    Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.

    To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

    The Bill will also eventually force private insurance companies out of business and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled.

    However, as scary as all of that it, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated. If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

    The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people and the businesses they own. The irony is that the Congress doesn’t have any authority to legislate in most of those areas to begin with. I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.

    This legislation also provides for access by the appointees of the Obama administration of all of your personal healthcare information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a direct violation of the specific provisions of the 4th Amendment to the Constitution protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.

    If you decide not to have healthcare insurance or if you have private insurance that is not deemed “acceptable” to the “Health Choices Administrator” appointed by Obama there will be a tax imposed on you. It is called a “tax” instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn’t work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the “due process of law.

    So, there are three of those pesky amendments that the far left hate so much out the original ten in the Bill of Rights that are effectively nullified by this law. It doesn’t stop there though. The 9th Amendment that provides: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;” The 10th Amendment states: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people.” Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.

    I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 of the Constitution requires the members of both houses of Congress to “be bound by oath or affirmation” to support the Constitution. If I was a member of Congress I would not be able to vote for this legislation or anything like it without feeling I was violating that sacred oath or affirmation. If I voted for it anyway I would hope the American people would hold me accountable.

      The constitution never advocated free health care. ONLY life, liberty and the pursuit of happiness. BTW, it never said we would catch it!!!!

      Like the Good Samaritan, I believe God intends for those among us with resources to help the less fortunate. God loves a cheerful giver, and it’s a lot more fulfilling to give out of one’s own choice and generosity than to be forced into it.

      We surely would do a better job of holding the needy accountable than the govt does. But it should be our choice to help, not be raped of our hard-earned $ so some illegal can camp out in the ER without contributing anything.

But I’m so busy trying to digest all the stuff coming down the pike, warn my friends and family, and beat the physical effects from the CTs. And the constitution and bill of rights is becoming more moot every day as it is violated and shredded. It’s hard to read when you’re under the gun.

      Hate to nitpick, but nowhere in the Constitution can you find the phrase: life, liberty and the pursuit of happiness. The constitution’s preamble does specifically mention liberty, but also mentions domestic tranquility, common defense and general welfare. However, the quote you mention IS stated in the Declaration of Independence. The way I had been taught that the Constitution protects the “life, liberty and pursuit of happiness” is through many of the Amendments, on of them being the 4th Amendment. Happiness is a subjective term that is not easily defined, much like the word “obscene”. For what makes you happy may not make others happy. No one can contest deprivation of life or liberty. Deprivation of happiness, however, is hard to define.

      A big start toward fixing the Health care problems already exists in some laws we already have.
      The Health Maintaince Organizations or medical insurance companies engage in price fixing and the doctors engage in price gouging to the folks that actually can pay. Those folks pay their part and then pick up the losses that the insurance companies force on the doctors through their market manipulation. We have laws on the books pertaining to both price fixing,price gouging,monopolies etc.
      The working folks have paid social security all their lives and it was miss used. If SS had been properly administered then there would have been a lot of money availabl to take care of folks when they became too sick to work but instead the SS administration witholds our money when we are legally entitled to it.
      Enforcing existing laws against the organized criminals[insurance companies] and making sure that doctors charged the same rates to all patients would go a long way towad fixing the problem.
      Professing Christians could start living by the teachings they profess and that would take care of the legitamatly poor folks but most of them are too greedy to actually help a destitute family.
      Finding and retaking the 3 trillion dollars that our esteemed leaders stold from the pentagon would go a long way toward treating sick folks.
      Forcing every federal government employee[hired,elected, or appointed] to have to use a plan identical to Obama’s proposed plan[and not being allowed to have any other care or secondary plan] would gurantee that it would end up being a pretty good plan.
      Our country has the means. The problem is that our government does not really have an honest desire to care for it’s people, only control us.
      Greed and lust for power got us where we are at and that is what is keeping us there.

      The American people will not go along with this. This will open up a huge underground operation of doctors and check cashing places with no ID and alternate Identification, the elimination of bank accounts, under the table jobs…The whole U.S. could very well go underground and black market with so many aliases and end of paper trails that the gov. will never know who is who or where they are or anything.
      People will rent an apartment in one name, cash their check weekly with another name and pay cash to get medicine from the black market.

      I think you forgot about the RFID plan. We have no idea how or when it will be implemented, and if the nanotechnology in the CTs is already identifying people.       That’s commonly known as working for a living. Just like a plumber,mechanic, or doctor. They supply a service for someone and they pay for the service or product. If you do not like the service or product then you take your business elsewhere.
      When you get big and and start working then you will get paid but if I were you I would not rush it. You will have to learn about arithmatic and telling time first because you will need to be able to check and see if Minimum wage x number of hours that you work = the amount that McDonalds pays you.

      while i trust this guy read the bill and has formed these opinions based on that reading, him telling us what they’re going to do doesn’t prove that’s actually what it says. this article would be much more effective if he specially points out the language in the bill that demonstrates the examples he is giving. i’m not bashing the author, i agree with his stance, i am just looking for an article to read that actually goes over and explains the language of the bill. i’m hardly a lawyer so if someone could decifer it for me i would be much greatful.

