When California wildfires ruined their jewelry business, Tony Becker and his wife fell months behind on their mortgage payments and experienced firsthand the perils of subprime mortgages.
The couple wound up in a desperate, six-year fight to keep their modest, 1,500-square-foot San Jose home, a struggle that pushed them into bankruptcy.
The lender with whom they sparred, however, wasn’t the one that had written their loans. It was an obscure subsidiary of Wall Street colossus Goldman Sachs Group.

Believe it or not, Attorneys, of all people, are quickly developing a national reputation as champions of homeowners facing foreclosure, and are becoming a serious adversary for those banks attempting to fraudulently take possession of the homes of troubled homeowner´s, and in some cases receiving the homeowner’s property back free & clear, by filing a notice of rescission, and a quiet title action, based on Federal violations pursuant to the Truth In Lending Act (TILA), or the Real Estate Settlement Procedures Act (RESPA).
The new focus on contract law, debt-collection practice, securitized mortgages, the trusts that hold them, and the agreements that govern the trusts, have put foreclosure attorneys at the forefront of the rapidly expanding specialty of foreclosure defense.
Over and over again attorneys have found sloppiness, fraud and outright criminality in the nation´s mortgage lending industry. Regardless of why homeowners have been unable to pay their mortgages, foreclosure attorneys maintain that nobody deserves to lose a home to the unethical and illegal foreclosure procedures that are now being used by many banks and loan servicers.
Recently, some homeowners have staved off foreclosure for more than four years using a newly employed legal strategy, which requires the lender to “Produce The Promissory Note”.
This legal strategy has been employed because of the way mortgages have been securitized. It´s often unclear who actually owns the debt, and what has been discovered is that systematically, the originating lenders only pledged these loans and didn´t actually transfer them” to the trusts that are supposed to hold them and issue the securities.
But only the true debt owner has the legal standing, or right to be a plaintiff in a foreclosure action. This is a basic first-year law school concept. If you´re Mike and the debt doesn´t belong to you, it belongs to Alice, then Alice better be in court, not Mike. You can´t show up in court as Mike, and tell the court you have the right to be there when you know full well that Alice is the true owner.
Yet, time and again, loan servicers and others have sought plaintiff status in order to foreclose on a homeowner, often by using affidavits stating that the actual notes had been lost, and stating that “they anticipate a transfer of assignment´” of the debt, but the loan originators can´t appear in court and claim the right to foreclose because they would be in violation of securities laws for not transferring the loan to the trust when they were supposed to.
Although making an issue out of the actual ownership of the securitized title might strike some as a shameless stalling tactic aimed at abetting a debtor who, after all, owes the money, attorneys argue that if such basic legalities aren´t adhered to, a homeowner could pay his or her way out of a foreclosure jam only to wind up in another jam when a new plaintiff emerges claiming to own the debt.
Attorneys describe cases in which homeowners have been sued for foreclosure by two different trusts, each claiming they owned their house, and cases where trusts have been sent documents on the same case by two different servicers. So it is essential for the homeowner to determine who is the rightful owner of the debt, before paying off that debt, in order to be provided the legal fairness, and protection that the law intended. Therefore, this legal approach has been viewed as a completely moral and ethical approach.
Additionally, the Government has a dirty little secret, which it has been surpressing for months. It is that most adjustable rate mortgages were illegally securitized in the haste to convert toxic loans into fee-generating mortgage backed securities.
Judges across the nation, including Boyko, Rose, Kurtz, Schack, Rosenblatt, Bufford, O’Malley, Shaw, Bryant and Foley have issued orders dismissing foreclosures brought by lenders that have illegally securitized loans and are no longer current holders of the notes.
These “quiet title actions” have forced lenders, including Chase, Citibank, Wells Fargo, Washington Mutual, Countrywide, Lehman, Shearson, Indymac, Bear Stearns, Wachovia, and Bank of America to unravel their notes’ dizzying journey from the mortgage closing to an investment bank or depositor, then to a series of trustees who pooled and sold the loans and issued shares of mortgage backed securities.
What makes these securitizations illegal is how fraudulently they were conducted, by foregoing proper assignments and transfers required by law to secure an interest in the underlying real estate.
Now, the Obama Administration not only wants to continue this fraud, but is planning to reward the very investment banks and hedge funds that were architects and participants of the securitization that created the global financial crisis we are now experiencing.
While this is devastating news to taxpayers who will be stuck with more debt, it is great news for homeowners’ with securitized loans. Ironically, their mortgage lenders’ haste to securitize their loans has provided a security blanket that protects them from foreclosure. In fact, many homeowners already own their homes free and clear and just don’t know it yet. Consider this reversal of misfortune divine intervention against a greedy global conspiracy aimed at defrauding homeowners and stealing their homes.
So, you can move to stop the foreclosure, and fight for your home by acquiring a “Forencis Loan Audit” that will identify any possible lender fraud, or Federal violations of the Truth and Lending Act (TILA), or the Real Estate Settlement Procedures Act (RESPA). Expose the fraud, stop the foreclosure, and take your home back by fighting your foreclosure!

in 2007 Experian the credit bureau bought the largest set of servers and debt reporting software in the world, now known as metro2 and eoscar, with an overall goal of owing 60% off EU, USA, and CA debt, so in simple terms the credit bureaus them self have now bought the largest collection company and debt reporter!!

Originally, drawing and quartering, was done with horses… and ropes. The punishment is still a standard in Russia. I watched a quartering in Russia on a very old Faces of Death VHS tape ages ago… and they said it was the most painful way to die, because the spinal cord stays in tact, allowing you to feel every bit of pain, before you finally bleed out.
I for one, think that almost immediate cauterization of the wounds to prevent instant death, would be suitable for a prolonged round of kick the bankers ass… family fun the whole family could get into.

