Texas Gov. Perry Favors Unconstitutional Checkpoints

AUSTIN — The state’s top law enforcement agency asked Texas Attorney General Greg Abbott for a ruling on the legality of setting up statewide driver’s license checkpoints.
The Houston Chronicle reported 15 lawmakers said such a move would be unauthorized immigration policymaking.
The proposed checkpoints would stop drivers to review their licenses, vehicle registrations and proof of insurance.

A number of state legislators argue the Department of Public Safety Commission overstepped its authority Aug. 25 by issuing new rules requiring applicants to prove they are legally in the U.S. before they can receive a Texas driver’s license or identification.
Two weeks later, lawmakers were further disturbed after learning the commission’s chairman, Allan B. Polunsky, wanted a ruling on the checkpoints.
State Sen. Leticia Van de Putte, D-San Antonio, and 14 other Texas lawmakers sent Abbott a letter asking him to ignore the commission’s legal opinion request because the Legislature has not authorized a DPS checkpoint program.
– Checkpoints haven’t been allowed in Texas since the state Court of Criminal Appeals ruled in 1994 they must be authorized by a “politically accountable governing body at the state level.”
– Spokeswoman Allison Castle said Gov. Rick Perry favors the checkpoints.

Austin PD has begun forced blood draws from anyone who refuses a breathalyzer or field sobriety test. Cops ALWAYS ask you to blow the meter, so anyone who doesn’t surrender their rights gets hauled to jail and stuck with a needle and has their blood drawn.
The US Supreme court has authorized sobriety checkpoints. Now DPS will begin their own cheeckpoints for registration checks. The one group that doesn’t have to worry are the illegals, they clearly aren’t after Illegals. They are after us. This is about the same military style checkpoint strategy they are using on the Iraqis.

This article is slanted towards pro-illegal immigration, and doesnt mention how these checkpoints would also reduce the frequency of stolen cars, and the amount of cars being caught that are stolen, not to mention decreasing illegals.
Look at what #4 said, “leave the borders open”. Everything about this article is pro-illegals and is very biased in that sense.
Yes, the checkpoints are a nuisance, but, they arent at every street corner (yet) and if you have nothing to hide, then dont be worried about them.

I wouldn’t mind so much if they ONLY asked to see your license and gave it a quick look to see that the photo matches the drivers face…as that would be a quick and fairly benign way to check for illegal immigrants whom might be driving without a license, etc. However, to ask for registration and insurance info reeks of alterior motive…that being to simply bust anyone whose “papers” aren’t in order, thus creating revenue for the city.

I have heard on talk local radio programs on this day about the subject of this article and have been appalled at the level of intrusion some consider to be prudent and otherwise good for the public. Checkpoints cannot be done and operated everyday, because they require more police to be on duty, and most precincts cannot afford to hire and keep the officers on duty. Checkpoints are not permanent, and are usually done on certain times or days.
Its called proactivity, that what checkpoints are.

I was just listening to alex and his guest and the guy said how to we put animals to slep when sick, we don’t sceare the animal, we take them in and inject them and they die quietly.
many of the people in this country are like little children or animals being put to sleep, they want to feel loved by government and made to feel a peace while they are slowly getting poisoned to death, but they take the poison happily, so they make mommy and daddy government happy and the nation will be stronger if they take the medicine.

Hi everyone,
I’ve recently noticed that we’re not doing enough to expose the New World Order. I’m a New Zealander, and I’m currently a 17 year-old armchair activist. That’s all going to change in a matter of days – because I’ve paid for an ae911truth banner which is being printed by a local sign-making company. I’m going to get the sign and then hang out around a local University with a couple of friends. More of us need to do this! It’s so damn easy. Forget about having a new computer/tv, forget about gaming, and realize what’s at stake here!
There are truth groups all over America. If you happen to live in America and you are reading this knowing that 9/11 was an inside job, then why aren’t you out there helping? Go to wearechange.org and make a difference by joining your local team. At the very least you should be showing documentaries to your friends/family/co-workers. Try running a movie night – buy pizza or cook something. Make it fun and get the truth out.
Now is the best time to act – let’s make a difference before it’s too late!

Well this will start in the cities, but will move into the rural areas. for anyone who does not understand the control system being put into place, check out some of the FEMA courses on line, especially the incident Comand Courses. You will see how the charts work for command and control, and the idea is to centralize all power into regions, then set up a large pyramid of control.
Now how do small groups run everyting, well it is all bout span of control. one leader should only have 5 to 7 people under them, and you can expand that so that one controlls five, those five each control five to seven, and it goes right down the line. Each Division head, or branch director only knows that they are supposed too, and this is how it is all done.
so the Elites have done thrir jobs well and are now just getting their plan in full swing, because now the time is right, and you will see it step by step and it will move quicker.
So most wil just stay asleep, not care or only care about their comfort and keep their heads in the sand.