      Any of these sites will give you a blow-by-blow summary of what the bill contains that is a threat to American liberty.

      And one more thing – this corrupt govt uses vague language so that once a bill passes, they can then twist it to be interpreted any way they damned well choose.

      It’s a little known fact but lawyers have the highest rate of default on student loans of any profession.       Meanwhile, in view of your background in Constitutional Law, do you agree with the article that states Obama is in violation of the Constitution in accepting/seeking Chairmanship of UN Security Council?       I object to many things currently happening in the Executive Branch. However, I will confine my comments to one issue at this time. I understand you are planning to accept another position concurrently with your present employment. I believe this to be in violation of your job description as provided in the employment contract of the Constitution of the United States of America.

      Please refer to the following paragraph:
      No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.

      Chairmanship of UN Security Council is another Title. I assume you have asked and are awaiting approval of Congress. If not, I find your actions in violation of the Constitution. As I wrote you on the eve of your inauguration, you took a solemn oath to the American people to uphold the Constitution of these United State of America. Please be sure you keep this oath. There is no room for debate or interpretation.

      Total US unfunded liabilities is about $60 trillion. $10 trillion of that – about the size of national debt – is for the Social Security government run ponzi scheme. $50 trillion – about 5 times the size of the national debt – is for future medicare/medicaid and prescription drugs costs. No one in washington has any idea how to fill this hole. The only way for politicians to evade responsibility for the huge sinkhole they have dug for us is to tax everyone at 100% (and keep the social security and national medical system facade up) and then kill off anyone who needs medical services or wants to retire.       Mr. Connelly has NOT read the bill, and that’s why he will not refer to any actual sections that say what he is claiming. I defy any of you to find any verbiage that states what he claims.

      This site claims to tell you the truth but it never backs up its claims with credible sources. Instead we get links to people trying to sell stuff or with personal axes to grind. If you don’t like being labeled as “conspiracy theorists” then try to come up with some actual facts.

      There are no actual bills before congress right now. How about waiting until there’s something that can be voted on before screaming that the sky is falling?

      To understand the government, we have to stop thinking in terms of “the feds”, Congress, or even the White House. There is no United States of America. It was usurped decades ago by the international bankers. They left us with a paper mache shell that ‘looks’ like a constitutional republic, smells more like a bloodthristy democracy, and in essence operates as a defacto tyranny. But don’t take it personal- it’s just business. What we see today are the profit-driven steps taken by any large corporate entity– fostering of legislation for particular advantage; creation of monoply control of marketplace; and eradication of any potential competitors to one’s marketshare. Obama’s handlers are simply consolidating their marketshare in the most lucrative sectors of our economy– banking, insurance, manufacturing, food and now healthcare. That’s why where once we had tens of thousands of independent news outlets, radio stations, and newspapers, today there are 5 or 6 coporations. Ditto banking, food production, transportation, etc. To claim this is just “business as sual” for Washington belies the fact of that corporations truly are- “soulless artifical persons, running amok.”

      single payer for all is the best (assuming that we really had a gov for the people and by the people that were not evil and corrupt eugnenecists). Obama care is insidiously evil and corportist like. The problem is that many sincere liberals and the like are willing to compromise on the issue by stating that ‘we need to get SOMETHING passed and we can work from there’. But that something is where those bastards will kill you. I have no problem with medicare for all. I have seen it work other places around the world and it does just fine.

      Neither party wants to implement single-payer. That alone should raise some flags for people. If politicians are against it then it must be good. Unfortunately, people are going to get stuck with a public option that doesn’t have a chance in hell of reducing health care costs.

      Yes single payer with competition from large non profit organizations would be the most efficient and everyone could get health care and we would spend less. Single payer is not socialized medicine ! Do your homework. 400 billion per year is now spent on administrative costs!!!!!! No health care just people on phones and computers trying to get the paperwork right and claims from patients covered by the Insurance companies. This is not a constitutional problem, it is a human problem. 35% of all bankruptcies are the result of illness with people WHO HAD Health care insurance. They thought they were covered, Sorry. Yes it’s OK to argue over the details of what the best way to provide health care to people is. The for profit corporations have an inherent conflict of interest in providing health care to people, they are bound ethically to produce maximum profits to the shareholders. It’s just not that hard to see that the current system is not working for the people and only working for big Insurance, big Pharma, big medical manufactures etc. Infowars is not covering the whole story.
