European Court Ruling spells an end to water fluoridation

Fluoridated water must be treated as a medicine, and cannot be used to prepare foods. That is the decision of the European Court of Justice, in a landmark case dealing with the classification and regulation of ‘functional drinks’ in member states of the European Community. (HLH Warenvertriebs and Orthica (Joined Cases C-211/03, C-299/03, C-316/03 and C-318/03) 9 June 2005)
Functional drinks are those products that have two different purposes – for example, nutrition and exerting a positive effect on some medical condition. They include ‘near-water drinks with added minerals’ and, in view of the properties claimed for fluoridated water by fluoride advocates, it must be classified as a ‘funtional food’, and therefore falls within the scope of the relevant legislation.
Medicinal law takes precedent over food law.
The Court ruled that, where two different sets of rules appear to apply to a product, medicinal legislation must take precedent, and the product must be regulated as a medicine. It emphasised that medicines regulators in member states do not have the power to exercise discretion on the classification of such dual-function products. The repeated refusal of the British and Irish Regulators to recognise fluoridated water as a medicinal product is therefore an unlawful misuse of their powers, and one that requires immediate reversal.
ECJ rulings do not establish new laws, but clarify how existing ones should be applied, and are enforceable in the domestic legislation of all member states of the EC. In effect, this decision at last confirms the claim that I have made for many years – that existing medicinal law has always required that fluoridated water be regulated as a medicine. Fluoridated water has no medicinal marketing authorization (’product licence’), and because of this it is – and always has been – illegal to supply it to the public, as the 1968 Medicines Act confirms.
As a ‘medicinal water’, the protection afforded by the water quality regulations that shield consumers from hazardous substances in drinking water does not apply. Its use in the processing of foodstuffs is also prohibited, under the food safety legislation. Aa a direct result of this ruling, all English and Irish legislation providing for water fluoridation are at last exposed as having been in violation of that fundamental prohibition, and must now be repealed.

Implications for international trade in food products
But the ruling also has an equally profound implication for export trade in processed foods and drinks. The Court stated that even if a functional food product (or a food containing it) is legally marketed as a food in one member state, it cannot be exported to any other member state unless it has a medicinal licence. So any company making a consumable product using fluoridated water in its preparation or as an ingredient cannot now export that product to any other state in the EC, even if their product is permitted in their home state.
The economic implications are enormous. Not only does the ruling ban the use of fluoridated water for all retail catering and wholesale food processing in the UK and Ireland, it also prohibits such trade from these states to other member states of the EC. But it goes much further than even this, because if British and Irish processed foods from fluoridated areas cannot be exported to the EC, this prohibition must also apply to the importing of such products into EC member states from any other country that practices water fluoridation. The decision effectively bans all processed food products from countries such as the USA, Australia and New Zealand, unless they can be positively proven to have been prepared using only water that was not fluoridated.
What does this mean for water undertakers who fluoridate their product?
Before British water undertakers allow Strategic Health Authorities to order them to start fluoridating their water they need to be fully aware of the implications to them and their shareholders should they agree to do so. Not only are medical damages compensation claims likely to be far higher, with charges of negligently supplying an unlawful product forming the basis of class actions, food processers who lose their markets will certainly hold their water undertaker accountable in law for their losses. This ruling means that Courts in other member states of the EC must support demands from competing food processors that an embargo be placed on British and Irish products unless they can be proven to have been manufactured using only non-fluoridated water.
I have previously warned that this illegal product substitution cannot be permitted to continue, and that members of the public are entirely entitled to demand to be supplied with water that complies with, and is regulated under, the drinking water quality standards that are enforceable under both EC and UK (and Irish) law. Since the ruling must be enforced in all EC member states, water companies will now have to come off the fence and accept that fluoridated water is not an acceptable alternative drinking water.
The only way out – repeal all fluoridation laws and ban the product.
This decision completely supports the challenge that I have issued repeatedly to the UK Regulator, the MHRA – identify the case law that justifies your perverse claim that this product is not a medicine. Ironically, it was the MHRA itself that finally gave the game away, in a formal response to another Regulator, the Advertising Standards Authority (ASA). In what I can only assume was a deliberate attempt to mislead the ASA, the MHRA actually cited this case in support of its continued perverse refusal to implement the medicines legislation that it is obliged to enforce!
The beginning of the end – fluoridation must now be banned, worldwide.
This ECJ ruling effectively puts the final nail in the coffin of water fluoridation, not only within the EC but worldwide. It establishes a very substantial but entirely justified obstacle to trade in food products that are prepared without proper regard to the protection of the public that is enshrined in law. The ruling must be recognised and enforced not only in every memebr state, but also in any external state that wishes to trade with the EC in processed foods. So just what can be done to resolve the present unacceptable situation?
One solution would be to grant a medicinal licence to fluoridated water. But the Court ruled that any evaluation of a functional drink may only be done under the rigorous procedures required to scrutinise any pharmaceutical product. In the present state of scientific concern over the evidence of its lack of efficacy and safety it is impossible to imagine that such a licence could ever be granted. If it were, it would immediately result in a world-wide denunciation from the scientific community that is fully aware of the improper commercial influence that is at the heart of the international promotion of fluoridated products.
The only acceptable response is to call a halt to this controversial practice now. The experience of the past half century has shown that it is completely unjustified – indeed, it is responsible for what may reasonably be described as a pandemic of avoidable chronic fluoride poisoning. In ruling that this type of product must be regulated under medicinal law, the Court has taken the final step towards bringing this disreputable practice to a long-delayed end. Let us hope that national Governments all over the world will heed this decision – the economic consequences will be dire for those who continue to attempt to continue this discredited and illegal practice.

