Obama Administration Begins Opposition To States Claiming Sovereignty And Gun Rights

The several states are lining up to reclaim their sovereignty and telling the federal government to butt out. This is being done in myriad ways but all are related in that most claim that the Tenth Amendment protects the states from federal tyranny. States are passing resolutions, memorials and two states have passed laws and they intend to apply those laws for their citizens. The two states are Montana and Tennessee.

It was expected that at some point these laws would be challenged and it appears actions to do such has begun. The Federal Bureau of Alcohol, Tobacco, Firearms and Explosives has published open letters to federal firearms license holders in Montana and Tennessee explaining that
federal law trumps state law when it comes to gun laws.“As you may know, federal law requires a license to engage in the business of manufacturing firearms or ammunition, or to deal in firearms, even if the firearms or ammunition remain with the same state. All firearms manufactured by a licensee must be properly marked. Additionally, each licensee must record the type, model, caliber or gauge, and serial number of each firearm manufactured or otherwise acquired, and the date such manufacture or other acquisition was made. Firearms transaction records and NICS background checks must be conducted prior to disposition of firearms to unlicensed persons. These, as well as other Federal requirements and prohibitions, apply whether or not the firearms or ammunition have crossed state lines.
In a report filed by CBS News, it seems to indicate that even though these states are claiming sovereignty under the Tenth Amendment, the Federal Government may have power over such gun laws as the Firearms Freedom Act, via the Commerce Clause.
Read literally, the Tenth Amendment seems to suggest that the federal government’s powers are limited only to what it has been “delegated,” and the U.S. Supreme Court in 1918 confirmed that the amendment “carefully reserved” some authority “to the states.” That view is echoed by statements made at the time the Constitution was adopted; New Hampshire explicitly said that states kept “all powers not expressly and particularly delegated” to the federal government.
More recently, federal courts have interpreted the Tenth Amendment narrowly, in a way that justifies almost any law on grounds that it intends to regulate interstate commerce.
World Net Daily points out in an article of their own that the Montana Firearms Freedom Act bill declares that Congress has not “expressly pre-empted state regulation of intrastate commerce pertaining to the manufacture on an intrastate basis of firearms, firearms accessories, and ammunition”.
I have been saying for some time that all of this will eventually wend its way through the courts ultimately landing at the feet of the United States Supreme Court. This is one reason the approval of Sonia Sotomayor as a Supreme Court justice is vitally important, especially due to the fact that she is anti Second Amendment and has shown little regard for the original intent of the Constitution.
Also at issue in this debate are pending lawsuits challenging gun laws in other states. Chicago’s gun ban is being challenged after the District of Columbia vs. Heller decision reaffirming an individual right to keep and bear arms. The Seventh Circuit Court of Appeals has ruled that federal gun laws do not pertain to the states, a position taken by Sotomayor.

While we are discussing the Fourteenth Amendment, the Second Amendment and Ninth and Tenth, the BATFE is sending out public letters, assumed to be authorized by the Obama administration, to federal firearms dealers in Montana and Tennessee, stating that federal law supersedes state laws, at least as they pertain to firearms and ammunition.
Where will this all end up? I believe the Supreme Court but I know not how long this may take. In the meantime, the Obama administration, made up of mostly anti-gun people, are grasping to gain control over your right to keep and bear arms. From the day Obama was elected, the people rushed to stores buying up guns and ammunition at unprecedented rates. With the combination of a new president and staff known to want to ban gun and gun sales and the District of Columbia vs. Heller ruling, it has helped spur more laws to relax gun restrictions. This, I am positive, angers the Obama administration.
None of this comes as a surprise to Gary Marbut, President of the Montana Shooting Sports Association. Marbut was directly responsible for the Montana Firearms Freedom Act. In a letter sent to his members of MSSA, Marbut points out what he views as little concern over the letter and how it was expected.
1) The letters are addressed only to FFLs and purport to assert authority only over those licensees already under the federal thumb because of their licenses. We’ve always assumed that people with existing FFLs would not be players in the state-made guns exercise because they will not wish to risk thwarting the earned reputation the BATFE has for vindictiveness. The letters are not addressed to non-FFLs, those folks who are potential participants in the state-made guns business.
2) The BATFE letters may lack any official import because they are not signed by the official who appears in the signature block, but by some unknown other person. It’s difficult to place much credence in a missive upon which the purported issuing person is unwilling to put his signature, and for which the signer is unknown.
3) The essence of the letter is a declaration that the laws that the BATFE enforces supercede the U.S. Constitution and the Tenth
Amendment. I understand that the BATFE hopes that is so, but that’s far from proven yet. (We still recommend that nobody make these state-made guns until we can litigate and vet the principles involved.)4) The letters, if they are official even though unsigned by the issuer, will help us establish standing to get this issue squarely before the federal courts. The feds have thrown down the gauntlet.
I like Montana’s approach to their action in the creation of their Firearms Freedom Act. They are proactively seeking to bring this issue to the courts for a ruling. They believe in their own state’s constitution and that they, according to their contract with the people and the United States Government, have the sovereignty and freedom under the U.S. Constitution, to make their own laws in matters such as this.
This will be a long and drawn out affair but one that is ripe for a good battle. Let’s hope this battle arrives before Obama can stack the Supreme Court with more anti-gun “empathetic” justices.

