Texas Cop Tasers 72-year-old Great Grandmother

Fox News has obtained police dashboard video of the tasering of a 72 year old great grandmother in Travis County, TX.
The police claim that after Kathryn Winkfein was stopped for driving 15 miles over the speed limit in a construction zone, she disobeyed an order to sign the speeding ticker, used profane language, and became “violent.” They say the officer who taserer her and took her to be booked for resisting arrest was completely justified.
However, Winkfein says that’s a lie, and the video appears to back her up.

It shows Constable Richard McCain screaming, “Get over here now!” Winkfein replies, “Give [the ticket] to me and I’ll sign it.” Instead, the officer reaches out and pushes her, and she starts complaining, “Oh, you’re going to shove me? You’re going to shove a seventy-two year old woman?”
McCain then tasers her. As Winkfein lies on the ground screaming, he orders, “Now put your hands behind your back. Put your hands behind your back or you’re going to be tasered again.”
Fox’s Brian Kilmeade commented after running the video, “Officers insisted they acted by the book. What book is that?”

Thank you to all trolls and patriots alike for using cuss words on this forum. The government “loves the children” of this nation too much to let them be exposed to such language. Internet 2 will impose fines on websites that allow such language to be used. It will be up to the website host to either pay the fines, pay a fee to allow x-rated content, or pay a moderator to censor your comments since you can’t seem to censor yourselves.
BTW 80% the so-called patriots who make valid, cogent points, and then throw in 3 or 4 cuss words, are paid or unpaid trolls. The old women clearly stated in the video that she would sign the ticket. The coward police officer just wanted to kick around and torture and old women in order to get his rocks off and teach her a lesson. If I would have been driving by I might have lost control of my vehicle and accidentally plowed into that cop. The new mandate is to torture anyone who does not immediately submit their Constitutional rights to the jack-booted thugs calling themselves police officers. I hope their are some police officers out there (real police officers) who’ve seen this video and became completely outraged. There have to be a few good cops left out there (I’ve met a few myself) willing to do something about this mess. The problem is that the good ones never seem to rise to positions of power. The system is looking for the demented cops with twisted minds. Those are the ones that tend to wind up controlling things. It’s a real shame, especially for all their victims and for the few good cops out there who actually follow the Constitution and are willing to risk their own life instead of pulling out a tazer to solve every little problem.

The video that we’ve seen thus far clearly shows that the old women was going to sigh the ticket. It also shows that young thug pushing her to the ground and tazing her. In her interview she said that she didn’t use profanity, did you hear any profanity coming from her lips? Nope, you didn’t. So far two things she said the officer lied about have been shown to be true. Just because we haven’t heard a second statement coming from her means absolutely nothing. If she has a lawyer she may have been told not to make any further statements and even if she wanted to make another statement that doesn’t mean the local news has to cover it. So far your logic 9or lack thereof) is flawed.
No, I don’t hate the police. I understand they have a job to do but there is a proper way to do that job and they haven’t been doing it according to their oath. Bottom line, the police officer used excessive force and should be fired. I can see you’re either a police officer or a cop lover, either way your loyalty to the boys in black has blinded you to the point of excepting anything they do as being justified.
A police officer is supposed to be a peace officer and is supposed to be a public servant. You’re twisted if you think that old women deserved to be tazed. Mary… let me help you out and explain the basics. Way back in the “dark” ages people figured out what were the fundamental, self evident rights of mankind and they wrote them in a document called the magna carta. Basically what the law requires is that no one injure or damage another. I know this may be a bit complicated for you… so let me explain further… if you hit me – you broke the law and I am a victim – if I steal from you – I broke the law and you are the victim. Still with me? Great so you will have noticed that a key component in a crime is a victim… in fact it’s essential.
Now look carefully at the video again and see who hurt who… who was the victim of the crime? Very good – the grandmother… yes she was the victim of a crime and the police officer was the criminal or law breaker… see it’s not so complicated after all.
Oh and btw, exceeding the speed limit is not a crime… it is “illegal” meaning it contravenes a statute which has nothing to do with the law of the land… the law that people understood hundreds of years ago… back when they were obviously much smarter than many people today.
The reason the officer wanted the lady to sign the ticket is to con her into entering a commercial contract with the corporation the officer respresents. It is her self-evident basic right to refuse to enter into any contracts and it is a crime to injure her and subsequently kidnap her by force. That my dear Mary is the basics of law in a civilized, free society… wouldn’t you like to be part of one?

