Guilty of Being Poor

The jailers of the 19th century — even in the pre-Civil War South — largely abandoned the practice of imprisoning people for falling into debt as counterproductive and ultimately barbaric. In the 1970s and ’80s, the U.S. Supreme Court affirmed that incarcerating people who can’t pay fines because of poverty violates the U.S. Constitution.

Apparently, though, some states and county jails never got the memo. Welcome to the debtors’ prisons of the 21st century.
“Edwina Nowlin, a poor Michigan resident, was ordered to reimburse a juvenile detention center $104 a month for holding her 16-year-old son,” the New York Times wrote in an editorial.
“When she explained to the court that she could not afford to pay, Ms. Nowlin was sent to prison. The American Civil Liberties Union of Michigan, which helped get her out last week after she spent 28 days behind bars, says it is seeing more people being sent to jail because they cannot make various court-ordered payments. That is both barbaric and unconstitutional.”
The details of Nowlin’s case are even more alarming than the Times editorial suggests. Not only was Nowlin under orders to pay a fine stemming from someone else’s actions, but she had been laid off from work and lost her home at the time she was ordered to “reimburse” the county for her son’s detention.
Despite her inability to pay, she was held in contempt of court and ordered to serve a 30-day sentence. On March 6, three days after she was incarcerated, she was released for one day to work. She also picked up her paycheck, in the amount of $178.53. This, she thought, could be used to pay the $104, and she would be released from jail.
But when she got back to the jail, the sheriff told her to sign her check over to the county — to pay $120 for her own room and board, and $22 for a drug test and booking fee.
Even more absurd, Nowlin requested but was denied a court-appointed lawyer. So because she was too poor to afford a lawyer and denied her constitutional right to have the court provide one for her, she couldn’t fight the contempt charge that stemmed from her poverty. And her contempt conviction only added to her poverty, as the fines and fees she was obligated to pay now multiplied.
“Like many people in these desperate economic times, Ms. Nowlin was laid off from work, lost her home and is destitute,” said Michael Steinberg, legal director of the Michigan ACLU. “Jailing her because of her poverty is not only unconstitutional, it’s unconscionable and a shameful waste of resources. It is not a crime to be poor in this country, and the government must stop resurrecting debtor’s prisons from the dustbin of history.”
Michigan isn’t the only place where you can be imprisoned for the crime of involuntary poverty. The same Catch-22 ensnares poor defendants daily in courtrooms across the country.
In 2006, the Southern Center for Human Rights (SCHR) filed a suit on behalf of Ora Lee Hurley, who couldn’t get out of prison until she had enough money to pay a $705 fine. But she couldn’t pay the fine because she had to pay the Georgia Department of Corrections $600 a month for room and board, and spend $76 a month on public transportation, laundry and food.

