2 men facing bomb-possession charges say police conducted illegal searches of trailer, basement
St. Paul police had no authority to break into and seize a cargo trailer rented by a group of protesters at last month’s Republican National Convention, attorneys for two men facing bomb-possession charges argue.

In motions filed in federal court, the attorneys for the Texas duo say because police didn’t get a warrant to search the trailer, the things found inside it — homemade riot shields — should not be allowed as evidence in their upcoming trial.
The attorneys also claim other evidence involving eight Molotov cocktails found in the basement of the men’s St. Paul apartment building should be thrown out. The reason: Even though police had a search warrant for the building, it didn’t specify a basement search.
“It’s our position that the Constitution didn’t get suspended when the Republican National Convention came to town,” said one of the attorneys, Jeffrey DeGree, who represents David Guy McKay.
Last month, a federal grand jury indicted McKay, 23, and Bradley Neal Crowder, 22, on charges they possessed Molotov cocktails during their stay in St. Paul. The government contends they were part of an Austin, Texas-based protest group that intended to use the incendiary devices to destroy property and injure law enforcement officers during the convention.
DeGree also has filed a motion requesting the government disclose the name of the informant it used to infiltrate the protest group. Independent sources, who declined to be named, have confirmed the informant was Brandon Darby, also of Austin, a former organizer for a grass-roots group that helped with relief efforts in New Orleans after Hurricane Katrina.

A basement is an appurtenance to a building much the same way as a closet. The police “strayed” into the basement? Those naughty boys, huh. Describe the premises to be searched “…the property at 1234 North Street.” Good enough? Criminals are always trying to duck the law by any means. If you break the law, you should be ready to pay the penalty when caught at it. If they can’t say that it “belongs to someone else”, then it’s this ploy. Enough, already, you did the crime, now do the time.

molotov cocktails are illegal and dangerous, if you throw one of those how are you supposed to know who it’s going to hit, stupidity pure and simple. High powered 7mm rifles are legal, so are scopes, why don’t people just use what’s legal and if they are planning on doing something stupid make sure they hit the target? Guns won’t save anyone and if you burn a cop, do you really think him and his buddies aren’t going to hunt down your family and burn them? Not to mention the cops will use people they put in prison, while you are in prison to torture and beat the crap out of you daily. This is a proven daily fact, they do this every day so why would you want to put yourself in this situation? What’s 8 molotov cocktails going to do? They’re either going to injure somebody or damage somebody’s property. What’s needed are people who can fight. I have seen many of there so called searches and 85% of the time the so called authorities
bring there evidence with them to the search and claim they found it there.

Cocktail or not I don’t care. They have my moral support. I’m 40 years old. Been arrested about 15 times in my life. Only four or five of thous times was legitimate. Of the other 10 or 11 times I’ve been either beat, robbed, or flat out taken down a back road and beat, robbed and left there. I even had a cop tell me that he would have done the same thing but he had no choice but to take me in. So you ass wipes out there that think that you know whats going on, you don’t. I know cops that don’t even like whats going on. Not that that maters. Because if your not part of the solution then your part of the problem. illwill (Nos. 20-21), I too experienced my first censorship on this site yesterday in connection with the Australian internet filtering article, and I wonder who is doing it. I didn’t advocate violence, but rather a technical means that has worked in the past in China to possibly circumvent the filters. It’s a project that allows people in China to make connections to Americans’ computers through some type of VPN connection, I think, and browse the Web as if they were in America and not China. Maybe it was my comment about understanding the British kowtowing to their noble masters, but not the Aussies.
With regards to the article above, I’m not positive but if the illegal search of the trailer served as the basis to issue a warrant for the building, then anything obtained from the building search will be inadmissible. Maybe a criminal lawyer could comment. I tend to agree with SearcherT.

Probably the police found a gas can (next to the mower) in the basement–the empty coke bottles were in the kitchen and the wicks (pile of laundry) were next to the washer–incriminating evidence!

This principal is arresting people who have actually done notihng, and through the changes of definitions of key legal terms have impeached on the cilil rights of the people. British police force have the power (granted to them by good old Tony Blair in the face of ” the terrorist threat which looms over our nation”) to arrest and investigate anybody that they think may commit or is likely to commit a crime in the near future. This gives law enforcement an open agenda to investigate anybody they want and then prosecute them for crimes that they believe they will commit in the future. Try quizzing the next police officer you meet on the streets of Britain about their own powers. What exactly is anybody guilty of in these situations and moreover how did the police come to be aware of these crimes in the making ? The people of not only Britain but America also must press their local members of parliament to review and reform the powers held by police officers, in a way which provides more oversight from local communities and restructures police complaints procedures ( the IPCC in Britain needs to be fundamentally altered to offer the public real protection from law enforcement officials ).