I have come to the conclusion that we don’t need to do anything else other than point out the truth and live by it. Evil and wrong are not sustainable indefinately… it will eventually implode upon itself because the very nature of existence is good and right. This is why this country is imploding right now – it has been taken over by evil and wrong.
A small example of how this putrid system is shooting itself in the foot… you can now happily sign any ticket an officer of the corporation gives you and go on your way. Then if you choose to back out of the contract, you can do so by showing this tape to any jury… it is prima facie evidence that you signed under duress as you had every reason to expect to become a victim of a crime if you didn’t!

Well the only they must have cut a whole lot of this video. I would like to see it from the very beginning. But looking at how the officer was dealing with her, he looked like he was threatening her with the taser after he pushed her around. She was going to sign the ticket, but he kept her there. He looked like he was waiting for a reason to taser her. He should have let her sign the ticket and move on. I guess his pride didn’t want her to get away with talking to him like that. He should have just nodded his head and said “Yes, Ma’am. Her is the ticket. Sign it and your on your way”. This whole thing would have passed without incident. Most of the old guys are gone and the new batch of police are dangerous and psychotic. I’d be afraid to give them a water pistol. Sure, there are a few (the key word is few boys and girls) good cops out there but the majority have no common sense and are eagerly excepting the propaganda they are being taught within the force. As soon as you become a police cadet it becomes very clear very fast what you’re job really is and it’s got nothing to do with protecting and serving the people of the United States of America.

I am well aware. That is why i made the distinction. There used to be “serve and protect”. We are their authority. Public servants are supposed to answer to the people. Obviously it has changed. Perhaps these public servants: mayor, governor, congressmen, and on up the chain of politics should read Romans 13 with that concept in mind.

I don’t care if the old women refused to sigh the ticket (which I’m fairly sure she originally did until psycho boy started acting like a lunatic). No matter what she did or said, even if she smacked this cop in the face, justifies the use of a tazer on her. A tazer is supposed to be used only when deadly force is necessary. It was supposed to be an alternative to shooting someone. Now these despotic jack-booted thugs calling themselves police officers use it as much as possible because they enjoy it. 95% of police officers are on a serious power trip, they think that disagreeing with them constitutes a crime!

Mary, In Texas you do not have to sign the ticket, that is why this cop who was picked on all his life took it upon himself to rewrite the Texas laws and taze a 72 year old lady.

Watch an episode of “Cops”, and you’ll see plenty of cops that are a lot smaller than this guy physically subdue many big and threatening looking males that aren’t 72 year old grandmas. Seriously? A tiny 72 year old belligerent grandmother warrants the use of a potentially deadly device such as a taser. This has absolutely NOTHING to do with party lines and has everything to do with common sense. There is no way she was any kind of threat to this giant bear of a man and in no way shape or form deserved to be subjected to the use of a taser. I agree that she should have cooperated by signing the ticket instead of arguing with the police officer, however the officer’s choice to subdue the woman in an overly excessive manner is inexcusable. I would like to see this officer released from duty. Thank goodness she didn’t die due to injuries…these officers are meant to protect and serve not maliciously inflict punishment on the elderly, no matter how obstinate.

I got the ticket but the officer didnt disarm me, didnt pull me out of the vehicle, and certainly didnt taze me. All because I conducted my self in a manner consistant with a person who knows he was in the wrong and accepted the fact that there are consequences!!!!!!

When the officer demands she step back, the women tells the cop to hand her the ticket and she’ll sign it. He immediately shoves her back then tazers her. She did agree to sign it before any contact was made between them.
That officer violated her rights and assulted her.

The new qualification exam for cops should be they have to take down a 72 year old woman without using any torture weapons. If they cant do that they should not get their god license. COME ON! if you cant physically contain a 72 year old woman you have no practical use as a police officer. I pray that just once the cops could do the right thing and hold a press conference and contritely beg the forgiveness of the people and then resign. Remember the original article that was accompanied by the video of a police officer from the same police station where the psychotic cop works out of? The cop who was interviewed by a local reporter backed up the tazing of the old women and said his officer acted in a completely satisfactory manner. The police are completely corrupt. The MIAC report and others like it prove beyond a reasonable doubt that the our nation’s police officers have become nothing more than goons with guns. They refuse to arrest and charge their out of control police officers and they will not change.

