Obama Signs Executive Order Barring Release Of His Birth Certificate

First, we did a story about an Army Major who filed suit regarding his deployment to Afghanistan on the grounds that Obama was not America’s legitimate Commander-In Chief.
World Net Daily thought highly enough of this article to link to it on their front page.
Then we did an article pointing out the differences between a Birth Cerificate and a Certification Of Live Birth.
Some of the biggest names in conservative news have weighed in on this topic, such as Michelle Malkin, Sean Hannity, Rush Limbaugh and numerous others have offered their opinions.

They are even running an online petition demanding Obama produce a long-form birth certificate.
Thanks to the alertness of our great friend and loyal supporter Erica, who gave us the heads-up on this. it appears that the issue of Obama being forced to produce a copy of his birth certificate may prove to be extremely difficult, if not impossible.
On January 21st, 2009, his very first day in office, Barack Obama implemented and signed into law Executive Order 13489.
For those of you who can’t take the time to read it. here is the section that applies:
“Sec.2
Notice Of Intent To Disclose Presidential Records
When the Archivist provides notice to the incumbent and former Presidents of his intent to disclose Presidential records pursuant to section 1270.46 of the NARA regulations, the Archivist, using any guidelines providied by the incumbent and former Presidents, shall identify any specific materials, the disclosure of which he believes may raise a substantial question of executive privilege.”
Now for all of you who commented on our previous articles that we were no more that right-wing nut jobs, that this thing about Obama’s birth certificate was a non-issue, and those of you who tried to shift the focus of the stories, doesn’t this strike you as just a little odd?
That the first order of business Obama took care of on day one of his Presidency was to sign off on an Executive Order that states that only the records he chooses to be made public will be released?
This is the subject that was at the absolute top of his agenda?
If this isn’t proof that Obama is hiding something, I don’t know what is.

You have to recognise that, he was notured by zgbiniew brezsinski right from college at columbia university where brezsinski was a professor. If there wasn’t a bigger force at play, he wouldn’t have gotten to the senate given his ineligibility.

Just the mention of “anti-christ” indicates a belief in the Bible, even, perhaps, Christianity. How about “thou shalt not murder” (Matthew 5:20-22 and Romans 13:8-10)? You should be praying for those who govern this country, down to mayors and city council members, etc.

If President Obama was not born in America can someone show conclusive proof as to where he was born? Hawaii IS America and further, had he been born in any other country in the world it would have aired long ago. This is a non-story and will go no where. Lets go to Section 1 of this Executive Order and look at the Definitions. For the purpose of this order:

(f) ‘‘Former President’’ refers to the former President during whose term
or terms of office particular Presidential records were created.
(g) A ‘‘substantial question of executive privilege’’ exists if NARA’s disclosure
of Presidential records might impair national security (including the
conduct of foreign relations), law enforcement, or the deliberative processes
of the executive branch.
(h) A ‘‘final court order’’ is a court order from which no appeal may
be taken.

SO now lets go to the Presidential Records Act, 44
U.S.C. 2201–2207.. And see what is the definition of “Presidential Records” and “Personal Records.”

