Fed Judge Throws Out Berg’s Obama Case

A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.
Philip J. Berg alleged in a complaint filed in federal district court on Aug. 21 against Obama, the Democratic National Committee and the Federal Election Commission, that Obama was born in Mombasa, Kenya.
Berg claimed that the Democratic presidential standardbearer is not even an American citizen but a citizen of Indonesia and therefore ineligible to be president.
He alleged that if Obama was permitted to run for president and subsequently found to be ineligible, he and other voters would be disenfranchised.
U.S. District Judge R. Barclay Surrick had denied Berg’s request for a temporary restraining order on Aug. 22 but had not ruled on the merits of the suit until yesterday.

Obama and the Democratic National Committee had asked Surrick to dismiss Berg’s complaint in a court filing on Sept. 24.
They said that Berg’s claims were “ridiculous” and “patently false,” that Berg had “no standing” to challenge the qualifications of a candidate for president because he had not shown the requisite harm to himself.
Surrick agreed.
In a 34-page memorandum and opinion, the judge said Berg’s allegations of harm were “too vague and too attenuated” to confer standing on him or any other voters.
Surrick ruled that Berg’s attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were “frivolous and not worthy of discussion.”
The judge also said the harm Berg alleged did “not constitute an injury in fact” and Berg’s arguments to the contrary “ventured into the unreasonable.”
For example, Berg had claimed that Obama’s nomination deprived citizens of voting for Sen. Hillary Clinton in November. (Berg backed Clinton in the primaries.)
Berg could not be reached for comment last night.
Obama was born in Honolulu on Aug. 4, 1961, and the campaign posted a document issued by Hawaii on its Web site, fight thesmears.com, confirming his birth there.
Berg said in court papers that the image was a forgery.
The nonpartisan Web site FactCheck.org examined the original document and said it was legitimate.
Further, a birth announcement in the Aug. 13, 1961, Honolulu Advertiser listed Obama’s birth there on Aug. 4.

While the judge maybe right that this is frivolous, that’s no reason to not allow full access to everything that a could-be president has in their past, other than underage charges and such. Its screwed how there is a question, and the Judge just says No, I won’t allow a definitive answer, because its crazy and far out that someone might forge a document…. just 1 more reason to have no faith in any branch of government.

This is an outrage. It is not frivolous to ignore the rules of the Constitution. Nobody should have to explain why it causes personal harm for a presidential candidate to run for president in complete defiance of the rules of the Constitution.
It means the person who is running is a fraud, a liar, and thereby on his face Obama is not fit to be president, and needs to be in prison instead.
These judges are all Freemasons who were packed and chosen by one devil worshipper to support the evil doings of all the rest of the devil worshippers.
Our country is trashed. Our courts are full of trashy judges who use their authority to destroy our country, our freedom and our Constitution.

There is no ruling on whether Obama is a “natural born citizen” as required by the constitution, only that this law suit had no standing because Mr. Berg could not prove harm to himself.
Perhaps Berg filed the lawsuit to gain publicity.
I am voting for Cynthia McKinney, the 9/11 Truth Candidate, and I have no faith that the votes will be counted anyway.
This was a legitimate news story. If information makes you upset or angry, you should look into it and try to find out why.

I guess the judge forgot to look at the fact that Obama, by moving with his mother to Indonesia, surrendered his US citizenship when he went to school there after his step-father had ackowledged him. And the fact that when Obama traveled to Pakistan and India in 1981 on his newly re-newed Indonesian passport seems how no US citizens were allowed, by order of the US State Department, to travel to either of those two countries. Indonesia did not allow for dual citizenship in those days, and certainly not until 2006. Whether or not Obama was born in Honolulu he still lost his citizenship when he lived in Indonesia for five years with his mother and his step-father ackowledged him so he could attend school there, which only citizens of Indonesia could do. If even if Obama re-gain his citizenship he would only be a nationalized citizen, not a native citizen, so therefore he is still not eligible to be President nor can he hold his current senate seat. If he is allowed to get away with this then there is no hope for the rest of us and it’s that simple. On the other hand, it really is of no suprise. Obama is after all going to be the next NWO sock puppet.