I don’t think that the police should be conducting investigations on police. I feel that it’s impossible for them to make an unbiased investigation. Being police officers themselves, they are obviously going to see only the officer in question’s side and determine that he “acted in accordance with police procedure”. Does anyone have any suggestions?
Perhaps a committee made up of legal research assistants with clean records that are not working in law enforcement, and additionally, do not have family members in law enforcement. I think its becoming necessary to make some changes regarding police procedure.
What about mandatory testing for steroid use? Many of them are so aggressive that I suspect they could be taking testosterone to meet their requirements for physical fitness. Isn’t it possible that steroid use may be causing some of these overreactions? I just don’t recall the police being so buffed up when I was younger, nor so psychotically agressive. I used to work out a lot when I was 18, and I hung out with a lot of bodybuilders. Anyhow, some of the guys were taking testorone. They bulked up pretty fast, but they would also get into fights and get super angry for no reason. It just seems to be the same type of behavior that we keep hearing about with many of the police officers out there. I really think that we should take a look at this possibility.

The best option would be to go with a committee made up of regular citizens. No permanent positions, a revolving body of citizens like jury duty. The steroid thing is probably partly true but it doesn’t explain why the police and the military are combining forces and policing the streets together. It doesn’t explain the Armored Personnel Carriers or the fully automatic MP-5’s or other military equipment. Even if we had a civilian investigation board with all the powers of a grand jury things still wouldn’t work out for us because most of the people in this country are completely asleep.
Maybe if anyone on the committee had to watch a two-hour video of police brutality caught on tape that would help but who really knows. Things are getting so damn bad in this country. You can’t look at a cop cross-eyed without them going gangbusters on your ass. I think the oath keeper guys are probably doing the most effective thing possible. Cops waking up other cops is a decent idea. I don’t agree with everything they stand for but you can’t tackle every issue in the beginning. Let’s just hope their having a real effect. They need to spread out nation wide like We Are Change.

Yeah a committee of citizens to investigate police, yeah that would work. Well CPT aggrees with you, no surprise there. Look cops are human beings just like everyone else, they don’t just show up and someone gives them a badge, gun, handcuffs and taser and go get people. One cop doing something that you think is wrong does not make all police BAD. Yeah juries decide court cases, but you have the choice of a judge or jury trial. Guilty people take a jury trail, because the defense lawyer knows that he/she can pick the most ignorant people to help get his/her client off. Two letters OJ. Would this committee know anything about police policies and procedures? No. It would take them 1-2 days to read the entire book on them, they are different in every police dept.
Do you know what would happen, every time an arrest was is made…..a complaint would be filed; the citizens would have to be put on these committees you speak of (and get paid minimum wage) to investigate these arrests. Because if you really think that this would be for isolated incidents you are wrong. Arresting people is not pretty, I can’t name one person that likes to get arrested. So every time there was an arrest made, the arrested person would scream brutality, there would have to be an investigation. Or would you have to have another committee to determine if this arrest is actually requires to be investigated by the 1st committee? Every one in towns/cities would be making minimum wage. That would get old real quick. Because your employer would not pay you every time you had to be on one of these committees. at the rate of arrests that would be about once every 2 two weeks in a city like NYC. Small towns/cities, it would be a full time job. And what would you do if there was no video? Have to get another committee to determine that. Hey look at that you just created a bureaucracy. Yeah!
These laws that you refer to are not made by the police, they are made via a legislation, from people who run for office; politicians. But they are enforced by the police. If you want to make changes run for office. Or you could join CPT in his little world, he wants to get ride of police all together and let everyone do what ever they want.
In CPT’s world it would be like, Hey I like that car, I am just going to take it, yeah it would be great. Or hey I like that girl, I am just going to take her, yeah sounds like fun, for CPT. You would call 911 and they would say put the person on the phone, Hey would you please not do that…..pretty please…..please with sugar on top……OK mam’ he won’t listen to us, sorry he gets to do what ever he wants, but we said please to him 3 times, sorry…….you may have to get raped or even die. Captain took our powers, and guns, handcuffs, pepper spray, tasers, but we are allowed to raise our voice on the pretty please part, but if we hurt his feelings you can file a complaint and we will have the police brutality committee look into this…….but that will take weeks…………this is Captains world.

