HR 45 May be More Troubling Than the Average Anti-gun Bill

Those of you who regularly peruse the GOA website know that there are dozens of anti-gun abominations which are introduced as legislation in the Senate and House each Congress. These include, particularly, national gun licensing and broad gun bans.

| Barack Obama was fond of saying during the campaign that he supported the Second Amendment. And we read of gun buyers who are flocking — while it is still legal — to purchase firearms, but who concede that they believed Obama’s assurances and voted for him. | |
GOA provides a summary of these bills for the benefit of our members and friends. But we do not focus on most of these bills because they are so extreme that they have no chance of passage. They are cynically introduced so that the Brady Campaign can raise money by threatening anti-gun measures it could never pass.
But the first anti-gun bill of the 111th Congress -– Chicago Congressman Bobby Rush’s H.R. 45 –- has caught the attention of many in the Second Amendment community as something we need to be worried about.
This is because of the extremity of the bill:
* H.R. 45 would require a federal license for all handguns and semiautomatics, including those you currently possess; and
* It would require handgun and semi-auto owners to be thumbprinted at the police station and to sign a certificate that, effectively, the firearm will not be kept in a place where it would be available for the defense of the gun owner’s family.
Pretty scary, huh? But, while this despotic nuttiness makes you wonder why a congressman from the Murder Capital of the Midwest would think that it would help to make the residents of New Hampshire, Alaska, and Wyoming comply with his blood-soaked city’s anti-gun laws, there have been other bills which are just as unconstitutional.

Rather, what makes H.R. 45 troubling is its sponsor and its timing.
Its sponsor is Congressman Bobby Rush –- a scion of the same super-corrupt Chicago political machine that produced disgraced Governor Rod Blagojevich and President Barack Obama.
And as for its timing, it was introduced during the confirmation of Attorney General nominee Eric Holder — the man who tried exploit the Columbine tragedy in order to pass gun licensing as Deputy Attorney General in the Clinton administration.
And make no mistake about it: Licensing is only a way-station to discouraging, arresting, or humiliating gun owners and outlawing guns. Under H.R. 45, for example, the applicant must also make available ALL of his psychiatric records, pass an exam, and pay a fee.
So… are you a veteran who has ever consulted a psychologist or psychiatrist? Guess what? The FBI would soon be examining every confidential statement you have ever made during those consultations.
Private sales of handguns and semi-autos would be outlawed, and reports to the attorney general of all transactions would be required, even when — as the bill allows — the AG determines that a state licensing system is sufficiently draconian to substitute for the federal license.
But, you may be thinking, “I’m just a hunter with a deer rifle… surely, none of this is relevant to me”?
Then you should know that, with virtually no exceptions, ALL firearms transactions (including person-to-person private sales of long guns, hunting rifles, shotguns, etc.) would be subject to the same paperwork hassles that are required when buying from a dealer.
In addition, the bill would make it unlawful in virtually all cases to keep any loaded firearm for self-defense. A variety of “crimes by omission” (such as failure to report certain things to the government) would be created.
Criminal penalties of up to ten years and virtually unlimited regulatory and inspection authority would be established.
Combined with the Ammunition Accountability effort to outlaw ammunition in numerous states, this two-pronged attack would soon make gun ownership a thing of the past.

But we may soon see a more horrific, nastier side of Barack Obama… and a capacity to go after his political enemies. And we have to assume that he will view gun owners as just about the most important of those enemies.

Has HR 45 been slipped into the “stimulus” bill which will be signed on Tuesday, in Denver of all places? Still trying to research but haven’t found proof of this yet.

First of all, the 2nd Amendment of our Bill of Rights is my concealed weapons permit. Period!
Secondly, I don’t need that document to tell me I have the right to defend myself. If anyone thinks I will allow a gaggle of num nut bureaucrats in Washington to dictate to me if, how, and where, I can defend my gift of life; they are sadly mistaken.
Our right to defend our lives doesn’t come from a ducument, a law, or a governemnt. Our right of self-defense is a basic human right that comes from our creator.

I agree with all Brian said, and I add this.. It’s un-Constitutional, why might you ask. What happens if you refuse to comply with the thumb prints? And requireing the thumb prints puts conditions to the 2ond admendment, which is infringement, so it’s un-Constitutional and I will NOT comply nor reconize the requirements. The 2ond admendment is a GOD given right, NO Government or man can take it away or infringe upon it, come and try, see what you get.