Whoa that is entirely bullsh*t. Check the image in a hex editor. In fact you will see in the info there that it was in fact edited with photoshop. This is fucking nuts, any moron can check that so called birth document and see that, even that it has no state seal. They really are conceited, to believe they can skip finding a way to stamp the state seal and no one would notice, even Kevin Poulsen had the brains to make sure his illegitimate birth certs he used to get driver’s licenses had the state seal. Even if that was the only problem with the photo (which it’s not) it should of raised more questions. They even had the balls to edit it with photoshop and left it in such a way that you can use a hex editor and see that information was added to the photo with photoshop. We are in a lot of trouble here, if they can get away with this, just imagine.
Should there be no doubt left about what I said before? This election, as I mentioned before is entirely rigged in Obama’s favor, even McCain is aware of that I’m sure. McCain is just a paid actor, of course he benefits from all of this, even though he is and never was meant to win or put up a real fight. Great. A Federal Court Judge that thinks damage to citizens doesn’t give “legal standing” to check out a birth certificate! Good, don’t worry about the U. S . Constitution or enforcing those pesky qualifications for president, just tell the plaintiff that “there’s no legal standing” and the suit is “frivolous and not worthy of discussion”. It is very suspicious that Hussein Obama went to Hawaii by himself recently, and was spotted walking down the street for a little stroll. Why wouldn’t he stay with his “dying” grandmother the whole time if it was serious enough to leave the campaign trail? And isn’t it odd that he would have a dying relative in the state he supposedly has false birth records? All the more reason to suspect that Barrack Hussein is not a U.S. citizen, and therefore not qualified to become President. People that write long comments need to start using paragraphs. I pass over and do not even attempt to read any comments that are more than 4 lines with no paragraph spaces. No matter how good your statement may be, I will just go to the next comment. Learn to write the correct way.
Same goes for any religious statements. As soon as you start quoting scripture, you lost me as a reader. I do not care if you are religious or not, try to write comments that would appeal to everyone or else you are just talking to a percentage of the people reading, instead of everyone.
Just my thoughts. I am sure I am not alone on this one.

The real truth is that even if we were to have a foreign president or any for that matter, we need to tell him what to do. If we demand free health care, electric cars, alternative energy resources, or what is the common good of WE THE PEOPLE does is really matter who the person is? Another reason you can tell this whole thing is rigged is look at the “non-partisan” website that they said confirmed that the birth certificate was legit, Factcheck.org. If you do some research on Factcheck.org you will realize that it is related to The Chicago Annenberg Foundation. And guess whom The Chicago Annenberg Foundation is related to, William Ayers. Can you say conflict of interest. Then again I’m sure that Factcheck.org is completely “non-partisan” simply because they claim to be (please note I am being sarcastic). This judge could simply be a useful idiot for the party or he could have owed a favor to the “family” that has ties to Chicago. Or maybe he’s a 33rd degree-er. Doesn’t matter, the easiest place to stop a court case is always with the judge.
I’m sure that if Berg can appeal this, then he will, but there’s no guarantee that any higher court will even hear the case.

The judge ruled on the law and the facts. The guy didnt have standing. He wasnt harmed.

Aside from the imprecision of the descent you draw (monkeys are cousins of man, not ancestors), yes, it was awful lonely feeling after 15 years of “the presence of God” to finally face the fact that it had all been in my head, being suddenly cut off from the only friends I had (my church) since for all the love I had toward them, I could no longer visit them without being a fly in their ointment, and they in mine.
It took me about a year before the awful silence of the heavens and isolation on earth gave place to a wonderful openness to nature in all its reality.
It’s a lot like quitting smoking. Very hard at first, but once you’re free, a wonderful, fresh-air feeling.
I’ve never been happier or more confident and relaxed.

Since they haven’t settled this issue properly and beyond a doubt, I will just assume that Obama is foreign born and therefore breaking the law to run as a candidate. I’m sure the judge didn’t want to touch this issue and had lots of pressure to disqualify Berg’s legal complaint. To declare there is no potential personal injury to Berg or any other citizen is absurd. Every time the Constitution is circumvented we all suffer major injury.
A fair minded judge with courage and backbone should take all precautions to ensure the presidential
candidate meets the qualifications of office. This has not been done.

In a 34-page memorandum and opinion, the judge said Berg’s allegations of harm were “too vague and too attenuated” to confer standing on him or any other voters.
Obama violating the Constitution is no harm to any of the citizens of the United States under the judge’s opinion. If Obama is a proper citizen then why doesn’t he produce the true birth certification and or allow opening of the records of his birth? Would it not be so much easier to open the records than the legal court battle in several states he now faces over this matter? Why does Obama resist openness if he is telling the truth? Does Obama think he does not owe the American people an open and honest history of his life? Due to Obama’s own actions we have no clear idea of the truth regarding his citizenship and he refuses to provide assurance to the people of the United States. How are we to trust Mr. Obama if he becomes President under illegal and false pretenses? I would like to know the truth whatever it might be. If Mr. Obama is qualified to be President then put this to rest and move forward. If Mr. Obama is not qualified to be President then make the necessary corrections by putting in a new candidate and get on with the election.