A ticket is a contract. It is a contract stating you acknowledge the ticket and that you will appear in court at the appointed date and time. If you do not sign it, you will be arrested. That means that you have to sign a contract UNDER DURESS, which makes the contract NULL and VOID! Great game the cops and courts have going there…

I was a police officer in my younger days at a top height of 5′4″. I never had a problem with making arrests. This cop was out of hand. For one he’s way the hell bigger and younger and stronger than this woman. He couldn’t handle a little old lady without using a Tazer? This whole department needs retraining on the use of force.
State law does not require the signing of the ticket. The ticket is valid without it. He shoved her first and got her upset. So she used profanity. An officer of the law does not get alarmed or disturbed by the use of profanity. At least they didn’t in my time. Apparently they’ve gotten a lot wimpier at this police department.
I hope she sues and wins a big settlement.

The problem (one of the many problems) with our fine law enforcement officers is that most of these guys are more qualified to work at a gas station than to work in law enforcement. When you have an IQ of about 3.5, it makes decision making difficult. This can easily be seen by the great decision of this fat pig to TASER A 72 YEAR OLD WOMAN?!

Notice how once the victim has been tased and is incapacitated, the officer then threatens the victim with another tasering if the victim does not move exactly as directed (i.e., placing hands behind back). In other words: keep tasering the victim because the victim suffers from the effects from the last tasing.
Does this means that police officers are no longer required to manually place a suspect’s hands behind their back to then handcuff that person? They tell the suspect to make a self-arrest, under the threat of a tasering for either A)Not doing it as instructed, B)Doing it too slow, or C)Doing it wrong.

The crux is that this person just disagrees with you on whether the cop was in the right, or if the cop was on the wrong… whether it was justified or not will be dealt with by the courts… personally, looking at the video, the gal was a bit out of control… It was an unwise move to use the Taser on her however that was a possible death sentence for someone of her obvious age… A taser is a helluva poor substitute for people skills, which are conspicuously absent in a lot of cops these days.

If you want to help prune the disgusting, spam and threatening comments from the news, please add a feature such that the social networking sites such as digg.com and youtube have whereby a number of users can marks a comment as spam and when a certain number (say 5) do so, it is automatically buried. This would help take away most of the trash. Perhaps you could force users to signup before posting comments and then ban their IPs. I know this isn’t perfect but it could be a big improvement and short of stopping comments altogether.

Although it is that simple to solve the ‘problem’ the side-effect complications on a truth site MAY not be worth it…
By starting a ‘flag war’ on a (very popular) ‘truth’ site you are in starting a war with ‘true’ public oppinion. Infowars comment sections will quickly become biased towards non-violently worded, pro Alex epistles…Is this worth it?
It is also possible for trolls to delete all comments externally unless some limit on the number of flags / -ve ratings per page per user is implemented – complicated and still not enough to stop attacks..I contacted via the contact page warning about a comment that posted the address of the coppwe and it was dealt with almost instantly at this time of day (during working hours)…A better solution is to have a contact moderator option buried in a few sub menus of the ‘contact’ menu option…IMO.It already has the anti-automated access facility (all be it crackable as it doesn’t obscure the number image – in theory at least – I digress)….

Hey Cops Rule – There’s a thing called “excessive force”, and that’s what the officer in the video used. Whether she was right or wrong, that amount of force should not have been used on a 72 year old woman.
If she DID have a gun, that would be a different story. But that’s not the case in this situation, is it? Just the facts, man. The facts.
P.S. – I was in the military and can take orders. Just not UNLAWFUL ones. And yes, what he did was unlawful. “Excessive Force” was used, and there’s rules that must be followed.

Why did he want her to sign the ticket when you can get one in the mail from a camera? Didn’t The Book suggest alternatives for clients who decline to sign an admission of guilt?
Manners, civilty and social skills could have taken care of this situation. Even if the woman was rude (and there is no indication she was until he became agressive) he could have mediated the situation without force but with some common sense. His behavior very immature, insecure and completely unacceptable.
Next time, Granny, stay in the car, open the window only a crack, take the badge number and keep your hands visible. Don’t get into a power struggle with an armed individual who is bigger than you are. You could have used a little common sense too, old girl.

