Oakland Cops Want to Search Without Warrants

A six-month pilot program where Oakland police officers would knock on doors and ask permission to search homes for guns got the green light from the City Council’s public safety committee Tuesday night.

It goes to the full council Tuesday, when the council will meet at 6 p.m. at City Hall, 1 Frank Ogawa Plaza.
The consent-to-search program, as it is called, is based closely on a similar effort launched in St. Louis in 1994 and on ongoing programs in Boston and Washington, D.C. The idea is simple: To ask parents for permission to search their homes for weapons their children may be hiding.
Under the program, officers would request permission to search homes for guns. Guns would be taken away, but officers would not pursue prosecution unless the weapon was tied to a crime.
The St. Louis effort fizzled after initial success, but Oakland’s Deputy Police Chief David Kozicki said that in Washington, police officers say they cannot keep up with requests from parents to search their homes. Such is the interest in the program, he said.
Councilwoman Patricia Kernighan (Grand Lake-Chinatown), who is on the public safety committee, said she was surprised to hear that and hoped Oakland might see the same results.
“I think it’s worth trying and seeing what the community reaction is,” she said. “If it’s embraced as a way to get guns off the street, great. If people don’t want to cooperate, then we don’t continue the program.’

they just keep pushing. i have noticed lately that there are two(2) things they keep pushing…
1) gun control – under many different disguises
2) federal ID cards – under different names and purposes. most of us have heard about the Real Id Act. after many states shot that one down along comes the Social Security ID card(just read about it the other day)

I agree and disagree with this tactic. I live in San Francisco acroos the bay from Oakland and I cant tell you haow many arcticle I read about gun violence in Oakland. Its literally everyday someone is getting shot, or someone is geting killed. The violence has reached very high levels in Oakland and is spilling over into SF. Not cool, people are staying indoors and afraid to leave their houses, even social workers are staying away from the elderly in violent neighborhoods.
I disagree with the tactic, but I also see the positive side to it…..and I AM against the police state, in case you are wondering.

Hell if I lived in Oakland I would DEFINITELY be packin, do to the FACT that it(oakland) has a high percentage of poor minorities in substandard housing. Mix in the fact that drugs are prevelent in such communities, which brings in more crime due to supporting their enslaving habits which therefore leads to higher homicide rates. I still dont agree with cops comin’ in to search for weapons. Its unconstitutional. But then again, how many poor drug addicted black folks really read the constitution??? Maybe these guys are just making a profile of each house. They want to see which house would allow the search and which house doesn’t allow it. You are partly right VP Cheney fan. But this is a dumb idea, all this will do is make it possible for police to search your house without a warrant under the guise of looking for a weapon that a child may or may not have. If any of you noticed, but much of this is being tried in heavily minority areas. The parents thing this is a good idea because they believe that it will control their kid, wrong. They don’t think that this is a tool that will be used against them in the future. They know this wouldn’t fly in a more “white” area or economic sound area because people would be able to see this as what it is. By them doing this they are wanting to set a precedent so that it will make it possible for congress or the Supreme Court to okay searching a residence as long as the owner of said residence says it’s okay.
Here’s something that should be considered, the reason why they have to go to court and get a search warrant is that they believe and have evidence that a crime or instruments pertaining to a crime are in an area. They go in front of a judge (at home or in court) and show the evidence and swear on it. This way it locks in the police from the get go about what they thought. Now since they won’t have to go to court for a warrant, it’s your word (mother, father, residence owner etc.) against the cops when they say that you gave them permission to come into the house. It’s a tool to unburden the police from proving their suspicions and a tool to burden you into trying to prove that you said no to them coming into your house.
In a fascist dictatorship and police state, they always trot out that such and such is for the good of the kids or the family or the “Fatherland, Homeland whatever”. This way it makes it hard for a person not accustomed to debate or freedom to dissent to challenge them. Because they would think that they are on the bad side of the argument and don’t want to look bad to their peers or the public. A black scholar years ago made a comment that the govt. always tries out their new ideas and/or laws on the minorities poor and disenfranchised first before they do it to the majority in the country. The reason is they know americans better than we know ourselves. We are a very intolerant society (it’s better but still intolerant) so by focusing these on faces that they deem as “not them” they can say sure go ahead they won’t ever do it in our Joe and Jane suburbia. But they are wrong, because once they are done with “them” then they come after you and there is nobody to fight for you then.

