    By now we have all heard the cliches and seen the posters from the “Tea Parties” espousing freedom, less government, and perhaps most of all, how the federal government had better back off trying to shove their national healthcare down our otherwise healthy throats. The truth of the matter is all the slogans of “Don’t Tread On Me” or “Give Me Liberty Or Give Me Death” or “We’re Mad As Hell And We’re Not Taking It Anymore,” don’t mean a thing when compared to reality; the real and actual answer to all the protests, marches, and outrage. The answer is in our own backyards! The States can stop every bit of it! That’s right, the individual States can stop “Obamacare” and all other forms of out-of-control federal government mandates and “big brother” tactics. If Arizona, Hawaii, New Hamshire, Texas, etc. want nothing to do with National Healthcare as proposed by Barack Obama or Congress, then all they have to do is say “No!”

    If we are to take back America and keep this process peaceful, then state and local officials will have to step up to the plate.

    For you skeptics who think the States could no more do this than fly to the moon, let’s look at the law. First, the U.S. Constitution is the ultimate and supreme law of the land. More specifically, the Bill of Rights was established, because some of our Founding Fathers, feared that the Constitution did not go far enough in restricting or limiting the central government. Hamilton was one of a select few who wanted a bigger and powerful federal government. However, several key states and powerful delegates such as Patrick Henry, said they would not support the formation of a new government if the Constitution did not contain a Bill of Rights, a supreme law to establish basic and fundamental human rights that could never, for all future American generations, be violated, altered or encroached upon by government. So the Framers of our Constitution came up with ten; ten God-given freedoms that would forever be held inviolable by our own governments.

    The last of these basic foundational principles was the one to protect the power, sovereignty, and the autonomy of the States; the Tenth Amendment. This amendment and law underscores the entire purpose of the Constitution to limit government and forbids the federal government from becoming more powerful than the “creator.” Let’s be very clear here; the States in this case were the creator. They formed the federal government, not the other way around. Does anyone believe rationally that the States intended to form a new central government to control and command the States at will? Nothing could be further from the truth. Article 1, Section 8 of the Constitution details what duties the federal government will be responsible for under our new system of “balanced power.” Anything not mentioned in Article 1, Sec. 8, is “reserved to the States respectively, or to the people.” (Tenth Amendment) Hence, the federal government was not allowed creativity or carte blanche to expand or assume power wherever and whenever they felt like it. The feds had only discrete and enumerated and very limited powers. Omnipotency was the last thing the Founding Fathers intended to award the newly formed federal government. They had just fought the Revolutionary War to stop such from Britain and their main concern was to prevent a recurrence here in America.

    In perhaps the most recent and powerful Tenth Amendment decision in modern history, the U.S. Supreme Court ruled in Mack/Printz v U.S. that “States are not subject to federal direction.” But today’s federal Tories argue that the “supremecy clause” of the U.S. Constitution says that the federal government is supreme and thus, trumps the States in all matters. Wrong! The supremacy clause is dealt with in Mack/Printz, in which the Supreme Court stated once and for all that the only thing “supreme” is the constitution itself. Our constitutional system of checks and balances certainly did not make the federal government king over the states, counties, and cities. Justice Scalia opined for the majority in Mack/Printz, that “Our citizens would have two political capacities, one state and one federal, each protected from incursion by the other.” So yes, it is the duty of the State to stop the Obamacare “incursion.” To emphasize this principle Scalia quotes James Madison, “The local or municipal authorities form distinct and independent portions of the Supremacy, no more subject within their respective spheres, to the general authority than the general authority is subject to them, within its own sphere.” The point to remember here is; where do we define the “sphere” of the federal government? That’s right; in Article 1, Section 8 of the Constitution and anything not found within this section belongs to the States or to the People. So where does health care belong? The last place it belongs is with the President or Congress. It is NOT their responsiblity and the States need to make sure that Obama does not overstep his authority.

    Just in case there is any doubt as to what the Supreme Court meant, let’s take one more look at Mack/Printz. “This separation of the two spheres is one of the Constitution’s structural protections of liberty. Hence, a double security arises to the rights of the people. The different governments will control each other…” What? The Constitution, the supreme law of the land, has as a “structural protection of liberty” that States will keep the federal government in check? No wonder it was called a system of “checks and balances.” The States (and Counties) are to maintain the balance of power by keeping the feds within their proper sphere.