She was released five days a week to work at the K&K Soul Food restaurant, where she earned $6.50 an hour, which netted her about $700 a month after taxes. Hurley was trapped in prison for eight months beyond her initial 120-day sentence until the Southern Center intervened. Over the course of her incarceration, she earned about $7,000, but she never had enough at one time to pay off her $705 fine.
“This is a situation where if this woman was able to write a check for the amount of the fine, she would be out of there,” Sarah Geraghty, a SCHR lawyer, told the Atlanta Journal Constitution while Hurley was still imprisoned. “And because she can’t, she’s still in custody. It’s as simple as that.”
Georgia also lets for-profit probation companies prey on people too poor to pay their traffic violations and court fees. According to a 2008 SCHR report entitled “Profiting from the poor”:
In courts around Georgia, people who are charged with misdemeanors and cannot pay their fines that day in court are placed on probation under the supervision of private, for-profit companies until they pay off their fines. On probation, they must pay these companies substantial monthly “supervision fees” that may double or triple the amount that a person of means would pay for the same offense.
For example, a person of means may pay $200 for a traffic ticket on the day of court and be done with it, while a person too poor to pay that day is placed on probation and ends up paying $500 or more for the same offense.
The privatization of misdemeanor probation has placed unprecedented law enforcement authority in the hands of for-profit companies that act essentially as collection agencies. These companies, focused on profit rather than public safety or rehabilitation, are not designed to supervise people or connect them to services and jobs. Rather, they charge exorbitant monthly fees and use the threat of imprisonment and a variety of bullying tactics to squeeze money out of the men and women under their supervision.
For too many poor people convicted of misdemeanors, our state is not living up to the constitutional promise of equal justice under law.
In Gulfport, Miss., the municipal court started a “fine collection task force” to crack down on people who owed fees for misdemeanors. According to the SCHR Web site:
The task force trolled through predominantly African American neighborhoods, rounding up people who had outstanding court fines. After arresting and jailing them, the City of Gulfport processed these people through a court proceeding at which no defense attorney was present or even offered.
Many people were jailed for months after hearings lasting just seconds. While the city collected money, it also packed the jail with hundreds of people who couldn’t pay, including people who were sick, physically disabled and/or limited by mental disabilities.
The disregard of the justice system for the rights of poor people to equal protection and due process is cause for outrage. But it shouldn’t come as a surprise in an era when the government spends billions bailing out banks while letting foreclosures and unemployment ruin the lives of working people.
We need to build a movement, like the working-class struggles of the 1930s, that can demand an end to the inhuman practice of incarcerating people for no other crime than finding themselves at the bottom of the social ladder.

Actually you could argue that flogging might be cruel, it doesn’t necessarily meet the unusual clause as it has been practiced in the past. There are several court decisions that state it must be both and unusual to be constitutionally banned.
Besides I would love to see flogging handed out to a number of people who rightly deserve it, I can think of several fraudulent financiers and politicians that would fit this bill.

How can one pay rent and the needs of everyday life when you can’t find an apartment for under $700 a month and you’re barely making that much a month? I pray all works out jaymz32. Since I lost my $15 an hour job in 2004 (outsourced), it’s been downhill since. We’re barely keeping our house, we’re going to bankruptcy court and will have to turn over the best of our two vehicles and I’ve had to settle working at a fast food place making less than half then what I’m use to. Don’t be afraid to do what you gotta do. Screw them.

jaymz32—-If you make under a certain amount per month, you can collect food stamps. No shame in that when you’re down and out. That’s what they’re for. Pay only half your bills each month. They can’t shut off services or take you to court if you’re paying something each month. Hit food banks. Go down to social services (god, I hate saying that, but…), I just got a $300 gift card for albertsons from job service. Fuck man, theres all kinds of help out there if ya swallow your pride. At least ya got a job. That helps.

Have you ever actually paid just half of your utillities for any amount of time? I don’t think you have, because after a few months (if your lucky) they will still come cut you off. They will cut you off in the winter. They don’t care if you have kids or elderly, all they care about is if you have their money! As a matter of fact, the last place I lived would cute you off befor the next bill even comes out even if you do pay half. The were “set up to take partial payments.” So while what you suggest is good in theory, it doesn’t work that way in real life. To own the prisons! ALL prisons that are not state run, i.e. minimum security, are privately owned! Mostly by judges!
So, when they sentence people to go to those prisons, they are paid with your tax dollars to house the “prisoners”. They provide minimal nourishment, as illustrated in the recent Alabama story of the sheriff who was LEGALLY pocketing everything he didn’t spend feeding the inmates.
They provide NO clothing, we had to send clothes for my little brother when he was locked up on some BS charges.
And they collect per day/per prisoner fees from the state(tax dollars) for doing it!
IT IS ABSOLUTELY OUTRAGEOUS! But NOBODY is going to do a damn thing about it so just shut up and watch the basketball game! Until they come for YOU!

