Brown and his wife, Elaine, were found guilty of tax evasion on Thursday. She returned to her son's Massachusetts home to wait for sentencing on April 24. Ed Brown, meanwhile, holed up in his fortress-like home and skipped most of his federal tax trial.

Anti-tax supporters join Plainfield fray
PLAINFIELD Ed Brown's Plainfield (New Hampshire) home is buzzing with supporters again this week, as the anti-tax militia man continues his stand-off with the government.
Brown and his wife, Elaine, were found guilty of tax evasion on Thursday. U-S marshals say they have no plans to escalate.
About 30 people joined Brown on Sunday at his fortress-like home. Some of them are armed.
Brown has repeatedly said he would rather die than submit to the federal government.

properly COMPLY with the federal tax laws. For example, if your Uncle
Fred gave you a gift of $200 last year, you should NOT have reported it
on your tax return, because the tax code specifically says that gifts
are NOT subject to the federal income tax (26 USC 102). It's not
patriotic or noble to have reported such income on your return; it's an
ERROR. It's income you're NOT SUPPOSED TO pay taxes on (because it's
non-taxable).

Update on the Brown's Situation 01/21/07
More and more supporters are streaming in to the Brown's home in Plainfield. At first, most of the supporters have been of the unarmed variety. Now, many are coming with weapons. Families with children are coming. The Brown home offers especially good sledding, which the kids enjoyed. About 30 people showed up over the weekend.
Bob Shultz, founder of the We the People Foundation joined Ed at his home Sunday. We the People is a group dedicated to educating about the Constitution and facilitating civic action to force government to obey the Constition. We the People recently held a demonstration in Washington DC with ~100 people in V masks demanding answers about the income tax.

Letter: Government is Guilty not Browns
The entire United States Government is guilty of the tax crimes they are blaming Ed and Elaine Brown for. When I think about it, why should the Browns or anyone for that matter pay any taxes at all? After all, much of the tax money we are made to give the government winds up being wasted and/or used improperly.

David Baker has read the entire internal revenue code. Twice. The Auburn, Mass., man, who drove to Concord several times to attend Ed and Elaine Brown's tax evasion trial, said that he's spent more than 1,000 hours poring over title 26 of the federal code, searching for the provision that requires him to pay taxes.
"You will not see a law making anyone liable for these taxes," he said last week in the federal courthouse.

At least a dozen people braved the horrific wind yesterday to show their support for the Browns yesterday. Supporters from Jaffrey came with signs saying "God Bless Ed Brown", "Are the Waco Killers Coming to NH?" and "Taxation Equals Slavery". There were a lot of kids who enjoyed the sledding in the new snow. A couple of people camped out near the bonfire, and some elected to stay in the Brown's home overnight.

Elaine Brown, who the prosecutor said owed more than $625,000 in unpaid taxes, was in court to hear the verdict. Her husband, who decided to stop attending his trial last Friday, remained barricaded in the couple's fortified home in Plainfield.

to expand. I've been surfing and exploring more about Mr. Brown and the
movement behind and against him. Honestly, yes, Mr. Brown is a bit
radical. Not in standing up to Federal Forces, but in some personal
conspiracy beliefs. However, he is acting inside his constitutional
rights and in the spirit of freedom in defending himself. He tried to
fight inside the system, and failed. He now has the option of bowing to
the State, or actively fighting it.
Now, I don't desire for anyone to be harmed. Well, okay, most people. Even the police and federal agents. They are, for the most part, merely pawns of the Federal State, being told what to do. They are the soldiers, not the opressors, and I doubt many of them are Nazi-style stormtroopers.