Whatever. I’ve been looking at a lot of these websites today for one article: Obama taking on the thuggish police actions involving the Harvard prof. NOT ONE!
Why not? Because the article does not make sense if you only see the world in the Us vs Them mode. So many articles are about how the govt is giving the police the power to come in your house, steal your guns, kidnap your kids, and impregnant your wife with thier huge, NWO junk.
So when the President calls the police actions in this case out of line, how does that affect your pre-conceived notions of how the world works?
Not one article on these websites about this story. A president standing up to the jack-boot cops, and not one story!!! Please, infowars is just as bad as Daily Kos: they just report the world view of it’s auidence.

Keep up the fight! I often feel like our situation is hopeless, but its not. If you don’t know what to do, write your congressmen, (you should only have one in the House representing your district,) and your senators (You should only have 2 for your State), and that’s it! Easy.
Still, another idea is to join the NRA. Seriously. $25-$35 annual membership, or $1000 lifetime membership, and it comes with a free magazine subscription. Let them do the fighting for you, just help them financially. You won’t find a better group dedicated to the Constitution. Join your children early for lifetime memberships at $500 each!

The facts surrounding that Harvard professor are not clear. From the one story I read, it sounds like much of the problem was precipitated by the professor. He had to break into his own house. Okay, that happens. Nothing wrong there. But when the police show up and ask you for identification, you better damn well show it. You can’t just say, “I live here, I don’t have to show you anything.” (I am paraphrasing). Under those circumstances, it is justified for an LEO to request identification. Race has nothing to do with it. There is nothing to report. Sorry, but Infowars is not biting on the race baiting propaganda.

Mr gates was frustrated and started yelling at the cop the cop asked him to calm down MR gates brought up the issue of race by saying that ur doing this because im a black man in america. NO the cop went there to investigate a breaking an entery asked for an id didnt say anything racial. peopel are saying well the cop should have known that he was irate and should have left after establishing his identification. well the prfesser should have calmed down and realized that the policeman was responding to a 911 call about a robbery in progress. and be happy that the police did their job. people have ben usuing the “WHAT IF” scenerio today all day saying if he was white this wouldnt have happened. this is entirely false if any citizen violated the law the get acted on the same way regardless of color. As far as information is concerned I got rid of my Satellite dish – I refuse to pay for literally a 12 inch sewer line that runs into my livingroom. Unlike piped in TV the internet is like an ocean with polluted and clean waters and you get to choose where to swim. I enjoy people becoming the media and reporting firsthand what is going on. And remember that California, on its own, would be one of the biggest, richest, most powerful countries in the world. So there is indeed a foreigner running one of the most important countries in the world, which is California. That, and 10 million illegal aliens in California alone, and look what a mess we are in now! California has become a crowded, polluted, sweltering, bankrupted cesspool, and all in the space of my lifetime! When I was born, California had just 10 million residents. Now it has nearly 40 million. It used to be known as being politically conservative, now, thanks to massive legal and illegal immigration allowing the importation of collectivist mindsets, to the point of completely displacing the formerly individualist population, California is a lost cause, with more long-time residents leaving for other states than Americans from other states coming here. But still the mass influx madness continues unabated. Seems that so long as it is better being unemployed here than elsewhere, they will come, making jobs irrelevant.

