Rep. Clyburn, like many of his colleagues, seems to have conveniently forgotten that the federal government has only specific enumerated powers. He also seems to have overlooked the Ninth and 10th Amendments, which limit Congress’s powers only to those granted in the Constitution.
One of those powers—the power “to regulate” interstate commerce—is the favorite hook on which Congress hangs its hat in order to justify the regulation of anything it wants to control.
Unfortunately, a notoriously tendentious New Deal-era Supreme Court decision has given Congress a green light to use the Commerce Clause to regulate noncommercial, and even purely local, private behavior. In Wickard v. Filburn (1942), the Supreme Court held that a farmer who grew wheat just for the consumption of his own family violated federal agricultural guidelines enacted pursuant to the Commerce Clause. Though the wheat did not move across state lines—indeed, it never left his farm—the Court held that if other similarly situated farmers were permitted to do the same it, might have an aggregate effect on interstate commerce.
James Madison, who argued that to regulate meant to keep regular, would have shuddered at such circular reasoning. Madison’s understanding was the commonly held one in 1789, since the principle reason for the Constitutional Convention was to establish a central government that would prevent ruinous state-imposed tariffs that favored in-state businesses. It would do so by assuring that commerce between the states was kept “regular.”

Yes, the imagery falls in line with the original old religious pretence of the Gothic age. When the early Celts and other pagen religious societies were forced to observe Christianity, they hid thier religion in the things around them so that they could continue to worship. To a certain extent, I would say the the Honorable Andrew Napolitano knows who is handlers are, and goes on his rants in spite of them. He does not need Fox News to make a comfortable living, unlike many of his “colleagues”. My guess is that Fox does not know what to do with him just yet. He has already made complete fools of Fox as per his speaking engagement tour in which he lambasted the Patriot Act that his Fox bosses helped sell to the masses, yet he still has a job at Fox, for now. Regardless of his Fox show, I await what he may say next when he hits the road again.

Doctors have been getting screwed in the past few years with increased regulation and less compensation and will continue to get screwed more with this plan to the point that I predict that many currently practicing doctors will soon be leaving the profession in mass exodus and there will be few new doctors entering the profession. I predict a massive shortfall of doctors in the near future, which will make waits longer, doctors overworked and under paid, and their work will be more superficial which will exacerbate the problem like a self sustaining exponentially accellerating decay.

WTH you are correct. Please, people, understand that doctors are not the enemy, any more than teachers forced by the board of education to teach the curriculum given to them on pain of termination.
My family has a good doctor friend who wanted nothing more than to open a free clinic, and when he did, promptly went out of business. He now is forced to work at a cosmetic laser clinic just to earn a living. A laser clinic! He is a doctor of internal medicine who was just trying to treat the seniors in his town. So when he treated all patients on government healthcare he never got compensated and went broke.
Come on people, not all doctors are bad. Some still believe in the Hyppocratic Oath. (sorry if there’s a spelling error) Grouping all doctors into the enemy position is ignorant and one would expect better of this site.

Nothing upsets me more than when people say doctors are the crooks and that they make too much money. Why don’t you get your head out of your ass and see the education these people go through. Do you not realize that we spend 4 years of undergraduate then 4 years of med school all in addition to residency? Do you not realize the hours that doctors work during residency as well as the pay? Hell unless you are loaded it takes making big money to pay off all the student loans. Give me a break, doctors work hard as hell for every penny they make.

Wow. There’s nothing dumber than a dumb person who thinks he’s smart. Sad, really. True, however, that doctors do want to get paid and paid well, but that is because of the liability and responsibility they are assuming. Generally the more education and useful knowledge you have and skills you’ve trained for give you an opportunity to profit from it. We spend a long time schooling and training in order to, yes, help people. There is a great satisfaction knowing you’re able to help someone, even if its just advice and reassurance. It is also interesting to learn about health and disease. But all that takes a lot of investment and sacrafice and doctors get paid for their services just like anyone else; mechanics, plumbers, carpenters, lawyers, professors… That is basic economics. The overhead, the liability, the responsibility, the on-going training, the insurance, the costs of delayed gratification and the expense of training is expensive. That is what doctors are compensated for. Some make a lot of money, some not so much.
Your advice to buy a house really doesn’t accomplish the same thing, now does it? Everybody works hard, but not everybody is willing or capable of going to college and medical school and residency. It’s not easy and it’s not cheap. So sumsrent, you are angry at your doctor because he is richer than you? Or because he thinks you’re nuts? Or as you backwardly put it stupid or just plain ignorant?

My insurance premium is directly effected by theft, false claims and rising costs… all in the name that I won’t be singled out…
The judges and lawyers are all in it… the politicians and doctors too…
Do doctors need to be compensated for their work? Sure… but that doesn’t qualify them to be thieves along with it!

True, its not the doctors’ faults health insurance is so godamned high and that 100% of them dont cover pre- existing conditions which is practically what 100% of the people in america are buying it for. I have a pre-existing condition because i was born with a gene that made my colon rot inside my body when i was 18, and the health insurance i have now wont cover ANYTHING to do with ANY subsequent problems that arrived after i had my colon removed.
Docs do earn every penny they make, it takes a strong stomach to be able to reach into someones body and fiddle with dead organs and whatnot in medical school, i wouldnt be able to do it because i would never stop vomiting.