Exactly, Homebrew. When 2 laws contradict each other, the higher law supercedes or invalidates the lower. The US Constitution is the highest law of the land.
But again, I don’t need the Constitution, any law, or any government, to tell me I can defend my life. That’s a basic human right from God.

Is this legal under the US constitution?
Gun owners should refuse this measure referring to their unalienable and absolute right to weapons for their daily use (ie available at home= under the US constitution.
It’s clear that giving away your gun, allowing your use of the gun to be severely restricted by these licencing laws or being forced to give information about your gun to a body that might then use that information to confiscate your gun will spell DEATH.
Why are they so concerned about getting everyone’s gun? The Obama Illuminati administration wants your gun because they want to be able to kill you.
To fight this measure, all Americans must organise NOW! Their right to a weapon rests on the constitution and cannot be taken away or restricted to the point where they de facto are not allowed a weapon.

As of 1992 the U.N. passed articles 44 and 45 I believe, or 45 and 46. Can’t remember but you can go research it. The article states the U.S. Congress no longer has to follow the U.S. Constitution. You can research this. I’m very sorry I can’t remember the name of the bill or article, but I did look it up, and the words are there. However, looking at all the responses, I’d put my money on us. “People have been waking up in record numbers since 9/11. Because of this they’ve had to carry out their plans fast.” Haste makes waste. You have to think. These people f--- things up enough that the “Agenda” is well known by a lot of people. I don’t believe they are going to reach their goal based on the principle that they love keeping us in the dark about vital information, and pistol whipping us when we ask about it. Eventually, again like the responses to this article, everyone’s going to realize and stand up and say, “Ya know what, assholes, everything you regulate is fine until you regulate it. Go f--- yourselves and leave us alone.”.

I was wrong, it’s Article 55 and 56 of the U.N. Charter. The quote was wrong as well. This is right from the charter;
CHAPTER IX: INTERNATIONAL ECONOMIC AND SOCIAL CO-OPERATION
Article 55
With a view to the creation of conditions of stability and well-being which are necessary for peaceful and friendly relations among nations based on respect for the principle of equal rights and self-determination of peoples, the United Nations shall promote:

Because this is a treaty, it “technically” overrides the constitution since we’re a member of the said treaty.
On a side note. Just to spread the mentality. A long time ago, I really just stopped caring about what documents who wrote up and signed at 1am on a foggy Wednsday morning under a waxing moon. I feel that the federal gov. wants full control and this would come at the expense of the 10th. I remember back in collage in 1989 that my government prof. saying with a smile on his face that some wanted to get rid of the states and just have the federal gov., I was asleep then. The schools have dumbed people so to the point that most people need Big Brother/Big Sister to care for them like little kids. They do not talk about personal responsibilty either in schools or by the parents who were not that at home or in school either. A fully responsible person is capable of owning a gun and taking care of person and family.

Evidently the new crew from Chicago is expanding the gang turf to Washington, DC. If DC wants to live with that its OK with me, but don’t try to bring it into my home. All aspects of this Stimulus Bill is unconstitutional. If it can be passed without the congress even reading it, why do we have a Congress? It seems that we are paying for services that we are not receiving. How does the President get to determine unilaterally what is so urgent that the people’s representatives are not given time to review and debate the issues? If it was so urgent why did he just not do it with an executive order as so many other dastardly acts have been done. I think that he bated Congress and they were gullible enough to take the bate. He now can point to Congress and say it was not me but your representatives who sold you out. If Congress had any integrity it would have refused to vote and forced a review. Evidently integrity is not in the vocabulary of the Washington elitists. I don’t understand why people find it so difficult to do nothing when they have made their livings most of their lives doing nothing. May all of these parasites live to regret all that they are bringing upon the American people.

I honestly believe that most gun owners and Patriotic Americans don’t have a clue to what is going on with our gun rights. I come from a family of hunters and law enforcement, who are clueless.
I recently when I encouraged a family member to purchase a firearm due to the current administration, that they realized the madness it was to get a firearm. Due to an unpaid ticket he was not able to receive his purchase until it had been clear. Then, they had to resubmit his paperwork along with paying more fees.
While purchasing gun ammo in Los Angeles gun dealers are scanning your drivers license even if you pay with cash.
It’s getting harder and harder until it’s impossible to own a firearm.

Since an unconstitutional law is void, the general principles follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it… A void act cannot be legally consistent with a valid one. An unconstitutional law cannot operate to supersede any existing valid law. Indeed, insofar as a statute runs counter to the fundamental law of the land, it is superseded thereby.