We filmed Ed's interviews all day today, and are going into the studio tomorrow to document his position more thoroughly than the mainstream press snippets. (In fact, Ed declined to take the call below because he was filming with us and others, and had Bernie answer the phone, which just
kept ringing all day).
We will do our best to capture Ed's side of this dispute, and will make The video available for viewing as soon as possible. Many media people came To the house today, but we hope to do Ed justice by allowing him to tell His own story without going through five managers, as one reporter said Would occur to their footage before it hit the news (Channel 4 Boston).
We would have stayed if the feds showed up, but it looks like they may Cool their jets for a while and hope things cool off. Ed is exhausted, but Is truly grateful for the immense support he has been receiving. It seems obvious that it is not just Ed which is making this story grow, but the ardent and far-reaching support his story is creating. Personally, I think the mainstream media are completely baffled by the fact that so many people are rushing to Ed's aid, an aspect we tried to catch in our filming today: we shot the press as they interviewed him, and you can see that they are bewildered and trying to understand what's going on. Perhaps the internet is becoming a driver of news now, for there is no doubt that Rick Stanley's and others' efforts are galvanizing people where there would otherwise be No story. Please keep up the effort, for the feds are surely counting on a Lull to then grab Ed. He's ready to go, though he'd prefer peace and life.
Please pray for him and his family, and for those who are there in support. Ed Has plenty of room in his house, and a large heated barn. When we left at 5:30 EST, supporters had lit a bonfire at the end of the Browns' driveway, and some were sleeping in tents by the road. Ed is not alone in his ordeal.
We'll be going back down in a few days for part two, God willing.

Scofflaw 'to nullify' tax plight
Plainfield resident Ed Brown, who along with his wife was convicted of multiple felony tax evasion charges this week, said yesterday he and a group of legal analysts are preparing to take legal action "to nullify the whole problem."
"We're working on legal matters and actions," Brown said during a telephone interview. "This court is totally off the wall for its actions, and the record will show that clearly."

N.H. Tax Evader Prepares for Raid

CONCORD, N.H. — A former militia man convicted of tax evasion prepared for a government siege Friday at his fortress-like home, but U.S. marshals gave no indication they were planning to confront him.

Rick Stanley, a Denver-based Web radio host and a militia leader, urged listeners to join Brown at his home.
"We are continuing to ask patriots to surround Ed Brown's property and life with a ring of armed Americans with firearms and video cameras to protect a fellow American," he said. "This is the flash point. This is the time of raised pitchforks."

For example, are you a student who only needs a bus ticket and room and board? Are you elderly retired with a mobile home that you just need gasoline for? How much would it take to get you to Ed's place? What do you need the money for? How do you intend to spend it? I might even pitch in a few bucks myself. As you may or may not know (some sheriffs don't), the sheriff is the highest law-enforcement authority in a county. It is the duty of the sheriff to uphold the Constitution and protect the citizens of that county from any and all forces threatening them, including federal agencies which have no authority or jurisdiction within the county. Without the sheriff's permission, federal agencies cannot arrest a citizen anywhere within the county. Yes, they often do it but they do it illegally every time they do it. A few sheriffs around the country have put federal agencies on notice to stay out of their counties. One, whose name I don't recall at the moment, told them he would not conduct background checks for purchasers of firearms. Though he approached it for the wrong reasons (he didn't want to bear the expense), he did learn in the process that the feds don't have jurisdiction within the external boundaries of the 50 states. The Supreme Court has so ruled in quite a number of cases.

What are we to make about Ed Brown, the New Hampshire man who hasn't paid federal income tax since 1996, and who is promising an armed confrontation if the feds try to take his home?
Ed lives in Plainfield, N.H. A jury convicted Ed and his wife, Elaine, of failing to pay their income taxes. I saw one report that said the federal taxes owed are in excess of $620,000.
Ed's wife is somewhere in Worcester. But Ed himself is in the couple's house. And when I say house, I mean a huge concrete building with a watchtower. It sits on a 110-acre plot of land. The house is equipped with a large battery room, which Ed says, will provide power even if the power to his home is cut off.

