“I don’t want to get thrown in jail,” she explains.
It is, in fact, illegal in Colorado to collect rainwater. State law is vague about the penalties, except to say that violators can be taken to court and ordered to pay damages. The state lacks the resources for vigorous enforcement and fines are extremely rare, officials say. Still, the law is the law — and so Ms. Looper has set out to change it. This might just be her year.
Colorado, like most Western states, lives by a rigid and byzantine knot of water laws. Vast quantities of river water are made available, free of charge, to a variety of public and private interests, including oil companies, ski resorts, fire districts and breweries. The international food conglomerate Nestlé has applied for a permit to draw water from a Colorado aquifer and sell it in plastic bottles under its Arrowhead brand.

The state is blowing things out of proportion.
Imagine Nestle building a giant man made lake and selling the bottled water.
Now imagine this old lady who owns her residence and all rights to air and minerals including water on it.
She is not profiting from her rights. Otherwise she could not chop down her tree or rake the dirt.
You CANNOT prosecute someone who is NOT profiting from their exercise of rights.
Years ago the lawyers did like John Yoo and convinced law makers to break the old law that water and air should always be free.
It will take several attempts to counter-sue these cases to win back the freedom to live and breathe free air and drink water the essentials to life on this planet.
It is ILLEGAL to charge rent to exist on this planet.
Seems to me like the State owes us money for our mineral rights.

Simply solution. Ignore the laws. They only get away with this because people are too much of a bunch of cowards to simply ignore the laws, pay off the police and tell politicians where to go.
In Thailand we ignore all the laws imposed upon us. We don’t need the government’s laws – human society is naturally cohesive and only in extreme circumstances does order break down – like in war torn nations or areas of extreme ignorance and poverty. Laws are there to give the elite the edge and screw the rest of us. File sharing, water, food, energy – that is ours for the taking – ours for the managing, the FDA and all the laws in the world don’t protect us from cronyism and corruption – people still die from tainted peanuts and poisoned milk – might as well toss the laws and spread the wealth from this mal-regulated industries. If I could buy milk from my neighbor I could just LOOK myself at what he was doing and determine if it was safe or not. I can’t do that for Nestle and their melimine riddled garbage they peddle worldwide made only God knows where.
Dont fight the system, replace it! We can do it better. In Thailand we already do – Americans have 10 times the resources, 10 times the imagination, they simply need to have more faith in themselves and ZERO faith in the system elitists made to confine them with.

This has started in Australia also where multinational companies upstream draw enormous amounts of water while placing cities & towns downstream on extreme water restrictions. Meanwhile in catchment areas the state government is trying to impose taxes on business who collect rainwater because they believe the water run off belongs to the state. Next stop will be everyone. It appears that the idea comes from Agenda 21, policy not set by the people.

I lived in Colorado (Colorado Springs and Denver) for 11 years I always had plastic 55 gallon drums on 4 corners of my house and collected rain water (filled all of them with most rainstorms) and NEVER had anyone challenge me. In fact neighbors that saw me doing it thought it was a GREAT idea and ended up doing the same thing. In my neighborhood in Denver I would say at least HALF were doing it. If it was so illigal we would have all be busted.

we can’t save the water, but yet we can’t use the public water freely as needed, without paying a higher rate for it and getting a visit from the water dept., who handsus a warning about using too much water. They get us from al angles!!!

Here is a quote from the Colorado Constitution:
Section 5. Water of streams public property. The water of every natural stream, not heretofore appropriated, within the state of Colorado, is hereby declared to be the property of the public, and the same is dedicated to the use of the people of the state, subject to appropriation as hereinafter provided.
Section 6. Diverting unappropriated water priority preferred uses. The right to divert the unappropriated waters of any natural stream to beneficial uses shall never be denied. Priority of appropriation shall give the better right as between those using the water for the same purpose; but when the waters of any natural stream are not sufficient for the service of all those desiring the use of the same, those using the water for domestic purposes shall have the preference over those claiming for any other purpose, and those using the water for agricultural purposes shall have preference over those using the same for manufacturing purposes.

It could be that I am too simple of a person: “Unappropriated water” would tend to indicate “rain fall” to this pragmatic father and farmer.
I have come to the conclusion that Colorado does NOT operate under or within it’s Constitution. Any Statute that conflicts with the Colorado Constitution is null and void as if it had never been created. Yet, the process of corruption is through the institution and interpretation of Statutes

Collecting rainwater was, at one point, deemed illegal and would cause you to be arrested, fined, and even dispossessed of your home and belongings in Chile (?) which brought about A REVOLUTION. The corporament was ousted and the people reclaimed their water etc. What with Codex Alimentarius, organic foods and home gardening turning into crimes, even if the majority of the US population has been indoctrinated/brainwashed this water thing will be the straw to break the camel’s back. This water law in a ruling elite fantasy. It’s ludicrous to claim ownership rights on rainfall especially since many modern housing designs incorporate rain catchment guttering systems. This is nuttier than the growing your own food ban.