I’d keep a close eye on this to see whether it also applies to any drink that have been ‘enhanced’ beyond being ‘neutral’ water; does or would it include mineral water for example, anything in fact that’s touted to have *any* “health benefits”.. it’s potentially a back-door into Codex implementation.

Australia is now talking about adding fluoride to all bottled water in the very near future. for reasons of dental health of course. yeah ive heard that. dont you think that such a costly undertaking as adding a chemical to an entire nations water supply, that they would at least add a chemical that is actually beneficial to peoples health? i mean why not do a study, find out what vitamins the general population seems to lack, and then add those to the water? does that not make sence? why add something that has absolutely NO benefit whatsoever? i hear the dumbing down theory alot, and since i refuse to take peoples word for anything these days, i looked into it. and yes, it does seem to be the only real side-effect of ingesting fluoride daily over long periods of time.
but on a good note, at least people have finally gotten a win!

Most Water Authorities get their water from a local freshwater source like lakes or rivers, and then add it at the plant. (For your teeth….)

Is is just me or does this also set a precedent for the Codex Alimentarius to be the go to in cases where a vitamin or mineral could be seen as a food and a drug? The Euro court said that bottled drinks with SUPPLEMENTS are to be treated as MEDICINE. That means no more Vitamin Water in at the corner store. The ruling has nothing to do with flouride, other than the back that they can’t put it in bottled water and say its good for you. But neither can they put MINERALS, according to this rule.
This is TERRIBLE news, and should be recategorized in the “police state” section.

That’s correct A Rex. The whole codex things is set to start in January 2010 in 5 months. The idea is to classify vitamins, minerals and nutrition as medicines. They will also add sodium fluoride to food stuffs so they don’t need to poison the water supply anymore.
This is basically a war against vitamins and nutrition. By reducing nutrition and anti-oxidants you can create a huge wave of deaths through preventable illness. I have started a micro-farm to grow my own. Many vitamins occur naturally and a good balance of non GMO veggies is a great way to stay healthy.
Open pollinated “heirloom seeds are perfect for this. They require a bit more care but provide real food and a constant source of more seeds for the next year. I use car tires to make vertical stacks filled with home made compost on an old bit of driveway in red brick. I know what you’re saying and completely agree on scrapping BIG BROTHER.
I also agree on removing/reducing central government – gradually – let’s be at least a little realistic – as it stands. It could be removed entirely but we would still need local government because we need laws and regulation on some geographic level.
Eg. Even if we could privitise every single part of our infrastructure without regulation these companies would RIP US OFF eventually. Even if competition lowered prices eventually monopolies would emerge or collusion would take place – it always happens.
Personally I’d arm the people with non lethal weapons, reduce the size of the police force, keep a small nuclear deterrent, practically disband the armed forces, sell off the (aging) military hardware and use the vast acres of military land for wonderous, low density housing projects. Issue apologies to all nation’s we’ve screwed over and start trading with them as a good will gesture in return for our companies to operate there (works for the Chinese!).
BRITAIN WOULD NEED A NATIONAL CONSTITUTION or we could have major problems legally speaking…

Reading many of the comments all over this site, it is apparent that the problem with conspiracy activists is that there is nothing that can ever be done that they will not distrust or scorn. Don’t get me wrong Alex, you’re information and posts are excellent. But the comments are relentlessly unbelieving to the point that even if we did finally achieve a just world, amny of these depressive wackos would still try to tear it apart.
I hope the European Court ruling is just as it seems. The wording seems clear enough for me. No doubt Alex and the rest of us infowarriors will keep a check on developments in any event.

