Man Held on $500,000 Bail for 30,000 Bullets

HAVERHILL — Keni Garcia told police he intended to use the 30,000 bullets they found in his car and home for target practice.

Garcia, who allegedly bought thousands of rounds of ammunition and had 10,000 bullets in his car when he was stopped by police Thursday, was ordered held on $500,000 cash bail yesterday.
Attorney Socrates de la Cruz of Lawrence, who represented Garcia, 32, of 12 Freeman St., at his arraignment in Haverhill District Court, said he will appeal the high bail in Superior Court.
Garcia is charged with three counts of possession of a high-capacity firearm, illegal possession of ammunition and illegal storage of a firearm. His case was continued until June 12.
Assistant District Attorney Christopher Holland asked Judge Patricia Dowling to impose $750,000 cash bail.
“He has no reason to stay here,” Holland said.

Although i think that 30,000 bullets is both overkill and dangerous to store (imagine if storage caught on fire) it still is his right to own and keep the ammo and gun (god rest his soul if he drops a cigar in the wrong spot). We cannot allow a limit to be set or they will continue to shorten it untill you can only be in possesion of 1-2 rounds for “hunting purposes” only. Another thing is if you buy all that ammo all at once you be marked down and one of the first to be raided when martial law is declared. I suggest buy 50 rounds at a time at infrequent intervels at different stores. Also if possible buy it from a regular person that’s not a licenced gun dealer or *forgot he was* so no papers or credit card transactions are recorded. Getting ammo is important, but keeping it from being stolen is equally as important. It is our right to buy it in such amounts, however our rights are not really worth shit anymore except to the select few that still have brains that function. So lets go about this issue by not triggering an alarm.
Another idea is that you should bury ammo (maybe some other gear too) out in the woods with an X by the tree just in case they are coming and you get raided illegally. This way they can’t get it, you can escape to the woods with ammo already in it, and you don’t have to carry it to the woods.

Massachusetts is a gun-nazi state, they have several different licenses, each with different regulations. The standard class license only allows 10 round capacity in your handgun. Your weapon must also be transported in a locked container, and inside the vehicles trunk.

I live in massachusett’s and i know exactly what you mean. I had to talk a gun safety class in order to later get my hunting liscence. They do a background check on you before the class and pretty much every time you move. Also the magazine sizes are rediculous. 5 rounds for a rifle and 10 for a handgun? WTF?

Thats what I thought. I didnt think that it was illegal to have ammunition of any amount in your vehicle,but then again i do not know all the laws concerning ammo and any firearms in your vehicle. Except that you have to have your license with them seperated or your right to carry permit concealed weapons.

Not True!
In Florida (the state I live in), it is perfectly legal, for anyone who is legally allowed to own a gun, to have the gun loaded and have a round in the chamber (Ready to Fire), as long as the gun is in the glove compartment (it does not have to be a locking glove compartment), or closable console, and it is in a case with a closure (like a cloth case with a zipper or a plastic case with a snap latch), or in a holster with a thumb strap.
I learned this from a police officer who was teaching a firearms safety class. He showed us the statute and the interpretation…

According to the officer who taught the class the “3 step method” does not apply in Florida law any longer.
The statute only says “Securely Incased” and has NO provision about the gun being unloaded or an empty chamber.
The court made the decision that the minimum requirement for “Securely Incased” is; the gun must be in a closing (but not locking) console or glove compartment in the car, and the gun must be in a holster with a thumb strap.

The “3 Step Law” is not a law, rule, or any other means of legally binding restriction. To cary a weapon on you, you must possess a valid FLorida concealed weapon permit. To carry it in your vehicle, it simply has to be “securely encased”, in some kind of contained (center console, box with a lid, ect.).

In case you haven’t noticed, the price of ammo has tripled for some calibers, and has gone up as much as 10 times for less common sizes. This is pure theft by the police, the same as if they came and took your house and kicked you out of it so they could keep it for themselves and charge you with intent to commit insurance fraud because you had matches so you must have planned to burn it down. Ammunition is property, we have the right to have it secure, not stolen by government.

