    (L.A. Times Opinion) – The Supreme Court’s decision in the District of Columbia vs. Heller case settles a long, heated debate, finding the 2nd Amendment protects an individual right to own weapons for self-defense — not merely a right related to membership in a “well-regulated militia.”

    But the ruling doesn’t end the struggle over gun control, nor does it mean gun regulations have been eliminated. The court lists a number of laws the decision does not affect, including concealed-weapon prohibitions and “long-standing prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms.”

    Still, even though the decision didn’t ban gun control outright, it did make a strong statement about our right to self-defense and safety.

    The city of Washington claimed its gun ban helped protect citizens. But the facts show how foolish it is to rely on gun control for safety.

    Washington’s per-capita murder rate has exceeded the rate in 1976 (when the ban passed) every year but one since then. For 10 of the last 30 years, its murder rate was more than twice as high as in ‘76. The ugliest aspect of D.C.’s law was its implication that your life is not worth protecting — given that police cannot, and don’t promise to, protect you in every life-threatening situation.

    Like other epochal Supreme Court decisions, Heller will give rise to a protracted legal and public-policy debate.

    Leading gun-control advocates, such as the Brady Center, are already spinning Heller as a victory: They claim the gun-rights lobby’s strength is based on stoking the public’s slippery-slope fears that any gun regulation is a forerunner to a total ban. With that ban now impossible, gun-control advocates believe they’ll have more ability to restrict sales, possession and carrying in ways short of prohibition.

    Gun-rights advocates, for their part, are expected to use this decision to challenge Chicago’s handgun ban next, attacking another important question: Does the 2nd Amendment apply to state and local or only federal laws?

    The right at issue — an ancient right, preserved but not created by the 2nd Amendment — is that of self-defense. The gun-control debate will continue, but it is a blessing that the court has refused to deny us the means of protecting our homes and families.

      It’s a start in the right direction. As far as I’m concerned, anybody not imprisoned should be
      allowed to possess a firearm, including ex-felons. They’ve done their time and are entitled to
      the same rights as the rest of us, including the right to protect themselves and their property.
      As far as mentally ill people, unless their mental illness can be demonstrated to absolutely
      pose a threat to society, they should also be allowed to possess firearms. For instance, are
      our soldiers returning home with PTSD to be denied the right to defend themselves. I wonder
      how many would serve in the military if they were told if they return home with PTSD they’ll have
      less rights than the criminals and the police.

      Gun rights enthusiasts who believe that gun ownership in some way protects them from the U.S. military have another thing coming… Guns can’t protect you from psycho-tronic warfare. I guess it’s good to own a gun to protect yourself from other citizens, but you don’t stand a chance against beams of microwave radiation!

      First realize 50% of the worlds problems is bad parenting. Once that has sunk in, consider this. Neighborhoods that require you own a gun to build a house there, across the country, have not had a single break in. Guns secure the good people. The founding fathers anticipated crazy people getting guns and doing stupid stuff. All the more reason for us good people to have guns, to fight the bad. Good kills bad, this is how it works jas. Consider VA shooting recently, imagine if the people were armed, the death toll would more than likely be 1, the shooter. Instead of relying on the cops to flack jacket up for 2 hours, we the militia take care of these things, it’s an American responsibility to grow balls, and not cower.

      We are supposed to be able to wield our weapons openly, on holster or rifle strap on back. This is how it was in America for some time, the streets were allot safer. The amount of people does not matter, some try to say since there are so many more crime increases. You must look at this as a ratio, amount of crime per person living. If you took guns away from the citizens of this country you do not destroy the ways criminals get guns on the black markets.

      travis, if you read the courts ruling, it describes that the arms available may be used to raid armories and acquire more and better weapons, as the founding fathers did. microwave guns wont be a standard weapon in the event of a coup. there will still be many ground soldiers and ways to take out vehicles that have advanced weapons. God forbid this happens of course, but the amendment still provides a sufficient starting point for citizens.

      Yes this is a major victory. However, we still have a battle on our hands as not all of America is free to own guns. Too many cities and states are still being led by evil suppressors who will stop at nothing to squash the nation’s second amendment rights.

