    OAKLAND, California (CNN) — A former police officer for the Bay Area transit system pleaded not guilty Thursday in the New Year’s Day shooting of a passenger at an Oakland rail station.

    Johannes Mehserle, 27, appeared in a packed Alameda County courtroom, with his supporters separated by a courtroom aisle from relatives of shooting victim Oscar Grant III and other spectators. Mehserle is charged with shooting Grant, 22, in an incident that spurred violent protests in Oakland after being captured on video.

    Mehserle resigned his job as a Bay Area Rapid Transit police officer days after the shooting, and he was arrested in Nevada earlier this week. Thursday’s proceedings took less than five minutes, with Mehserle appearing behind heavy windows in an enclosure out of view of all but a handful of spectators.

      Pretty sure BART uses Glocks. There is no safety per se. The “safety” is a lever on the trigger itself that is automatically deactivated when the trigger is pressed to the rear during the act of discharging the weapon. The idea is that this system makes the arm quicker to use and eliminates the possibility of forgetting to take the safety off, as well as allowing a consistent trigger pull each time with no first shot long, heavy double action pull.

      Call in and ask Jason Bermas to explain it. LOL Gee, that guy is making me sick with his ignorance of second amendment/militia issues and the effectiveness thereof. I can’t stand him anymore. I’ll listen to someone else until they pull that snot nosed kid off of the show. Sorry.

      I give far more leniency to these street cops who confront unscripted scenes than the pigs who dress up in black with masks and kick in doors (many times at the wrong house). When they kill it is MURDER. This guy made a mistake looking at the video. I don’t know what should happen to him but in many forces he would soon get his job back. In those forces the chief should be indicted for murder.

      As anyone who sponsors, participates or posts on this site would. Very few short of Tomothy McVeigh had the coruage to accept the responsibility without exhausting all resources to save their ass.

      It is very easy to point the finger… and many of the posters on this sight remind me of the movies scenes where people were going to be beheaded or hanged. They enjoy it as long as they are pointing the finger… Once they become the one pointed at.. they want rules changed.

      If we had a justice system that was fair, instead of corrupted by lawyers and ex-lawyers who are now judges, perhaps we would fair better as a society. That is not to be..because the common citizen has lost touch and no longer wants the responsibility of being a citizen and the duty that acompanies such status.

      You had the principle backwards, but it’s more correct to say that there’s a *presumption* of innocence prior to trial proceedings. One of my ‘pet peeves’ is the folks running around saying that people are “innocent until proven guilty” which is, often, not the case.

      For example, a man could commit a murder for which he’s never caught, tried and proven guilty. Since such a man was never brought before the judgment bar and convicted, does this mean that he’s innocent? (rhetorical) I try to look at criminal justice matters objectively, and in light of fundamental morality.

      Unfortunately, our criminal justice system is totally broken at all levels. Attorneys are at the core of the failure (check out the meaning of the Latin root for that word, *tornere*). The innocent are convicted and the guilty go free.

      Additiionaly ..perhaps you missed my point. Everything may or may not be as it appears. What was going through the BART officer’s mind, how many encounters/confrontations has he had, was he afraid of someone acting as Grant had been acting prior to the video taping,(Note: a fight was mentioned.. we do not have the advantage of seeing what transpired there to suggest the evnts that lead up to this incident) etc.

      I am not a bloodthirsty human thinking I can determine “justice” without all the facts. It is obvious many are on this site sincethis article has began to be milked over a week or two now

The main concern of the people of this site is that this executer does not get off scott-free as they so often do. The man wasnt fighting back and was defensless laying on his stomach no need for the taser to begin with. The taser could have killed hi just the same.

      We need to understand the police are out of control in this country and through media you begin to think thier actions are justified. Any police officer that has used a taser when in a non life threatening situation should be charged with attempted murder. These less lethal weapons have become accepted by the public mainly due to the name change to non lethal, and that name is simply not true. Tasers have killed over 500 people in America alone, seems kinda lethal to me.

      One more thing before I go, you do not have to be a victim to these monsters. John Bad Elk v. United States, 177 U.S. 529, states you have the right to defend yourself from a unlawfull arrest to the death. We the people have the power!

      If Johannes Mehserle gets of murder I think Grants family will take it ok-not. J.M. is a coward till the end pleading not guilty with all the proof there is. His best bet would be plead guilty, and throw himself at the mercy of the court. He would get a better deal, plus it’s the right thing to do. He’ll have a nice welcoming comitty when he’s walking out of court. Oh wait that wont happen. He will get a police escort out the back in one of many unmarked cars with tinted windows.       The cops supporters where all behind him I see, what a crock. How much you want to bet that many of his supporters are cops themselves. I have always wondered why haven’t the Federal Govt. used the RICO act against police organizations. I may have the answer to it, they know the police are bending and breaking the law. I think they are afraid that they need these “front line” fighters to do the dirty work in order to keep society in check. It’s truly amazing that cops can get away with murdering a person and people still say that it’s okay. Some people think that cops can do now wrong regardless of what they have done. Some like the idea of a cop beating up or killing a minority because they can get some form of revenge on a slight or a look or loss at the hands of a minority. Some also think that this is a line that is protecting the majority from the “evils” of what minorities can do.

