    AUSTIN — The state’s top law enforcement agency asked Texas Attorney General Greg Abbott for a ruling on the legality of setting up statewide driver’s license checkpoints.

    The Houston Chronicle reported 15 lawmakers said such a move would be unauthorized immigration policymaking.

    The proposed checkpoints would stop drivers to review their licenses, vehicle registrations and proof of insurance.

    A number of state legislators argue the Department of Public Safety Commission overstepped its authority Aug. 25 by issuing new rules requiring applicants to prove they are legally in the U.S. before they can receive a Texas driver’s license or identification.

    Two weeks later, lawmakers were further disturbed after learning the commission’s chairman, Allan B. Polunsky, wanted a ruling on the checkpoints.

    State Sen. Leticia Van de Putte, D-San Antonio, and 14 other Texas lawmakers sent Abbott a letter asking him to ignore the commission’s legal opinion request because the Legislature has not authorized a DPS checkpoint program.

    – Checkpoints haven’t been allowed in Texas since the state Court of Criminal Appeals ruled in 1994 they must be authorized by a “politically accountable governing body at the state level.”

    – Spokeswoman Allison Castle said Gov. Rick Perry favors the checkpoints.

      Austin PD has begun forced blood draws from anyone who refuses a breathalyzer or field sobriety test. Cops ALWAYS ask you to blow the meter, so anyone who doesn’t surrender their rights gets hauled to jail and stuck with a needle and has their blood drawn.

      The US Supreme court has authorized sobriety checkpoints. Now DPS will begin their own cheeckpoints for registration checks. The one group that doesn’t have to worry are the illegals, they clearly aren’t after Illegals. They are after us. This is about the same military style checkpoint strategy they are using on the Iraqis.

      This article is slanted towards pro-illegal immigration, and doesnt mention how these checkpoints would also reduce the frequency of stolen cars, and the amount of cars being caught that are stolen, not to mention decreasing illegals.

      Look at what #4 said, “leave the borders open”. Everything about this article is pro-illegals and is very biased in that sense.

      Yes, the checkpoints are a nuisance, but, they arent at every street corner (yet) and if you have nothing to hide, then dont be worried about them.

      I wouldn’t mind so much if they ONLY asked to see your license and gave it a quick look to see that the photo matches the drivers face…as that would be a quick and fairly benign way to check for illegal immigrants whom might be driving without a license, etc. However, to ask for registration and insurance info reeks of alterior motive…that being to simply bust anyone whose “papers” aren’t in order, thus creating revenue for the city.

      Checkpoints cannot be done and operated everyday, because they require more police to be on duty, and most precincts cannot afford to hire and keep the officers on duty. Checkpoints are not permanent, and are usually done on certain times or days.

      Example: When driving down the road and you see the cruiser in your rear view mirror, what happens. Everyone one goes through the process of oh shit! Am I going to get pulled over and for what? Total paranoia. This is wrong. It shouldn’t be that way. We should have the feeling of security and safety. I’m sure glad that the officer is behind me because if anyone was actually committing a crime, they would be there to deal with it.       I just got back from Russia. They have check points like this entering cities, where they stop everyone and check their documents. They police also stop you for bribes.

      In my own town I grew up in Beautiful California, the police departement has morphed from a Live and let live attitude to stopping pretty women in SUVs so they can strut their power. They even stoped me twice this year. I’ve watched police departments across the country turn into monsterous instruments of the police state. Until we all start banding together enmass we will go no where.

      We have only one Ace up our sleave. The federal govenrment or even Scwarzenneger Gross Archige Tuepe will in their hubris really pull something that is going to require a responce. Be ready for it. Make peace at least with your neighbors. You may need them later. People are not ready for the truth, but at that point they just might be if they see their fate and that of those they love flash in front of their eyes. It will be a catylizing event, and at that point patriots need to do to them what bush and all those criminals have done to us. Push it for all its worth. I appreciate the fact that your law abiding person and want to follow the laws of the land, but if a law goes against the US Constitution the supreme law of the land than it’s an unlawful law and should be questioned. You have a right and a duty as an American to question such laws, and have them changed. Just because the legislature makes it a law it does not mean that it’s right. Remember Politicians make the law and their character is in question most of the time. Checkpoints violate the US Constitution, and Texas law and should not be allowed please call your Representative and tell them you want this stoped. If you are a illegal immigrant, drinking driving (drunk), a wanted criminal, and terrorist I can see why you would not like check points. The only disadvantage I see in check points is the time it might take to do it, but when you consider the advantages, like the drunk driver that might kill another car load of people in an accident, or someone that doesn’t know the laws of the land (yield, slow for yellow caution, stop on red, wrong way, etc., etc.), or possibly a terrorist that has no intentions of following any laws what so ever. I think even though they might inconvenience me and others from time to time they might just be quite acceptable.

You also impede their right of enjoyment of any right when you stop them for no reason! This is wrong and should not be tolerated by the American people. Write your Representative or call and tell them to stop not because you dont have anything to hide, but you have the right to be left alone when you are not doing anything wrong!