    So do the States have to take the bullying of the federal government? Not hardly! The States do not have to take or support or pay for Obamacare or anything else from Washington DC. The States are not subject to federal direction. They are sovereign and “The Constitution protects us from our own best intentions.” (Mack/Printz) Which means the States can tell national healthcare proposals or laws to take a flying leap off the Washington monument. We are not subject to federal direction!

    In the final order pursuant to the Mack/Printz ruling Scalia warned, “The federal government may neither, issue directives requiring the States to address particular problems, nor command the States’ officers, or those of their political subdivisions, to administer or enforce a federal regulatory program. Such commands are fundamentally incompatible with our constitutional system of dual sovereignty.” It is rather obvious that nationalized healthcare definitely qualifies as a “federal regulatory program.”

    Thus, the marching on Washington and pleas and protests to our DC politicians are misdirected. Such actions are “pie in the sky” dreaming that somehow expects the tyrants who created the tyranny, will miraculously put a stop to it. Throughout the history of the world such has never been the case. Tyrants have never stopped their own corrupt ways. However, in our system of “dual sovereignty,” the States can do it. If we are to take back America and keep this process peaceful, then state and local officials will have to step up to the plate. Doing so is what States’ Rights and State Sovereignty are all about.

We need to do mass protests at every state capitol, im talking tens of thousands of people, but as i have said before, in todays world that is nearly impossible. People are afraid to have strikes and walkouts because they think they will get fired. Not only that but everyone being so consumed with jobs and daily life they cant even see whats coming. As the saying goes”forewarned is forearmed”, but most people dont even care. They live day in and day out oblivious to the goings on in their states and nation. If someone were to ask me what i see when i see other “people” i see machines of flesh and bone, each performing the specific task they were programmed to do (think matrix) yet never having the presence of mind to stop and look up. Those that can and do look up have agents sent after them while being branded “terrorists”. Look on youtube about Obama’s red pill/blue pill statement, does it look familiar?

      The States have the legal capacity to withdraw all powers delegated to the federal companct known as the United States, a.k.a. secede. Once seceded, a State resumes its place among the nations of the world, and then it can issue currency. But as long as a State is part of that federal compact, then it has agreed to vest this power in Congress only. (Not a private bank like the Federal Reserve).

      If you are NOT from the USA, you will have a bit tougher row to hoe: think about your own “American Revolution”. While I would prefer a “peaceful Revolution” (even in my own USA, in order to RETURN to the U.S. Constitution!), I am enough of a realist to understand that it is MOST unlikely: tyrants and would-be tyrants will NOT give up their power without a fight! One either fights, or one sits down, shuts up, surrenders, and becomes a slave, learning to “enjoy” their servitude as best they can…

      If you decide to fight, the U.S. Constitution is an EXTREMELY good place to start. It’s not “perfect”, but it’s FAR closer to perfection than any governmental system I have yet discovered… ;)

      States, cities, towns etc. They can all create their own currency, it’s just a matter of who will honor that currency. Several months ago I read a story about some towns creating their own currency to help keep spending local. The strength of having a national currency is the ease of being able to trade between states, the weakness is that we now have idiots in power who have turned our national currency into toilet paper. Just think about how bad it could get when the NWO has their one world currency.

      It’s not illegal to use whatever you want as currency as long as both parties (buyer+seller) agree on it. so technically it is legal, actually I heard that quite a few small towns across the country have developed their own form of currency, and most of them are doing quite well economically.

      I have seen ads for the book Social Viability and I think it shows you how to do just that, I’m still pretty interested in checking it out.

      States used to issue currency but I’m not sure when that was stopped — maybe after the War Between the States? I remember seeing notes from all states (at that time) – I actually bought a pack of copies from a shop in Gettysburg, PA. So, at one point, the states did issue their own money.

      Why are you not able to read the Constitution for The United States of America for the answer to your question and before you do google search and video search “the act of 1871″ just so you understand there are two constitutions. Ours is the Constitution for the United states of America and theirs is THE CONSTITUTION OF THE UNITED STATES OF AMERICA which is a Corporation owned by off shore banks that also own The District of Columbia.       I’m getting a bit irritated with all this upper/lower case bulls---. Seriously, as if it makes a difference. The Constitution ratified by the states is the only Constitution. You can get a copy of it just about anywhere. Arguments like this are the same they use when trying to argue that the 2nd amendment didn’t apply to individuals because of a comma here or there. Total bulls---. You can read the framers intent in the Federalist papers. Upper/lower case and punctuation doesn’t change the meaning.

