The search and seizure proposal is one of a long list initiatives — some new and some old — that Cieslewicz wants examined in the wake of a sharp increase in gun violence on the south and west sides of Madison this year.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.- To me, the cops going in your house to search for something legal, whether you want them to or not, seems unreasonable to me.

House the sky is falling, but you can’t see beyond the tip of your nose. Do minors have a fourth amendment right? I agree on one point but go further; the parents may have some right here if they believe it requires police to search but a vouluntary blanket search tells me they are pretty dumb if they do. But last time I checked the 4th amendment did not say for adults only. Now this may not be the case here as it was below, but I ask do parents really want to open up pandora’s box?

Cieslewicz also is calling for a program under which landlords would register their properties and provide contact information for a local person responsible for each property.
Absentee landlords and apartment owners who don’t screen out troublemakers are considered a major factor in neighborhood crime.”
This is not good because it looks like they want the whole community to submit to random searches=no probable cause!

Minors, unless emancipated, are under the control of a parent or guardian. If that parent/guardian chooses to allow the police to search a minors room, then NO, the minor has no say about anything.

Exactly my point cafehead…..an “informed” parent wouldn’t, a parental sheeple would because the nanny state has convinced them they lack parental abilities, and therefore need the government to parent for them. Parents SHOULD know if their kids are involved in drugs, gangs, weapons, etc……and they can damn sure do it without calling in the governmental mafia for assistance. However, as I mentioned above, if they chose to waive those parental rights, and allow a voluntary search which may not only allow their own kid to be jailed (costing the parents money), but also allow their home to be “sized-up” for whatever or something planted…..then they deserve what they get.

I’m assuming you mean the “income” tax? If you are not going it then first make sure of the following:
1. Don’t work for anyone. Be in business for yourself
2. Have no property in your name
3. If you have a bank account, don’t keep much in it. Live on cash.

No, Kurt, I mean ALL taxes. All taxes are intrusive and intrusion has no right to exist, so no tax has the right to exist. How do we finance public infrastructure then? If you have a 10,000,000 people country and it needs 10,000,000,000 dollars, you simply divide the 10,000,000,000 dollars by the number of residents, and each pays $1,000. Fiscal intrusiveness disappears and fiscal irresponsibility vanishes too. In the current worldwide so-called “progressive” taxation schemes, the richer pay a larger percentage of the fiscal revenue. Knowing that a minority will pay the bulk, the majority of voters allows wasteful spending. The majority in fact abuses the minority, at least in the beginning, because later, politicians having practiced intrusion with impunity, they start ripping off everyone.
When each voter pays the same share, an unduly raise of the contribution angers the whole electorate; officials will be afraid of grabbing too much public money. In case fear of the ballot box does not deter them enough, fear of the ammo box will.

Protesters marched through central London to Trafalgar Square
Tens of thousands of people have protested in London against President Bush and the war on Iraq.
Organisers claim 200,000 joined the demonstration, although police put the numbers closer to 100,000.
The protest was overshadowed by the bombs in Turkey, but was described as good-natured and non-violent.
Meanwhile Mr Bush carried on with his engagements, which culminated in a banquet for the Queen at the US Ambassador’s residence in Regents Park.

I don’t understand the problem. The article says police will ASK PERMISSION of parents to search their houses. No violation has occured. Police can go to any house or any car or person right now and ASK permission to search. Then you say “no” not too difficult.

I agree…. I also see the need to for a community to combat a rising tide of gun violence. On the other hand it seems as if it could (and should) be the responsibility of the parents to keep track of their children.
When somethings needs to be done and the people responsible for doing so, don’t, someone will, and probably will in such a manner to treat the irresponsible as irresponible.
You cant tyrannize a responsible self-sufficient community, just eliminate it, which brings with it a heavy dose of karma.

The problem is that they can pressure the parents into granting permission. And we all know that all too often, cops abuse their authority. They don’t like to be told “no”. Just try saying “no” to a search of your car if you’re pulled over, and see how you’re treated. And in this case if the cop says he saw something through the door, while the parent was refusing permission, then forget about the fourth. This plan reeks of abuse of authority and potential “parents’ words against officers’ words” type of arguments after the fact.
Let’s also remember that if the police have legitimate information that a juvenile is in illegal possession of a gun, then attaining a search warrant will not be a problem for the police. Whether this is pure laziness, or brazen rebellion against the constitution, Cieslewicz is asking for some serious problems with his plan.