Yes I agree, if Lisbon passes, we’re stuffed. I expect the same kind of sweeping, draconian changes and wholesale looting as we are seeing in the US, though I suspect the Europeans will put up a fight at an earlier stage. The danger is that the leaders from member states with larger populations are set to carry more clout in the Council, and these are typically less in touch with their people than the smaller states.

I take back the above somewhat, I started reading the top and I didn’t scroll down to see the other comments, apologies. I agree with T-wolf though, it’s somewhat suspicious that they would just stop if this was on a NWO agenda.
To me the NWO is loaded with contridictions, mainly due to the fact that the theory covers such a large idea, it makes it almost impossible to be accurate. Thus I don’t believe in it fully. Here’s what happened: I started a petition to get the fluoride out of the water in this town I’m in. I started at the mayors office, the town attorney’s office and the local courthouse to get it right, but nobody there knew how to get a petition started, so I went to the com. college and asked an instructor how to do it. She told me how. I put an article in the local paper first with my email to answer questions about it, I got one email and she called me a freak of nature and then went behind me and took down half of the petition forms. lol. Well, at least I tried. I didn’t get enough signatures to even follow through with it. But the best part of it was, every place of buisness I hung a petition up at, I got to explain about it and they all listened and supported what I was doing.

At the moment it’s only added to a few areas, occurs naturally in many supplies (or does it? Should check out industrial activity in high ‘natural’ fluoride areas)…
In all honesty, al fluoride research into the recommended safety levels is inconclusive.
Studies are small & poorly funded so the gov. can turn round and say:

If it says, DO NOT SWALLOW, on toothpaste warning labels, that’s exactly what it means. Why would i want to drink it all the time. Surely… it could build up to dangerous levels over the years in the body, and even include environmental issues as well.

I agree that water should not be fluoridated, but if the western governments are trying to dumb us down as some speak of when they talk about fluoridation, why would Europe ban fluoridation?
Something just doesn’t make any sense here.
They say that Hitler’s regime put fluoride in the water to dumb down and make prisoners more passive. Well, how much did they put in the water in that case.
Do cities and towns that fluoridate water today, put comparable quantities of fluoride in the water compared to the Nazi regime?

I suggest you find the nearest factory that uses quantities of smelted aluminium and demand your free fluoride. They will gladly fill you to the brim! It would save us all a lot of (women esp. see. hormone water pollution too) potential brittle bone disease and mind-numbing brain-damage (see Hitler too) when the sensors at the sewage works go wrong or some idiot leaves the wrong valve on for too long and they dump/pump a few 100,000 liters tanks-worth into some ditch somewhere…hmm??

OK, it won’t be an idiot leaving a valve on, my late father used to design the electrical control systems that controlled sewage works. It will be a LEAKY valve, corroded pipe or even data entry mistake if this happens but those (monitor) sensors are the real weak link, I can tell you…

Just to be serious for a moment, I don’t believe fluoride at certain levels is actually all that dangerous. HOWEVER, if it is ADDED there is always the chance TOO MUCH will be added. This has happened before with CHLORINE (which is also not all that good for you but is better than sewage based diseases).