§ 2201. Definitions
As used in this chapter–
(1) The term “documentary material” means all books, correspondence, memorandums, documents, papers, pamphlets, works of art, models, pictures, photographs, plats, maps, films, and motion pictures, including, but not limited to, audio, audiovisual, or other electronic or mechanical recordations.
(2) The term “Presidential records” means documentary materials, or any reasonably segregable portion thereof, created or received by the President, his immediate staff, or a unit or individual of the Executive Office of the President whose function is to advise and assist the President, in the course of conducting activities which relate to or have an effect upon the carrying out of the constitutional, statutory, or other official or ceremonial duties of the President. Such term–
(A) includes any documentary materials relating to the political activities of the President or members of his staff, but only if such activities relate to or have a direct effect upon the carrying out of constitutional, statutory, or other official or ceremonial duties of the President; but
(B) does not include any documentary materials that are (i) official records of an agency (as defined in section 552(e) of title 5, United States Code; (ii) personal records; (iii) stocks of publications and stationery; or (iv) extra copies of documents produced only for convenience of reference, when such copies are clearly so identified.
(3) The term “personal records” means all documentary materials, or any reasonably segregable portion thereof, of a purely private or nonpublic character which do not relate to or have an effect upon the carrying out of the constitutional, statutory, or other official or ceremonial duties of the President. Such term includes–
(A) diaries, journals, or other personal notes serving as the functional equivalent of a diary or journal which are not prepared or utilized for, or circulated or communicated in the course of, transacting Government business;
(B) materials relating to private political associations, and having no relation to or direct effect upon the carrying out of constitutional, statutory, or other official or ceremonial duties of the President; and
(C) materials relating exclusively to the President’s own election to the office of the Presidency; and materials directly relating to the election of a particular individual or individuals to Federal, State, or local office, which have no relation to or direct effect upon the carrying out of constitutional, statutory, or other official or ceremonial duties of the President.
(4) The term “Archivist” means the Archivist of the United States.
(5) The term “former President”, when used with respect to Presidential records, means the former President during whose term or terms of office such Presidential records were created.
Presidential Records does NOT include his Birth Certificate as defined above after the amended section has been added..
This purpose of this Executive Order 13489 is to Hide what a current President is doing while in office and and to Hide what former Presidents did while in Office NOT before they came into office…
IT HAS NOTHING TO DO WITH SEALING UP HIS BIRTH CERTIFICATE!!!!!

Doesn’t a birth certificate relate to and validate the president’s constitutional right to be president?
For me, the following section of EO 13489 is key:
Sec 3(d) If the President decides to invoke executive privilege, the Counsel to the President shall notify the former President, the Archivist, and the Attorney General in writing of the claim of privilege and the specific Presi-dential records to which it relates. After receiving such notice, the Archivist shall not disclose the privileged records unless directed to do so by an incumbent President or by a final court order.

But this Executive Order is dealing with “Presidential Record” and not personal records.. Look at What is covered under “presidential records.” IF you read subsection (B) below “presidential records” does not include (ii) personal records..

His Birth Certificate are “personal records” for they are not part of what is defined as “presidential records”

I read laws daily over 3 hours a day, being a small business owner who runs a company where we don’t require a SSN to come work for us, we are set up as a “NOT FOR PROFIT” company not a non-profit we don’t need permission from the IRS for a 501(c)(3) We have over 2300 workers and have been in business for over 10 years the IRS leaves us alone..
I am 55 year old and have never filed a state or federal income tax return the IRS leaves me alone as does the Franchise Tax Board….

I don’t read legal petitions on a regular basis but it seems to me that this definition of what constitutes a “public record” does not apply to a birth certificate as a birth certificate does, in fact, “relate to or have an effect upon the carrying out of the constitutional, statutory, or other official or ceremonial duties of the President,” does it not?
The fact that a birth certificate is listed under the rubric, “public record” which is not cited as pertinent to the president’s validity as being president sounds like double speak to me – not by you Jah but by the definition cited in 2201.
Here’s an excerpt from an article dated Aug 11, 2008, “Where is Obama’s birth certificate?” posted by Chicago GOP:
“The 14th Amendment defines citizenship this way: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” But even this does not get specific enough. As usual, the Constitution provides the framework for the law, but it is the law that fills in the gaps.
Currently, Title 8 of the U.S. Code fills in those gaps. Section 1401 defines the following as people who are “citizens of the United States at birth:”
Anyone born inside the United States
Any Indian or Eskimo born in the United States, provided being a citizen of the U.S. does not impair the person’s status as a citizen of the tribe
Any one born outside the United States, both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S.
Any one born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national
Any one born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year