This artical is a repeat of the past. About 300 years ago in Europe, you could be jailed or killed for not paying your taxes to the king. We are entering a very scary gray area. If good people don’t keep their eye on this kind of stuff, we will be in a world of hurt if this kind of behavior goes unchecked. I was in a fast food restaurant a few days ago. This man walks by me with a Ron Paul t-shirt on. Thats basically what happened to me a few years back. I couldn’t afford to renew my tags or insurance cuz I lost my job and I was pulled over while looking for a job. I explained in court, but no laawwyer was appointed, no help granted, I was given 3 options…… Pay the money and leave, lose my license for a year and go to jail for 30 days, or that stupid private probation. I paid my fees and everything like agreed. I lost my house and had to move, once I moved they said they never recieved my mail in. I lost my money order reciept in the move becuzz it was a last minute move do to I had nowhere to go. So I had to pay it again along with a late fee and then they still violated my probation and called me into court. Luckily I was able to get the money together at last minute before court thanks to family and I paid out of my probation. But they was planning to lock me up over bein poor!

You guys just figured this out? The county I live in, in southern Colorado has been doing this for 4 years or more. Last time I was in jail I had to pay 50 dollars for 5 days. Except where I live doesn’t throw you in jail if you can’t pay, instead they report you to a collection agency and fuck up your credit rating.

I have a brother who has fathered three children with three different women, from Oklahoma, Tennessee and Pennsylvania. Sorry, but this article is completly inaccurate, all throughout it keeps implyig that she is in jail for debt, but if you read carefully, you will see that she is in jail for Contempt of court, not for her debt.
Then again, that’s nothing new, The Family courts have been Violating the Consumer Credit Protection act by ordering moe than 50% of income to be paid in support, then jailing fathers as “Deadbeats” when they can cannot possibly keep up with their support.
Funny, dads have been arguing to the ACLU that this is illegal for decades, and all they ever get is a 4 hour telephone “Hold”, but let one mother get jailed for the same thing and it’s a travesty of justice.

That’s true,I was between jobs once and got behind in my support payments.The judge actualy told me that he didn’t care if I ended up living in an alley,If I didn’t pay within the next 30 days I was going to jail.I have custody of my other son,his mother is behind in her support payments by about $17,000 (she has never payed anything since the court order) and the court or dept. of support have never done a thing.The case worker and I got into an arguement about it once (I told her there were two sets of rules.One for men and another for women.If a man was that far behind they would come and take you right off your job to be locked up) and now she won’t even talk to me about the case.If I call the office she is never in,and if I go see her she is too busy to see me.My son is 17 now,what are they going to do in July when he turns 18 and the case will need to be closed ? In all these years they have never garnished her wages,or taken thr income tax refund like they do to men.You always hear about deadbeat dads,what about deadbeat mom’s ?

ALL contempt judgements made by judges need to be independently reviewed by juries WITHOUT interference from lawyers and judges. Judges should be subject to criminal penalties when they abuse the powers they have been granted, as they have obviously done in this case.

Frankly, I have so had it with the behavior of our so-called “justice system”, that if a cop tried to arrest me and take me in unjustly, I’d give serious thought to beating him unconscious to avoid all the attendant evils that these guys are perpetrating on the average citizen to “keep them in line”.
And nowadays, you are as likely to be hauled into a FOR PROFIT institution that’s not even a part of our government. Real justice does not exist, especially when the profit incentive is so great that prison corporations give healthy kickbacks to judges who sentence young kids to prison terms for completely minor offenses, revealed in the press recently but hushed up very quickly.
Fuck that. If the punishment does not fit the crime, it’s immoral, no matter what the “criminal” did. From the top to the bottom, our government has shown it has no moral authority at all and therefore no true authority, legal or otherwise. Take a look at the pathetic videos from St Paul, Denver and Los Angeles, cops having a field day releasing their pent-up anger on citizens exercising first amendment rights. Take a look and you’ll see what I mean.
If you still insist that we have to give these jerks the benefit of a doubt, then we are on opposite teams. Cops don’t give a rats ass whether you live or die, and are now little better than mercenaries hired by a government committing outrages on its own people. If this doesn’t stop, the citizens will stop it the hard way.
I frankly can’t understand why the hell entire neighborhoods haven’t stormed the local police stations to put the fear of God back into them instead of the other way around. You don’t stand up for what’s yours, you lose it, especially civil rights. No more for this citizen.

