Why is a U.S. Army brigade being assigned to the “Homeland”?

Several bloggers today have pointed to this obviously disturbing article from Army Times, which announces that "beginning Oct. 1 for 12 months, the [1st Brigade Combat Team of the 3rd Infantry Division] will be under the day-to-day control of U.S. Army North" — "the first time an active unit has been given a dedicated assignment to NorthCom, a joint command established in 2002 to provide command and control for federal homeland defense efforts and coordinate defense support of civil authorities." The article details:
They’ll learn new skills, use some of the ones they acquired in the war zone and more than likely will not be shot at while doing any of it.
They may be called upon to help with civil unrest and crowd control or to deal with potentially horrific scenarios such as massive poisoning and chaos in response to a chemical, biological, radiological, nuclear or high-yield explosive, or CBRNE, attack. . . .
The 1st BCT’s soldiers also will learn how to use "the first ever nonlethal package that the Army has fielded," 1st BCT commander Col. Roger Cloutier said, referring to crowd and traffic control equipment and nonlethal weapons designed to subdue unruly or dangerous individuals without killing them.
"It’s a new modular package of nonlethal capabilities that they’re fielding. They’ve been using pieces of it in Iraq, but this is the first time that these modules were consolidated and this package fielded, and because of this mission we’re undertaking we were the first to get it."
The package includes equipment to stand up a hasty road block; spike strips for slowing, stopping or controlling traffic; shields and batons; and, beanbag bullets.
"I was the first guy in the brigade to get Tasered," said Cloutier, describing the experience as "your worst muscle cramp ever — times 10 throughout your whole body". . . .
The brigade will not change its name, but the force will be known for the next year as a CBRNE Consequence Management Response Force, or CCMRF (pronounced "sea-smurf").
For more than 100 years — since the end of the Civil War — deployment of the U.S. military inside the U.S. has been prohibited under The Posse Comitatus Act (the only exceptions being that the National Guard and Coast Guard are exempted, and use of the military on an emergency ad hoc basis is permitted, such as what happened after Hurricane Katrina). Though there have been some erosions of this prohibition over the last several decades (most perniciously to allow the use of the military to work with law enforcement agencies in the "War on Drugs"), the bright line ban on using the U.S. military as a standing law enforcement force inside the U.S. has been more or less honored — until now. And as the Army Times notes, once this particular brigade completes its one-year assignment, "expectations are that another, as yet unnamed, active-duty brigade will take over and that the mission will be a permanent one."
After Hurricane Katrina, the Bush administration began openly agitating for what would be, in essence, a complete elimination of the key prohibitions of the Posse Comitatus Act in order to allow the President to deploy U.S. military forces inside the U.S. basically at will — and, as usual, they were successful as a result of rapid bipartisan compliance with the Leader’s demand (the same kind of compliance that is about to foist a bailout package on the nation). This April, 2007 article by James Bovard in The American Conservative detailed the now-familiar mechanics that led to the destruction of this particular long-standing democratic safeguard:
The Defense Authorization Act of 2006, passed on Sept. 30, empowers President George W. Bush to impose martial law in the event of a terrorist "incident," if he or other federal officials perceive a shortfall of "public order," or even in response to antiwar protests that get unruly as a result of government provocations. . . .
It only took a few paragraphs in a $500 billion, 591-page bill to raze one of the most important limits on federal power. Congress passed the Insurrection Act in 1807 to severely restrict the president’s ability to deploy the military within the United States. The Posse Comitatus Act of 1878 tightened these restrictions, imposing a two-year prison sentence on anyone who used the military within the U.S. without the express permission of Congress. But there is a loophole: Posse Comitatus is waived if the president invokes the Insurrection Act.
Section 1076 of the John Warner National Defense Authorization Act for Fiscal Year 2007 changed the name of the key provision in the statute book from "Insurrection Act" to "Enforcement of the Laws to Restore Public Order Act." The Insurrection Act of 1807 stated that the president could deploy troops within the United States only "to suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy." The new law expands the list to include “natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition" — and such "condition" is not defined or limited. . . .