That is why 2 out of 3 are threatening to retire or go into the research field if “Health Care Reform” passes under any of it’s many current versions. The doctors are beholden to liability claims (due in large part to no TORT reform), and are not a party to the exorbitant costs of health insurance or pharmacueticals. But yeah, it’s all about making doctors richer. Especially the young ones working in ERs 80+ hours a week all year long and still only pulling between $150 and $250 a year while having 10+ years of medical school student loans to pay for. Yeah, that must be it. Schmuck! It would behoove you to go talk to a few, and maybe you would realize that most (I’m talking 80% or higher) are against this f---ing thing. Idiot…

Health insurance companies totally control nearly every doctor in the U.S.
Because most doctors are too busy to be concerned about laws and contracts they nearly always get the short end of the stick. The insurance companies have complete control over whether a doctor even gets any patients and then the insurance companies control just what procedures a doctor can perform and just how much money a doctor will get paid.
I am not pro doctors but I do have inside information about the insurance companies. My wife works in the insurance industry and the company she works for is owned by a company that’s primary business is investing in things that kill people. The carlyle group make it’s trillions by investing in things related to war and insurance.
You have no idea just what goes on behind the scenes in the health insurance industry.

Wow would it be fun for a patriot posting a viedo of sevearl big name advocates of
single payer government run health care trying to cite the part of the US constitution
that empowers the government to run any health system.
There is no constitutional authority for even providing health care for veterans we are morally obligated to and there is that pesky 10th admendment that forbids government interventions unless the power to do so is enumerated with spificity in the constitution.
Some state constitutions may allow a state wide universal care system, but Uncle Sam does not even have legit power for its unconstitutional fraud filled medicare disasters.

Any Judge or lawyer knows, that in the United States a case prior to 1938 can not be introduced in a courtroom. Why is 1938 the cutoff date ? It is because that is the year a precedent was set in a trial and from that trial, we were codified as to being in bankruptcy mode.
We are still in bankruptcy proccedings and as Alex has said, assets are being liquidated and we are in receivership…to the international network of central banks.
Think about it. Why can no case that exists prior to 1938 be cited in court ? There is a reason. Think about this too. Our ‘government’ is broke…busted, kahpoot….doesn’t have a pot ta piss in. The banks ( just as they did in England with the Bank of England with Rothschild ), loaned out money. The bank then become the creditor and the government in debted to the bank. When a governemnt then can not repay, guess what ? The government is owned by the creditor.
The US Treasury is now like a middleman between the banks and persons within government. The governmnet isn’t the one providing millions upon millions of dollars to contractors in the Defense Departments or Pharmacuetical giants and the likes. It is that banks. The government is broke. Remember?

In my opinion, both Congress and the Executive Branch need to be put into “Time Out” where they stop doing damage to our country. During this “time out” both branches of government need to read the Constitution.
The 10th Amendment needs” teeth” to stop all this foolish legislation coming out of D.C. Circumventing the Constitution needs to stop, also. That means making “back room” treaties and agreements, signing statements and a myriad of nonsense that is UNCONSTITUTIONAL.
Maybe we should run a sensible person like Napolitano for President. However, a president alone can’t fix this country when we need to restructure the party system to allow for honest representation of the people, not just two controlled parties. Both Congress and the Executive branch need fixing. Then we still have the problem of a corrupted military, powerful corporations too big for their britches, banksters running a world-wide ponzi scheme bent on controlling everyone. Nevertheless, if we could position enough intelligent, honest, Constitution following patriots in office, we might have a chance of saving our country and thereby positively affecting the world for good not greed.

Now, show me the words Health Care! Any Legislature that pursues this Bill is once again violating their Oath of Office. If any Legislature wants to change our Constitution then get 66% of Congress to agree on the 28th Amendment and get 75% of the States to Ratify the 28th Amendment of the United States. Then and only then will Congress have the Power to make Health Care Laws! Until then, sit down and keep your lips together.
If you think that our U.S. Constitution is NOT the Supreme Law of the Land, and is just a piece of paper, then pack-up your personal property and go home, since this piece of paper is the only paper that empowers your employment. Furthermore, all of the other pieces of paper that you have created and call Laws are all just another piece of paper.

As the time goes on , people of america have everyday less and less freedom due to politics conducted by federal power. Also , as a consequence of the economic crisis , more and more of them have lost their job and home. But the crisis is not finished , and in near future the consequences could be catastrophic. Keep in mind that any change can not come from the federal government , but only the people , the only source of any future chagement. If a majority of them think a change is possible , so it can be. A way to preserve freedom , ideals , welfare of people is federalism must come to an end. People will have to make a choise , federalism versus freedom , ideals , welfare… . The first could lead to the establishment of a martial law. A state as texas is ready to cross the line , it could be an example for the others. People could put under pressure every state government in the aim to declare secession , the american constitution allow such a decision. Such an aim can’t be aimed without any precaution , as it is evident the federal power is not ready to yield or abdicate. Probably , this one will use force to submit people , but constitution give garantees on firearms. people can put up a fight against the oppressive federal power if a political issue according to the will of people can not be lead. People have to make his will respect , otherwise it will be an opressed people. Saying that federalism must come to an end mean it must be break down , it appears to be the only way to preserve people. America can be easily imagined without federalism and preserved.