Been there said no and got detained unjustly I might add. Pulled over for not wearing my seatbelt when I had it on the whole time. Because I questioned the officer he ask to search my vehicle. Ask why and was not told. Said no. Got ordered out of my vehicle. But I locked the doors behind me with windows up and shut the door. Got them mad. They then ushered me away from my vehicle called for a search dog. As soon as that was done Started to be questioned as to why I would not let them search the vehicle. “Because I do not want you to and you really have no probable or reasonable cause to do so for just a supposed seatbelt violation.” Was directly told and I quote “we are here to protect and serve the people and their best interests and if we think that someone is carrying contraband we can search for it any way we like.” I responded “Ummm no you cannot. That is called unreasonable search and seizure.” Then A cop got in my face and sternly stated “now look you little shit we are the police and you have to listen to us.” The search dog arrived. Keep in mind I have friends that are real cops on the force and have been to their training with dog searches and their normal training. The dog sniffed and walked around my vehicle for a while and never once growled or sneered or gave any more than just walked and sniffed. Then they put the dog away. Next The Lt. on scene now comes up to me asking “Sir do you have drugs in the car?” I replied “Nope I do not do drugs at all and never have.” The Lt. responds “Well the dog reacted like you do.” I told him “Bull. That dog never reacted what so ever and you know it. So do not sit here and lie to me.” His response was “Well we are going to search the vehicle anyways because the dog reacted and now we do have probable cause.” Two cops pull me aside while two others go to the vehicle and search it. But then the Lt comes back and asks for the keys to open the door or they would open it by force “if necessary.” Knowing that it would mean them busting up my vehicle I gave them the keys thinking I am about to be screwed. Then this other officer pulls up on scene from I did not recognize. Nor said anything audible around me. But their attitudes of the other officers changed to being very polite and suddenly doing things by the book. Though they now had my keys by my legal willfulness they searched my vehicle to no ends for about 1/2 hour maybe a little less just to find “Nothing. He is clear.” So they let me have my keys back and I got no violations. I figure I got extremely lucky somehow. I sensed this other officer that showed up on scene was a fair and honest officer and held a position of power. He never said a word to me he was always off in a distance from my position so I could not even read a name tag. If he had not shown up I think I probably would of went to jail on charges of possession that would of been trumped up and planted. I have never seen this guy again since. It has been years since this happened. And I thank him for whatever he did. So there are good police officers out there but too few if you ask me.
But point is now apply this to them asking homeowners and them searching for guns “with permission.” Sounds to me like a polite way of saying we are going to pressure you or make up excuses anyway to be able to search your home when we get there. Crooked cop rule: When pressuring somebody to do what you want and it does not work and When probable cause does not exist in reality MAKE IT UP!!!

I had 2 boys I couldn’t control and it’s a lot worse now than then. were all to blame for not paying attention to what the government education centers were teaching them. as for this new bill it’ll be mandatory after a while, give them an inch they’ll take a mile.

The problem is, today they ask permission, but tomorrow, they come uninvited! These kids who’s rooms they are searching, will grow to think that this kind of intrusion is totally normal, & acceptable. They ask permission to get people use to them doing raids, next time they will not be asking permission. They take your Liberties from you so covertly & slowly, that one day you’ll turn around, & they will all be gone! Being a life-long WI resident, I can say that Madison is by far the most liberal city in this state (some say the entire midwest)…and it’s liberal in absolutely every possible forum. It’s common knowledge that smoking pot in public is usually never addressed by the Cops, unless it’s done in a brazen or disruptive manor…yet they’re talking about a crackdown on the dealers??? How do they think the “users” get the stuff in the first place???
Having said that, I’m not surprised to be hearing about the gun-grabbing and room searching…and I’m sure that the “peace loving” residents will be happy to bow down to their Masters and comply with anything asked of them. Madison’s become such a messed-up place that I hate to even go their anymore…just too many freaky, whacked-out people anywhere you happen to go.

He didn’t say that he wanted to go after VIOLENT street gangs who use guns in their fight over drug turf, instead he said he wanted to ‘pull out every enforcement lever’ against
1-people who deal drugs (use?)
2-people who fire guns
This seems like another slight of hand first to broad brush and try and connect anyone connected with ‘drugs’ (pot smokers?) to violence (only BIG Pharma drugs allowed) and then to connect gun owners with ‘drug culture’. Can’t these people make valid DISTINCTIONS??? We are now in Witch Hunt territory where the tactic is to try and *LINK* anything and everything together by BS ‘associations’, setting up straw men in order to try and prejudice and stereotype people and things often completley unrelated.
If I recall Madison voters (among many mnay others nation wide) made pot use very very low on their list of things they felt like police needed to put time and money into, and I feel sure many Madison residents support the 2nd amend as well. Why is it so many police depts. often have their OWN agenda, Voters and citizens be damned. If they TRULY want to end battle over drug turf, join their fellow officers over at LEAP (Law Enforcement Against Prohibition) and put and end to the Failed ‘war on drugs’ with all of it’s violence, death, and misery.

Parents actually allow authority figures to search their children’s rooms, etc? If the parents allow this, there is not much a kid can do. However, the parents need educated. But I can see the allowing parents’ point of view. They can’t seem to control their own house and children, so they welcome the intrusion of authority figures. Personally, if my mom had allowed a search of my bedroom, without a warrant, and with nothing to back up her suspicions, I would still not be speaking to her to this day. OF course, I hardly ever speak to her anyway due to her paranoia and strong armed tactics in the first place.
Funny thing. When I got my first “above the table” job at 14 and it was time to file my IRS return, she gave me a booklet and told me to learn it and file it and not bother her. Okay, so I did. And got a dollar back. lol. Just last month she asked me to help her file her income tax return and I told her, well, just go to the IRS site and read and learn and file it on your own. lol. Yeah, what you do to your kids comes back to haunt you. Remember that, parents who invite police in to search your kids’ rooms. You coulda done it yourself you weak ass parents.

Wisconsin is one screwed up state. The taxes are absolutely insane and it’s home to the University of Wisconsin at Madison, one of the most communistic hellholes in America. It’s also a state where law abiding citizens cannot carry a concealed firearm, yet 19 year old kids can be cops. About 2 years ago, a 20 year old cop in a small Wisconsin town killed his ex-girlfriend and 5 others with an AR-15 rifle. He became a cop at 19. About 3 years ago, the police in Oshkosh were going door to door and consficating guns from law abiding citizens so they could find a gun that was used in a shooting. Did I also mention the fact that Jeffrey Dahmer was from Wisconsin and that’s where he killed most of his victims. At least they make good beer, cheese, and bratwurst in that state.