Those who argue against a more proactive reduction in risk and size of TBTF institutions will, as always, revert to an argument that strikes a natural chord in every American’s heart: ‘Doing so would create an unleveled international playing field for our institutions relative to their international competitors.’ Level playing fields are a worthy goal, but this is not a relevant argument. Instead, this tired bromide must be resoundingly dismissed on several counts:
* Those countries with the largest banks as a percentage of GDP (Iceland, Ireland, Switzerland) demonstrated that a concentration of banking power can cause significant sovereign risk and tilt global economic playing fields away from that country.
* The likely breakups of ING, Lloyds and KBC suggest that it is we who seek to support an unlevel playing field where we subsidize our TBTF banks while other nations recognize the policy failures of moral hazard. If we continue down this path we will likely be at risk of violating international fair trade regimes.
* When the “unlevel playing field” argument is cited, keep in mind this reasoning supports the disadvantaging of 8000+ community banks relative to our largest banks, all in the name of protecting big banks from government- subsidized international competition.
* There is no longer any evidence that, beyond a cost of capital advantage that comes with implied government support, there are sustainable and tangible economies of scale arising from being the largest. The financial supermarket concept has been proven a failure. The only ones who benefit are the high-level executives.
* We must demand that our legislators no longer allow unelected officials at the independent Federal Reserve to sign international accords created by the TBTF banks through supra-national bodies like the Basel Committee.
* Are we to believe that if we did not have such large and globally dominant firms, US borrowers might be paying more that the 29% interest that several of the TBTF firms are now charging on their card accounts? Perhaps we should think about what advantage our population has gained as a result of our financial institutions being such a large part of our economy or being globally dominant.
* Since when did we accept a national strategy of following rather than leading? When we do what is right, others follow. As example, consider the bank secrecy havens — they made money for a bit. Now, even the Swiss and the Cayman authorities are coming around to our view.
* We are already at a disadvantage given that the largest foreign banks operate in the US without any tier one capital requirement and yet most large, foreign banks have not built a bricks and mortar presence here. Nobody screams about their undercapitalization nor has that undercapitalization caused deposits to migrate to foreign banks.

I have an urgent message for you, more important than any message you can hear. You could be perfect in all the law and stumble at one point and it is as if you broke all of them:

God wrote the law on each man’s heart so they are without excuse on judgment day when we will ALL stand before Christ(”Which shew the work of the law written in their hearts, their conscience also bearing witness, and their thoughts the mean while accusing or else excusing one another” Romans 2:15). The penalty of sin is death and eternal punishment in the LAKE OF FIRE. I am warning you about hell because I love you! You are dead in your sins and headed for hell which is described in the Word as a FIRE THAT QUENCHES NOT(”…the fire is not quenched” Mark 9:44). It is a horrible and terrible place of everlasting torment that people will go because of their sins.
“And it came to pass, that the beggar died, and was carried by the angels into Abraham’s bosom: the rich man also died, and was buried; And in hell he lift up his eyes, being in torments, and seeth Abraham afar off, and Lazarus in his bosom. And he cried and said, Father Abraham, have mercy on me, and send Lazarus, that he may dip the tip of his finger in water, and cool my tongue; for I am tormented in this flame.” Luke 16:22-24
“In flaming fire taking vengeance on them that know not God, and that obey not the gospel of our Lord Jesus Christ: Who shall be punished with everlasting destruction from the presence of the Lord, and from the glory of his power;” 2 Thessalonians 1:8-9
But God has provided a way for each to escape the lake of fire. He sent his Son Jesus(God manifest in the flesh-1 Timothy 3:16) who was conceived by a virgin by the Holy Spirit of God,lived a sinless life, and suffered a horrible death/shed blood and rose again 3 days later to take the penalty of YOUR sins so you dont have to pay for them in hell for eternity! He loved you so much which is why he did it! He is the only one to have fufilled the law perfectly(sinless) and paid the price of the entire world’s sins so that man could be saved on the merits of His perfection(see Romans 5:19). All you must do to be saved is BELIEVE in Him(trust in Him to save you as a sinner). You must admit your lost sinful condition to Him/that you’re worthy of hell, and ask Him to save you by placing complete trust in Jesus ALONE for salvation(an example in the Word of someone doing this- “And the publican, standing afar off, would not lift up so much as his eyes unto heaven, but smote upon his breast, saying, God be merciful to me a sinner.” Luke 18:13).It is not even partly by yourselves that you can be saved, but only by the merits of Jesus Christ!

No works or anything you do can save you! May God open your eyes, that one day I may see you in heaven. Read the Word of God(the 1611 King James version- NOT the modern versions, they are corrupt) before rejecting it! Death is fleeting. You may NOT have tomorrow! For death comes when we least expect it! Make sure you are saved TODAY! The Bible condemns the rich, the wealthy, and those who take advantage of the poor, so it CANNOT have been made up by the elite. Because the Word clearly CONDEMNS people such as those! It declares all mankind as sinners(myself included).

Now it is like they cant wait to sell them.They trade hands many times and the company you initialy did business with just sells your loan off to some 2 bit company that you can never reach.Or they will split your loan in 2 loans so they can sell to different markets a high value note 70k+ and then they will sell to a up and coming company that don’t have the funds to take on a high mortgage loan.or they will sell to a subsudiary, get there profit up front, secretly owning the other company either by proxy or through other avenues. Then when the mortgage business bubble pops the other company goes down and the person who initiated the loan keeps the cash clean . Wow ponzi scheme.