      In Switzerland, it is law that every citizen (male) be armed, for just that reason.
      Yes, we hate the weapons, but the world is what it is, and sooner than you might think,you will have a gun or else perish. No one has the right to take that away from you. THAT was the message sent through in the court’s decision.
      It is pointless to quibble whom might have guns. And, frankly, I would be more
      worried about a drunk with a gun than a felon. And, as to the mentally ill issue, what is to consider is the authorities’ defenition of that. If you so much as go to a
      marriage counselor, you will lose your right to have a gun.
      Back in 1991, there was a Leninist thing presented as the Bush Crime Bill. It would’ve
      made registration of all guns mandatory.The extent of it was that if you had an
      inoperable antique and it wasn’t registered with the feds, a mandatory 25-year prison sentence would come down on you. A bit harsh,eh? No surprize when nazis are trying to disarm this nation for a takeover. History repeats itself. Over and over.
      The purpose to having guns is to prevent tyranny, and for self-defense. What the
      bad guys do is less likely to happen if they fear their intended victims might be armed. Are you “getting it” yet? I ask you, and all others who think about guns the way you do, to think about what I have just explained. Common sense needs to
      come to the forefront. We can’t afford to get locked up in hippie-esque disdain.

      It has somehow become unpopular to own firearms, the media did this to us. If everyone owned firearms it would be impossible to regulate, if we were armed to the teeth the NWO would come to a stop. The saddest part is if the redcoats showed up today they could take the city with muskets.

      YOU HAVE NO EXCUSE NOT TO OWN A FIREARM. Go to the next gunshow and buy a military surplus semi-automatic rifle (Ak47, G3, FAL, or cetme knock off… THE BAN IS OVER for now so buy them while you can, buy the 100rd beta mags, the 30rd mags), you are looking at $300-$500. If you are worried about paperwork do a private transaction with a citizen. Then go to your local range and have them teach you firearm safety (most ranges will do this for free). Learn how to shoot and teach your children how to shoot. Buy guns as gifts for people, Christmas is coming and there are millions of people in the US who have never shot a gun…STOP BEING SHEEP.

      I hate to say this, but the ones who worry me the most are many of my fellow liberals. We should
      be the first to support the citizens’ right to possess firearms. We’re the ones always calling the
      neocons a bunch of fascists, and rightfully so. For those of you who have some kind of fear of
      firearms, such as your little kids getting ahold of them, let me give you 4 pointers on guns, not
      from your enemy the police who want you disarmed, but from a fellow concerned citizen:
      1) never point a gun at anybody unless you intend to protect yourself from them
      2) whenever you decide to fire a gun, loaded or unloaded, assume it’s loaded and either shoot
      into a telephone book (probably 2) if inside or shoot at a tree or some other object if outside
      3)if you should decide to ever carry a gun with you, don’t be afraid to pull it out if necessary
      and
      4)once you pull it out if necessary, you better be willing to use it or the folks you are trying to
      ward off will use it on you.

      The great thing is that I have the right to bear arms. But we as Americans need to be aware that the U.S. Constitution only protected us from the federal government infringing our rights to own and bear arms. Nothing is mentioned about State Storm Troopers coming to our door and telling us that the state government has decided to force us to get a weapons permit to take the firearm with us for protection as we leave our house. This clarification is not a victory for gun owners. It will only lead to our having a biometric chip implanted in order to take the firearm out of our house. We are going to be disarmed by the state and local governments if we are not carefull. This Clarification is a loss not a victory. And don’t ever believe it is a victory. The supreme court has now efectively locked our guns in our oun houses. You watch

      Read carefully; “A well regulated militia, being necessary to the security of a ferr state, the right of the people to keep and bear arms, shall not be infringed.”
      James Madison argued the point with many others that the people need to fear the federal standing army due to the tendancy of government toopress the people. By argueing for the second amendment he and others made guarantee the ability of the people to stand against federal opression or take over. This point was debated extensively because the fear of federal power exceeding that of the individual states and the people. THE RIGHT OF THE POEPLE TO KEEP AND BEAR ARMS IS INTENDED TO “REGULATE THE MILITIA” OF THE FEDERAL INSTITUTION! If the debates of our forefathers are read and remembered there is no question about this right. The idea of self protection is true, however in those days it was to protect oneself from federal powers (such as King George!) not to merely protect oneself from a crackhead mugger.
      Keep your arms, no matter what some idiot may proclaim as “law”, we are collectively responsible for the protection of our nation and freedom. Be a true Patriot, stay prepared and fear no other man. Our Constitution and Bill of Rights have delivered that to our hands.

My “right” to carry, own or use weapons in whatever way I find necessary is not granted by nor can be questioned by some government body or a court. You see, the police can only react to what already happen. The police can, hopefully, catch the person(s) who committed the crime, but never stop it.
      The reasons the victims of Katrina didn’t fight back was because for one they where out-armed. Two, those people are good law abiding citizens. They, unlike your comment, are civil.       If every law abiding citizen carried a gun there would be less crime period! All this hype about how many people die each year from hand guns. What about the hundreds of thousands that die each year from the drugs put out by the pharmaceutical cartel and doctors that prescribe this poison?       What about all the deaths each year from car accidents? Maybe we should start banding cars.