I’m a Deputy in Texas, and I will refuse to work a checkpoint which violates the US Constitution and Texas law! I will consider the order as unlawful and refuse! By the way I’m one of the few Deputies that isn’t fat. Not all of us are fat fascist pigs! Some of us believe in the US Constitution which we swore an oath to uphold and defend against enemies foriegn and domestic. Some of my co-workers agree with me. Last year I returned home to San Antonio; my great grandfather was the last messenger out of the Alamo and 1st Mayor of San Antonio…the short of my point is I am as much Texan as Texas.
Like many in my family I went out into the world to make my fortune; I had no idea I would not be able to go home one day. Good for you #38, but also keep in mind that you can fight for the truth and justice much better from the inside as #47 posted. Many of us would love to have the trust and respect for law enforcement, but unfortunately as you are aware circumstances will not permit so.
Example: When driving down the road and you see the cruiser in your rear view mirror, what happens. Everyone one goes through the process of oh shit! Am I going to get pulled over and for what? Total paranoia. This is wrong. It shouldn’t be that way. We should have the feeling of security and safety. I’m sure glad that the officer is behind me because if anyone was actually committing a crime, they would be there to deal with it. Also what gives any man the right to take away our God given rights to sell them back to us in the form of licenses and permits under the color of law? The whole system has been twisted and perverted and just because we don’t have chains on us, (yet) doesn’t mean we live in a free society. There is no doubt that anyone driving a vehicle under the influence of anything that would endanger other people needs to be taken out or off the road period, but to stop someone for some minor infraction, which is not a crime, to run them through the 3rd degree, your papers please and all the other processes is not right, justified or lawful. It’s all about generating revenue because our entire so called law system is based on UCC code which has fraudulently subjected the American people to admiralty/maritime law which has absolutely nothing to do with rights, the constitution or even real law itself. I just got back from Russia. They have check points like this entering cities, where they stop everyone and check their documents. They police also stop you for bribes.
In my own town I grew up in Beautiful California, the police departement has morphed from a Live and let live attitude to stopping pretty women in SUVs so they can strut their power. They even stoped me twice this year. I’ve watched police departments across the country turn into monsterous instruments of the police state. Until we all start banding together enmass we will go no where.
We have only one Ace up our sleave. The federal govenrment or even Scwarzenneger Gross Archige Tuepe will in their hubris really pull something that is going to require a responce. Be ready for it. Make peace at least with your neighbors. You may need them later. People are not ready for the truth, but at that point they just might be if they see their fate and that of those they love flash in front of their eyes. It will be a catylizing event, and at that point patriots need to do to them what bush and all those criminals have done to us. Push it for all its worth. Maybe I can just drag ass, but I do agree with you about DUI illegal checkpoint or not they endanger other innocent people and I will put their ass under the jail! It’s good to know that there are other Law Enforcement Officers out there that still believe in the US Constitution and in America! To #57 I’m a Deputy in Texas and I have to disagree with you I dont consider myself an owner of anybody. I appreciate the fact that your law abiding person and want to follow the laws of the land, but if a law goes against the US Constitution the supreme law of the land than it’s an unlawful law and should be questioned. You have a right and a duty as an American to question such laws, and have them changed. Just because the legislature makes it a law it does not mean that it’s right. Remember Politicians make the law and their character is in question most of the time. Checkpoints violate the US Constitution, and Texas law and should not be allowed please call your Representative and tell them you want this stoped. You have that right, and you live in a free country so dont feel like you have to obey an unlawful law.

law abiding citzens don’t worry about check points, and if you don’t have check points, why have drivers license, or laws requiring insurance. If you are a illegal immigrant, drinking driving (drunk), a wanted criminal, and terrorist I can see why you would not like check points. The only disadvantage I see in check points is the time it might take to do it, but when you consider the advantages, like the drunk driver that might kill another car load of people in an accident, or someone that doesn’t know the laws of the land (yield, slow for yellow caution, stop on red, wrong way, etc., etc.), or possibly a terrorist that has no intentions of following any laws what so ever. I think even though they might inconvenience me and others from time to time they might just be quite acceptable.

#63 I appreciate the fact that you are a law abiding citizen, but you should not have to justify that you obey the law when your stopped illegally at a checkpoint. You should not be stopped, and treated like you are a criminal when you are obeying the law. When there is no probable cause to pull a person over they should not be stopped period! I’m a Deputy in Texas and if you are breaking the law I’ll pull you over, but I will not stop people if they do not give me a reason to pull them over. Number one when they stop you at a checkpoint you are considered detained, but in order to detain somebody are to pull them over I need probable cause. In a nut shell I need to be able to prove that you are breaking a law before detaining you. You cant do that if you stop everybody indiscriminately! You also impede their right of enjoyment of any right when you stop them for no reason! This is wrong and should not be tolerated by the American people. Write your Representative or call and tell them to stop not because you dont have anything to hide, but you have the right to be left alone when you are not doing anything wrong!

I have a friend who is a die hard replublican, in his eyes replublicans do NO wrong. Hence his blinders. We totally agree on hating Obama at least. N-E-ways he is the one that told me about these checkpoints. My IMMEDIATE response was that it was unconstitional. He asked WHY? I said because of illegal search and seizures. He was like, well they are just asking for your license. I told him it was illegal for them to search for your license unless they had a warrant. He said a policemen can ask for your license anytime he wants. SIGH I gave up on argueingwith him. When his Replulicans can do no wrong face came on and I got a speech about illegal immagration.. Sigh logic went out the window at that point so there was nothing i could say.

My daughter recently enrolled in a driver’s ed. program offered by the high school. She was told that she had to present a state certified birth certificate, a federally issued social security card, and a variety of notarized paperwork. I find this interesting about the article: the article implies that the decision to require these documents was a state level mandate; however, my daughter’s driver’s ed. teacher and a staff member at the DMV told her that the requirement was established by the Department of Homeland Security.

Unfortunately what your saying is true #77, but I as a Law Enforcement Officer I think that illegal immigrant’s are just that ILLEGAL, and need to be arrested and deported back to Mexico! I will do what I can to defeat the NWO! Again I’m against checkpoints period as they violate the US Constitution, and Texas law.