The story of how Section 1076 became law vivifies how expanding government power is almost always the correct answer in Washington. Some people have claimed the provision was slipped into the bill in the middle of the night. In reality, the administration clearly signaled its intent and almost no one in the media or Congress tried to stop it . . . .
Section 1076 was supported by both conservatives and liberals. Sen. Carl Levin (D-Mich.), the ranking Democratic member on the Senate Armed Services Committee, co-wrote the provision along with committee chairman Sen. John Warner (R-Va.). Sen. Ted Kennedy openly endorsed it, and Rep. Duncan Hunter (R-Calif.), then-chairman of the House Armed Services Committee, was an avid proponent. . . .
Sen. Patrick Leahy (D-Vt.), the ranking Democrat on the Senate Judiciary Committee, warned on Sept. 19 that "we certainly do not need to make it easier for Presidents to declare martial law," but his alarm got no response. Ten days later, he commented in the Congressional Record: "Using the military for law enforcement goes against one of the founding tenets of our democracy." Leahy further condemned the process, declaring that it "was just slipped in the defense bill as a rider with little study. Other congressional committees with jurisdiction over these matters had no chance to comment, let alone hold hearings on, these proposals."
As is typical, very few members of the media even mentioned any of this, let alone discussed it (and I failed to give this the attention it deserved at the time), but Congressional Quarterly’s Jeff Stein wrote an excellent article at the time detailing the process and noted that "despite such a radical turn, the new law garnered little dissent, or even attention, on the Hill." Stein also noted that while "the blogosphere, of course, was all over it . . . a search of The Washington Post and New York Times archives, using the terms ‘Insurrection Act,’ ‘martial law’ and ‘Congress,’ came up empty."
Bovard and Stein both noted that every Governor — including Republicans — joined in Leahy’s objections, as they perceived it as a threat from the Federal Government to what has long been the role of the National Guard. But those concerns were easily brushed aside by the bipartisan majorities in Congress, eager — as always — to grant the President this radical new power.
The decision this month to permanently deploy a U.S. Army brigade inside the U.S. for purely domestic law enforcement purposes is the fruit of the Congressional elimination of the long-standing prohibitions in Posse Comitatus (although there are credible signs that even before Congress acted, the Bush administration secretly decided it possessed the inherent power to violate the Act). It shouldn’t take any efforts to explain why the permanent deployment of the U.S. military inside American cities, acting as the President’s police force, is so disturbing. Bovard:
"Martial law" is a euphemism for military dictatorship. When foreign democracies are overthrown and a junta establishes martial law, Americans usually recognize that a fundamental change has occurred. . . . Section 1076 is Enabling Act-type legislation—something that purports to preserve law-and-order while formally empowering the president to rule by decree.
The historic importance of the Posse Comitatus prohibition was also well-analyzed here.
As the recent militarization of St. Paul during the GOP Convention made abundantly clear, our actual police forces are already quite militarized. Still, what possible rationale is there for permanently deploying the U.S. Army inside the United States — under the command of the President — for any purpose, let alone things such as "crowd control," other traditional law enforcement functions, and a seemingly unlimited array of other uses at the President’s sole discretion? And where are all of the stalwart right-wing "small government conservatives" who spent the 1990s so vocally opposing every aspect of the growing federal police force? And would it be possible to get some explanation from the Government about what the rationale is for this unprecedented domestic military deployment (at least unprecedented since the Civil War), and why it is being undertaken now?
UPDATE: As this commenter notes, the 2008 National Defense Authorization Act somewhat limited the scope of the powers granted by the 2007 Act detailed above (mostly to address constitutional concerns by limiting the President’s powers to deploy the military to suppress disorder that threatens constitutional rights), but President Bush, when signing that 2008 Act into law, issued a signing statement which, though vague, seems to declare that he does not recognize those new limitations.
UPDATE II: There’s no need to start manufacturing all sorts of scare scenarios about Bush canceling elections or the imminent declaration of martial law or anything of that sort. None of that is going to happen with a single brigade and it’s unlikely in the extreme that they’d be announcing these deployments if they had activated any such plans. The point is that the deployment is a very dangerous precedent, quite possibly illegal, and a radical abandonment of an important democratic safeguard. As always with first steps of this sort, the danger lies in how the power can be abused in the future.