Not only must a warrant specify WHERE the officers will be searching, it must specify WHAT they will be searching for. From what I’m reading about Australia these days, it wouldn’t surprise me if that’s not the case there and it certainly doesn’t surprise me that someone from Australia would not know this. Aussie, post and re-post the same line over and over if you want. It doesn’t change the law. The warrant must state EXACTLY where the contraband is to be found. Otherwise there would be no stopping any illegal search and seizure.
I can “have a hunch” that something’s there, get an ambiguous warrant and then search until “I find something” under your way of thinking.
Don’t presume that you understand our Constitution unless you live under it. Although, granted, most of us Americans can’t balance our checkbook’s, let alone grasp the Constitution.

Pleefer, recall that aussie lives in a police state where nearly two decades ago, they were illegally disarmed because they succumbed to the same sort of black ops being perpetrated against our citizens, that is, the CIA feeding psychotropic drugs and brainwashing induividuals to commit heinous crimes in order to facilitate gun control support and law in contravention to common sense and our beloved Bill of Rights.
Such as been the cae here is the last week with several contrived incidents occuring just prior to them installing obama bin laden who has already decreed he will employ the corrupt united nations to TRY and disarm us…what most people don’t already know is, our military is already operating under the auspices of the dirty/pagan united nations, this treachery has sub rosa, “under cover of darkness” been the case since at least Vietnam!

How to Catch a Wild Pig
Many years ago there was a Chemistry professor in a large college that had some Exchange students in the class. One day while the class was in the lab, the professor noticed one young man (exchange student) who kept rubbing his back and stretching as if his back hurt.
The professor asked the young man what was the matter. The student told him he had a bullet lodged in his back. He had been shot while fighting communists in his native country who were trying to overthrow his country’s government and install a new communist government.
In the midst of his story he looked at the professor and asked a strange question. He asked, ‘Do you know how to catch wild pigs?’
The professor thought it was a joke and asked for the punch line.
The young man said this was no joke. ‘You catch wild pigs by finding a suitable place in the woods and putting corn on the ground. The pigs find it and begin to come everyday to eat the free corn. When they are used to coming every day, you put a fence down one side of the place where they are used to coming. When they get used to the fence, they begin to eat the corn again and you put up another side of the fence. They get used to that and start to eat again. You continue until you have all four sides of the fence up with a gate in the last side. The pigs, who are used to the free corn, start to come through the gate to eat, you slam the gate on them and catch the whole herd.
Suddenly the wild pigs have lost their freedom. They run around and around inside the fence, but they are caught. Soon they go back to eating the free corn. They are so used to it that they have forgotten how to forage in the woods for themselves, so they accept their captivity.
The young man then told the professor that is exactly what he sees happening to America . The government keeps pushing us toward Communism/socialism and keeps spreading the free corn out in the form of programs such as supplemental income, tax credit for unearned income, tobacco subsidies, dairy subsidies, payments not to plant crops (CRP), welfare, medicine, drugs, etc. While we continually lose our freedoms — just a little at a time.
One should always remember ‘There is no such thing as a free lunch!’ Also, ‘You can never hire someone to provide a service for you cheaper than you can do it yourself.
If you see that all of this wonderful government ‘help’ is a problem confronting the future of democracy in America and if you think the free ride is essential to your way of life then you will probably delete this email, but God help you when the gate slams shut!

Here’s my point….what if they were to find a .22 rifle or a 30-06? Would they have arrested them for “having guns” and being protesters? Would they rightly know that they were going to use those guns against the police?
Makes you think that they get a warrant and then look for everything that could be used against the police and then make the jump that they were going to use it, and charge them with that crime.

What is the federal version of a Molotov cocktail, anyway? I’ve a bottle of lamp oil for the kerosene lamp in case the power goes out, so is that a molotov coctail? Probably. Or how about paint thinner? If you don’t use much of it, the can will eventually rust, so – - – if you put into a quart jar, or a wine bottle (properly labeled as ‘Paint Thinner’) is that a molotov cocktail? Probably. And of course the ‘John Doe’ warrant does not ‘particularly describe the person or property to be seized’, and neither do the catch all ’search warrants’ so popular these days, specify the items which are the goal of the search. The next question is, ‘Were there illegal assembled components for Molotov cocktails in the basement BEFORE the cops got there?’ Dollar to a doughnut the so-called ‘evidence’ came into the building with the cops.