      Federal funding – comes from taxes/fees collected at the state level that are SENT to Washington, where the feds take a “cut” to administer it back to the states (redistribute…). The plan is to have each state STOP sending the funds to Washington. Keep the money in the state and stop funding the giant federal bureacracy.

      It is a fact that the state you live in – is YOUR JURISDICTION. You are responsible for electing the sheriff you want to provide overwatch on the Constitution. You are also responsible for seeing to it that the people in the state legislature “hold the line” where the Constitution is concerned, the idea being that since they are local, they can be seized and tried for treason when they make a mockery of Constitutional Rule of Law. I remember something about the National 55mph speed limit not going over too well and some states (can’t remember which) threatened to stop sending or accepting federal dollars.       This is all besides the point. Schools arent even teaching our kids about the constitution much less the bill of rights. My nephew thats a 16 year old junior in highschool even admits that. I asked him to tell me who Patrick Henry was or Samuel Adams or to name ANY of the founding fathers and he couldnt do it. The feds are dumbing down our future generations and that is a fact. Every other nation in the world admits that the US has the dumbest people in the world.

      Only when the states conduct a review of what loss of federal dollars means to the local state economy will we understand why certain states are so reluctant to remove themselves from the federal tit of money.

My city is trying to tax sports groups as well as people who use them for using any of our public parks because its to expensive to care for them, but isnt that what we pay taxes for.       Amendment 2: “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

      Amendments 9 and 10, the last two Amendments to the Constitution in the Bill of Rights, are quite closely related, and deal with the carefully enumerated and strictly limited powers granted to the Government by the Constitution:

      Amendment 9: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.”

      Amendment 10: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

      As the late Dr. W. Cleon Skousen, who taught me the Constitution with great care, used to say in discussing the meaning of these two amendments: “…and if there was ANYTHING else we FORGOT, YOU CAN’T DO THAT, EITHER!” ;)

      No wonder we are in such a mess. I have read all the comments above and they clearly show that most of those leaving comments have little or no idea of what is in the Constitution!

      Article I, Section 8 clearly states, in part, “Congress… shall coin money…”.

      Article I, Section 10 clearly states, in part, “No State shall…coin Money”.

      No where is the power granted to the Federal or state governments to issue paper bills to circulate as money. In fact, at the Constitutional Convention the power to “emit bills” was contemplated and unamimously rejected for the federal government, and, except for one abstention, the states also. *[The two New York state delegates present during this vote voted opposite from each other so New York's single vote (one vote per state, but multiple delegates were present from each state) was recorded as an abstention]

      Article I, Section 10 also states, in part “No State shall… make any Thing but Gold and Silver Coin a Tender in Payment of Debt…”. So, while the Federal government (Congress) coined Money the states declared the substance of the coin, and were restricted by the Constitution to declaring only gold and silver coin. These provisions amount to a guaranty of economic liberty and confidence that the state and federal governments would not declare a fiat currency and rob the people of their wealth, as has been the case for nearly one hundred years now, since the Federal Reserve Bank came into existence. *[This was the case at the time of the Convention as many state governments issued paper currency of uncertain and varying value, and were often devalued by the governments that issued them. This sorry state of affairs is what led to the Article I, Section 10 prohibition to the states that "No State shall... impair the obligation of contracts..."]

      The Constitutional Convention actually came about due to the fact that the people did not have a
      monetary system in place that was sound. They couldn’t trust the value of state and federal paper currency or that of private banks and so trade and commerce stagnated, and was basically limited to barter of goods for goods (or services). Being called a “friend of paper money” in that time was very insulting and properly so. It still should and would be if people would only learn their history and their Constitution.

      I fail to see how Sheriff Mack has the ability or the right to “stop national healthcare” if it is what our elected representatives legislate and our elected president signs into law. Universal healthcare falls under the ‘general Welfare’ mentioned in the Preamble to the Constitution:

      “We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”

      :and further clarified in what is known as the ‘Taxing and Spending Clause’ of the United States Constitution, Article I, Section 8, Clause 1.