I have always believed that the only valid gun control is being able to hit your intended target. In support of that belief, I have in years past, participated in the purchase of ammunition and reloading supplies to be able to personally fire 50,000 rounds of .45, .357, and 9mm over the course of a year toward that end. It was a hobby that I and a few friends enjoyed. Being able to hit what you aim at and do it in a friendly competitive atmosphere of exercising and supporting our 2nd amendment rights. I have in years past, held upwards of 90 thousand rounds of varied caliber ammunition from the venerable 5 mm Remington, up through 7.62 for my rifles, and upwards of 50 thousand rounds of pistol ammunition .45 auto, .45 long colt, .357, and 9mm. I don’t hold or shoot anywhere near that now, but rest assured, I have enough to fulfill my oath sworn in April 67( USMC) to uphold and defend the Constitution for these united states of America, against all enemies foreign and domestic. What the NWO fears is the unknown number of people who maintain ammo supplies that are weighed not counted. This guy has the right to hold any amount of ammo he chooses to own. What he subsequently does with it is the determining factor. Support Oath Keepers. Be active, be aware, or be enslaved.

Screwyl, You must live in one of the conservative states, that do not impose rediculous gun laws.
Most of the states allow any capacity handgun magazines, any capacity rifle as well. But several of the NAZI states have retarded limitations.
Example: NAZIfornia has a 10 round limit on all weapons, yep even AR’s and AK’s, not only that if your lucky enough to own one of those it must also be equiped with a “bullet button”. Which is a modified magazine catch that requires a tool or bullet to release it.
That is why I left Nazifornia and returned to my midwest roots, f*ck those Nazi laws.

Good luck hitting something with it. If we fought in swamps it would make sense, but not in an urban setting. Me, I prefer a highly accurate sporting rifle in the .308 caliber. It’s a one shot, one kill approach that accounted for 95% of the kills in nam. The idiots firing full auto did nothing but carry useless dead weight as they hit shit. This caliber is also used by the enemy, aka police. As an asiede, though I’ve carried guns on my person, and was advised to do so by friendly law enforcement (many years ago in south georgia in a different universe where men had balls) I’ve never had a license to do so. Also, my carrying was not relegated only to a time frame where such was considered the norm. Interesting point you make…….and quite logical. If we were to make the assumption that the US had gone completely totalitarian and ammunition was no longer readily available, then the ammunition the general public had on hand would take on the characteristics that would indeed make it similar to gold, silver, etc. or other hard commodities that could represent real money. I’ve heard that ammo is used as a form of money in Zimbabwe so I think it will happen here when the dollar finally collapses.(which I think is 3-5 years off)

Umm, full article says it was in Massachusetts. No matter though, his lawyer says he did not do anything that’s a crime, period. And then there’s that pesky Second Amendment thing, like what part of “shall not be infringed” do they not understand. Up toward the top of the page, someone using 30,001 bullets was talking about the danger of this many rounds in a fire. They tried to close down gun stores using a Federal BATF reg change a few years back, that basically “Limits Handling, Storage and Amount of Ammunition for Safety”. It mentioned the “fire hazard” and that was one of the things that got it shot down. Tests have already been performed and in a fire, ammunition cooks off slowly and doesn’t “fire” like it would in a gun. All those movies where the ammo dump goes up are right, but only because of military explosive rounds, not the small arms cartridges.

The full article states that he was found out courtesy of the BATF making an “investigation”. They think he was shipping ammo back to the country he was from, though they’ve given no evidence of charging him with gun smuggling or illegal export of ammunition. In other words, this is a big honkin’ put up job to give them “probable cause” to snoop into his affairs some more. A fishing expedition.

The cartridges might explode but there would be little damage from that because in order for the bullets to become “supersonic” they would have to have been in the barrel of a gun or someother similar confining space which would allow the gas from the burning powder to build up the pressure required to move the bullet to that speed. I just got my LTC/FID in Massachussetts and it was not only an expensive process, it took me forever. 100 bucks for the NRA “course”, 100 bucks to my local city for\ background check, Finally got my. Process started Marchl 16, and got my FID on May 4. It took my 8 weeks from beginning to end. Anyway, they have my address when they want to come and get it. All they have to do is go and find it.

-He didn’t break any constitutionally authorized laws that is. They DO have laws which say you can’t own that much ammo, and he’s charged with violating that, but just being a law passed by a legislative body doesn’t make it written in stone and absolutely mandatory. An unconstitutional law is no law, is null and void at it’s inception- that point was made by a good judge (rare especially now) in the famous case of Marbury v Madison.