they will gladly go to the camps to be fed gruel twice a day. Aside from a few brave souls

The sad part to all of this is far more Americans feel all of this is for their own good. I know tht the military is taking part in public celebrations, helping with crowds, traffic control, and medical operations to help the citizens, but think about this. When we have had fights the people do not run to Police, they come to us, when people have medical problems they come to us, and the fact that they are exposed to the Military here is really winning over the people.
We have their trust, and they thank us for all we do for them, and I bet they will thank those in uniform for putting them in the camps, people are so conditioned.
Many states also have Defense Forces, alaska force is armed, and helps the police, and soon more will be armed, and these are volunteers who believe in what the government is doing, and in basic training they are watching films that work the emotions, and get in their heads. Our troops have much shorter training, but can out march many of the regular troops and show more military bareing, and also show total dedication.
They are hitting us from all sides, and you will see troops marching citizens to the camps for a lengthy stay and some reeducation.

In response to #21, I don’t think this person is taking into consideration all the chemical dumbing down that has been happening in America for decades. Even if people WANTED to fight back, #1 they are terrified of their government’s oppressive force (and it’s constantly being reminded on TV just how terrifying that force is), #2 there are fluoride compounds as well as other chemicals that are known to the CDC as neurotoxins, #3 we are BOMBARDED by junk news from a controlled media, #4 we’re a fascist country so nationalism is prevalent (it’s a country love it or leave it attidude), #5 with the financial crisis and people in debt to their ears, nobody wants to make any “irrational” decisions without fully understanding the breadth and scope of the problem which even I, who spends at least 5-6 hours a day researching, can’t fully understand.
SO then you have to ask yourself: What do you want the average American to do? How are we supposed to overcome all these paradigms so quickly?
In my opinion, people of the world, it’s going to take a miracle. A real miracle.

If the military can have fully automatic weapons then so can we!!! Make you weapons full auto now!!! Get a gas mask, ear plugs, dragon skin vest, bullet helmet and face mask, full body armor, full metal jacket bullets, AK-47 you get the point. When they come for you just make sure you take more of them before they take you. Oh and get an off road motorbike and paint it flat black but make it wash-off paint to change the color… And tell everyone you know what is taking place and to prepare themselves for what is to come.

They are going to be conducting the first urban attempt at gun confiscation militarily. The objective is to get those 220 million guns out of our hands. NO was the first small war game on that issue… do not think this hasn’t been planned and set up for a very long time including this crash….. is all for moving toward globalization.
You have to understand with what they have planned for us, they are afraid…. they want ALL THE WEALTH this nation has, then globalize and move on to stripping other nations of their wealth as well, but first they have to finish us off….THEY ARE AFRAID OF US. There are only about 3,000 of them and 300 million of us and over 220 million guns out here. We lost many opportunities to turn this around before now, but we didn’t act… if they take those guns we are dead. Did you know in the 20th century, in the rogue nations that confiscated the guns of the population, those same leaders masscred over 56 million of their citizens…. they wouldn’t hve been able to do it if they had kept their guns or fought to keep them.
In fact, I talked with an ffl dealer yesterday and he said he sold over 7,000 guns in the last 10 days and an undisclosed amount of ammo…. boy its beginning to really sound like war if they try to take the guns… its what started our revolutionary war before…… the shot heard round the world, indeed. Many will not give them up…… I fear there will be blood of my fellow Americans on the streets of my lost beloved country.

The author forgot to mention that in that article it also says at the time of the permanent status, that the “source” of the troops would be determined… what does that mean??? NATO? Mexican military troops??? Canadian??? In any of those cases that is foreign soldiers occupying American soil with the permission of our White House and congress, that means treason….. pure and simple… if one single foreign soldier steps foot on our soil to occupy this nation than that is an enemy without and domestically.