If Obama was not born in Hawaii, he is ineligible. Even if he was born in Hawaii (for which we have no proof), the following above requirement from Title 8, sec 1401 would be pertinent:
“Any one born outside the United States, if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time).”
The article continues:
“Was Obama’s mother here for 5 years?
According to a legal researcher who has contacted AFP , U.S. law very clearly states: “If only one parent is a U.S. citizen at the time of one’s birth, that parent must have resided in the United States for a minimum of 10 years, five of which must be after the age of 16.” And therein lies Obama’s new problem.
Obama’s mother was born in Kansas and was only 18 when Obama was born. This means even though she satisfies the citizen requirement for 10 years, she was not a citizen for at least five years prior to Barack Obama’s birth. In essence, the mother alone is not old enough to qualify her son for automatic U.S. citizenship. At most, two years elapsed from his mother turning 16 to the time of Barack Obama’s birth when she was 18. His mother would have needed to have been 16 + 5 = 21 years old at the time of Barack Obama’s birth for him to be a natural-born citizen. Barack Obama was already three years old at the time his mother turned 21.”
I have not been able to find any other references to the additional legal requirement cited by this “legal researcher” mentioned in the article. Nevertheless, we’re still waiting for that birth certificate, which appears to be pertinent to me despite the legal doublespeak…………..

I don’t think this Executive Order is higher than the Supreme Court’s rulings; if the many lawsuits against O and/or the Democratic National Committee ever get that far. Someone check this fact: is the Judicial Branch controlled by Executive Orders under the constitution? …I would show logic that the validity of the office in itself ‘relates to or has’“an effect upon the carrying out of the constitutional, statutory, or other official or ceremonial duties of the President”…and would assure that a jury would also logically deduce that the validity has precedence in this situation.

Whatever is in section 1270.46 should be very thorough indeed, no loop holes.
This is indeed very wrong and suspicious…However the spelling mistake was a schoolboy error and highly unprofessional for such an important (and only) piece of evidence in the article…

Yeah I’ve seen all of alex’s videos, listened to him rant and rave on his show. I learned about this guy years ago. And do you know what? When I used to tell people about the things he talked about, I got bad reactions. So bad that it impeded the process of making benificial social connections. I agree with ‘ireadthepost’ – that the wording seems a bit opaque/murky/obscure — typical obfuscating hope-they-can’t-figure-it-out ‘legalise.’
But assuming that this is true, isn’t this kind of like signing an EO saying that you are above the law…? Or am I just a ‘bear of little brain…’? If he can do this, then he is evidently immune from any law – can just sign an EO saying so, as the need arises….
Speaking of EOs, how did it happen that presidents can now make law by uttering or writing it? I thought the law-making function was Congress’ domain. When and how did that change? Not by Constitutional amendment – so how? There are literally, I believe, thousands of EOs now on the books, none of them made or approved by Congress, giving the govt. total draconian powers just on the President’s declaration of an ‘emergency.’

I work at a occupational position that I am more or less verbally bashed all the time, but regardless how much I want to scream, “Hey, Some people gotta make a living too! .” I can’t. Why? Because that is a lack of class.
My occupational position is just a side note of my college life. My feelings most often do not blend well with the agenda intended in the survey interviews that I conduct on a daily basis. However, I feel what matters is the most is my own reactions to what is being presented in life and commending those who question the authority of the survey writers.
Most days, I work for practically peanuts… I don’t have the position of power to question those who write the questions for the surveys that I conduct. However, I do have the power to contact those who the subject matter pertains and voice my opinion to the proper avenues to attempt to right what is unjust.
In my occupation position, I am viewed with such hatred just as much as admitting someone works for the IRS. Regardless how much people try to get you down, you can’t let them keep you down.
I know this sounds selfish, but this is true…. You do not mind and those who criticize you do not matter. Mainly due to the fact those who criticize you fail to tolerate the evidence and appreciate it for what it is. We can only change ourselves, but people have to want to change themselves if they want to change.
Keep up the good work on finding wonderful evidence. Please still keep an academia classy respect to the work.

Just read the book of Revelation in the Bible! Or at least the left behind series… One world currency, new world order, master government super-leader, and somehow the Vatican is involved. With the Pope supporting Der Fuherer Obama and the new totalitarian government like he is, the “man of Roman descent” will probably come from the Roman church proclaiming to be “for the little guy” and to be for peace and good things.