Ed and Elaine Brown were convicted Thursday on various tax evasion charges. Why would someone committed to the nonviolent approach support Ed Brown, who says he will shoot federales who come to arrest him? A man willing to stand up for what is right is a rare and beautiful thing these days. I don't want that man to stand alone. So, I've been out there in the frigid cold to say to the government, "Don't come kill this man and steal his property! Just leave the Browns alone." While I don't agree with shooting people, it's understandable that Ed Brown wants to defend himself, his family and his property. It is without a doubt the government who is the aggressor here, not Ed Brown.

Reading various accounts of the Ed and Elaine Brown saga in several newspapers, I suspect that most of them were either written for the papers by the PR department of the IRS, or at least edited by them. The slant is just too great to be genuine or unbiased.
What happened in the Brown court is not unlike what happens in hundreds of tax cases tried around the country every day. Pre-trial motions are heard by the judge before the jury is brought in. The judge disallows whatever the prosecutor doesn't want the defense to present, i.e., anything the prosecutor cannot counter.

learned from Irwin's trial that the law is not what is found in the law
books, the law is whatever the judge says it is. Judges ignore the law
and the supreme court. They are in court representing the Federal
Reserve (creditor)against the defendant (debtor)in a court of equity.
It is their JOB to do everything they can to ensure a guilty verdict.

Im thinking about walking around my current home city of Portland Maine with a sign that says Ed. Brown is right!!! and hand out copies of freedom to fascisim and flyers. If I had a motor vehicle I would make the trip over to plainfield, but I only have a bicycle these days, yes even ride it through the snow and 2 degree weather, hey I lost 40lbs since May.

As I write this, another government Gestapo siege is developing, this time near Concord, New Hampshire, where the state's official motto is "Live free or die."

Summary of events to date:
Ed and Elaine Brown complied with the law. They didn't file or pay federal income taxes the past ten years because THE LAW SAYS, and the Constitution says, their domestic income is NOT SUBJECT TO TAXATION by the federal government, despite the government's knowingly false implications and insistence the past 90 years....and the general population's mistaken belief....that "everyone must pay their fair share."
The Browns were indicted on multiple trumped-up tax-related charges (as are hundreds of Americans each year, especially in the three months leading up to April 15). They went to trial where they were not permitted to present much of the evidence that would have proven their innocence, or proven to the jury what the law ACTUALLY SAYS. Last Thursday they realized they were being denied a fair trial in court (the judge had denied their motion for a fair trial), so they elected to stay home Friday instead of returning to court, and die if necessary rather than succumbing to the government extortion and tyranny the rest of America accepts as routine.
Monday was a holiday. Though they had vowed to remain at home and fight to their deaths, the pressure of the situation motivated Elaine (a dentist) to cave in, and she returned to court on Tuesday. She rejected a plea bargain offer and elected to take her chances in persuading the jury she had violated no law. The trial resumed, with Elaine present and with Ed being tried concurrently in absentia. The uninformed jury, cleverly manipulated by the government prosecutors, found the Browns guilty of all charges
Note: Contrast this case with the Whitey Harrell story that follows this one, in which an INTELLIGENT jury acquitted him of similar charges because the government could not produce...when the jury asked for it....any law requiring him to file or pay federal income taxes. Government prosecutors cannot show a law that doesn't exist, all they can do is mislead and manipulate ignorant juries. That is the only way they get convictions in the 85% of the cases they "win." Unfortunately for America, only 15% of innocent defendants are lucky enough to get juries containing one or two intelligent jurors who steadfastly and properly insist the government must prove its case (what a novel concept!).
Now Ed Brown stands alone, at the Brown home, to face whatever comes. He's not really alone, many fellow informed citizens and patriots are there, presumably to stand with him. To what extent and for how long remains to be seen.
Meanwhile, the media are gathering around the scene to await the government's arrival. It'll be interesting to see what rogue government agencies will show up, and which will assume the lead role. Will the DEA show up and falsely claim there must be some illegal drugs on the premises? Will the BATF be there and falsely claim Ed must surely have some illegal weapons? Will the FBI take charge and justify their presence by claiming the government has been defrauded? Will the county sheriff permit all this to happen, or will he properly perform his duty and protect his county residents from illegally invading federal forces with no jurisdiction or authority inside his county?

