    Steamed over a perceived increase in federal usurping of states’ rights, Oklahoma’s House of Representatives told Washington, D.C., to back off.

    Joint House Resolution 1089, passed by an overwhelming 92-3 margin, reasserts Oklahoma’s sovereignty under the Tenth Amendment to the U.S. Constitution, and, according to the resolution’s own language, is "serving notice to the federal government to cease and desist certain mandates."

     

    Charles Key, the Republican state representative who authored the resolution, told WND that he introduced it because he believes the federal government’s overstepping of its bounds has put our constitutional form of government in danger.

    HOUSE JOINT
    RESOLUTION 1089 By: Key

    AS INTRODUCED

    A Joint Resolution claiming sovereignty under the
    Tenth Amendment to the Constitution of the United
    States over certain powers; serving notice to the
    federal government to cease and desist certain
    mandates; and directing distribution.

    WHEREAS, the Tenth Amendment to the Constitution of the United
    States reads as follows:

    "The powers not delegated to the United States by the
    Constitution, nor prohibited by it to the States, are reserved to
    the States respectively, or to the people."; and

    WHEREAS, the Tenth Amendment defines the total scope of federal
    power as being that specifically granted by the Constitution of the
    United States and no more; and

    WHEREAS, the scope of power defined by the Tenth Amendment means
    that the federal government was created by the states specifically
    to be an agent of the states; and

    WHEREAS, today, in 2008, the states are demonstrably treated as
    agents of the federal government; and

    WHEREAS, many federal mandates are directly in violation of the
    Tenth Amendment to the Constitution of the United States; and

    WHEREAS, the United States Supreme Court has ruled in New York
    v. United States, 112 S. Ct. 2408 (1992), that Congress may not
    simply commandeer the legislative and regulatory processes of the
    states; and

    WHEREAS, a number of proposals from previous administrations and
    some now pending from the present administration and from Congress
    may further violate the Constitution of the United States.

    NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES
    AND THE SENATE OF THE 2ND SESSION OF THE 51ST OKLAHOMA LEGISLATURE:

    THAT the State of Oklahoma hereby claims sovereignty under the
    Tenth Amendment to the Constitution of the United States over all
    powers not otherwise enumerated and granted to the federal
    government by the Constitution of the United States.

    THAT this serve as Notice and Demand to the federal government,
    as our agent, to cease and desist, effective immediately, mandates
    that are beyond the scope of these constitutionally delegated
    powers.

    THAT a copy of this resolution be distributed to the President
    of the United States, the President of the United States Senate, the
    Speaker of the United States House of Representatives, the Speaker of the House and the President of the Senate of each state’s
    legislature of the United States of America, and each member of the
    Oklahoma Congressional Delegation.

      I first heard about this a few days ago… and I must say, for nearly the first time in my life i am PROUD to be an OKIE!

      However, I am skeptical that their motivations in passing this were as pure as we all hope… seeing as how Oklahoma is still one of the most backwards states in the Union.

      It’s surprising to hear you speak like that of your native state. I grew up in Michigan, actually Detroit. I wouldn’t go back there for anything. However, I have spent a great deal of time in Oklahoma and followed the news from your state. The stance against REAL ID and the current 10th amendment issue shows the true backbone of your friends and neighbors. Frankly, if I could sell my home in AR I’d move to OK in a heartbeat.
      Backward state? Look at the more progressive states like: Connecticut, Massachusetts, Michigan, California, Illinois, etc. Perhaps you should re-evaluate what you have.

      This resolution is pure bullshit!!!

      It is a fake and phony sham, and is nothing but a pure deception to throw the people a bone to give a false sense of hope.

      It is symbolic at best, and here is how to prove it:

      1. Call any government agency or department in Oklahoma, city, county, or state; 2. Ask the head of that agency or department to provide you with the Federal Taxpayer Identification Number for that agency or department; 3. Ask yourself, “Why does a city, county, or state agency have a FEDERAL Taxpayer Identification Number (TIN)?”, 4. Then, ask yourself how it effects state sovereignty if a “state” has a “federal” TIN.

      Ponder this question long and hard, cuz it is extremely important.

      I will guarantee you that HJR 1089 contains no provisions to rescind one single TIN anywhere in the State. Know why? Because there is no separation of powers, and there is no independence. The states are agents of the federal government, they have been since the Civil War, and that is the way they will remain regardless of whatever fake legislation they may pass.

      The moment Oklahoma, or any other state, rescinds their TIN at all levels, you will then see a serious reaction from the federal government, like a military invasion. That is when you will know that the legislation is legitimate and that the so-called “law makers” weren’t just pulling everyone’s leg.

      This bill went dormant when it got to the state Senate. They refused to even have a hearing on it.
      Though House Joint Resolution 1089 received great support in Oklahoma’s House of Representatives, it has now hit a roadblock. In the state’s Senate, where the seats are split, 24-24, between Republicans and Democrats, the resolution was sent to the Senate’s rules committee, where it languished without action until the legislature adjourned.

