Johnson City Mall Shuts Down “Nobama” Kiosk

Fuchs’ business, the Graphic Edge, printed slogans and pictures on items such as coffee cups, bumper stickers and T-shirts. He said more than half of his business came from the sale of anti-Obama merchandise. Bumper stickers with slogans such as “SOS: Stop Obama’s Socialism,” “Nobama,” and “Chicago got the party, but the country got the hangover” were displayed around the small stand.
Now it appears Fuchs is out of business at the mall, but mall officials say this decision was not based upon political views.
Friday afternoon, Fuchs was handed a lease termination notice by mall officials and signed by Mall General Manager Tembra Aldridge. The letter states that the option to terminate the lease agreement is effective 11:59 p.m. today and that he must vacate the mall premises and remove his property before then.

The mall is private property and it’s the decision of the owner of the mall to allow people to sell things inside.
Whether we agree or not with the guy’s Nobama kiosk, it’s the rights of the owner of the property that matter here. The mall owner might be being a douche by cutting the kiosk’s lease, but that’s his right.
Remember that whole rights thing, it’s what we’re trying to protect here.

This guy should start a mail order business off of a website. I’m sure a lot of ticked off people here would buy some of his merchandise to help him out. I think it is the right of the mall to be able to shut him down because it’s private property, but it is also the right of the public not to shop at that mall anymore because they shut him down. However, sometime malls do receive money through redevelopment, and various government programs. If it was a lot of money then maybe the property should be treated a little more like public property. Just things to consider. I know I wouldn’t shop there anymore, and I would call the mall and tell them that.

I work at this mall and I can’t believe something like this happened so close to me. But, you are exactly right Marvel… I agree with everything you said. I have had to deal with Tembra a few times before and she isn’t a very pleasant person. I really hate this for Mr. Fuchs. I hope he gives them hell!

I work in this mall and what happened to Mr. Fuchs is completely ridiculous. He was making what the customers were asking for. I know for a fact that only three people complained about his kiosk. These people should have been told that we have something called Freedom of Speech in this country and that if they can have pro-Obama merchandise then others can have anti-Obama merchandise. What I don’t understand is that this story aired on our local news here in Johnson City, and at first, Mr. Fuchs was asked to make pro-Obama merchandise as well to be more politically correct (I hate that term by the way) and he could stay in the mall. It was then stated on the 6:00 news that an hour prior to the broadcast, the GM, Tembra Aldridge, informed them that they had 24 hours to leave the mall. So… what happened after Mr. Fuchs agreeing to the pro-Obama merchandise that resulted in his eviction? Nothing! My personal opinion is that this was a very poor decision for her to make. She will more than likely be catching hell for this. She should have just dealt with the customer complaints. It’s not like Mr. Fuchs refused to make pro-Obama merchandise. If that were the case, this would make a lot more sense. Bottom line is… rights have been violated here. If you like Obama, it is your right to have pro merchandise, but don’t take away my right to have anti-Obama merchandise! It’s just like religion… people get offended by God now, but does anyone ever think about how it offends the Christians when people try to remove God from the Pledge of Allegiance among many other things. EVERYONE in this country has freedom, not just certain groups. If you are going to preach freedom for your specific group, that is wonderful! It is your right as an American citizen to do that! BUT!!!, you must also learn to be tolerant of those who don’t agree with you, and respect that they have the same rights as you.

I live here in JC, TN and it’s really crazy to see this story on infowars. I was just walking past that little kiosk the other day laughing at the shirts for sale and now it’s gone. That really doesn’t surprise me that much though… things have been getting steadily worse here for a while. Hell, we got armed coppers guarding the ever so important movie theater. WHY? I don’t think anyone here, if asked, would agree that we need cops watching little kids at the theater making sure no one watches anything inappropriate. However, I’m not sure the kiosk got shut down for anything political cause I’ve grown up going to that mall and that kiosk is different every month it seems. On the other hand I wouldn’t put it past those cookie cutter fake as hell bastards at the mall to kick out anyone that’s potentially a “trouble maker”. All I know for sure is that this country has been going downhill as far as personal liberty goes for a long long time. It’s bit by bit people. You’re not going to wake up to martial law tomorrow. Chances are that Gestapo fuckin storm troopers won’t kick your door down tomorrow either. What will happen is more cops… then more cops. Then military troops working WITH cops for YOUR safety will be common. It already is in places like NY. Once the cops and military are pretty much the same thing we’re all fucked. Like I said it’s bit by bit. All you can do is resist in any way possible (make it know you won’t stand for it) and make sure to take care of yourself and those you love in any foreseeable scenario. Don’t go crazy and buy up all the ammo you can… buy what you think you’ll realistically need and use your money for other things like food and water storage. Maybe get a motorcycle or some land. Maybe some gold or silver. Just be smart and don’t take shit from the man. We own them they don’t own us. Even if things look horrible just remember that we are people and we have rights that are god given. Always be free.

I do live in Johnson City and have been patronizing The Mall since the 70’s. No more! I will not spend another dime there and I will drive to neighboring cities if I find a need to go to a mall.
I guess as a privately owned mall, they can choose to terminate businesses at will, and I support that decision but as an individual with freedom of choice, at least thusfar under this administration, I choose not to do business there. I applied the same concept with the Dixie Chicks. They had every right to criticize President Bush. I had ever right to discontinue purchasing their music.

I work in a commercial real estate office. What they have done is illegal. All he has to do is have his attorney contact them. They can not shut him down for selling these products. His lease protects him from that. If the lease states the type of company he has that is all he needs. No lease tells you the products your company is allowed to stock, carry and sell.

Hey I know this is a load of crap him being kicked out of the mall and such, I live in Erwin and I shop at the mall frequently and his stand has never really bugged me by issue is the tons of comments that are bashing the city, the area, and the people in it. The Klan City??? are you kidding me thats a ridiculous comment I saw more Klan activity living in Memphis than I’ve ever seen in Johnson City. There are more White guys trying to act black than anything. Erwin Hanging the elephant?? The story behind that is often warped. Mary was an elephant on parade in Kingsport and her handlers lost control of her and she rampaged killing her handler and I think one or two civilians they tried her like a criminal in court although she was an elephant and she was sentenced to death by hanging, KINGSPORT is where it all happened but they didn’t have the equipment to go through with it so they brought her to Erwin, The town of Erwin had nothing to do with it other than location and the equipment so don’t blame Erwin for Kingsport stupidity. As for Wagon Wheel being the areas theme song that was a rather stupid comment as well, Yes it is a country song yes it says johnson city tn in the lyrics but that doesn’t classify the whole region as loving that song unfortunately most of everyone loves rocky top and UT Vols so before you make a comment about an area how about you do a little bit of research on it.