30,000 rounds is only 1,500 boxes, folks, if he bought .233 ammo in 20 round boxes. In any case, how much ammo the guy had is irrelevant. The Second Amendment makes no stipulations whatsoever about types of weapons anyone may have, nor does it make any stipulations as to how, when or why we may be armed, nor does it state who may or may not be armed. All of us have the right to the defense of our lives and property, without exception. That is what the Second Amendment was intended to protect.
30,000 rounds wouldn’t go very far in a firefight against a SWAT team or government troops intent upon killing you or taking you to a FEMA camp. I wish I had that much ammo.

What kind of rounds are we talking about? If its .22LR then this is sad. 22LR can be bought for about 500 rounds for $30. So if he bought 60 blocks of 500 rounds then thats only $1800 worth of ammo.

Dear Mr Fiorentini, I have read that Keni Garcia has been arrested in your town for crimes that do not exist in the United States of America. I believe that Haverhill, Massachusetts is in the USA. Our Bill of Rights clearly states that: A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. I have also heard that an incident similar to this kicked off The American Revolution in Lexington, Ma. The police officers, prosecutor and judge swore an oath to uphold the US Constitution as a prerequisite for holding their jobs, they have failed miserably. They need to be suspended immediately without pay, pending the outcome of this very expensive trial that will be coming up. A trial that your city will lose. The voters of Haverhill will be very disappointed that they will have to pay millions of dollars in court costs and punitive damages to challenge the US Constitution that their forefathers gave their blood for. If Patriots from around the country organize to have a million gun march in Haverhill, that will cost millions of dollars more in infrastructure and damages. Let’s all grow up and end the tyranny now.

Mass. Law does not define high capacity amo storage its very and ambiguous. As far as license goes there is a class A and B required to carry. If he has a good lawyer and lots of money he should be able shake the charges but the reality of the situation is that Obama’s job is to rid USA of guns because it the one problem the police state can’t over come very easily so look for many more arrest of gun owner over legally possessed guns and amo and new laws curtailing gun ownership.
The motto of ” the only way you are getting my gun is prying it from my cold dead fingers” should be taken to heart if the republic is to be saved.

Didn’t the American revolutionary War start on the basis of ammo depot confiscation by the BRITISH? How far off the beaten path does the US go before they lose the right to VOTE in a election on the basis that true patriots pledge allegiance to whomever the ELITE selects? Are people so asleep at the wheel that we are going to wreck on the basis of enfocement of rules that were once considered the basis for “war”? Maybe he wanted to resell the ammo, or use it for barter in a post-economic crash era?

Anyone in this country should carry a gun. It is the most dangerous country in the world to travel in. Calm down, this is no story. The guy broke Mass. law and was arrested. I’m all for no restrictions whatsoever on firearms, it’s a right, even if you “committed” a felony. But, you live in a liberal state, you get busted by liberal laws. The question isn’t whether this guy should have been arrested…he should have…he broke Mass. law by not properly storing his weapon and ammo in a car. That’s pretty black and white. The question is whether Mass. should have the right to make such a law. We focus on this one incident, but the problem is the big picture of the thing. I go back to an article I read the other day…will have to find it again…the citizens are the militia…the police should not be allowed to carry weapons, nor the military, on US soil. It is them that are in violation of the Constitution. It is the right and responsibility of each citizen to defend themselves, not the police. The answer is more guns. It should be near mandatory for every citizen to conceal and carry. All the police can do is try not to step in your blood after the fact. Not only that, but most over look the real reason for the 2nd. It is not for hunting…it is not for grandma to have that .380 in her purse for protection….it’s for way more than that….it’s to ensure the freedom on this country. Guns are your insurance policy for your rights. An armed country will always be free because not even their own government has power over them. Of the people, by the people, for the people. If you feel like your government is “them” then something is already wrong. Abolish all gun laws. The foundation of this country is based on the basic principals of freedom and the ability to defend that freedom. Disarm the police and military on US soil, defend yourself.

So why is he under arrest and what law did he break. So the possibility of this person potentially doing something wrong has gotten him arrested being threatened on being held with a $750,000 bail. Again, what law did he break. I think we need to look hard at the police cheif and D A there.

Oddly enough, when my wife and I go to the range, it is not unusual for us to shoot 1000+ rounds in a day.
If we went to the range twice a month, 30,000 rounds would be completely exhausted in 15 months.
If I could have gotten a really good deal on bulk .223 ammo, I would have bought 30,000 rounds.