      The sick thing that these people don’t understand is that we are hearing more and more cases where it’s happening to whites.       Recall the outrage when the police officers who beat Rodney King were found ‘innocent’ in a court of law. Every one saw the video; they beat the ‘you know what’ out of him. The people rioted…………….. BUT, what most people never noticed is that the officers were charged with and tried for ‘Attempted Murder.’ ……………. The jurors in that case had very specific instructions from the judge. …………. In the end, they had to find them ‘innocent’ because those officers didn’t intend to ‘murder’ Rodney King. ………………………………..Did they intend to rough him up and/or teach him a lesson?       Not sure if California law permits the jury to get a finding of guilty if they determine that the actions were manslaughter, the result of mistake, etc…. rather than an intention to murder………… BUT can see that a finding of innocence is going to set off a public display………

      That being the case: Please keep in mind that the us govt has the right to put down ‘riot and rebellion’ (constitution and other EOs) and I am cynical enough to think that they would indeed precipitate a reaction that would allow them to step in with force……………. for ‘as long as is needed’ to restore order.

If you watch the actual video .. its outrageous what happened… the poor kid is handcuffed .. laying face down on his stomach, first he gets tazered, and then shot in the back … The poor kid wasn’t a threat to anyone at that point. First, Bay Area Rapid Tranist police are an accreditted police force, are extremely well paid and for some reason travel around in automobiles instead of riding the rails like every other tranist force in the world does and as common sense would dictate.

      Second, a man with a bald head and a German name roughed up several black men in Fruitvale station between Lake Merritt and Colliseum stops in Oakland. Oakland is majority black and has a reputation for not putting up with impositions by whites in black sections.

      Third, one of the videos clearly provided audio of someone shouting “This is the Bart police” followed by an expletive that starts with N.

      Fourth, the fatal victim is clearly being bound with plastic handcuffs, held down by two cops in the lower portion of his prostrate body while the main perpetrator hits him in the head. A female officer who seems to have been the first responder stands guard on one side while a male officer stands guard on the other, to fend off possible rescuers from among the passengers.

      Fifth, the police attempted to confiscate all footage. If the fourth point doesn’t stand up as conspiracy to murder, the fifth nails the coffin in that lid. The BART police force then refused to comment and issued conflicting statements to local media. They attempted to cover up for the murder, making the entire force complicit as accessories.

      Sixth, the riot that resulted in 100 arrests at Fruitvale days later was described by one local resident as choreographed and performed by outsiders.

      Seventh, a person’s address is considered public information in the United States. Thus when the indictment for premeditated murder is passed down, it will list the prime defendent as Johannes Mehserle, 27, of 71 Belvedere Court in Napa, California (an dpossibly include the zipcode 94559-4140). This is long established practice in the US. Addresses are public information. For the FBI to go to Alex Jones with a search warrant for IPs because of the release of the suspect’s address is just wrong, it’s false. The demand for IPs has to be based on threats, not the release of public information.

      Eighth, Johannes Mehserle, the skinhead who shot an innocent man in cold blood on New Years’ morning of 2009. did so after the man begged him not to taser him because he had a young daughter. Johannes Mehserle, the neo-Nazi skinhead employed by BART to murder passengers, was on duty while his wife was awaiting the birth of their first child. This means the man will likely try to bring up an insanity plea, stress, trauma etc. It worked when the San Francisco cop who assassinated Harvey Milk claimed it was caused by excessive consumption of Hostess-brand Twinkies.

      Seriously, we don’t know all that went on. The officer might have had Twinkies before the public execution. Innocent until stamped guilty by the state. I mean really all you guys have to go on is a video showing him do it, a shitload of witnesses, and a body with the officer’s ballistically traceable round. It was probably an accident that he drew down on a defenseless person. Probably an accident that he shot him in the back. Probably an accident that more and more unarmed people are being killed by police. REALLY though, I have a suspicion this guy has been over in Iraq, spreading democracy in the same manner.

      Plead “Not Guilty.” Well DUH, anyone who has even a basic knowledge of the system knows that “NOT GUILTY” is the ONLY response the courts will accept during arraignment. You cant claim you are guilty, the judge wont accept that, the one only plea you can tell the courts is you are NOT GUILTY.

      So all of the people making comments about him pleading not guilty is like complaining that a judge, a bailiff and an attorney aren’t required during a criminal court proceeding. It’s the system.

      His commanding officer should also be on trial for trying to protect him after a crime was committed and not investigated for several days.
      There are many people guilty here!!!

      It is good to see how the protection of glass applies to the officer, but the victim had no rights or protection from the man being protected.
      I am not for lynch mobs normally, but this man could be better served by the victims and upset citizens.
      The concept that justice will be served would require life sentence or the death penalty for the officer!!
      Anything else is a slap on the wrist, and a pat on the butt.