I think you may be right!
The economic crisis is likely to come to a head this summer, which in turn, will lead to civil unrest. The establishment will use the MSM to their advantage and use it as a pretext to come after the guns. If the people start to gain an advantage, they will probably stage another false flag operation to gain complete control! I am paying close attention to the vast amount of foreign troops currently on U.S. soil. They are here for a reason.
You really have to wonder about recent events such as H.R. 645 (FEMA camp bill), 500,000+ coffin liners discovered in Georgia, national id cards, FISA bill, anti-gun legislation, etc.
Hate to speculate about all of this, but we need to be prepared for everything and anything! The writing is on the wall!

In this day and age of technology we can easily use ‘THEIR’ tools against them. The internet, GPS, Google Earth, tracking devices, compact cameras, etc. These can all be used to keep tabs on the elitist scum who are attempting to thwart the law of the people. Know where they are at all times. Know their every move, their bad habits, their patterns, their families, their dirty little secrets, etc. THEY DO THIS TO US. Usually a court order or an arrest warrant is required to compel a citizen to come into a police station, and then the citizen cannot necessarily be compelled to sign anything.
In other words, if you are aware of all applicable laws for a citizen AND the constitutional l amendments AND use them to your advantage AND request time for your legal reviews, the entire sphere of government could have a huge dilemma on its hands. However, anyone of these items alone or without careful finesse on your part can make things tricky.
Everyone should start studying law on a regular basis, and also really keep a tight review process on your friends, allies, and your places of business and trade.
Please use all of your freedoms in a robust and unapologetic manner. By using your freedoms, it can make using my freedoms a little easier, and hopefully I can return the favor.

I have to disagree patriot 2008, i think the longer we have before their master plan goes into full effect, the more people we can wake up. I know it’s probably a stupid movie to watch, however, if for nothing more than seeing what it would be like if it ever did happen, the movie “Robocop 3”, available for free in the internet is worth the effort. It is about some powerful Japanese company hiring the services of a US sort of homeland organization (OCP), which fronted as a “rehab” force for the population, however its true agenda was to destroy infrastructure, dislocate, relocate &/or exterminate certain areas of the population for the purpose of making their real estate available for their wealthy foreign customer. Towards the end of the movie the local police force revolts & refuses to help this other organization against their own people, & they join the local resistance against this malevolent & no good adversary, called OCP & labeled by its own movie description an “evil business corporation”. This movie made 16 years ago seems as though it was made w/ today in mind. Mind blowing to say the least…

You may not have been aware, but the steps to getting a gun mentioned in this article are exactly what is currently required by the state of New Jersey. I know that will come as a shock.
But with the “Heller” decision, by the U.S. Supreme Court in mind, I plan to bring suit to the state government for their code which makes all firearm purchase illegal, unless a permit is granted by the state, AND that without a special permit, a gun can not be on a person or in his car for personal defense without being granted a seperate CCW permit which is in addition to the firearms ID and pistol permit [which is issues only one at time; meaning you can buy one gun only; and is issued on the basis of once every 6 months].

Obama didn’t say he supports the Second Amendment; he said the Second Amendment is an individual right. But that did not mean he was going to respect that individual right. ‘(aa) Firearm Licensing Requirement-

‘(A) under title I of Blair Holt’s Firearm Licensing and Record of Sale Act of 2009, which license has not been invalidated or revoked under that title; or
‘(B) pursuant to a State firearm licensing and record of sale system certified under section 602 of Blair Holt’s Firearm Licensing and Record of Sale Act of 2009, which license has not been invalidated or revoked under State law.
‘(2) APPLICABLE DATE- In this subsection, the term ‘applicable date’ means–
‘(A) with respect to a qualifying firearm that is acquired by the person before the date of the enactment of Blair Holt’s Firearm Licensing and Record of Sale Act of 2009, 2 years after such date of enactment; and
‘(B) with respect to a qualifying firearm that is acquired by the person on or after the date of the enactment of Blair Holt’s Firearm Licensing and Record of Sale Act of 2009, 1 year after such date of enactment.’.