Right on Brother – Let’s look at people who can’t afford child support due to under-employment… First off, there’s a big difference between dead-beat and dead-broke… If a poor person owes child support, first any professional license, passport, drivers license, all taken away. – None of these things are better for the child because they make it less likely a parent could pay. Then the person is thrown in jail for civil contempt – again less likely to pay PLUS the child now has a 500% greater chance of going to jail themselves because their parent was thrown in jail – not to mention the shame etc. – And of course it never makes anyone a better parent to be gang raped. So what happens is that they make it impossible for a parent to pay child support because they could not afford to pay it. — Think it’s a joke, dont, the last statistic from 2006 said IT WAS CLOSE TO 1 MILLION PARENTS in jail for this and that was before the economic meltdown which coincidentally has been close to 80% men who have lost their jobs – the ones most likely to need to pay child support.

Also – The average cost to a county to incarcerate someone for being poor is 64K a year to put the impoverished father in jail (most likely he owes way less than that). – Also – it’s indefinite, I talked to a kid who was there for 3.5 yrs for only being too poor to pay the child support. Also – because its CIVIL contempt, they can’t get a free lawyer to rep them. – it’s debtors prison, wake up America, they just want you to get used to the idea by using phrases like deadbeat dad – as if these poor fuckers had some choice. Rich people who don’t pay – immediately pay up before the first gang rape, but the poor guys cant so they sit in jail indefinitely so a child molester can get out due to overcrowding. a drunk driving ticket in the stat of mi will cost aprox 3500$ and probation classes exc. then you have no licenes to drive to work if you still have a job.. then for the next 2 years you have to pay 1000$ per year for driver responsiblity fees its like being charged twice becuse if you cant pay you go to jail even though the fines put forth by the judge were conpleted..

By design, pendulum style. First, after the advent of the automobile, they let folks drive drunk legally for decades, no penalties. This is pendulum fully one way.
Then, after the bodies stack up, they use it for justification to impose a harsh police state, with huge unreasonable fines and conditions even for first time offenders- with which compliance is extremely difficult. Now, the pendulum is swung fully the other way- BY DESIGN.
Proof? These government assholes could have made breath ignition interlock mandatory on all vehicles long ago, and forced manufacturer compliance, thus virtually eliminating the problem and alot of dead folks.
But now that would interfere with their real agenda, a full blown oppressive police state/revenue machine catering to psycho babble parasites and law enforcement types.

It is all about power and money. It is getting worse! I am a Chrisitan and I worked in a prison over 20 years and for Homeland stupidity and others. It made me sick how corrupt the policies and laws have become! And the shit they hire as professionals! It is all so wrong! Guilty until proven guilty and the porr or innocent don’t have a chance. Then they put in you a cell with child moelesters and rapeo’s! You get raped or messed up! Nobody cares and they make billions of dollars on fake safety and security. It makes me sick to remember all the discrimination! Hateful men that work in for crime INC. I guess that is what you get for obeying evil monkey men in black robes! If we would just trust in Jesus Christ and turn away from such sin. It will only get worse! Thank your politicians, education and other humanist shit systems! Amazing – I followed the comment rules and my comment was deleted. This is on topic – many non-custodial parents are unable to keep up with court ordered payments and are placed in jail because of it. Title IV-D federal incentives encourage the creation of a non-custodial parent. This non-custodial parent is often made to make court ordered payments called child support, however they are sent INTENTIONALLY high because the court systems profit from how high the child support orders are and also how many non-custodial parents they make. Hey folks:
Let’s NOT forget all the “non-custodial” parents who have their paychecks automatically garnished by their local friend of the court. The courts take the money whether it is there or not, regardless of what the (usually) dad’s other bills are. They con’t care if dad can make his house payment, or car payment, or even if he has a job-JUST SO HE PAYS HIS SUPPORT.
Why? Under Social Security Title IV-D, the states are REWARDED for this-$4.2 BILLION anually folks-for forcibly removing a child from a loving, caring and fit parent.
Who is behind this? The system’s FOC employees, judges, attorneys, social workers, and all the others who PROFIT from this. They want the status quo to continue, and THEIR status of living to remain intact, and TO HELL with Michgan’s families and their kids.
Who else? Women’s feminazi groups-they expect men to pay for everything, and have their hands out, REGARDLESS of the consequences to our families and children.
Parents who cannot pay their child support are jailed too-the less time they are “allowed” to spend with their kids, the higher the payments they are FORCED to make.
What crime have they committed? Divorced a cheating or lying spouse? Even the false accusations of domestic violence reaps BILLIONS more for the system, and for the invented and indoctrinated victims.
America, wake up, and see what is going on here…..