I remember the California you remember before the public employee unions and illegals took it over. Anyone hard working and honest is screwed in this state. I can hardly wait to leave – have a house to sell first so it could be awhile. Anyway, it will be interesting when all the taxpayers leave or stop working and the public employee unions and illegals have no one to suck off of anymore, what will happen then? Damn straight!!!! A little unknown fact about jury trials . . . .IF THE people of the JURY DEEM the laws they are supposed to enforce UNCONSTITUTIONAL then indeed THEY are not bound by SAID LAWS and can enter a verdict THEY see fit.
Too many times judges instruct jurors of the law telling them THEY MUST DO THIS OR MUST DO THAT. It is time to take back the country and enforce the CONSTITUTION. If ANY law is deemed unjust it is UNJUST. From here on out if you ever are a member of ANY JURY please remeber these facts. Act as if the Constitution is your guide and NEVER ever ENFORCE an UNCONSTITUTIONAL LAW!

I spent there days in trial court do to a cop that thought it was illegal for me to pass him on the street. Verdict. Not guilty. The cop lied, the jury knew he lied. I picked him apart bit by bit. But you never know till the jury is in.
I hope that you dont ever experience that but if you do you will wish the jury to have the moral authority to do the right thing and distinguish truth from fiction and the fortitude to stick to their GUNS, pun intended.

You will find out that any one charged with a crime that is brought before a jury can not only have that charge dismissed, but any “law” deemed unconstitutional by any jury can be declared so and the law can be repealed BY THAT JURY!! “They” harrass public defenders who try to bring this up to seated juries and some attys. have been brought into the Judges chambers and threatened if they try to disclose this to the juries seated in the trials that are going on. http://www.fija.org/ is the link. You are talking about “jury nullification”, and it is the principle that the job of the jury is not just to judge the facts, but to also judge the law itself. The jury has the right and power to nullify ANY law, if it feels that doing so is necessary for JUSTICE, which is the entire point of having laws, courts, judges, and most of all, juries.
But many judges will not even allow the words “jury nullification” to be spoken in their courtroom, and if you even ask about it, they will instantly disqualify and dismiss you from the jury, just for asking. I have considered changing my legal name to “Jury Nullification” so that if I am ever in court, they cannot avoid the issue, because they must speak my name in order to conduct any case against me. Surely, having such a an usually name ought to make the jury and everyone else in the courtroom curious as to what it means.

You are exactly right! That is why the current legal system calls them trial BY jury. Meaning, literally, the actual commercial court is having the hearing by/close to/near a jury. A Jury trial is the lawful way, the trial by jury is the commercial way.

That would be every law on the books because the US (sic) Supreme Court has ruled that every law must have an enacting clause or statement on the face of it – that is so WE THE PEOPLE can know by whose authority the law is given – if not then it is NULL and VOID! Most state constitutions have this written in as well. Iowa for instance says that the style of the law shall ‘be it enacted by the general assembly of the State of Iowa.” At the end of their constitution it say “If any any law does not conform to this constitution, it shall be deemed NULL and VOID.’ Hmmm … I wonder if we can charge them with barratray?

Talk is cheap, sooner or later the people will have to go to war with the government. I say it just as well be now. You think I am crazy, this has been predicted back in the late seventies, and just recently a senior Russian wrote a paper on the dissolution of the USA by the second Civil War. It’s not if it will happen, but when. My assumption will be the early morning hours when they start breacking down doors confiscating guns. These will be the first shots fired in the next civil war.

It’s the next logical step up in gov’t. I can see states passing some laws that take some power back, but not total sovereignty. The state where I’m at has gun laws that are for the state citizens. 1. The resolution postively states that if Federal troops are sent to

People have to wake up and realize that we are sovereign because we were born that way. Before the federal government, there were the states. Before the states, there were the people. That which is created can never be sovereign over that which was its creator.
WE the People created the states, and delegated powers to them, which could not have occurred unless WE were the sovereign. The States, acting in our behalf, formed the Federal government, and delegated to it certain limited and specifically enumerated powers, via the constitution. This could not possibly have occurred unless the states were in fact sovereign over their creation, which was the federal government.
The natural order of things, in descending order, is God, man, and then government. Governments are not the sovereign over man, just as man is not the sovereign over god. Each must serve their Creator, because they own their very existence to them. Man must serve God, government must serve man, and the federal government must serve and protect the states, not rule over and dominate them.
When the federal government no longer serves the states, and the people whom the states were established to serve, then it must be abolished. Like Frankenstein’s monster, the creation has run amok, believing itself to be the sovereign, and so, as a usurper of power, and a danger to the creator it was created to serve, it must be burned alive, by burning down the entire castle, if necessary.