When the officer demands she step back, the women tells the cop to hand her the ticket and she’ll sign it. He immediately shoves her back then tazers her. She did agree to sign it before any contact was made between them.

The county next to my county just bought two tazers for their City Police. Tazers are only to be used in a violent situation as non-deadly alternative instead of using deadly force by firing a rifle, or a pistol. Tasers are not to be used for any other reason.
This case is apparently police brutality. What happened was pure evil. So, Third Reichish.
We do not harm our senior citizens in any way for traffic violations. I did not see this lady resist, but she was compliant, and said that she would sign the ticket. But then, he pushed her, and then he tasered her. There is a place in the heart of the earth for men like him. It is called Hell.

Now was the Cop in the right or in the wrong for using the taser? Technically I’d say it’s excessive force to use a taser on a 72 YEAR OLD WOMEN however, there is a sign of non compliance in the women’s attitude that can bring on harsh treatments as we have seen above and she stated and I quote “Taser me I dare you” right at the beginning.

I would like to see a class action lawsuit against the manufacturer of the taser device. I think that the mountain of videos of the elderly, mentally impaired, injured, children, and innocent people who have been tortured with this device by sycophant excuses for real police officers should be played for a jury. I would love nothing more than to see a billion dollar settlement against the manufacturer to put them out of business. I would also like to see legislation requiring officers who chose to carry a taser to be recertified each year with the weapon and be shocked with it at least three times during this certification so that they know how it feals when they do it to someone else.
That is the way I was certified with chemical spray. I think that you should be required to re-certify periodically the same way you are with a firearm.
The original intent was for this weapon to be a defensive one. I am amazed that it has become acceptable for this device to be used for compliance. I refuse to carry one! With the daily videos depicting abuses with this weapon, the public now has every reason to be afraid of the police. You never know the next time you get pulled over, you might end up like granny there. I know some officers who joke about tasing people daily! They think it is funny enough to make a comment about it every damn day! If departmental policy allows for the use of this device in that way, the departments should suffer litigation as well!

It’s absolutely unfathomable for his superiors say that his actions were justified in spite of what was seen on the video. Tasers should only be used if the officer is being attacked or threatened. If you live in Austin, you can go to the Travis County Commissioner’s court meeting. They meet each Tues at 9am and are the “chief policy-making branch and administrative branch” of Travis County. Maybe you can get them to create ‘no tazing granny rule.’ The next meeting is Tues June 16 at 9am 314 W 11th Street (catacorner from the burned Tx Gov mansion)

If you search the internet, you can find under Part B of the General Orders of the Austin Police Department General Policies and Procedures under B101A.08F 6 that it is generally unacceptable to use a CED (Conductive Energy Device) against an elderly person as defined in Texas Penal Code 22.04 which defines an elderly person as someone 65 years of age or older. There was no doubt by this officer that the woman was over this age as she contiually told him her age as 72 so by the Austin Police Department’s own rules, the police officer was out of line.

Start a petition for your local municipality that requires all police officers be drug tested randomly and immediately after any “incident”.
“Incident” being defined from simple auto accidents to deployment of any weapon including taser.
After you get enough signatures get legislation or an up or down vote in an election to make this law.

Improper Escalation of Force.
I don’t want to explain too much, you can Google it. But as a former Police Patrol Supervisor, I can tell you that officer used improper force. He should use the least amount of force possible. I doubt he did that. Common thing to reprimand officers for. That and screwed up paper work. And driving cruisers recklessly (jumping them over curbs, and rolling them) and using code lights to blow through red lights for no reason. And talking on the cell phone. And going to girlfriend’s houses while on patrol. And sleeping while on patrol. And running people’s plates for fun, like friends, enemies, fellow officers, etc.
If a police officer can’t detain the “suspect” in the video without tazing, he should be relieved because he is unfit and cannot perform the job.
(My little sister could have detained that lady. She might have, once or twice.)
Truthfully, I heard her say she would sign it. If she wants to sign it in her car and she’s a little off-kilter
you deal with it in a safe manner for both the officer and suspect. Let the crazy lady sign it in the woods if she wants and send her on her way.
The officer is still responsible for the suspect’s safety as well. I wouldn’t want this shitbird working for me. We took a pistol from one officer he was so irresponsible, and made him dispatch. This is THAT kind of officer.