Berg is correct and the judge is wrong. Nothing new about this injustice. Why complain? Berg fought this on his own, he deserves credit. Foreign born people are frequently announced in the local newspapers if they have ties there. Vote for someone else besides Obama and it won’t matter. The last two elections were rigged so perhaps McCain will win even if he is out voted by 10%. Best bet is to flee the country now and go to Venezuela.

I just talked about how one of my heroes, Michael Rivero, has been ridiculing the Berg case — I just finished listening to his Friday podcast (go to GCN/Podcasts/What Really Happened/ 10/24/08) &mdash right in the first segment he hits it with both barrels, saying, among other things, that if it were true that Obama were born elsewhere than the US, fer sher Hillary & Bill would have found proof before the primary.
When that was over I listened to one of my other great heroes, Webster Tarpley, both of whom I found thru Alex, in the same page, GCN/Podcasts/World Crisis Radio/102508.mp3, and he makes a very good and frightening case that Bill Ayers and Bernadine Dohrn should be in prison. Instead they are receiving millions of dollars in grant money for projects academic and otherwise.
Why? Tarpley says it’s because they are and have been agents, wreckers who were sent in to destroy the peace movement in the ’60’s.
So there’s that. Tarpley is desperate to eliminate Obama, to fend off what he calls “crushing austerity, killer austerity, genocidal sacrifice” imposed on the American people and economy under Left Cover, much harder for left-leaners to oppose, with the profits going to Soros and Rockefeller.
I hope he’s somewhat wide of the mark.
In any case, there’s one scenario that seems worst of all to me, that Rivero brings up: with wide margins of preference for Obama in polls before the vote, the GOP steals it yet again with their voting machines and dirty tricks, the fraud is too blatant for the people to swallow this time, they go into the streets, the brigades cycling thru Detroit and Cleveland and Chicago, & al., break a lot of heads, shed a lot of blood, and the camps start filling up, just at the same time the inflation that has been fed to the banks (8 trillion since June) is released into the general circulation (it doesn’t yet show, because they’re sitting on it till after the election) and food prices go thru the roof. One bright spot: gold would presumably climb back up due to the inflation, but safety deposit boxes could be seized.
Oh, and Bush might feel obligated to stay on, eh?

I’m an officer in the military. How the hell am I supposed to carry out any orders if the Commander-in-Chief is illegal. That makes all his orders illegal. Our oath also compels us to defend the Constitution against all enemies foreign and domestic. It would be my duty to ignore his orders. It’s like having an army without a general. As stated before Factcheck.org is owned by Annenburg a company in which Obama sat on it’s board so that’s a conflict of interest there and the judge should have seen the fact that there’s no stamp in the bottom right by the registrar.
Also you will notice the bottom left corner says laser they didn’t have laser jet printers in 1961 so that’s not an original like the one we have all shown for our drivers license renewal. NO COPIES ACCEPTED.
Also the paper is not aged and of technology (surface background, watermarks) we did not posses then.
If the father is African and listed on the birth certificate then how is it she ends up in Hawaii having the baby? I thought she didn’t leave his dad until after he was born.
So if she didn’t leave the dad for a couple of years after he was born and moved to Indonesia and married Lolo Soetoro at which time Obama was adopted by Lolo how does Hawaii come into the picture? You just don’t fly to Hawaii to have a baby.
The Hawaii story doesn’t fit between the fact his grandmother said she remembered she was in Kenya watching the birth and later stated she was so proud that her grandson is going to be president and his mother’s couple of years later marrying Lolo Soetoro.
Seems to me if you can find proof of Obama’s mother (Dunham, Obama or Soetoro names) living in Hawaii prior to the birth and after then that would be a lynch pin, but if she has no bills in her name or purchases or apt rentals or car rentals or electric bills in her name or phone bills in her name then she wasn’t living in Hawaii the time Obama was supposed to be born.
Now if you can track her in Kenya and Indonesia afterward and during the same time period then that would prove she wasn’t having Obama in Hawaii.
Honolulu county should have record of her address and utility bills or taxes paid if she indeed did live there.
So the judge must have had a golf date prior to this ridiculas ruling because he fail to see there’s plenty of room for doubt and it should be looked into further and I wonder if the judge has had a recent deposit into his bank account or the judges association account? His judges financial statement of economic interest has to be filed every year and it’s public domain info.