Since the nationalization of the federal/state child support programs throughout the United States it has become well-known for failing the taxpayers and their clients on a variety of levels. In Maryland a Child Support Worker Pled guilty to theft. What could a child support worker steal? Identity Theft, Fraud, and more in the article below. Who should really be imprisoned? The system is riddled with the crimes that they are committing against the public, not the other way around.

The courts profit from the destruction of our families and persons. There are many federal incenitve funds that create state laws for the courts to rip us apart. Why is Divorce so high conflict? Why does CPS and DHS look for more ways to increase adoption? Look at the funding incentives. They prey upon the poor for profit.

All we need is a leader, we have the cause, the desire and the need to take back our home. The time is coming, more people are waking up to the reality of the situation everyday. IF you have the ability and the time, print out and pass out papers informing your neighbors and everyone you see about the Federal Reserve, how it is unconstitutional, and that the average american works 4 months of the year to pay federal income tax that goes to the pockets of the bankers who run it. There is no law that says you have to pay income tax.

“THEY” hate the GOD of the Bible, hate Jesus Christ, and will tolerate(for now, anyway) ANYTHING BUT the LORD GOD. I do know this for a fact, and those that used the Bible for control, didn’t use much of the Bible….Nor did the self-same allow anyone access to the Bible(granted, many were illiterate).
Jesus came, so that we human beings could be close to GOD on a personal level, and He does show Himself that way.
Jesus will also come again in a very real, physical, way, and according to the Bible, a majority will NOT be glad to see Him!!!!!
It will come down to a choice…To reject Christ or die, and it will be more than obvious then, that “THEY” hate the LORD, and if they hate something THAT MUCH, then it’s a threat or a detriment to them in some way.

Things used to be logical, fair, honest and just but everything has gotten FU<K’d up!
I don’t want to point fingers unless it’s warranted BUT let’s consider LAWYERS?
1) They benefit from all misfortunes TRUE? (Divorces, deaths, arrests, etc.)
2) They draft the laws that are passed by our “representatives”
3) They charge more for an hour than most of us earn in a week
4) One can’t even declare “bankruptcy” unless you can pay a lawyer
5) They are free to charge whatever they think they can get out of you
OK now POLITICIANS:
Do politicians investigate their own “wrong-doings”? (Is that like the fox guarding the henhouse?)
1) Politics is basically a popularity contest
2) It helps if you’re RICH $$$
3) Do you think politicians pay millions of dollars to get elected so they can do GOOD for taxpayers?
4) It’s a power trip!
5) The rich get richer.. The poor get poorer
6) The punishment of the rich doesn’t nearly fit the degree of the crimes they commit (dollars to donuts)
7) Politicians can “vote” for their own pay increases (what would you do in their place??)
9) Let’s pay for a government study to determine if there’s any truth to the above statements
and
10) If we lived on credit to the extent that the government does, we’d all be bankrupt! (Unfortunately, we can’t print CA$H like the Federal Reserve “Bank” does)

Why do we value some entertainers (actors, singers, athletes) so highly? Isn’t this just another “opiate” of the masses?

