom line is all cops suck and can’t be trusted. This isn’t the 50s and 60s anymore ChiefSmoke! Wake up!

You and I both know for one that even if he was shouting something at him. The OFFICER is suppose to just ignore it because in actuallity it means nothing per trianing. For two if he was not following a command here and the only one that could have been with him on the ground already surrendering would be not putting his hands behind his back he could of just waited for backup ( which there obviously was just behind him ) because the guy was showing he was surrendering. For three and this is important IT WAS THE FACT THAT THE COP WHILE STILL RUNNING RAN UP AND IMMEDIATELY KICKED HIM IN THE FACE!!! This was in El Monte.. Some ghetto suburb outside of Los Angeles. I live a city away from here and everyone knows how brutal the cops are.. Police are not paid to put their lives on the line. They are paid to enforce laws and collect fines.
Traffic stops for speeding, unless to extreme degrees (more than 20 MPH over) are unconstitutional, as they do not endanger the safety of nearby drivers. As an example, the LAW allows for an increase (over surrounding cars, indeed, over the speed limit) of 15 MPH while passing.
Travelling is a right, not a privilege, and you are entitled to do it at your inclination and in a safe manner, free from arrest or detainment. The cop doesn’t know that; very few do; however… Laugh all you want; it’s what the courts have ruled, when they bothered.
My point? 90% of traffic stops are illegal. If this ws merely for speeding, unless it be excessive, then it was unconstitutional.
By the police departments’ usage of the force continuum (torture), and policies allowing violence without justification (brutality), and their tendency to arrest on unconstitutional charges, this man was legitimately fleeing for his life from violation of his very liberty.
You’re a woman, so I wouldn’t expect you’ve ever gotten the full royal treatment from a cop (yet)… Just wait until november next year. Your smugness will be quickly forgoten.

The nerve you strike may be your own. Not all cops are bad – or do not deserve to die. There are many cops that are some of the best human beings that you would ever want to meet. I was a military policeman in the army. I met the good the bad and the ugly. What always got me was how the few assholes that would do these dispicable things were allowed to continue being cops at all. They would rape women for traffic offenses. They would beat a minority for a non-violent crime. They would do some of the most discusting things anyone could imagine, and they wore the badge! Then they would get out of the military, and become civilian cops or prison guards. They gave the good cops a very bad name. I saw it for years, and then after getting out. I was begged to re-up. I told them all to have a nice day, and got on with my life – but I never forgot! You can’t! It’s that bad!
This cop needs to be beaten down so badly that he would not be able to walk away – and would need medical attention – by his own fellow cops! They should beat him right out of the police force, and then taken to court for his aggrivated assault to this little tiny boy – that happens to be a minority! The fellow cops should literally tare every bit of his uniform off his body, and beat him from head to toe – and video tape the whole thing – and let the world see it! That would absolutely make the other cops think twice before they ever tried to brake the law while they wore the uniform! What a concept!!! But you – you are a magget with not a bit of sense to you – you could never understand what it means to protect and serve – you don’t have a clue! Butthead puppy…

My best friend is a police officer and he acts nothing like those jerks in this video. So to make such a terrible generalized statement like “the only good cop is a dead cop” has got to be the most ignorant concept I have ever heard. Many men and women put themselves at great personal risk everyday protecting their local communities. So to lump all cops together and demonize them is sheer idiocy. We do however need to unite against these bully cops but at the same time need to lend our support to those who wear the badge with honor and are motivated only by their desire to protect their local communities. I totally agree with you when it comes to people protecting themselves. Self defense is a natural right inherited to all humanity. I also agree with the Supreme Court which has ruled numerous times ensuring citizens have the right to defend themselves against law enforcers whom are behaving in a manor outside the scope of the law. My only complaint is with the gross generalization of all those who wear the badge. It’s no different than the B.S. line of thinking that says all Ron Paul supporters are terrorist. You can’t judge a whole group of people based on an individual’s actions but instead judge people based upon their individual actions. Right now we are losing many good cops who believe in liberty to these thuggish bully types and we need to let them know we’re on their side. Finely liberty cannot survive in a culture of fear and mistrust so all of us who want to pass on this great boon to our future generations need to come together and stop letting the elite play us off each other.