This is an episode of the Peter McCandless (Ph.D.) Radio show (known as the Perter-Mac show) from last August. His guest is a WONDERFULLY INTELLIGENT lady named Marcy Brooks, a lady who sat on a jury in a case where a man, Whitey Harrell, was being tried on four counts of WILLFUL FAILURE TO FILE A TAX RETURN.
This will give you an insight as to just how CROOKED tax trials really are, and to what lengths judges and prosecutors COLLABORATE and routinely go to keep the LAW out of the courtroom and CONVICT people they KNOW ARE INNOCENT, simply by DELIBERATELY misleading UNINFORMED juries.
Although this is a case tried in Illinois state court, regarding state income taxes, this trial nonetheless addresses the same issues because Illinois state law stipulates that "anyone required to file a federal return is required to file an Illinois return." As Marcy Brooks noted in this audio interview, that also means "if a person is NOT required to file a federal return, then he is NOT required to file an Illinois return."
Though Marcy Brooks was not the foreperson of the jury, she was clearly intelligent, ALERT and outspoken. She went into the jury box knowing nothing, but soon detected the railroad job that was being attempted and she asked questions. She even raised her hand during the trial and directed a question to the judge, something 99.9% of jurors mistakenly believe jurors aren't allowed to do. Near the end of the interview, she gives some GREAT guidance to future jurors. In fact, throughout the interview there are points that will curl the toes of most people. This is a quote from her interview:
"I have never felt more humbled, and more proud at the same time, in my life. I remember thinking as our verdict was being read, 'The system may not work all the time; but THIS time, for THAT man, it DID.' "
She also describes a scene from a documentary she had seen and she quotes Adolf Hitler when he tells a crowd of tens of thousands "You don't have to THINK...I will think FOR you," and the crowd cheered jubilantly. How frightening it is to realize that too many Americans refuse to think, and are apathetically content to let the government think for them.
Bottom line is that this interview IS NOT TO BE MISSED by any decent, intelligent American who claims to care for individual rights under the Constitution. But for the grace of God, YOU could be the defendant in such a kangaroo court, on most any charge you can imagine.

As I write this, another government Gestapo siege is developing, this time near Concord, New Hampshire, where the state's official motto is "Live free or die."

Summary of events to date:
Ed and Elaine Brown complied with the law. They didn't file or pay federal income taxes the past ten years because THE LAW SAYS, and the Constitution says, their domestic income is NOT SUBJECT TO TAXATION by the federal government, despite the government's knowingly false implications and insistence the past 90 years....and the general population's mistaken belief....that "everyone must pay their fair share."
The Browns were indicted on multiple trumped-up tax-related charges (as are hundreds of Americans each year, especially in the three months leading up to April 15). They went to trial where they were not permitted to present much of the evidence that would have proven their innocence, or proven to the jury what the law ACTUALLY SAYS. Last Thursday they realized they were being denied a fair trial in court (the judge had denied their motion for a fair trial), so they elected to stay home Friday instead of returning to court, and die if necessary rather than succumbing to the government extortion and tyranny the rest of America accepts as routine.
Monday was a holiday. Though they had vowed to remain at home and fight to their deaths, the pressure of the situation motivated Elaine (a dentist) to cave in, and she returned to court on Tuesday. She rejected a plea bargain offer and elected to take her chances in persuading the jury she had violated no law. The trial resumed, with Elaine present and with Ed being tried concurrently in absentia. The uninformed jury, cleverly manipulated by the government prosecutors, found the Browns guilty of all charges
Note: Contrast this case with the Whitey Harrell story that follows this one, in which an INTELLIGENT jury acquitted him of similar charges because the government could not produce...when the jury asked for it....any law requiring him to file or pay federal income taxes. Government prosecutors cannot show a law that doesn't exist, all they can do is mislead and manipulate ignorant juries. That is the only way they get convictions in the 85% of the cases they "win." Unfortunately for America, only 15% of innocent defendants are lucky enough to get juries containing one or two intelligent jurors who steadfastly and properly insist the government must prove its case (what a novel concept!).
Now Ed Brown stands alone, at the Brown home, to face whatever comes. He's not really alone, many fellow informed citizens and patriots are there, presumably to stand with him. To what extent and for how long remains to be seen.
Meanwhile, the media are gathering around the scene to await the government's arrival. It'll be interesting to see what rogue government agencies will show up, and which will assume the lead role. Will the DEA show up and falsely claim there must be some illegal drugs on the premises? Will the BATF be there and falsely claim Ed must surely have some illegal weapons? Will the FBI take charge and justify their presence by claiming the government has been defrauded? Will the county sheriff permit all this to happen, or will he properly perform his duty and protect his county residents from illegally invading federal forces with no jurisdiction or authority inside his county?