This sort of explains why it’s essential that America maintains one or more “police actions” (fighting for democracy/freedom), war on drugs & terrorism to make the world feel more secure hahahaha! It sort of pisses me off that I have been pointing out that all judges are and were lawyers and with few exceptions, is there anything lower or more crooked than a lawyer? And what kind of humans work at prisons? And while I have to believe not all people are bad, no matter what they do for a living, has anyone ever known a cop that was not a predictor type personalty who often have more in common with criminals than normal people?

power supply units is concerned So I may be unable to post for a while. Going to the net cafe is not much fun when you live on the side of an urban motorway and I am laughabley poor.
I would not want you to think that I was gone to the new improved deluxe flu although that could happen. Of course I will keep pluging away until the last of my P4 (12v) can no longer power a P3 mobo then I will have to use the money I was saveing to go to America, where you can get hand cuffed by a sexy woman for nothing. It`s on this site somewhere as a youtube thing.
And buy a used computer as I have an XP pro licence.

I have just spent the last 2 hours reading all your comments and some I had to skip over or I would still be reading. The consensus here seems to be a disbelief in our government and how it treats the low income or no income people. Let me say this I don’t agree with Obama on 99% of what he is doing to our country, but there is one area we do agree on and that is education. Obama says we need to educate outselves so we can be productive people, the days of working on a manufacturing line are over, now we need to know something, we have to sell our knowledge to get a job. Some of the spelling and misuses of words and incomplete sentences that I have just read tells me we have alot of work to do here. Using swear words dose not make us tough, it makes us look low and powerless, easy pray to those who have a good command of the english language and can use it against you. I see much feeling sorry for ones self in your comments and also much hurt, in some cases things have moved too fast and left us behind and it’s too hard to catch up, we still need to try. I agree with the person who said we need a leader but were not going to get one by showing how ignorant we are, a good leader needs good followers some will be well educated some will be needed to do the grunt work but both are just as important. I see the enthusiasm in your words and the love for your country that is real don’t lose it, but don’t scare good people away by talking about killing and going off half cocked, this can be handled through reason if we move soon. Well you know what kind of a person you need for this job, go out and find him and NO I’m not applying I just wanted to set the foundation for your search. Good luck to us and I’ll be there to do my part when the movement starts.

There’s another name for this:
Indentured servitude.
And the extra-sad part is that the concept is illogical if it’s being used to try and dissuade and/or recover debt. Because the person, without legal counsel, recourse, or income, cannot and will never be able t pay back the debt to the original creditor/institution. That leads me to two conclusions.
1) The companies are being paid their debts owed by the detention center on the side, so they can keep up the income into the detention center, and use the low wage labor. Or
2) This has absolutely nothing to do with paying back the debts, and has everything to do with “punishing” people. Of course, the punishment is cruel and unusual as it has no end (in comparison to time served for a crime, where the person eventually settles the debt on a schedule as ruled by a fair trial), and it’s is being exacted without due process of the law. It is indefinite punishment for being poor, or irresponsible, or simply hitting hard times.

Yrs ago I was placed in a work release program for violating my probation. Violation? I couldn’t find a job so I couldn’t support myself so it violated my probation.
The day after I arrived to serve, facility was in another city, I had a full time job at minimum wage washing dishes.
I was required to pay room and board and also had child support. I didn’t make enough to pay all of both so I kept going deeper in debt for room and board. I also had court costs and attorney’s fees to make payments on.
Eventually they had to waive what I owed for room and board because you had to be current before you could leave. I had been there for 9 months. Longer than any other person they had, up to that point, ever had. I had not missed one day of work the whole 9 months and had even gotten a raise and promotion. I also ended up getting a better job after 6 months and still could not catch up, (interest on what I owed).
This goes on all of the time.

The Welfare Reform Act of 1996 and the Title IV-d and law 666 have created a virtual debtors prison. Going to jail for not being able to pay child support does nothing for the child just add a huge bill to for the state and their contractors to make money.

When did the state force people to pay for their own prison cell? I had no idea this took place.
I was aware of the traffic violation increases and extra expenses that must be paid.
The US is going crazy because of greed and stupidity. Government in not a money making business. This proves there is too much government. If black folks would come on board with the tea parties and other groups, change could come. It is time to come together because we are in this together.

I’ve been homeless more times than I care to count from childhood on–debts add up fairly easy. I have clawed my way out again and again only to be beaten back into poverty. I am still clawing back again there will be no next time because if there comes a next time I would likely kill the person or persons responsible then they can have a legitimate reason to put me in jail.