Until he delivers PROOF of his citizenship he is NOT my president. He may have been elected but has not lived up to his oath and HAS NOT DONE ANYTHING for the good of the Country!
Any article/ item that has anything to do with a President’s private/former life before being elected should not be declared illegal to see. Why can we see his voting record but not where he was born?
We – The people – have to see these things so we can decide if things are right.
This does not mean a certificate of birth! Which has been online as proof Obama was born in the US
Hawaii will not accept any certificate of birth as evidence in its courts!! Should we???
This question is not new but was brought up during the primary but the Democrats turned all the light on John McCain with the same question. He gave the requested information but Obama did not!!

No matter what one says the EO 13489 means in legalize, it is highy suspect being his first EO as president in “the most transperient administration ever”.

I doubt it………” O.K., the issue is, not whether Obama should disclose it or not – the issue is that IT IS A PRESIDENTIAL REQUIREMENT IN THE CONSTITUTION TO DISCLOSE IT. There is no language that one person can “opt out” from disclosure. It does not matter who the president is; it is a constitutional requirement!

Much ado about nothing. Obama’s birth certificate, if there is one, is not a presidential record, and didn’t become one retroactively upon his inauguration. The executive order simply doesn’t apply.

This article is fraudulent. It does not say in that Executive Order anything about not releasing the birth certificate. It says that anyone who wants and receives Prez records needs to run it by either the incumbant prez or prior presidents. Can’t you read?

TOO LATE NOW! There are now some constitutional/legislative “theologians” who say that even IF the DemocRAT votes COULD be found to impeach him, that Obama is legally UNIMPEACHABLE, if in fact he is not a natural-born American. They say that, because then he would never have been eligible to hold the office in the first place, and so is NOT the President, and thus CANNOT be impeached! The articles simply would NOT APPLY to him, any more than they would to you or me. Meanwhile, he occupies the White House, sitting around smoking cigars, drinking Crown Royal, and flitting about on Air Force One. If true, HOW would he be removed from the White House? Perhaps via an ordinary EVICTION process? Don’t let the media bury this story!

I think it’s sickening that the leader of our country is not honest regarding his birth records. If he won’t share this with us, what else is he hiding and what else will he hide in the future!!!. I wish I could make an executive order that bans anyone that can not prove their citizenship, that they cannot be president. Oh, wait a minute, there already WAS !!!!!

Wow… I love how it is NEVER mentioned that EO 13489 by Obama was just restoring EO 12667….. ORIGINALLY PASSED BY REAGAN BEFORE HE LEFT OFFICE IN 1989! I guess Reagan wanted to hide his birth certificate too! Impeach Reagan posthumously! Ban him from the history books!!

Sorry to burst your demented bubbles but the Immigration and Naturalization Act of 1965, the law under which we currently operate, calls a natural born citizen anyone who was born in the United State, regardless of parentage — excepting diplomats — and any child born of a US citizen anywhere else in the world. It doesn’t matter where Obama was born, no one can deny his mother wasn’t a US citizen. This act was made retroactive to those born back to 1951 to override a cold war era law that had a stricter definition.

I wouldn’t call the ‘birthers’ “crazy” because that’s using emotionalism to counteract emotionalism; let’s approach the subject from the POV of logic; President Obama has produced a ‘certification of live birth’ from the State of Hawaii, verified by that state’s Dept of Health director Dr. Fukino and Regitrar of Vital Stats Alvin Onake; see: ; also see a more recent article ‘Obama’s Birthplace Questions Linger-Officials Try To Put End To Questions’ in which Rep. Neil Abercrombie, D-Hawaii “spoke of arriving in the islands 50 years ago and later befriending Obama’s father while at the University of Hawaii.” Where is the comparable proof that he was born somewhere else? All I’ve seen is some third-hand gossip.
By all means keep an eye on President Obama, ‘hold his feet to the fire’ but please let him do some good for the beleagered American people and stop throwing sand in his eyes and setting up this unwarrented stumbling block. Would you prefer a President Palin in 2012? for godsakes!