It always good to see so many people as fired up about this stuff as I get. Unfortunatly, we preach to the choir here. What is the reality of this situation? Look around you. Do you honestly think your neighbors know about, care about, understand, or even know the stimulous bill passed? I doubt it very much. I look around and I see a huge number of people ignorant, slovenly, cowardly, selfishly, dragging through their pathetic existence waiting for someone to do it for them so they won’t have to go through the inconvenience of reality. They are the people of the matrix that know about the matrix and still prefer to stay in it rather than deal with life outside of it, even if it means perpetual slavery. Almost nothing will wake them up, shake them to reality, short of them losing everything they have and running out of other citizens to betray to serve their own weak minded needs and more importantly wants perceived as needs. We are ALL in serious trouble. As with all fearful situations, a true human being will hold his/her head high, give the fight all they have, stand for what is right, and leave the rest to God. There is nothing else, this is as it has always been, we are judged by God and ourselves by the choices we make and the actions we take.

Everything fj says is true. Most Americans would rather give up their freedoms for a “safe, comfortable” existence. Hell, they already have. They signaled that intent when they voted for the 2nd black president. I don’t think any of them have a clue where all this money is going to come from. Or what taxes will be imposed on the back side to pay for it. Too bad. But nature has a way of clearing the flotsam and jetsam, and unfortunately, a large portion of the electorate is flotsam and jetsam. Personally, in light of the 2nd black president’s decree closing Gitmo and shipping all of those people over here, most of which will end up in the prison system where they can foment rebellion with their Nation of Islam brethren, not to mention several thousand Palestinians, I believe we’re being set up for another massive terrorist attack. The flotsam and jetsam of the American public will not have prepared for that because they believe that now that their god is on the throne, eveything is going to be alright, he’ll fix everything, and everyone will be safe and happy. So nature will clear the flotsam and jetsam away, and then the remaining remnant who really cares about things other than sports and the latest electronic gadget can rebuild the country.

The newspapers are going out of business. Most people I know get their new from the Internet or word of mouth. The TV cable or regular news is a joke. Thank god most of our generation knows how to read. The problem I see is the youth don’t know how to read and the art of problem solving is almost gone. Probably to make the next and further generations dependent on the beast.

One part of my family escaped the Austro-Hungarian Empire about a hundred years ago. It was run by a king at the time who, if you weren’t ethnically Austrian or Hungarian, you were screwed.

These new requirements sound a lot like the old gun owning requirements in the UK before guns were banned all together. If they get it through then they start cranking up the requirements and wait for some psyche drugged maniac to go postal which blown up by the media is when they get the ban.
This is exactly what happened in the UK.
They know they can’t just come and disarm you so they will try to do it in stages. Because laws are only followed by law abiding people the only gun owners left are the criminals and the drug gangs so just as many people get shot but the tend to be defenseless law abiding types without the means to defend themselves, property and family. (This is what happens in the UK).
The principle reason that Japan never wanted to invade the US in WW2 was because of the widespread gun ownership of US civilians.
The key thing is, “Do you have the right to protect and defend person, property and family against deadly force”? Taking legitimate guns from a society using laws empowers the criminals and strips away this central right. If politicians are trying to push this through it has nothing to do with helping you and everything to do with be able to terrorize a defenseless population

Can we, as gun-owners, stop with this blame the “FAR LEFT” nonsense? I am part of the FAR LEFT and I am against ALL gun control. I think we ought to be able to purchase fully automatic weapons and Surface-to-Air missiles.
It is the ersatz left i.e., ‘LIBERALS’ that want to ban guns– and frankly gun control is like many other government intrusions into people’s lives (e.g., drug laws, sex-laws, et.al.)– that is to say, usually the domain of RIGHT-WING FASCISTS (Ronnie REAGAN was in favor of Gun Control in CA when the Black Panthers were exercising their 2nd Amendment rights BTW. The non-libertarian right (i.e., most of the GOP) is in favor of all kinds of government intrusion into our lives if they think it offends their (non-existent) god. So banning gay-sex, or drugs, or tattoo-shops in the city limits is the work of right-wing conservatives 9 out of 10 times. Therefore I suggest the right stop pretending it’s the FAR LEFT that is trying to use the government to control our lives. The establishment-RIGHT is more guilty of using the STATE to control us than the REAL Left (not ‘liberals, mind you— but REAL LEFTISTS, like me!)…
The REAL left in this country is very very PRO-GUN (I am a RMGO member by the way; an NRA member; and a member of the ACLU). The simplist way on this issue is to support the NRA. If you don’t know how, go to the local magazine stand and buy a gun magazine. NRA subscription forms are in them. Don’t let our founding father’s down. Remember, all of those who do not choose to own a gun to protect his or her family, will run to those of us who do for protection when big brother drops the hammer. Our right to KEEP AND BARE ARMS was designed for that very reason as well as personal protection.
