Embedding a YouTube Video May Cost You a Bundle

ASCAP licenses the performance rights for music, collecting royalties for its songwriter members when their songs are played in certain contexts.
Those contexts now include a YouTube video embedded on your blog or website, assuming your site is not “purely” non-commercial and is deemed large enough by ASCAP. The group just sent a collection letter to internet entrepreneur Jason Calacanis for YouTube videos embedded on his Mahalo reference site. Based on what the group told Valleywag, other startups should be worried:
ASCAP does not offer licenses to – or require licenses from – those who simply make their personal blogs available on purely noncommercial Web sites. Mahalo.com is a larger venture than simply a personal blog, and therefore ASCAP is engaged in discussions with Mr. Calacanis concerning the use of ASCAP members’ music on the site.
ASCAP sent collection letters to other website owners in the spring; YouTube told recipients to refer the group back to YouTube. But then a judge ruled Google owed ASCAP $1.6 million while a court fight between the two sides over licensing drags on. At some point, website owners are going to start wondering how much longer Google will offer to handle all the legal complaints over YouTube embeds — and just how many songs they’ve embedded over the years and now owe royalties on.

This documentary, The History Of Hacking is really worth a look, and watch out how both Apple and Microsoft started, if it wasn’t for any “copyright theft”, Apple Computers and their offspring never would have happened, and to an extent neither would microsoft, Sir Bill Gates was a member of the Homebrew Computer Club, which was a hackers club until he realised he could make more money if he no longer made his work available for use by everyone. He basically resigned from the club after giving them warning about using his work.
(I lost all of the uploaded videos of Bill Hicks cos of a copyright claim, but I’m sure even though he wanted to make money in his life, that if he were alive, he would be against copyrighted material. Many great people, musicians, comedians etc have found it hard to accept the Commerical side of showbusiness, that’s why there is so much alcohol and drug abuse and deaths with stars. Some can handle it and want it, like the Beckhams and others feel like they are losing their soul.

Texas’ constitution forbids imprisonment for debt and it has been outlawed at the federal level since 1833. Some states can and do allow imprisonment for debt. That is, for non-citizens of that state(i.e. federal citizen or other foreigner/alien, resident alien).

What I mean to say is that anything I create I create for one purpose: to Glorify God! now if anyone wants to share in that creation they are more then welcome to do it for free. If it is the type of creation that cost money for me to do, I probably would except payment for… however I would give the person the ability to have it for free if they choose. This is especially applied to music! I don’t think people can own an idea because I don’t believe Ideas are created but discovered, just as math and physics is not created by man it is discovered! two people can have the same idea with out ever being exposed to one another or the other idea. the idea is both legitimately had by both individuals. However at the same time a person could be exposed to an idea and later take bits of that idea and form a new one, and they can still reap the rewards of said idea.

How does copyright law work in regards to performance rights? If I buy a CD and play it in my car, home, yard, or at the local park the original artist has no claim of performance rights. It was always my understand that was because of the fact that I was not profiting from the work of another.
How is using someone’s music from a CD that I bought and paid for in one of my YouTube videos a violation of their copyright if my youtube video 0is not a profitable endeavor? How is it any different than me driving road with my windows down, volume cranked and rocking out to the same CD in my car? It’s my CD. I paid for it. The artist sold me the right to play and use his material for personal not for profit use when i bought it.

I’m a platinum selling artist and believe me guys, the whole royalty/copyright thing gets so involved and is so crooked it’s really a pointless discussion. For the most part the only cash most artists ever see from their product is upfront money as no one ever recoups. The label will own your masters forever and continue to profit, but since the artist will still “owe” money to them, you only get paid your writers royalties. If your a credited songwriter of course. I have played on songs being used in some very big video/computer games and am not entitled to performance royalties because I’m unrecouped, and the label (sony in this case) owns the masters. It’s a very shady biz at all levels, only gets worse as you get bigger. I long for the days when I was playing covers in clubs, made more money and had less stress.

Thanks muso and it looks like this is going to get far worse as they push to change the copy write laws to use fees. Doing so would effect libraries, and the net. Now the police can brake down your door for the illegal use of books.
I knew things could get scary when the book *Hit Man* was sued and won. It had a clear warning that it was for entertainment use only. It was used in the commission of a crime. That leaves a door open to all kinds of problems with other laws are in the mix today. As it all would be based on a judges ruling.

Doesn’t seem like a bad Idea , A labor is worthy of his hire. If you use someones intellectual property property you should pay a royalty. Maybe this will be a new model going forward. If you are a conglomerate with millions of hits and use others music you should pay. These sites are getting advertising bucks anyway , so why not share the wealth ? Doesn’t seem sinister at all.
No different that radio stations paying royalties , yes? It also might create a market for new music , that just wants the exposure and is not a product of the Marketing machine that is Nashville.

There should be a limit for how long an artist can be paid royalties for “his” music. Say, 10 years maximum. A carpenter doesn’t get paid everytime someone walks the floorboards he’s laid down. He gets paid once. It’s just insane how music artists can buy huge mansions and a stable of cars after ONE album. The payment is nowhere near equal to the achievement. I would say 5 years max for royalties, but okay, give em 10.

Yes some entertainers do get paid well and I’m ok with that but the corporations should not be ranking in continues profits because it was not their idea. How can you say that Americans will never be forced into camps…Never really? During WWII AMERICANS of Japanese descent (and AMERICANS of Chinese descent just for good measure) were rounded up and forced into camps for years on end. Family fortunes were lost, never recovered, never renumerated by the American Government. No apologies…nothing!
I am a 2nd Generation American on my Fathers side, my Grandfather was Chinese and forced into a camp. The Government can do whatever they want! After he was let out he left California and moved to Texas.
My mothers family were land owners in Texas since the late 1700’s before Texas was Texas. Texas was taken by the United States. My family were wealthy cattle ranchers with over 100,000 acres. The Government took it not recognizing the deeds and land grants issued by Mexico. Again the Government can do whatever they want.
I am so grateful that I found Alex’s website because no one in my family believes that we live in the land of the free. I’d rather die free than live a life on my knees!!!!

Well, if you avoid using google ad’s, and other ad’s, that should make your blog non commercial. How they win these things in court is beyond me, as they no doubt sell more product by people seeing something that they want to buy. I know I have purchased music based on what I have seen for FREE on the internet, as I am sure most here have also done. Of course we know the real reason, and that is censorship, and that is why we also support the infowars network. This helps in the fact that Alex Jones does make his films available to the public, and not very many people would do so with the quality of his films. I am so glad to be able to help support him in that endeavor to help awake the masses at no small personal cost to him, and his own. Another great way to support music, and have music for videos that you make is by joining magnatune.com, that gives you a open license for non profit music used in your videos.