I worked for an aerospace company and a verified copy of my birth certificate was required to step foot on their property. At any point if someone disputed my citizenship it was as easy as producing that verified document that I purchased from the county clerk where I was born and ta-da… charge answered. When a cantidate submits their bid to run for party backing is’nt there some sort of verification done at that point where certified copies are submitted? I can’t believe that it is so hard to nail a verified document down when the office of the president of the united States is concerned. Or to re-phrase, it just seems like something that would have been definitively verified by whatever body governs the processing of those documents long before this point in the game.

Obama went to Hawaii because the case is going to be appealed. His grandmother is a problem for him because she knows he was born in Kenya, not Hawaii. This is why the Obama campaign would not allow interviews with Mrs. Dunham, his grandmother. I will not be surprised if she dies very soon. My guess is he went out there to get an affidavit from her or a statement on videotape saying Barry was born in Hawaii. This couldn’t be used in court for anything but the media will run with it.
The birth issue is only part of the suit. His passport applications and college applications state he is a citizen of Indonesia (his mother remarried because Obama Sr. was married with children at the time he married Obama’s mother). His was adopted by his stepfather and his legal name became Barry Soetoro. He attended primary school in Indonesia. Indonesian law requires that students are Indonesian citizens. I believe his adoption of the Soetoro name also made him an Indonesian citizen by operation of Indonesian law.
To make matters worse for Obama, there is no evidence that he ever took the oath of U.S. citizenship upon reaching the age of 18, which means he was never naturalized as a U.S. citizen, (i.e., he is an illegal alien)!
The birth certificate said to be his–never produced in original form for inspection–is alleged to be his sister’s. I believe the hour of birth and/or the hour the certificate was created is identical to his sister’s, the odds of which are almost impossible. Also, the certificate number is redacted on the copy posted on Obama’s website. There is also an issue with certain language in the certificate that was not used by the state of Hawaii the year Obama was actually born, but was in use when his sister was born (and it’s not the “African” “negro” race description, which is yet another anomaly highly indicative of a thoughtless forgery by a member of the current generation).
Obama has also identified himself as an Indonesian citizen in college applications as well as when he traveled to Pakistan after college.
My question is, why has no other campaign raised this issue? Clearly the fix is in.

To Yo-Yo: I forgot to mention that the Democratic National Committee and the Federal Election Commission were named parties in Berg’s suit.
Also, lately it has crossed by mind that Berg is just an operative. If I recall correctly, he didn’t really address some of the cases the defendants cited in their motion to dismiss. I haven’t read the court’s opinion yet, but this could pose a problem for Berg on appeal. Was this by design? Is a Supreme Court opinion being setup for the former Mr. Olympia, the son of a ranking Nazi. If Berg is an operative, then others may need to intervene; however, this is all cynical speculation.

No surprises there. I think a little looking into the background of this judge is duly warranted. He totally violated the law; Obama and the DNC failed to respond to the suit within the prescribed 30 days. Therefore, by law, the admissions are deemed legally admitted. This judge has no back bone and probably a heftier wallet now.

In my opinion, Hawaii is a foreign land that had no place becoming a state of the US. Hawaiian natives are nothing but foreigners under the American name. I used to work in a call center, and people from Hawaii were the most demanding and hard to deal with of any of the customers I dealt with. I’m sure Obama’s mother felt right at home in their presence. Don’t kid yourself, Obama is a foreigner, maybe more by creed or moral than actuality, but these are all one in the same. It seems odd to me that someone who is running for the highest position in our country would be afraid to show their Birth Certificate… Also it is odd for a Judge that is sworn to uphold the law of the land, to not allow this suit to go foward. By the way we have to produce a birth certificate just to get a passport in order to leave the country and it has a chip in it, not to mention all the other security built in procedures. Face scans, not even allowed to smile.

Someone else stated that his father flew back to Hawaii the night Obama was born to register his birth, and the Hawaii newspaper reported the registration. Even if this is true–and it is not–Obama’s mother was only 18 years old when he was born. The law in effect at that time required that one parent must be an American citizen for a minimum of five years after the age of 14, i.e., age 19. There were other restrictions as well but this requirement acted as an absolute bar to Obama ever becoming a “natural born” citizen of the U.S. He could become a “naturalized” citizen later upon taking an other, but that would not make him eligible to be President.
So you see, he can never change the fact that his mother was eighteen when he was born. He has no choice, he must lie and state that he was born in the state of Hawaii.
The court didn’t address the merits of the case. Instead, the court claims a registered voter has no right to require that a candidate for President of United States provide proof that he is in fact a natural born citizen. Further, a registered voter has no right to require that the DNC and the Federal Election Commission provide proof that a candidate for President is a natural born citizen. In other words, SIT DOWN AND SHUTUP!