Sgt Greenbud, it looks like constable’s chain of command needs to be reassigned also. Elected Contable Richard McCain and Sgt Maj Gary Griffin both defended the actions of the officer in the video. McCain is featured in the ktbc original airing of this incident (pre video) and Griffin is quoted in today’s paper calling the officer’s actions “appropriate.”‘

She did not comply, he did not discriminate, and she was treated as any disobedient citizen should be. More than once, they crept dangerously close to the highway. She wasn’t being arrested, she was getting a ticket!!! The only thing she resisted was signing the ticket, which is legal by the way. The only time a cop is supposed to use force, and that includes a taser, is if someone is resisting arrest or he feels threatened. I doubt very seriously he felt threatened by a 72 year old woman. If he did he’s in the wrong line of work. A real PEACE Officer (ie: a real man) would have known how to stay calm and handle the situation appropriately. Dealing with difficult people is a HUGE part of being an officer, if he can’t deal with that in a professional manner he shouldn’t be an officer. You people who think we are supposed to bow down to those in positions of authority really need to educate yourselves a little. You might also want to keep in mind that WE pay THEIR salary!

This is 1000% uncalled for, I can think of reason’s to tase people if need be. On the cops tv show I’ve seen officer’s deal with people who definitely need to be tased and do not do it. This is a case of a cop who is not dealing with a full deck and is a danger to civilians and should have to undergo pyscho-therapy. He thinks he was in the right to do that to a 72year old woman; unless she has a weapon and can harm you or you feel she may do so then you are within your right as an officer to tase her. This is ridiculous and makes me sick, the officer needs to face consequences bc if this is by the book, how many more people will we see get tased if they question an officer’s authority? I was surprised at how poorly the officer controlled the situation and how little thought he gave to his options. As far as personal control, he sounds on the verge of hysteria; I cannot imagine him at Katrina.
First, he should never have reached the point of screaming;screaming never gets the job done and is only useful to overcome extraneous noise. It just communicates that you are uncertain of who is dominant.
Secondly, if he was uncertain on how to control the situation, he could have called for another officer/supervisor.
Third, he is a big strapping boy. Is he so untrained such that he could not physically take the woman’s arm behind her back and cuff her?
He had the option when she said to giver the ticket to calm the whole situation and quietly tell her the time had past for that; that he now had to arrest her and that now was the time to cooperated before additional charges would be considered.
She was not an obvious threat to the officer, the community, nor herself.
This has nothing to do with “his rights”; it has everything to do with judgment and the ability to control emotions under stress.
This is not a guy I can rely on in an emergency. In my lifeboat, I want people who can think the situation through and behave in an effective manner.

Some of the comments I am reading really are suprising and rather immature and without common sense. In reality if any of you were in that situation in either position, how you say you would handle it and how you would actually handle yourself are quite extreme opposites. Cops have an oath that they swear upon when taking the job of a Peace Officer. Many are good and upholding to that Oath so lets not forget that. My father was one of the Finest and REAL cops I have ever known and he earned respect of the community the old fashioned way, through devotion not only to his career, but to the People he devoted his life to protect. So lets not bash all cops, because there are good REAL cops and there are payed off ones as well. That cop should have called for a backup before taser was the option just so as to control teh temper I witnessed in the video from himself and from the woman. He didn’t seem compashionate at all and maybe I missed that I donno? She said ” give it to me and I will sign it” He should have given her the ticket to sign and not reacted in abrupt force. So I think variables here are against both parties.