I know what you’re saying and completely agree on scrapping BIG BROTHER.
I also agree on removing/reducing central government – gradually – let’s be at least a little realistic – as it stands. It could be removed entirely but we would still need local government because we need laws and regulation on some geographic level.
Eg. Even if we could privitise every single part of our infrastructure without regulation these companies would RIP US OFF eventually. Even if competition lowered prices eventually monopolies would emerge or collusion would take place – it always happens.
Personally I’d arm the people with non lethal weapons, reduce the size of the police force, keep a small nuclear deterrent, practically disband the armed forces, sell off the (aging) military hardware and use the vast acres of military land for wonderous, low density housing projects. Issue apologies to all nation’s we’ve screwed over and start trading with them as a good will gesture in return for our companies to operate there (works for the Chinese!).
BRITAIN WOULD NEED A NATIONAL CONSTITUTION or we could have major problems legally speaking…
I’d keep all taxes up front on a sliding scale from 10% topping out at 50% all in (and that’s for the mega rich peeps & comps.). 5% national sales tax/VAT, local sales tax max extra 5% This will pay for:
o Health insurance (keep ‘free’ health for all, we all benefit from this)
o School + uni fees (contributions, top ups from charity)
o Public land maintainance, including roads (technologically no more research
needed except for voluntary autodrive systems) but not rail (technologically
complicated – ie. maglev etc.).
o Justice system
o Prison maintainence (privately built, publicly run)
o Small police force (but more, highly regulated bouncers + sec. guards)
o A few, very small regulatory bodies covering major industry sectors and other
issues (pollution, fraud etc.) These are publicly accountable, all workings open.
o Laws and public spending voted on by any1 concerned. I hate to say it but I’d
use face/thumb recognition here – BUT NOT CENTRALISED DATABASE RECORDS
All person recognition records for the day deleted at the end of the day. Votes
on multiple, SIMPLE laws at once, say 4 times a year on a MANDATED HOLIDAY.
£1 to vote, 1 station for every 250 voters, computerised but checked by
multiple volunteers (maybe paid a little)!
Issues examples:
All private company accounts publicly viewable? Privacy vs. cheap, voluntary
regulation by any1…
Decriminalise all drugs (ie. heroine, PCP, crack), legalise many (ie. pot & I’m
not a toker, E) Strict sentences for dealers of illegal (but decriminalised drugs),
sales tax on legal drugs. It’s your right to harm yourself, Alchohol’s the worst
anyway!
Privatised justice would surely lead to arresting & framing for profit.
This is a shallow, back of the postcard idea (I know, it shows!) but it’s a start, Any1 want to rewrite and reimplement the MAGNA BLOODY CARTA coz it’s deader than dodo’s doodee!!
We will always need some form of publicly funded infrastructure, if not nationally, locally, but the present system is, I’d agree, REVOLTINGLY O.T.T. and FASCIST!

I am actually impressed that this is actually going through. However, Wouldn’t this create a trade embargo between European nations and nations who still continue to use water fluoridation?
Logic says that the water fluoridation is also used not just in municipality water systems, but rural farm irrigation systems as well. Therefore, this chemical would be in the food that we eat that was produced on the farms.

Fluoride is dangerous in tiny doses, it has done it’s work. You remember those microwave guns they developed? I bet no one ever told you that they can be modified to do other things such as stop your heart with no visible effect or make tiny quantities of chemicals become lethal. Its remote electroendocytosis… and once the mobile/cell network is configured you won’t need fluoridated water anymore because they can make the tiny quantities we normally injest just as harmful, and plus they can change the effect in real time per geographic area without adding any more fluorine. Its just the signal that they are changing to new more modern methods of mass poisoning. What a brilliantly simple idea.
Look up radiofrequency radiation dosimetry, I believe the EU just started work on a european wide standardised handbook for dosimetry… apparently to “avoid such effects” despite the fact there is no regulation, no guidelines and no oversight.

Wow. I was one of the ones commenting waaay back years ago on Alex’s sites, wondering why there were so few comments. How far we have come people! I’m astounded and amazed at how many people now comment, our numbers are swelling! And while we have a long and tough battle (perhaps the most vicious phase to come) ahead of us, I sleep easier knowing that now our scattered population is growing into a worldwide force!

I fought against this in my hometown and crushed the local board and dentists like little ants. I did not even base it on science I based it on my rights not to be medicated involuntarily. Fortunately, we got 3000 signature of 10000 voters. The politicians got the point pretty quick.
I cannot say that we did not use scientific data. However, for the average person, it is better to use freedom of choice.

Now we need to have a similar ruling in the U.S.
A note: I met people who believed that we should other medicated stuff, like Vitamin C. I told them that it was anti-American to add stuff because a few people cannot take care of themselves.

With the Codex coming up, cyber security bills, limited freedom of speech, Lissabon treaty that is being rammed trough our throad; while we pay for campaigning. So it is a good move/nice rejection of the court, but it sad that fluoridation came this far.

Beings I live here in Germany now , I can say that true , they might take the fluoride out of the main drinking water , BUT…. I have been reading the ingredents on bottled water , coffee creamers and just a number of other drinks and foods that have fluoride in it …
Most folks here dont check out the things in the foods or drinks they buy at the stores , but I do and just because they take the fluoride out of the city water dont mean they have done away with it at all , they just hide it in other products .
I even found it in my nasel-spray I buy here , now whats fluoride in my nose spray gonna do for my nose…. make it all better ? , I didnt know I had teeth in my nose…
leave it up to the N.W.O. and Bilderberg to be sneeky…