Yes! Thank you for stating the truth about Lincoln and the reason for the Civil War.
I taught in a private Christian school for 3 years whose history books, starting in 2nd grade, lauded Lincoln for his anti-slavery campaign. I spoke the same truth as you mention in your post. I also refused to display posters of Lincoln on the grounds that he went against the 10th amendment. The high school students at this particular private school were very inquisitive about my reasons for not agreeing to his ‘greatness’ stating that, “Lincoln ended slavery and kept the United States from separating which would have weaken our country; is was for the greater good.”
The teacher education classes taught at the college I attended also pushed the anti-slavery rhetoric through instructional materials and tests. Very little is mentioned about states’ rights as the true reason the North and South fought against each other.
Nevada joined the Union in 1864 in a rushed manner just so Lincoln could gain votes he needed to win his second term as president of the U.S. in order to continue going against the 10th amendment. Very shady piece of history seldom spoke of.

The National Guard will be subject to Federal control. A real state militia (ooooooh) is what is needed. One that is within the authority of states constitutions and cannot be federalized. The national guard is already under Fed Control, look at one of good ole GW’s John Warner Defense Auth Act which gives the president power to take over the National Guard and declare martial law when the states give them too much grief. It also overrides the posse comitatus act Section 1076. It basically gives the POTUS unlimited power. This will be hard to beat. It will take ALL of the men in each state to take arms and protect their state.

Exactly what I have been saying for years now. People I know in my area do not believe this. And so true as to the federal government has been overstepping their boundaries for enforcement of what they want. People need to see that none of those agencies where actually formed in the United States. They were in fact formed in washington D.C. A.K.A. district of columbia. Which means they have very limited authority in actuality. But due to fear most people let them enforce where they should not be. They can only do it under limited circumstances but practice all circumstances. Which in effect makes them law breakers. Hmmm..sounds similar to the DHS standards for their definition of a terrorist. Say can we put them on the possible terrorist list too?? But I for some reason think they are exempt from this no matter what behavior they display.

As for the bigotry and issues about slavery I agree with you that they may very well still be an issue today without the civil war and the FED’s. The real issue is the powers behind the scenes have always started racism to divide and conquer. The lesson is that you really do reap what you sow, and because of that our country is where it is today. It is sad because we have never experienced what the constitution has to offer.

I’m all for secession and the establishment of a dual federalist republic in my state once it secedes. If Wisconsin refuses to secede, I’ll move to a state that has the pills to do it happily enough. However, I will point out that Congress uses something called the 13,000:1 ratio, which means that for every person that calls in to voice an opinion, they assume that 12,999 of their constituents were too lazy to be bothered with calling.
While these folks are certainly freemasons and interested in crushing freedom, they have to stay elected in order to do so, so their “prime directive,” if you will, is to get re-elected. It doesn’t take very many people calling to complain to milk that 13,000:1 ratio. Figure out how many people are in your senator/representatives constituency and then divide by 13,000. That’s how many people you need to get to call in and complain. Then start a site with a counter that lets people leave a comment confirming that they have called or e-mailed (don’t bother with letters, they get screened for anthrax and never end up getting delivered half the time).
To give you a feel for how effective this can be IF YOU ORGANIZE IT, let’s say your congressman has a constituency of 1,000,000 people. 1,000,000 / 13,000 is approximately 77 people. If you can find just 77 people in your entire district that feel the same way you do and get them to call, you’ve got some major change. Heck, even if you only find 40, that’s a majority due to the 13,000:1 ratio.
I don’t think that isolated efforts will have any effect on Congress. I DO think that organized, group efforts that produce obvious majority opinions will. It’s up to you guys what you do.

While it is true that Lincoln fought against the European bankers who were behind starting and financing both sides of the Civil War,
No government or politician EVER gave power to the people!
In America, at least, the government DERIVES its delegated power FROM the people. It has never had any power of its own to give to anyone.
Those who believe that government has ever empowered anyone are the poorest possible students of history, and of the founding and principles of the U.S.A.
While Lincoln did indeed oppose the bankers, or at least appeared to do so, he did however violate the constitution in many other ways, especially concerning states rights and sovereignty, and the strict constitutional limitations of federal jurisdiction.
Several constitutional amendments, including the 14th Amendment, were never lawfully ratified, because the states were either at war or under military occupation. You cannot possibly achieve a lawful super majority of the states necessary to pass and ratify a constitutional amendment, if so many of the states do not have freely functioning and democratically elected representatives to cast their votes. As such, no constitutional amendment passed under conditions of federal occupation and martial law can be said to be lawfully ratified.