      These days a lot of people here in Australia can’t help but roll their eyes when yet another massacre in the US makes the headlines. That it keeps happening and that no one can do anything about it would almost be laughable if it wasn’t for the fact that people are dying everyday in your country.

      Gun control’s existed here for more than a decade, and I’ll tell you now that our right to safety seems so much more assured knowing that any Joe Blow can’t just wander into the corner shop and pick up such a deadly weapon.

      This talk about protection is rediculous. There’s a million ways someone can protect him or herself during a life threatening situation (particuarly if the chances are that your attacker isn’t carrying a gun). And if you seriously think that your firearms are going to keep you safe in the case that your federal institutions go mad with power as the US decends into some kind of police state then you’re just deluded. Getting yourself informed, speaking out and rocking up on election day are far more effective “weapons” of protection from your own government than a bloody rifle!

      Sure, your forefathers obviously thought the right to bear arms was an important right for Americans to have in their time, but they also understood that this kind of thinking could become outdated and ultimately need to be changed – hence they allowed for the possibility of amendmants…

      This government was designed to reflect the best the mankind could offer in the way of government, and as students of history our founding fathers found their inspiration in ancient Rome and decided that a government to be ruled for the people, by the people, was best a, Republic.

To this effect our founders struggled to come up with a system which would prevent our newly created Republic from doing what all bureaucracies naturally tend to do, grow. Grow to the point of no longer serving the interests of the People, but rather only serving the interests of itself, tyranny, which is exactly what befell their model, Rome, and what happened to Rome?
      So there lies the problem, one of many they faced. How do they maintain a Republic for the people, by the people without letting it slip into tyranny, into an Empire? How do they keep the control in the hands of the people?
      Our founders were truly great men, for they knew what all great men should know, that they do not know everything. So their answer came in a contract, the Constitution, in my humble opinion, the single most amazing advancement the world had known.
      Within lay the malleable framework of our Republic, meant to last into the ages because it was designed to bend and flex where needed so it could never be obsolete and the spine of the design, the answer to maintaining a Republic in the hands of the people, was the Bill of Rights. When viewed in this context, it’s easy to see what theses Amendments were designed to do, keep the People free. Just as Rome became an Empire, our founders knew that the same fate could and would befall all government, so they imbedded within our Constitution, certain clauses, along with our Bill of Rights, to prevent this and if needed combat this natural trend. They made sure the power would be with The People.
      As Citizens of this united Republic, the responsibility is ours to enact, invoke and utilize these Rights and clauses whenever the size and scope of our beloved Republic grows beyond the boundary of its original purpose. Sadly to this effect We the People, have failed. Why and how is a topic for a whole other discussion, but the effect is that we as a People are less free, we have less rights. Our Rights are trampled on a daily basis and our Constitution is not enforced. One only needs to look at how this country goes to war to see how badly eroded our freedoms are. We our bound by the Constitution to put congress to vote for a declaration of war, prior to going to war, this ensures Us the freedom of choice, to choose the fate of our Republic, and ourselves, but when was this done last? I don’t blame this Administration, because this one is only doing what was allowed to be done by the previous one, and next will do the same to be sure, because once obtained, bureaucracies never willingly relinquish power.
      If you want to see who is to blame for this you only need to look in the mirror. It is Our fault. Whether, by fear mongering, manipulation, or ignorance, We, neglected our responsibilities, We, let our grasp slacken and now the beast of Our creation is loose, trampling its creator. We have only ourselves to blame, and likewise we have only ourselves to reclaim Our power, Our control.
      Now, when it comes to the 2nd Amendment, it was designed with the same intent as the other nine.
      This Amendment refers to the “people”, which in every other Constitutional interpretation of every other instance “the people” refers to the collective right of the people. The “militia”, when defining it in the way our founders saw it, was not the National Guard, it was informal, where service was voluntary and whose purpose was to fight a defensive war against aggressors. A modern-day equivalent that comes to mind might be the French resistance fighters during WWII, who fought the Nazis and the puppet French government.
      So in the founders view, the 2nd Amendment was, to paraphrase:

      Because the ability to have at any time an effective resistance force is essential in ensuring and maintaining a Free State, the right of the people to have weapons should never be violated by the government.