The video on this website it chopped up to make it look like the cop is not justified. If you watch the whole video the lady is telling the cop that she refuses to sign and to take her to jail. Once she gets out of the truck she tries to run into the street several times, which is why he was shoving her. The cop warns her 9 times that if she doesn’t stop she will get tazed. Ticket is a contract. Sign the ticket without prejudice or under duress (UCC1-207) over your name then when the fascist bastard tazes you have already reserved your rights. The ticket/contract is unconscionable contract (UCC1-302) signed under threat of physical torture. When the judge asks you why the reservation of right tell him you felt threatened. I just want to say first off, most of you guys are idiots. Im going to explain a couple things to yall. 1 When you are stopped by a police officer you are technically under arrest not matter if its for a tag light being your tag being expired or thiers no mudflaps on your truck. 2 by signing a citation you are not admitting guilt, just that you will either take care of the ticket or show up to court to contest the ticket. 3. The citation is an OR bond, meaning that you our released on your “own reconssiance” which means on your word that you will take care of the citation. 4. When you refuse to sign a ticket your are refusing to sign your bond, and when you refuse to sign the ticket thier is no other option but to arrest the violater. It sucks to arrest someone for a speeding ticket, but the law is the law and no grandmother, teenager or cop is above it. 5. When a police officer attempts to make an arrest and you pull away from him, that is considered an act of aggression and will be dealt with accordingly, no matter the age. 6. Most police departments policy and procedures is that a tazer is the route to go with a non complient subject, it is medically founded that a tazer is lot less lethal and injuries occur a lot less then going hands on. 7. When an officer atempts to make an arrest and you tell him no and that your going back to your vehicle, that officer will do anything in his power to stop you. The officer hows no idea why your going back to your vehicle, what you have in the vehicle or anything. The lady apparntly has some from of demntia, who says she wouldent of got back in the truck and pulled out a pistol. Thiers alot of things going on behind the scenes, that most citzens could not even comphrend. 8. Regardless of age, an officer should not have to put him self at risk by being hands on when thiers a even small percentage of being hurt. True that is part of the job, but thats not a risk one should take. 9. If most of you idiots would take the time and actually listen to police, or even particpate in a ride along with your local police department, you might get an small understanding of what police officers do and the danger that they encounter on a daily basis. 10. Most of you people on here are bashing cops, dont have any idea what its like to be in that situation. In fact I would bet most of you have had a run in with law. The fact is that police officers hardly ever encounter the honest people, they alway encounter the bad part of society. 11. Every day its something different.
Last year I was crossing the street in a location with no crosswalk for 10 minutes down the road, so I could get to my car on the other side across from my work. A cop was hiding in a bunch of trees behind the cars, and comes out to give me a ticket. I tell him “Thats just great, yesterday I called 911 on a drunk driver speeding through my neighborhood where kids play and I was told there are no cruisers available to help. Yet you have enough time to stake out a jaywalking location.”
He made me lie on the ground with my hands behind my back, and I had to pay a 300 dollar ticket for jaywalking and obstruction of justice. Guess I was lucky they didn’t taser or kill me….

for all those that support tasering this lady: would it make any difference to you if she would have fallen and hit her head and died, or had a heart attack? Would her death also be justifiable?
To me this is why someone who is a senior citizen should be treated differently-an old person could die from the episode and a 19 year old probably wouldn’t. Why would an officer want to take a chance with a senior citizen, risk his career and cause the death of someone. Had that happened he would lose his job and the public would have been horrified and the city sued.
Old people are different, are more fragile are in pain and struggling….come on police, don’t support yourself or other officers to take a chance-the fall alone may cause severe injuries and broken bones and like I stated before – DEATH- does someone deserve that for being sassy or whatever you want to say about her……????

FYI – The meaning of the word punk has changed over the years but generally it had a negative connotation. It could be used to describe a street thug or even a younger man who is the lover of an older man. Just because another generation hijacks a word doesn’t change it’s original meaning. The taser is for when the cops feel their ‘life is threatened’.
They could have easily used conventional (dare I say it) methods and just use pain compliance via the appropriate nerves (cops are trained in this). The neato about that approach (beyond living is that the person administering the PC must reduce the pain when the subject complies or they will just end up in a fight. Too often cops say the taser got stuck ‘on’.