      According to Key, the Senate has worked out agreements on how to manage the political tie, including power given to the Democratic senators to not hear certain bills. Those senators, says Key, refuse to even hear Resolution 1089.

      In the House, where Republicans enjoy a 57-44 majority, Resolution 1089 received a hearing and was supported overwhelmingly on both sides of the aisle.

      “I was on the Democratic side of the floor,” said Key, “and one member went off talking about how far we’ve gotten, how bad (federal overreaches of power) are getting – it’s the kind of thing you hear in coffee shops.”

      Now we get to see if Uncle Sam will fight back by cutting benefits not guaranteed under the Constitution. Farm Loan guarantees, SBA, FHA, etc.

      If that happens, Oklahoma can fight back to end the Income Tax as the money handed out from that collected is not apportioned according to population.

      You said what Oklahoma is doing “is just what our democratic system is all about”, well “our system” was NEVER set up to be a “democratic system”, in fact our Founding Fathers denounced that type of governance. We were set up as a “Constitutional Republic”, and each of the states were to be “sovereign”, and each and every inhabitant was to be a “sovereign individual”.

      If it seems as though I am being nit-picky it’s because I am. The statement you made is pretty representative of a common misconception amongst my fellow Americans.

      Didn’t the STATE OF OREGON try this same exact thing in the 90’s? Anytime that you’re declaring anything for the STATE OF OKLAHOMA or any of the other corporate STATES, the constitution doesn’t apply. Well, California state doesn’t have an income tax but the STATE OF CALIFORNIA does.

      Please, could someone please tell me what this really means? What is the federal gov. going to do? What did the federal gov.attempt to enforce that caused Oklahoma to do this? I am a born and raised Oklahoman. It’s ground roots are crooked, admittedly. However, there are some descent folk around here. I’d like to include me and mine pertaining to the latter. Point being, NO ONE is talking about this. It is not in the paper, or the news. A friend of mine told me this, and I thought they were pulling my leg. Apparently it’s true. All oklahomans need to get on news 9 and give kelly ogle our two cents about not covering this resolution and the issues that could arise from this.       Natas, Oklahoma Born, the resolution was authored by state rep Charles Key partially as a response to the gov’ts pushing back against our tough immigration laws we passed recently (and partially because he’s a liberty-loving Ron Paul endorser!). They issued an injunction saying we couldn’t enforce our own law, so we pushed back. The resolution basically says we can and WILL do whatever we want as long as it’s not a power given to the federal government by the constitution, if we see fit to do so (in other words, BACK OFF!). Not secession, but a firm recognition of our rights and the proper restraint on federal power, which the other states need to do as well. I’m proud we’ve taken a first step, but it needs to be built on!

      I am so proud of Oklahoma! Living here in the People’s Republic of California, we will never see such bravery and patriotism by our state government because they are addicted to federal money. They don’t care about lost rights, state’s rights, or any such thing: as long as the money flows from DC, they don’t give a damn. Oklahoma is one lucky state to have Charles Key and the 93 other members of the House that passed this resolution. I understand it stalled in the Senate, but some serious pressure from the citizens could very well get the scale to tip. Hey: Does Oklahoma have any room for a family of four who have absolutely “had it” with California?

      All states should follow suit. The Federal Govt. has gotten a little big for its breeches. To these ends they have become destructive to a free people. Designed to be a servant and protector of rights now bold, authoritarian, displays no fear of retribution for transgressions against those sworn to protect. From this position, posturing as to annihilate the Constitution itself. Becoming so overbearing in authority as to remove the liberty teeth from the people, their firearms. Becoming so self centered as to expend the fortunes of the people and saddle with debt many future generations of American children. Becoming so corrupt that lobbyists flashing payola from foreign nations have destroyed our industrial infrastructure and rendered our peoples jobless. The servants now spout orders, peer down their noses and name their own raises in pay. Indeed, what started as a good idea has gotten out of hand and must be brought back into check.       If memory serves me correctly, back in the 90’s, there were a couple of “bill’s” that came out of the Oklahoma House of Representives, “Memorials,” if you will. One adressed the so called “Soverignty” of the State, and the other “Memorial” was in the form of a”Cease and Disest” order. This one “ordered” the Feral Government to cease activity to form a “one world government.” If you happened to read the Constitution of the State of Oklahoma, you would see that by State Constitution, the “State” is subserviant to the Constution of the United States. Soda Pop, and Candy to the People!

      The 2nd ,9th and 10th amendment exists to ensure that the government does not trample the rights of the people under color of law.There are some 90 million gunowners in the U.S. and at least one third of those maintain a relatively purist understanding of the second amendment: meaning that at least 30 million citizens would strenuously object to any to any overt infringement against those rights.This not Great Britain or Australia: Americans are freedom loving patriots,who will strongly oppose tyrannical behavior by our Central government. Let us not forget the federal government was formed and given its power by the states, not the reverse. We now have a situation where the tail is wagging the dog ,where abuse and corruption is the norm. States,stand up! and assert your rightful authority as enumerated in the Constitution and Bill of rights! Thank God for states like Oklahoma leading the way to freedom and individual liberty..
