Obama backs Bush: No rights for Bagram prisoners

The Obama administration, siding with the Bush White House, contended Friday that detainees in Afghanistan have no constitutional rights.

In a two-sentence court filing, the Justice Department said it agreed that detainees at Bagram Airfield cannot use U.S. courts to challenge their detention. The filing shocked human rights attorneys.
“The hope we all had in President Obama to lead us on a different path has not turned out as we’d hoped,” said Tina Monshipour Foster, a human rights attorney representing a detainee at the Bagram Airfield. “We all expected better.”
The Supreme Court last summer gave al-Qaida and Taliban suspects held at the U.S. naval base at Guantanamo Bay, Cuba, the right to challenge their detention. With about 600 detainees at Bagram Air Base in Afghanistan and thousands more held in Iraq, courts are grappling with whether they, too, can sue to be released.
Three months after the Supreme Court’s ruling on Guantanamo Bay, four Afghan citizens being detained at Bagram tried to challenge their detentions in U.S. District Court in Washington. Court filings alleged that the U.S. military had held them without charges, repeatedly interrogating them without any means to contact an attorney. Their petition was filed by relatives on their behalf since they had no way of getting access to the legal system.

This is positive news that Afghans don’t have any constitutional rights. If I had my way after we had finish interrogating & torturing them. We would just put them inside large oven for incineration even if they are still breathing. Don’t see the point of wasting bullet on them.

I agree that they don’t have OUR CONSTITUTIONAL RIGHTS, but they do have Geneva Convention protections that are ignored. Moreover, the evidence is overwhelming that OUR military is there to ensure bumper crops in the poppy fields. So, are these enemy combatants or people that don’t want to supply the world’s addictions?

The only reason the cowards in the US government felt it necessary to suspend these people’s rights is because if they put them through a proper trial, it will also be tantamount to putting their ridiculous and fraudulent war on trial. You’ve got nothing to fear with giving people due process and a fair trial if you are on the side of good. You have show trials, or no trials when your enemy has the moral high ground and you are left with grasping for straws.

Ask yourselves this, how many people assume these detainees are guilty of terrorism?
If they are guilty lets put them on trial and punish them accordingly, but if as i suspect they’re innocent then let them be free. Just because they live in poverty and have different beliefs to our own, it doesn’t give us the right to take away their liberty and freedom.
If this was happening with 18,000 of our people, who were locked-up in this limbo, with no end in sight we would be outraged, and rightly so. But this governemt has chosen to pick on the poor who have no voice, its shameful.
For all those who don’t give a damn about these peoples liberties while complaining about losing your own, i say this, “what goes around comes around.” How is it that we have become so inhumane, have we actually bought into this lie and deem these people as sub human, therefore they are not entitled to anything. Are we to treat them as savages to feed this governments lies, to further their cause, to eventually let them treat us in the same way.
It won’t be long before these indefinite detention centres will be coming to a place near you, enjoy your freedom while you can.

This is outrageous. Obama promised to close GITMO, now GITMO prisoners will be sent to secret prisons oversees. In otherwords the solution to GITMO according to Obama is rendition. So much for change, its more of the same. Its all smoke and mirrors, reshuffling GITMO detanees, thinking he can fool the American people into thinking the age of TORTURE and denying HABIUS CORPUS is over. When Obama signed executive order to end torture, I was hopeful that we had at least this positive change, now I see it was all a lie.