poor lady. when I was a kid when I saw a police officer I felt safe. when I had dealings with them they were always respectful.
now I am not so sure. as for the ticket I have heard several ideas about it. some people say just sign it writting under duress or under threat. I also heard sign it as agent for the name on the license. since it is believed by many, including lawyers, that names in all capitals represents a corp entity, which I tend to agree with to a certain extent, just look at all cap letters on names of departments in the government, corp names etc. I put on my license without prejudice ucc 3-301. and all rights reserved. which basically means I will not be compelled to honor or obey contracts that I did not knowing and with full disclosure enter into.
also I read the ohio revised code, united states code (no wonder they call it a code it is rather hard to decipher.) it says a motor vehicle is a wheeled, device, I think that is the term they used, that moves on the highway and roadways for commerical purposes. so do you drive or travel? blacks law says drive is to “drive” for hire. think taxi driver, carriage driver (real horsepower) etc.
so when you register your automobile, which I think is fraudulent considering I never registered anything, so maybe the dealer I bought the truck from did without my knowledge, as a motor vehicle which puts you under commerce and under fed jurisdiction. so you need a license to drive it, plates and special insurance etc. thus you waive your rights when you get your truck/car registered which is considered voluntary, if your not driving, but only traveling and that you have declared your auto a motor vehicle thus without your knowledge putting yourself in the commerce game with no rights only privileges.
thus they can enforce victimless crimes against you.
police officers are not taught law, codes etc, they are taught procedures. no wonder we are in trouble. if they took the time to actually read the fundamental law, the constitution, and then the defintions of motor vehicles, contract laws etc, then that would be half the battle.
if you read the motor vehicle code, the income tax code you will find the defintions we use in common usage has been given different defintions, no doubt deliberatly done, so as to defraud us of our life, property and freedoms. some people can be real CREEPS!
please be careful, do not incite violence against officers, remember they are only servants of people who are servants of another higher group etc, and are only taught what they want them to know. it is quite possible, in my opionion, that thugs are hired to enforce so called laws to abuse their authority and they back them up, you know problem reaction solution. create the problem, get people to react something must be done and offer your solution you wanted in the first place.
why not hire private police? or maybe allow the united nations to send in troops to enforce laws since the ones here abuse theirs so much, who knows what the agenda is in this instant. maybe they want to incite a civil war, create such distrust between everyone, divide and conquer that they hire thugs or misinform their officers of the real laws.
the owner of teamlaw forum said that there is only 2 ways corp U.S. (which the irs codes defines the United states federal government as a corporation, I read it myself) can become the legit government, instead of de facto or colorable, and that is either by majority vote, which means coming clean completely what they are doing, (and we know the people wouldn’t vote them in) or revolution, riots and violence to justify martial law and a coup.
so what is true and not about what is going on? can’t say for sure. one site I read believes, but admits no real evidence, that we are all really just been made beneficiaries to a trust the government de facto being the trustees, and beneficiaries do not have rights only priveleges thus the trustees can take away our car, house, money etc without due process. you labor is also considered part of this trust. contracts are only thing that overrides constitution. and they have used that loophole big time by tricking (shall I say lying) us into contracts without our knowledge.
that using federal reserve notes are part of a trust and that anything purchased with them belong to the trust and we as beneficiaries get use but not ownership and if we break terms of the trust we lose the property or privelege. that means the car could thus be considered part of the trust and as beneficiaries we have no rights and thus have to abide by terms of the trust, in this case the motor vehicle code. but if you can keep the fed reserve notes long enough for the debt on that particular serial number is paid for the note then becomes real money and thus you own what you buy, unless you register it. he thinks that is why they burn the notes and have anti hoarding laws on keeping large amounts of cash home in a safe.
reminds me of a couple who spent most of their lives saving up their money in a hidden safe, when they retired they had saved more than 400,000 dollars, no doubt those serial numbers notes had their debt paid for and were real money, so their house was raided on trumped up drug charges, later found there was no drugs, they found the safe and forced it open, and took the money saying there is no way this money can be non criminal gain, they never did get it back even then they had years of income tax forms and papers proving they had made that money over a long period of time. in other words guilty until proven innocent.
no doubt the anti hoarding law was one of the real reasons for seizure without due process under the pretext of no criminal should benefit from ill gotten gain. that money was real money at that point since the debt on it was probably extringuished long ago.
now how much of all of this is true? not sure, evidence is gradually mounting by many many people, and I hope true insight into what is really going on is found before the internet is shut down.

Gotta tell you, this guy had it right. The police don’t just “claim” she acted inappropriately, the video proves it to anyone with two eyes and ears. The woman resisted arrest and had her chance to deal with the ticket with civility (and for God’s sake, humility) in the comfort of her truck. She treated the man with disrespect and would not listen to the voice of reason, nor of the law.

I can not stand anything about cops. I hate the way they look, smell, walk, talk, and act. I cant even stand it when they breath. Having said that, the cop was in the right. Watch the video, the unedited video mind you, and tell me she did not provoke him. Be honest about what you see. This was not malicious, ill-willed or anything like that. She broke the law, resisted arrest and got what she deserved! And remember kids she hasnt said a word about it since the real video came out, so pay attention you fear mongering morons and shut your dumb faces. The day i belive she did not deserve this is the day I belive infowars has had a billion hits.
