Massive Checkpoint Operation in Tennessee Violated Posse Comitatus, Fourth Amendment

On April 3, Infowars reported on the decision of the Tennessee Governor’s office to call off an illegal seat belt checkpoint operation that was scheduled to be conducted by the Whiteville police with DHS and military participation on April 4.
Earlier today on the Alex Jones Show, Tennessee Representative Johhny Shaw admitted he was unaware of the planned operation. He also said Governor Phil Bredesen did not know the DHS and military planned to collaborate with local police in Shaw’s district in violation of the Posse Comitatus Act.

It appears this is not the case in regard to another illegal operation. Last month, DHS, federal and state agencies, the Air Force, and local law enforcement worked together to violate the law in Tennessee.
On March 31, 2009, the Marion County News reported on a truck checkpoint set-up by the Tennessee Highway Patrol, Homeland Security, the Federal Motor Carrier Safety Administration, the Tennessee Department of Health, the Tennessee Emergency Management Agency, the Tennessee Department of Transportation, the Tennessee Department of Revenue, the Marion County Sheriff’s Department, the Monteagle Police Department, the Tennessee National Guard, the Arnold Air Force Base Police, the Bureau of Alcohol, Tobacco & Firearms, the Department of Commerce and Insurance and the FBI.
“Tennessee Highway Patrol troopers led explosive and drug sniffing dogs around the bases of trucks while National Guardsmen circled overseas containers with explosive and radiation detecting hand held devices in a scene reminiscent of ‘24’. Dozens of law enforcement vehicles, lights flashing, lined the brake inspection station, as trucks, both private and commercial, queued in the far right lane of 24 for what seemed like miles,” reports a Marion County News reporter.
According to a Tennessee Department of Safety press release, the object if the Homeland Security type checkpoints is to stop, evaluate and inspect as many commercial vehicles as possible, focusing in commercial vehicles, rental trucks and cargo tanks. Furthermore, these checkpoints will be held randomly throughout the year.

Harmon didn’t discover anything one might find in an episode of 24. However, over a span of ten hours, cops issued dozens of tickets on 285 eastbound for everything from safety defects to DUI.
Posse Comitatus was violated during the massive operation held on March 24 due to the fact the Arnold Air Force Base Police participated.
As noted above, DHS and the military intend to participate in additional sweeps — not simply in violation of Posse Comitatus but also the Fourth Amendment — randomly throughout the year. Tennessee residents need to contact local and state officials and demand the Constitution and Posse Comitatus be respected.

When I lived in Memphis I was in a major road block one time. The cops had the main road shut down and the traffic was backed up for a mile. I was expecting to see a bad car accident or something when I got up to the front of the traffic jam. Guess what, …the f---ing pig cops shut the 4 lane road down to one lane so they could walk up to the windows of cars to ask motorists for donations to their favorite charity. I called the police chief and asked if I could shut the roads down to ask for money but they told me, “nope.”

If you like this you need to come on down Interstate 24 West about 30 miles to Murfreesboro TN (ie Rutherford County). We have the boys from ICE (Interstate Crime Eradication unit). It usually consists of four to six white SUV’s that constantly travel east and west within about a five mile section of interstate. They pull people over for no real reason and then go on a fishing expedition (ie ripping the car apart in search of anything,). Based on what I have witnessed (hundreds of times), it usually involves a person of color, traveling in a nice car, and usually with out of state tags. They probably make three or four busts per month that involve a moderate amount of drugs, but that’s only after abusing the rights of HUNDREDS of citizens in the process. While I am not for the trafficing of drugs, I would much rather see a few pounds of pot or coke pass through the state, than to see everyone’s rights eroded away like these F’s do ON A DAILY BASIS. The country really is turning into a “POLICE STATE”. I would really love to see this get some media attention too. I really don’t think the loss of freedom we suffer as a society is worth the five pounds of pot and coke they are getting off the streets (or in this case the interstate)..

Stop and think, what is martial law? if the government suspends the constitution to declare martial law the government suspends its own authority. a declaration of martial law is an overt act of treason. the people created the government the government did not create the people. government only functions by our consent. Nowhere in the constitution does goverment have the authority to take total control, at least not by our consent. government can pass any law it wants but that law must be constitutional or it is void and unenforceable. The authority of government is well clarified in the constitution and the constitutional the limitations on that authority. If the constitution does not exist neither does any governmental authority.

I’ve seen the use of military with police officers here in California quite a few times. I have seen a police officer searching a fellow and very harmless looking college student whom I attend school with, while an armed military personnel searched his car. I was told by some one (though not sure if it’s true) that soon in California, the police will be using military personnel as “ride-a-long’s” so they don’t need a “search warrant” to rifle through your personal items and your vehicle. World War 2 Germany, here we come.

I say we use our own posse comitatus act, and use our “militias” to do some “check point” searches and evaluations on policeman and military personnel, and set up “check points” in front of the white house, and any vehicle that comes in, or goes out gets a nice random searching.

Well if the police is harrasing the traffic AND breaking the law – you will have to conduct a civil arrest on them. Inform them of time, place and reason for their arrest. In addition read them their rigths. If they do not follow orders – you have the right to use appropriate force to maintain the arrest.

I have already been down that road, a citizens arrest is perfectly legal but you are required to turn the person over to law enforcment, then you get arrested by the assholes that you turned the police officer over to and he goes free. they tel you if you ever do that again you will spend enough time in jail to change your mind, without charges. it hapened to me.

Doesn’t Posse Comitatus prohibit “federal” troops from being used to police civilians? I understand that the “one force” concept and doctrine is more or less preparing to federalize the guard (allows for it in “emergency” conditions already) but at the moment that has not been unilateraly put into effect yet. Until it is, these guardsmen are state troops and are legally allowed to assist civil authorities (as militias could, but not regular army, in the days before the guard was estblished) if they are requested to do so. It is troubling that state officials are claiming not to know – either they’re lying to spare assocition with something really unpopular with the public at large, or those that set this up did so quickly an quietly enough to by draw attention until it was happening or done. Not knowing the state’s procedure for these things I can’t say what the legality of it is, but I’d put money on odds that these things are supposed to go through the governor’s office. If that’s true someone needs to explain this! And these happening are very alarming indeed and we have every right to be upset and worried. Legal or not, full check point style stops with any form of military without a REAL reason and need IS a huge problem!

It has been said that Bush jr. had suspended the Posse Comitatus Act, and all of other things. but this in particuliar. ok, now its been said if we have two governments then we have two constitutions. one still is and has not changed and thats the organic constitution. the other one is a corporate constitution to manic the O.C. and they can’t change it because they dont have the authority but by illusion they make us believe that they did. in fact they can do what ever they want without our consent, and thats why they have been able to get away with everything and anything, because they are corporation diguise as our government. and they are not. They are run by the bankers. therefore, they violate the Posse Comitatus Act without concern for repriasel, because who is going to bring them in.? well there is on branch of government that has hardly says a thing. and that we the people. we as sovereign have that right and is guaranteed by the laws we sent in motion since the conception of this country.