I think we would have seen these rights issued to women, and african americans etc. Think about it some states would not have slavery (ie. the north) some states would let women vote and grant the rights you speak of. What are all the oppressive states going to do when 80% of their women and 80% of the slave force move to more freedom loving states? They will either parish in economic turmoil or higher free men to work. They will either suffer mass population reduction from lack of child producing marriage or allow women rights. The point is when people see freedom somewhere else they tend to migrate to it because people innately love freedom. When a state suffers heavy losses due to its lack of freedoms it must, if it wants to survive, also offer the same freedoms as the other states. So, I don’t think that we would still have slavery or oppression based on gender.

Of course they can. You gave yourself up by getting a permit. Now they have your name, address, signature, picture, SS#, fingerprints etc. So does your local police, state police, FBI and all the other agencies they share information with.

I have a few problems in the wording in that Act. But I won’t get into that now.
From what I can see, the Patriot Act, John Warner Defense Authorization Bill, Veterans Disarmament Act, to name a few, pretty much takes care of the Dick Act 0f 1902 as well as the Constitution. It isn’t legal but they’re doing it. And not a lot of people have the funds to take the fight all the way to the U.S. Supreme Court (which I believe has been infiltrated by Communists/Globalists).

This is nothing more than the old “left vs. right” false front. Create two seemingly opposing factions and use them to deceive people into joining one camp or the other, both of which support the same agenda. Fact One: Yes, those on the “left” want to disarm you. Fact Two: so do the people on the “right,” but they pretend to be the opposite. They support, and draw support from groups like the NRA, Gun Owners of America, etc, all of which support the same agenda: the eradication of gun rights, while making the pretense of defending them.
As I have pointed out here, again and again, the ONLY way to restore the Second Amendment’s protections of our existing right to self-defense is to REPEAL all existing gun laws and never pass any more of them. Period. Anyone who says they are “supporting” the Second Amendment, but who is advocating new laws that only add to the hundreds already violating the Second Amendment, is a traitor, at worst and an unwitting dupe, at best. The useful idiots who join the NRA don’t even know they are supporting the very opposite of what they think they are supporting. The NRA has consistently backed gun laws while pretending to oppose a few, now and then, for show. But, somehow, these laws usually wind up getting passed, anyway. Organizations like Gun Owners of America pretend to be “true” gun rights organizations, and issue occasional “attacks” against the NRA, accusing it of the same thing that GOA is doing. Both have consistently backed concealed carry permits, which are totally unnecessary (you already have the right to carry any type of weapon, any time, anywhere and in any way you wish without the government’s permission to do so) and only turn your existing right into a government-granted privilege that you must pay for and which can be easily removed. Besides that, conceal carry permits are a means of registering every gun owner so a database of them can be kept and shared by all law enforcement agencies. Yet, millions believe concealed carry permits are some sort of “victory for the Second Amendment,” when in fact, they another nail in the coffin of the Second Amendment.
The short answer to this is: don’t support EITHER “side” in this conflict, because BOTH are after the same thing. Instead, demand that they campaign for the immediate repeal of all gun laws. Then you’ll see who these people REALLY are.

The states have no business being in the marriage business in the first place. Marriage is historically a religious institution, engaged in for religious reasons. Only in recent times has marriage become more of a business venture for the entitlement to certain government benefits.
Marriage, as a civil contract is one thing, but marriage based on one’s religious beliefs are another. Everyone is indeed able to marry who they please, and the government is free to recognize it, or not, for the sake of dispensing certain benefits, such as tax breaks.

In order to do that, get the judges oath on record, I believe you need to take your own court reporter. bielieve you need to get a certified copy of it. I believe that you need to know how to question him on his jurisdiction. The sixth ammendment says in criminal cases he must tell you the cause and nature of the charge.Is it a criminal or civil court? Under which jurisdiction on the Constutition is his court,common law or admiralty? If you can get him to say neither then you bring up his oath.Then if he says statuatory you ask where you can find the published rules of criminal proceedure for that jurisdiction. Whithout a reporter of your own and some witnesses he will probably throw you in jail. Heck, he still might.These guys are operating under color of law.
