Judge Rules It Is OK to Taser for DNA Samples

It is legally permissible for police to zap a suspect with a Taser to obtain a DNA sample, as long as it’s not done “maliciously, or to an excessive extent, or with resulting injury,” a county judge has ruled in the first case of its kind in New York State, and possibly the nation.

Smith was handcuffed and sitting on the floor of Niagara Falls Police Headquarters when he was zapped with the 50,000- volt electronic stun gun after he insisted he would not give a DNA sample.
He already had given a sample, a swab of the inside of his cheek, without protest the previous month. But police sent it to the wrong lab, where it was opened and spoiled. Prosecutors who had obtained a court order for the first sample went back to Sperrazza, who signed another order without consulting the defense.

Someone should disbar this bitch. I think taking DNA should be a violation of privacy according to the Constitution. Someone should also get Hate Crime laws overturned, since they violate the Equal Protection Clause.

every time one of these stories comes on here people act like”they cant do that”..I agree with the outrage but people better get used to the fact that this is a new day in dealing with police….the courts are going to,time and again,side with officers on this sort of thing and we,the people are going to lose…it may not be right but I can promise things arent going to change for the better…things will only get worse…what do you think is going to happen if and when martial law is in place?..this guy is lucky all that happened was he got zapped for 1-4 seconds….all this”they cant do that” is pretty much just wasted air….I know a lot of people thought things were going to change under obambi/….”its a new day now”..yeah…ok….Ive said it ebfore and Ill say it agin….people need to decide on how much pain and bodily injury they are willing to stand to “get their rights” and be ready…these dudes aint playing….I say pick your battles and these small time incidents that are getting people hurt are better fought in court than in some holding cell…good luck to you…peace

My local police dept(67 officers) has a policy of using the taser BEFORE using physical force…and it has been upheld in the state appelate court…on the “use of force scale” its before hands on and is used that way…in other words they say”do this” and you say no…they taser,then cuff you….they dont have to try to bend your arm first….and you better believe they have that unit out when they speak because their units have a camera and microphone in it…it records their command and your refusal….thats all they need to skate because their policy tells them they can….its a new day folks…get used to it

Without exeption, the individuals un-assing such sage wisdom no doubt had big balls of the brass kind themselves at every possible turn. They could leap tall buildings in a single bound. Having these’balls’ naturally involves shooting people in the neck or head; since simply everyone who is anyone has body armour this season darling.
Problem is, I dont want to shoot anyone; even if the stiff is wearing a baby-blue helmet—-I simply lack the balls to do such a thing and refuse to grow a pair besides. So, I’ll leave it to the John Waynes and supermen. And, while they rot in prison for murdering the ‘ bad people’, I will have their women cleaned off and sent to my tent.

Do you mean when a prosecutor has gone to court and convinced a Judge to issue a warrant for the DNA, after determining that probable cause exists for a criminal charge, and that the DNA is necessary to proving a case…. and then after the warrant is served, and the citizen in question has unsuccessfully challenged it, and then presents law enforcement with physical resistance… THEN you think it is okay?? Now there is proof that the officers lied when they said “none was observed.” To taser a person unconcious is causing internal injury. It would have to to make him go unconcious from electricity. It makes no medical sense to say that in an official report. To me what they are basically saying by that ruling is they can use the taser for whatever they want. This is wrong and denies due process. There are becoming too many incidences with police tasering for them just to do it and then being covered up later with justification that is total BS. Just remember people that they may seem like the Constitution has been demolished but they can not override it. There was major reasons why it was written along with the bill of rights. It was understood back then that one of the major reasons was that anything that in the future that was to be written could not contradict, go against or violate in any way the bill of rights or the constitution. If it did it was not supposed to be approved or even if it was makes it unlawful and illegal and is suppose to be automatically abolished. But this of course is not being done by our congress. But in turn we the people have been allowing it out of ignorance. All because they make all these laws, bills and such (which most of them can be found in all fairness) illegal. Remember this was written to protect us from a tyrannical government. To think that any government can override this is incorrect. The constitution and bill of rights is OUR COUNTRY not OUR GOVERNMENT.

Dlouble indemnity. He was ordered to give the DNA. He did. If they failed on their end, he should not be required to give it again. I think it’s wrong for them to force him to comply to give up his DNA in the first place. I am getting to the point where all citizens on juries should (except whenit is a violent offense), find all defendants innocent. The State has become vile. Therefore, it is the duty of the citizens to keep one another out of jail. Especially when there is no justice and DC is run by organized crime.
We should all find one another innocent and all practice jury nullification of the State’s assault on citizens.

I answered on another thread. I’m not for the whole living together thing. But congregating in a general area – yes – in different homes. But I do think we should gather and I think Texas is a great idea.
We need to become ACTIVISTS FOR SECESSION!! That ispositive proactive political action to defeat the NWO.
I want to call us the NFO… the New Free Order (as a group – not the name of a nation or anything) and I like the acronym to dually mean Now F Off to the NWO police state.
But I do believe there must be organized political activism and our most powerful positive pro-active political action is to PUSH for state secession.
People can even be conservatives or whatever – we just need to push the herd into state secession to defeat the NWO.

So, I think your idea is good – but there must be focus on self-sufficiency – and political activism to defeat the NWO in practical ways. Most practical is state secession.

If anyone goes out of their way to hurt me when I have not hurt anyone or done anything wrong, I’m positive there are people you can expect to see retaliation in a way that they will understand that the perpetrators will never be able to physically do that again. I’m all for putting scumbags behind bars, but only collecting DNA if they are accused of felonies and have a court order or warrant. I’m a strong supporter of Law Enforcement, but ask a LEO how far they should be able to go, and you will always get infinity.