I feel I must reiterate this again, I am not for a gun ban, I am not for this type of police measure, it is unconstitutional. All I was saying in my first comment is that it could do alot of good in Oakland. I tell you that most of those caught with guns already have them illegally. If the police want to go after those that have illegal guns then by all means they should. You can still refuse them searching your house.
I think people over-react sometimes to certain things going on in our world. I would love some of you to live in oakland and tell me they should do nothing. Two days ago there was a murder in the streets of oakland, the kid was 18. A lady lived right in front of where the kid was shot, who was killed by a stray bullet when she slept, that was meant for someone else who was at the street memorial.
The oakland police are in a huge bind right now, they are losing the streets to unruly thugs.
Again I say that it is wrong for them to search your house without a warrant, but they are asking. And parents are afraid of their kids, if they allow the police to come in then that is there own right. Yes the police state is bad, but maybe it will actually help a city that has almost 50 homicides already this year.

You know, the searching without a warrant goes on all of the time. I was pulled over a couple of years ago in california for my tail light being out. THAT WAS ALL that was wrong. But the two police officers treated the situation as if I were some kind of a major criminal. He asked me if I knew my tail light was out. I said “no”.
Next thing I know, he’s saying “Please step out of the car”. I said “What for?”
Here comes another police car. I’m thinking to myself, why are they acting so aggressive? What is the need for back up?
I’m just a middle aged woman all alone and it’s 10pm at night. Dark out.
They did not ask to see my license, insurance, nothing. They asked me to sit in the cop car while the took apart my car. I sat there and watched them go through my purse, my wallet, my prescription meds. Etc.
When the cop came back and sat in the car, I asked, “Why are you going through my whole car? What did I do?”
He said, “This is just routine. You’ll be on your way in a minute, if everything comes back fine. Do you have a warrant?”
I said, “Absolutely not”
Once everything cleared, they let me go.
Now someone please tell me, what was that for? Why was that necessary?
I remember a traffic stop back in the 80’s where the cop could hardly be bothered but to write a ticket and send me on my way.
Now they treat common citizens like we are criminals. Believe me, this incident messed with my head awhile. AND they do that on purpose.

That was illegal of the cops to search your car without your permission or a warrant. For them to ask you to step out of your car without informing you of their intent was illegal. Everything about the encounter was wrong.
I had a similar thing happen to me while driving through northern California once. They pulled us over because my license plate light was out. (????) They told us they were going to search the vehicle and I was 19 at the time, not aware of my rights and complied because I figured “I’m not doing anything wrong, don’t have anything illegal, so I’ll let them search the car.” I later realized that it doesn’t matter if you don’t have anything illegal, it’s wrong of the police to search your car without a warrant. They can do it if you give them permission and they will make it seem like you’re doing something illegal by not allowing them to search. But it is a violation of your rights.

If they knock on your door don’t even open the door. It’s your home you are responsible for what happens in it.
Parents should be parenting their children not the police. If there is a gun in the house it is the parents job to find it and deal with it. If the child has a gun in the house in the first place it is due to their failure as a parent and they need to wake up and deal with their child properly.
If I had a kid and he/she had a gun it would be quite along time before he/she ever left the house again other then for things like school and work and so on. Even then that child would be watched the entire time they were out of the house or in it for that matter. It would be house arrest x10.
I am not against guns I believe every responsible adult should have one and they should teach their kids how to properly and safely handle them but kids should never ever ever have guns their parents don’t know about and if that kid does not display responsible, mature behavior, and good moral choices he should not be allowed to handle a gun either.

This implies that the parents are too inept to search their own homes! To: #121- I live in Florida and did exactly what you suggested. I was arrested for “making a false 911 call,” shoved onto the ground in my nightgown (which blew up in the air) and brutally bruised while handcuffed. The case was later dismissed by the judge. The police wouldn’t let me lock my house, and after they took me away, the immediately went into my house and searched it. No warrant, no reason. When my neighbors (who watched everything in horror) came over and asked the “police” what they were doing…the cops said “You better get out of here and shut up or you’ll go to jail too for obstruction and interfering with our investigation.” This is not all to this story, but it is all I can stand to talk about. It disguists me when cowards who call themselves men only pick on innocent women and children. I have never been a coward and nothing is more revolting than dishonest, bullying cops.