This is an episode of the Peter McCandless (Ph.D.) Radio show (known as the Perter-Mac show) from last August. His guest is a WONDERFULLY INTELLIGENT lady named Marcy Brooks, a lady who sat on a jury in a case where a man, Whitey Harrell, was being tried on four counts of WILLFUL FAILURE TO FILE A TAX RETURN.
This will give you an insight as to just how CROOKED tax trials really are, and to what lengths judges and prosecutors COLLABORATE and routinely go to keep the LAW out of the courtroom and CONVICT people they KNOW ARE INNOCENT, simply by DELIBERATELY misleading UNINFORMED juries.
Although this is a case tried in Illinois state court, regarding state income taxes, this trial nonetheless addresses the same issues because Illinois state law stipulates that "anyone required to file a federal return is required to file an Illinois return." As Marcy Brooks noted in this audio interview, that also means "if a person is NOT required to file a federal return, then he is NOT required to file an Illinois return."
Though Marcy Brooks was not the foreperson of the jury, she was clearly intelligent, ALERT and outspoken. She went into the jury box knowing nothing, but soon detected the railroad job that was being attempted and she asked questions. She even raised her hand during the trial and directed a question to the judge, something 99.9% of jurors mistakenly believe jurors aren't allowed to do. Near the end of the interview, she gives some GREAT guidance to future jurors. In fact, throughout the interview there are points that will curl the toes of most people. This is a quote from her interview:
"I have never felt more humbled, and more proud at the same time, in my life. I remember thinking as our verdict was being read, 'The system may not work all the time; but THIS time, for THAT man, it DID.' "
She also describes a scene from a documentary she had seen and she quotes Adolf Hitler when he tells a crowd of tens of thousands "You don't have to THINK...I will think FOR you," and the crowd cheered jubilantly. How frightening it is to realize that too many Americans refuse to think, and are apathetically content to let the government think for them.
Bottom line is that this interview IS NOT TO BE MISSED by any decent, intelligent American who claims to care for individual rights under the Constitution. But for the grace of God, YOU could be the defendant in such a kangaroo court, on most any charge you can imagine.

Conclusion: There are no significant differences between the behaviors of Whitey Harrell and Ed and Elaine Brown. The laws which apply to them are the same. The laughable "evidence" presented against them in court was the same. Yet Harrell was found not guilty and the Browns were found guilty. The difference was simply the juries, nothing more. One defendant was released, the others' lives ruined forever.