It’s only a decaying piece of parchment. As GW would put it…it has no meaning or consequence if one doesn’t feel obligated to abide by it any longer. Even at certain times in the Roman Empire…the Caesar in power made up the rules as he went…disbanning the Senate…using the Praetorian Guards to find and kill insurectionists…putting Christians dipped in tar on poles and settign them on fire to light the highway to Rome…sporting gladiator contests…building monuments to themselves (like a legacy). Face it folks…we are nearly a heartbeat of an Executive Order away from complete dictatorship, and it’s been calculated and planned SO long that those involved have thought of just about everything. Just throwing something else out there to chew on…Our own troops would find it extremely, if not impossible to obey orders to arrest or kill citizens of the US. BUT……..If vast amounts of heartless, soulless, communist Chinese soldiers were bought in..they would have no difficulty at all in doing whatever they were ordered to do. The Chinese have a standing army of over 200 MILLION soldiers..muff said. Aren’t the majority of rail boxcars manufactured from China? Has anyone noticed the back-side of all street signs in the US? Flourescent tags are placed in strategic positions on the backs of State and Federal signs. Take a look and once you see the pattern, you’ll begin to realize that something is up. Certain signs are tagged in diagonal lines to indicate direction from the opposite side of any highway. Some are vertical to indicate position on a map, and some tagged horizontally perhaps for location of rail intersections. Chinese soldiers might not understand English writing, but they may KNOW what the backs of signs are used for if they are traveling on the left side of the highway.? Okay…maybe a little out there,, but what the heck…made you think, no?

You know what bothers me… The fact that if other countries military comes down here, there has to be at least some in the military that feels that is wrong…. When I sworn in 24 years ago, I knew what I was swearing to. “Protect the Constitution against all enemies, foreign or domestic”. The military men and women needs to understand that. If not, then they should realize that not only their freedom is gone, but, the freedom of their families.

This is nothing new. Look up the “Sedition Act of 1918″ !!!!!!!! This act also trashed the Bill of Rights and Constitution. How about the internment of Japanese Americans into concentration camps during WWII??? Have you ever heard of the Home Guard during the Civil War? Have you ever heard of the 4 Minute men during WWI? Have you heard of the American Protective League during WWI that deputized and federalized local police and sheriffs through the Department of Justice and was used to persecute, harass and imprison American citizens at will? This was a private organization contracted by the Federal Government.
This belief in a past “Golden Age” when the country was pure and blessed is one of the sources of fascism. Look into ANY fascist movement anywhere in the world and they all believe is some past Golden Age that they must return to. Fact is, America has always had excursions into totalitarianism and police state tactics. Name the era, and you will find examples of it. There was even a Sedition Act of 1798 !!!!! This act was also unconstitutional !! So right from the beginning of the Republic, there has been this tendency to fall into totalitarian behavior.
The principles of the Bill of Rights, The Constitution and especially the writings of Thomas Jefferson should definitely be defended and fought for but please get off this high horse attitude that prior to 1913 was this Constitutional Utopia heaven on earth !! You are partially correct. You must remember that during the hurricane katrina debacle that our own police and military were breaking down peoples doors to take away their weapons. They had no difficulty about doing it. Why is this? Because there were a few among the the majority who were firing on police. This caused the police/military to be justified in arresting and taking weapons. I believe thats what will make the police or military conduct martial law will be the few who stand up to them and possibly fire on them. That will cause the police to be happy to break into peoples houses and steal their weapons.

Interestingly enough right before hurricane ike hit Texas I remember seeing a news reporter saying that CANADIAN MILITARY would be coming to Texas to assist with cleanup and safety. Why in the world would we need Canadian Military in our country. Is our own military really not that capable? I believe you are correct stryker in that saying that they will use other military to do the dirty work that our military might question or not want to do. A Call To Arms, how is someone “ready” for a revolution, anymore than say they are ready for invasion, depression (economic not clinical), earthquakes, or cancer?
A revolution is a spontaneous thing where everyone rises up, whether they are ready or not. The conditions are present for revolution to occur, that’s why Alex or anyone sane would not call for it. When you have heat, light, & most importantly food, then why would you rise up without provocation? When Americans are without homes and jobs and FOOD by the *millions*, if Alex isn’t calling for Revolution, real revolution then, if this sham system is still in charge, then you can refer to him as unpatriotic or as some try to portray, a hypocrite.
I’m not from your country, but when the conditions are ripe, you Americans will do it all over again. Like your mothers or father or grandparents before you, maybe even do it with them. Imagine a Depression survivor, their activists-in-the-70s son, and the teenage grand-daughter all in line wanting change. Wanting jobs and food.
For all the “Bush can deploy the military anywhere, crowd control, etc.”, if millions of people are in that situation no President, no matter how despotic, can make American boys hurt and harm other Americans.
American soldiers will not shoot American civilians on American soil.
When they do, that’s your ticket to Revolution.