      It has nothing to do with hunting. It has nothing to do with protecting your home from robbers or drug addicts. It has everything to do with bestowing the responsibility of ensuring and maintaining a Free State squarely on the shoulders of The People, it’s meant to serve. We are essentially the guardians of Our Republic. When viewed with this in mind gun legislation, becomes absurd, and as some suspect sinister. Absurd, because gun legislation will only ever keep guns out of the hands of people who already obey the law. While the ones who don’t will always have access to guns. Absurd because gun legislation will turn law obeying citizens interested in self preservation, a fundamental human trait, into criminals. Absurd, because gun legislation makes us more susceptible to violent crime. Absurd, because gun legislation, will never remove the guns from the bodyguards of the rich and powerful who push for gun control.
      Sinister, because gun legislation turns citizens into serfs. Sinister, because gun legislation has always been the first steps taken by every Dictatorship and tyrannical government, essentially it removes the ability of the People, to perform the very task they were entrusted with by the founders, the preservation of the Republic.
      In the end We are responsible for ourselves out actions and our inactions. The right and ability to maintain a free Republic is the responsibility of every citizen, and it requires that we are knowledgeable, willing and able to fulfill our duties. Loosing any one of these reduces us to salves and serfs, and little by little our Rights and the ability to enforce them are taken away, until we, like Rome turn into an Empire ruled by the elites, only to fall as all Empires do, because they rule without the consent of the governed.

      I know absolutely zip about guns so I know I’ll have to have some pretty intensive training regarding handling/cleaning/bullets etc.

      Where I live we can conceal carry with a permit, and do have to prove we can handle it first and get some cert of some kind.

      The criteria I think I’m looking for is
      easy to use
      fits in my hand well
      no huge bulky ones, but one easily carried-even in a shoulder ‘holster’/purse etc
      has a good track record of reliability
      and what else I do not have a clue

      The thing that is nice about 7.62×39mm is the price. You can buy 1000 rds. of Wolf Military Classic for under 200.00. My AK shoots this ammo all day. I won’t run the Wolf through my ARs though, brass cases only. That makes that DPMS much more expensive to shoot, .338. Hell I can hardly afford my .223/5.56 ammo.

      It was the NRA concessions in 1968 that really changed our culture.

      Yet there is NO evidence that people suffering from mental illness are any more likely to commit a crime than any other demographic group.

      Simply look at the facts in say Chicago; before the passage of the Illinois FOID card and the 68 GCA there were 395 Homicides in 1965. That number skyrocketed in 1972 and again in 1994 to 972 homicides. The number of Homicides has never been less than they were before gun control was passed.

      The hell of it is 1965 was a year of Race riots in the city. Even during the 1930’s the years that saw Gangsters and Beer Wars in Chicago the Homicide Rate was still lower than current levels.
      Gun Control does not work it only removes the Checks and Balances in a society and actually makes crime worse.

      Has long has people ignore human history Human nature and the control and manipulation factors of our society violence will continue. Criminals prefer unarmed victims and that’s the only thing gun control does create victims.

      There are more reports of that kind than the few and far between ones of ordinary citizens no matter where they were from…even the south.

      It’s because we had a checks balances in our society that kept the Bad guys in check. An armed society is a civil society criminals prefer unarmed victims. Gun control only creates victims.

      Being charged with a felony is so easy just question a cop and you risk being charged with assault.

      Our rights are from God how can a Government limit a right that preexists law.

      The words “shall not be infringed” at the time of the writing of the constitution was written has a commanding prohibition.

      “Shall” is a command

      “Not” is a Prohibition

      “Infringed” in the law means “treaspass” which is entry and “transgress” which means “encroachment”

      Thus a commanding prohibition on the entry and encroachment on the right to keep and bear arms.

      William Rawle defines the right of the people to keep and bear arms has a natural consequence or corollary of the need of an armed citizenry/militia.

      The express need of an armed citizenry guarantee’s the right of the people to keep and bear arms as a duty and therefore absolute.

      The Corollary or natural Consequence between the 2 clauses goes both ways, meaning the arms of the militia become the arms of the people and the arms of the people become the arms of the militia.

      If you’re able-bodied not in prison or in a mental hospital it becomes your duty to be armed.
      The 2A was written to reflect the earlier laws of the colonies and maintain the duty of the citizenry to be armed.

      vigilante justice? here is the real scenario. if someone is breaking into your house to harm you you have two options: 1. call the cops, wait an hour for them to arrive, possibly apprehend the criminal, send him throuh the legal system and watch him get a slap on the wrist. or
      2. pull out your weapon , protect your family, make your neighborhood a better place in the future.
      I prefer vigilante justice myself.

      defense to me is just that- it’s the ones who after something happens, gets really steamed after a while and goes and seeks out the one they believe is guilty and retaliates as judge jury and executioner.