David Jahn Talks About Ed Brown Situation
I spoke with Ed Brown tonight. You can listen to that conversation on the blog that was set up for his case at (Ed's blog).
It was a difficult interview as Ed has obviously had a very trying day. He wants an army of people on his property now to help him secure a standoff.
I continue to hope for a peaceful resolution to this problem that doesn't involve sending this man and his wife to prison. As you'll here in my interview, he could have settled this within perhaps the last year by simply paying whatever they were demanding. Instead, he elected to present his side of the case in a court of law. But as we have seen in many of these income tax trials, defendants are denied the opportunity to present their defense.
It is painful to witness the abuse these patriotic citizens endure, simply for seeking answers to the same questions many other responsible citizens around the country are asking. Ed Brown is not alone in questioning the income tax laws. Many educated people claim the income tax laws simply don't say what the government would like us to believe they say.
Obviously he is going through a very difficult time. I'm not sure what lies ahead or what the outcome is going to be. I do know that ordinary people presented with the facts, tend to side with Ed Brown and his wife, so the court of public opinion may be in their favor. I can only pray that it is sufficient enough to overcome the evil that often comes at the hand of our government in these cases.

Holed-up tax protester, wife convicted
CONCORD, N.H. - A man who has holed up with armed supporters in his cement-walled house for most of his tax evasion trial was found guilty Thursday, along with his wife, of failing to pay federal income taxes for a decade.
Ed Brown has said he will defend himself against capture if necessary.
U.S. Marshal Stephen Monier said Thursday that members of his staff continued talking by telephone with Brown and had no plans to confront him.

Whatever happens in this case I am of the opinion that it is time to start standing up for our rights as Americans exactly as Mr. Brown is. I am opposed to the coercive tactics used by the United States government on the people that are responsible for it's existence. The government should answer to us and when they fail to comply we need to defend our rights just as the founders did against the British.

Crazy New Hampshire couple takes on the Feds
I find this story oddly uplifting, even though I'm not sure what I think of the cause. Still, I respect their passion and the beliefs, and their willingness to go up against the federal government. As the energy for resisting our continued occupaton of Iraq seems to have waned, I appreciate any effort to take on the federal government, who are doing violent and wasteful things with the money they collect from me in taxes. It feels inspiring.

Bernie
is a friend of Ed Brown. He attended pretty much the entire trial. As
we were doing this interview he said there were some 25-30 individuals
on Ed's property, including major national television and cable news
organizations interviewing Ed one at a time. The verdict from the jury
this morning came down guilty on all counts for both Ed and his wife,
Elaine. After the verdict all heck broke loose with interest from the
local and national news organizations. Ed has been making dozens of
interviews with radio stations all across the country. Bernie said he's
exhausted, but he's getting a lot of support.

Couple guilty on all counts in tax evasion trial
CONCORD – A federal jury found a Plainfield couple guilty Thursday of failing to pay their federal income taxes for a decade - but only the wife was in court.
The jury continued deliberations over whether Elaine and Ed Brown should lose their home, and sentencing was expected later in the day.
The home of Ed and Elaine Brown is seen in Plainfield yesterday. Brown said the home's walls are made from 8-inch concrete and he can run his home from generators, solar and wind power.

Update on Ed Brown from Mark Yannone
The
trial resumed today with Elaine Brown appearing without Ed. She made
her closing arguments to the jury, and the jury got the case. Jury
deliberations will begin tomorrow morning. Also in the courtroom were
her son and about thirteen strong supporters from the community, who
applauded at the conclusion of her statement.

motions in Concord, New
Hampshire's, US District Court
and had every one denied. The
couple then spent three days in
court last week listening to the
federal government try to build
an income tax case against them.

Dear Sheriff Prozzo: As you may or may not know (some sheriffs don't), the sheriff is the highest law-enforcement authority in a county. It is the duty of the sheriff to uphold the Constitution and protect the citizens of that county from any and all forces threatening them, including federal agencies which have no authority or jurisdiction within the county. Without the sheriff's permission, federal agencies cannot arrest a citizen anywhere within the county. Yes, they often do it but they do it illegally every time they do it. A few sheriffs around the country have put federal agencies on notice to stay out of their counties. One, whose name I don't recall at the moment, told them he would not conduct background checks for purchasers of firearms. Though he approached it for the wrong reasons (he didn't want to bear the expense), he did learn in the process that the feds don't have jurisdiction within the external boundaries of the 50 states.