the driver panicked ……….. ran and realized what he did was stupid. Then when the police officer kicked him………well that was just more stupid….rotten. We had a pastor who was “kicked out ” of the police force for kicking someone in the leg. The guy was an arrogant pastor too. We live in a world where we aren’t our brothers’ keeper. We don’t respect or help one another even when we do stupid. Sadly when our authority figures do what is awful…..judges, senators, lawyers, preachers, lawenforcement bankers….they hurt a lot more people in their area of responsibility. Just consider everybody guilty if a policeman says so. Make every cop, immediately and automatically, judge-and-jury-and-executioner. Here right in front of us is THE GREAT DIVIDE IN AMERICA. The issue is not the police the issue is the police officer in this video. I have friends that are police officers and if they behaved in this manner I would think of it as beneath them. I do not hate police but, the very nature of the job they are in is dangerous. It is stressful and that is why the process for becoming a police officer is meant to weed out anyone who would get off on beating suspects. We have civil rights for a reason. This was not an acceptable response to the situation and we all know that. Most of the people giving the officer kudos for kicking the suspect are not even able to become police I would venture. Either that or they are just ignorant. It is equally ignorant to generalize the police and to advocate killing them. We are not there yet. When they start going door to door to collect guns then yes, it is time. The fact is this officer did not do his job properly. We cannot trust that he will not use bad judgment in other situations as well and we should not be subjected to him.

There are many cases of police brutality where the brutality is totally unwarranted and sick, like when that boy was tasered. I apologize if I do not feel bad when some gang punk gets a kick in the head (which probably has nothing in it to begin with except corona). I also do not feel bad when somali pirates get shot or former war criminals from serbia get arrested. It is just one bully beating up another bully. IF! That boy was a HYUGE danger to the community while trying to escape, then a court will delve out the justice the way it was meant to. It has NEVER! the cops job to dish out the justice just because he was the one that got to him first. You are trying to justify an illegal action. This cop broke the law just like the kid did! I have witnessed this same discusting behavior during my military carrier as a military policeman, and I have never been able to forgive those assholes that deliberately injured someone just because he felt like it. I have been in huge riots where force was necessary. So, I understand exactly when and when not that kind of force is necessary – and so does every cop on the planet! They just think that they can get away with a crime that would put anyone else into prison! You are just a sick puppy that wants to see more unnecessary violence by a force that is supposed to do everything by the numbers. You like it when cops become criminals. Actually the Police Officer was in his rights as he did not know if the man was armed even while spread out and totally unable to do anything. Ya, they are told while being trained with the military – that it is their job to instill as much fear as they deem necessary. Especially with a people that are hard, strong minded, and could turn right around and stomp their asses into the ground – if provoked long enough. If the guy tried to get tough in the car, we’ed take him out – and really give him “what for”. Once they were processed in the jail – if the acted up – they got the “Hose”. Especially if they knew martial arts! It was all about mental control over a strong mind – a strong spirit. Don’t be surprised about any of this – pcycological warfare is all a part of control over a populus. Teach all of this to your friends and families. Don’t let it detour you from standing up when you know that you are right. But, on the same hand, if you are braking the law – and everyone knows what that is – don’t give them a chance to practice their trade. LOL

Do any of you actually know why they knocked him in the head? it may have looked bad on the video, but the reason that it was done was to stun the guy briefly so that they could safely cuff him. he was not actually injured in the kick. it is very easy to take that position on the ground if you are sufficiently fit and move in such a way that the police officer will be injured or killed. I know that I will be flamed for this, but i don’t care. If you actually know anything about cops and their real tactics, you’ll understand why i am coming to their defense. Well a goose egg is an injury. So hence you are saying the guy did get hurt and was injured. Which then makes it assault BY LAW! Now the man does require medical attention in the scenario you have set up with the goose egg. This is because seeings how he was hit hard enough to cause swelling to the head he might now have an underlying traumatic medical condition like a brain bleed which will eventually kill the suspect if it is not discovered in time. Department chiefs look down on this because it could very well end up costing the department unnecassarily. Also wrongful deaths suits are a real bear for the department to handle. I am by far not taking the suspects side at all. He is obviously guilty of fleeing and eluding amoung others charges. Hence he knew the guy was already down. For another about having a weapon under his chest…true you do have a point. But the suspect was already spread eagle with each arm about 2 to 3 feet from the chest area. It would take time for the suspect to reach from either side. The cop already had his gun drawn. All he would of had to do was squeeze the trigger to shoot if the suspect reached for a hidden weapon. At which as a cop you are suppose to verify as much as you can. Sometimes that is difficult though I must admit and you have to make a judgement call. So if that was suspect then the cop should of just waited for the officers coming right behind him and announce to them that there is a possibility of this while he kept his eye on the suspect while holding his weapon on him and ordering him not to move which the suspect was not moving at that time. I am just saying the kick to the head was very unnecessary in this case. So I would beg to argue with you to sit there and justify just hitting someone is alright in actuality makes you thinking like a criminal. There is a difference for an officer to know how a criminal thinks ( Which is a very useful tool ) than to actually think like a criminal. Keep on researching a little bit more.

