Mukasey Denies Request for Special Counsel to Investigate CIA Interrogators

Attorney General Michael Mukasey has notified the House Judiciary Committee that he will not appoint special counsel to investigate the actions of CIA officers and agents who conducted detainee interrogations that included controversial methods such as waterboarding, which simulates drowning.

The controversial interrogation practices were authorized by lawyers from the Justice Department’s Office of Legal Counsel.
In a letter to House Judiciary Chairman Rep. John Conyers, D-Mich., who had requested special counsel on the matter, Mukasey noted that “it would be unwise and unjust to expose to possible criminal penalties those who relied in good faith on those prior Justice Department opinions.”
Referencing “The Terror Presidency,” a book by Jack Goldsmith — former head of the Office of Legal Counsel — Mukasey said that the intelligence community was exposed to “cycles of timidity and aggression.”

Why the heck is it unwise and unjust to expose criminals? Don’t hold the personnel following orders responsible. Hold President Bush, Chenney, and any other high-ranking officer accountable who gave the orders for the illegal and war-crime torture!
Grant the CIA operatives immunity from prosecution and go after the real tyrants and criminals, starting with Bush. Hiding behind Justice Department opinions is one of the greatest farces and cop-out legal justification of war-crimes imaginable.

Justice Department Opinions? They were not opinions they were ORDERS carried out via the chain of command through the Justice department to the CIA.
It’s like saying at the Nuremberg trials: “it would be unwise and unjust to expose to possible criminal penalties those who relied in good faith on those prior [NAZI] opinions.”
In short: if you carry out unlawful orders you should be exposed to lawful “criminal penalties”. Everything is a word game with these bastards.

Isn’t that the job of juries to determine who “relied in good faith” and whether those prior Justice Department opinions” were legal in the first place? I know there was lots of talk of CIA officers wanting immunity if they followed what they thought, at the time, to be clearly illegal and criminal “Justice Department Opinions” –
So it the Justice Department issued an opinion that all Christians should be rounded up and interred, and then starved to death and their bodies cremated in vast ovens – wouldn’t this same reasoning exonerate “those who relied in good faith” from prosecution? Of course it would. Wake up. Look around you, at your leaders. This is what it was like to live in Nazi Germany.

Torture is a cruel and unusual punishment. Torture cannot be justified as it is illegal under worldly and divine laws. “those who relied in good faith on those prior Justice Department opinions.” Relying in good or wicked faith on anybody’s opinion is not an excuse to commit atrocities. Every person is responsible for his actions therefore the only reliance should be on one’s own conscience. If you were commanded to do something disorderly then disobedience is the righteous course. Ignorance in obvious matters is also not an excuse. Examining the subject from varying manners the logical conclusions seem to condemn torture. One would assume that the reason behind calling it inhumane is because it is not in humans’ nature.

11 Bob in Colorado, I enjoyed your lightening of the narrations of the situations to make them easier to handle. You say, “Depending on skills and determination your results may vary.” I think you meant “Depending on your skills and determination levels results may vary.” I could be wrong so I’ll consider what you said first then what I think you meant latter.
Your statement assumes that the outcomes of the events depend on two things, skills and determination. The world is dynamic. In any incident many factors come into play. Let us assume that skills and determination provide you all the support they can but frustration joined the mix and hindered them weak. What then would be the outcome?
Even if you had the highest levels in all traits known to us and your luck got stuck you could end up as a dead duck. The only factor that overrides everything else is The Almighty’s Will. That doesn’t mean not to be prepared and hone all the good traits we can. The All Able commands us to do so.