So, yes, you’re wrong, and I have “actually read” God’s Word(s) for thirty years. If God is supposedly so “for” His Apostles and/or Disciples carrying out violence for Him, where are any examples from the New Testament alone that “support” this where they weren’t stopped by Jesus the Christ Himself or eachother? Haven’t found, or can’t find, one instance, can you? Well, that ought to get the truth about it across to you, but it probably won’t because you want to read God’s Word(s), interpret them, twist them around, and/or use them to “support” whatever God-forsaken rationalizations you can come up with, the way you want to. May God bring you completely out of that before it’s very soon too late.
Clearly, if God was for New Testament disciples and/or True Christians taking violent action(s) to avenge God and combat evil, there would be examples of it in the New Testament, and not words to the opposite effect therein. But, since there aren’t such examples, and are many words to the opposite effect, it is obvious that “an eye for an eye”, as Jesus the Christ Himself so clearly spelled out in Matthew 5:38-48, was done away with from the moment God’s Word(s), Jesus the Christ, uttered those words. You and others can rationalize all you and/or they want to, but that doesn’t, and isn’t, going to change what is and is not in His Word(s), and “adding to or taking away” from His Word(s) will get you destroyed:
Revelation 22:18-19.

Wow, have you all listened to yourselves?????? I am as much a patriot as anyone. I would defend this nation to my death in a heart beat. But come on. If the “new world order” was everything people claimed it was, why is it not already openly in charge? After, how long, 1000 years, 200 or what ever number of years people have been claiming this stuff, why would not this all powerfull thing already be doing what everyone claims it’s going to be? Why are we not already in “fema camps”? Why weren’t our parents in them? Why were we not already born in to this scenario? For that matter, why is this thread still up? Would not a group this powerfull have iradicated this type of thing, this talk, this site ages ago? Why is this site still up? why has Alex Jones not been rouned up or mysteriously imprisoned? Why has the government not just nuked a few key U..S cities already. With all the resources and technology available, why is this scenario already a long ago realized reality?
If your all apposed to foriegn troops on american soil or federal troops operating on american soil, as am I, write you governors, state reps, etc. I have, I have spoken with one directly, lives in my town, known him for years. It seems to me that a state has the right to deny this authority to foriegn troops as well as federal troops. Get your state to stand openly against this type of thing, the state of Maine has already denied the authority of Canadian troops in their state. The state of New Hampshire has already refused to recognize the legitimacy of the national I.D. As has the state of New Mexico.
Instead of talking boisterously about a rag tag grass roots revolution/rebellion that very very few of you would ever really initiate unless a foriegn soldier was on your front lawn firing at you, why not get the standing of your state government on these issues before this type of thing ever does become a real threat? You realize that even discussing a rebellion out side of a state sanctioned malitia is a violation of most state and federal laws? All your going to acomplish with this thread is getting youyr ip recorded and tagged for investigation and possible arrest. Kinda hard to start a revolution in a jail cell. If you all truly believed this was happening, why are you taking such huge risks to your cause by talking about this revolution in the open?

The only way they can “Legally” do this is under the official declaration of Martial Law. If they do declare this on Tuesday or Wednesday then you know at that point in time where you stand in all of this economic fear mongering. Right now they are looting the nation to finance the NWO, so essentially you are funding your own demise if this goes through congress. Who is hiding in a church? I don’t even attend a church and haven’t in years. They’re all completely corrupt and believe in counterfeit “Christianity” which I do not believe in AT ALL, and I do not have anything to do with (such) hypocrisy. I ONLY believe in True Christianity and the True, Full and Complete transformation of character that all believers in Christianity HAVE TO receive or they’re NOT going to be in heaven, period. Also, who said anything about not doing anything? I’m doing something. I’m at least, for a fully physically disabled person, doing what I can; and, as a result, I’m probably on the “red list”. I’ve been visited by the government (DHS) once so far, and I’m probably going to be visited by them again soon because I won’t shut up about what’s really going on. So, those you who are not without sin yourselves, stop casting “first-stones” at me!

Prep for a storm. Get gas, meds, food, batteries, candles, pet supplies, anything you might need to hunker down for a few days. The most likely scenario for immediate use of these troops is riot control after a stolen election. If you feel your vote was stolen, or someone else’s was stolen and you’re unhappy with the outcome of the election, just go home. don’t go to work, don’t buy anything, hunker down. A general strike will be much more useful and safer than anything else you can do.