I don’t feel sorry for the suspect one bit. I know the cop’s emotion got away from him but the jackass just struck an occupied vehicle. If my wife and babies were in the car the suspect would love to have a cop kick him in the face. If I caught him I would do a citizen’s arrest, knowing he would resist I would not hesitate in beating the hell out of him and if he started to overcome me and whip my tale, I’d put a 9 mil round in his head in self defence.
If you get caught speeding pay the ticket, got a little bit of weed smoke it but for crying out loud don’t risk my family’s life over a stupid traffic ticket. You know the states still have the 10th amendment to enforce traffic laws…it is constitutional to have some traffic laws for public safety. Do some online research on how many 3rd parties get killed every year in vehicle pursuits.
Less than a month ago I held a 21 year-old female’s broken neck in my hands, praying medical would hurry because I didn’t think she would even last until then. The guy that hit her was a sloppy drunk. Her 2 year old daughter was laid out on the side of the road bleeding bad and had bad swelling on the left side of her face. Good traffic laws are okay to enforce…most people including myself would be tempted to do the same thing to a guy like the suspect on the video above.

In that situation the suspect is ordered to turn his head away from the officer. Maybe he didn’t comply, and the officer kicked him in the head. According to the new reports, the suspect had a long criminal history, and had been through this before. He new what the cops would want him to do.

I think what may be getting missed here is that while yes indeed the guy was running from the police he did indeed surrender.
While I would love to kick the guy in the head for being a moron the reason that police are not supposed to kick people in the head after they have surrendered is so that people wont be afraid of a beating if they do decide surrender peacefully after committing a crime.
It would be a shame for a suspect to decide to continue the pursuit longer than they otherwise would and continue to endanger peoples lives because they are afraid of being on the receiving end of “stick time” upon their willing surrender. It may make them think twice about surrendering..

Its this simple. THE LAW is just that. It applies to all human beings. Not statutes and codes but Common Law. The young guy broke it, the cops broke it and his collegues broke it by being accomplaces to it. The cop should be fired and fined that kicked. The others fined. The kid also needs a fair trial. Thats it. Nobody should be above the law, whether in uniform or not. Infact the uniform means you need to be extra careful as you are meant to be an example.

When I was a kid I learned REAL QUICK that

1.) Piss them off beyond belief.
and
2.) Waive all your rights “in the moment” they catch you.
Personally, I’ve seen people killed by criminals

Bottom line is the “suspect” was wrong and the “officer” was wrong. BOTH OF THEM broke the law. BOTH OF THEM should be punished. By the courts not by each other. My next point is to all of you who keep repeating the old line about not all cops being bad. In a SHTF scenario, no one will be pausing to ask if that target is a good one or a bad one. I am not condoning either the cop or the suspect. In my opinion they BOTH broke the law. It is not the cop to dole out punishment is the point here. And yes by running from the traffic stop he ( the suspect on the ground just for clarity sakes ) did endanger lives but in turn the cop should not of kicked him in the face when there was obviously a sumbission on the suspects part. Two wrongs do not make a right. No matter what he has done the officer still took an oath to uphold the constitutional rights of all. NO MATTER WHOM IT MAY BE. Unfortunate on a lot of circumstances but the officer is still suppose to remain professional. But I must admit to a point but not to the point of breaking the very laws he is suppose to uphold.

As a police officer I had witnessed this type of abuse several times in my short career. When I was in the M.P. Corp I called out my Sgt one day and told him to pick on someone his own size and who wasn’t in handcuffs. The stupid dolt took me up on the offer and found himself being laughed at by whole platoon. I despise police officers who use that kind of b/s . Our job its to ” PROTECT AND SERVE ‘ not to harrass intimidate and cause unecessary harm on individuals. But your idea to protect and serve while still in the police force, is a faint and flickering flame of hope. The best you could do right now is to support the people you can, and i imagine that is hard to do in the position you’re in, assuming you are still in the force.
