<p><strong>A lawyer representing former President Donald Trump in a pivotal <strong>Supreme Court</strong></strong> <strong>case on presidential immunity on Thursday posed a hypothetical question asking if ex-presidents George Bush, Barack Obama, and Joe Biden could similarly be retroactively charged for their transgressions while in office.</strong></p>



<p>&#8220;Without presidential immunity from criminal prosecution there can be no presidency as we know it,&#8221; Trump attorney D. John Sauer said during his opening statement. </p><div class="4347XNAY"><div id="fullAd"></div></div>



<p>&#8220;For 234 years of American history, no president was ever prosecuted for his official Acts. The Framers of our Constitution viewed an energetic executive as essential to securing Liberty.&#8221; </p>

<p>&#8220;Could President George W. Bush have been sent to prison for obstructing an official proceeding or allegedly lying to Congress to induce war in Iraq?&#8221; asked Sauer.</p><div class="L8VWA61t"><div id="ifwAd"></div></div>



<p>&#8220;Could President Obama be charged with murder for killing US citizens abroad by drone strike?&#8221; he continued. &#8220;Could President Biden someday be charged with unlawfully inducing immigrants to enter the country illegally for his border policies?&#8221;</p>



<p>&#8220;The answer to all these questions is no. Prosecuting the president for his official acts is an innovation with no foothold in history or tradition and incompatible with our constitutional structure.&#8221;</p>



<p>Meanwhile, attorney Michael Dreeben, representing the Biden Justice Department and Special Counsel Jack Smith attempted to claim the Constitution does not grant presidential immunity.</p>

<p>Elsewhere during the proceedings, Supreme Court Justice Sonia Sotomayor questioned if presidential immunity extends to a president who orders a military assassination of a political rival.</p>

<p>Of course, Dreeben when asked if Obama could be tried for murder for the drone strikes argued this could not be the case.</p>

<p>&#8220;So the Office of Legal Counsel looked at this very carefully and determined that, number one, the federal murder statute does apply to the executive branch,&#8221; Dreeben said. &#8220;The president wasn’t personally carrying out the strike, but the aiding and abetting laws are broad, and it determined that a public authority exception that’s built into statutes and that applied particularly to the murder statute, because it talks about unlawful killing, did not apply to the drone strike.&#8221;</p>



<p>Justice Samuel Alito later discussed the prospect of vindictive prosecutors with ulterior political motives with Dreeben.</p>

<p>Justice Ketanji Brown Jackson also got smacked down when she tried to argue a broad immunity scope would &#8220;embolden&#8221; a president to act with reckless abandon, to which Trump&#8217;s attorney replied it hadn&#8217;t been a problem for the past 234 years.</p>

<p>Now,&nbsp;<strong>Manhattan DA Alvin Bragg, who&#8217;s currently prosecuting former President Donald Trump, will have to decide whether to seek a retrial of Weinstein</strong>&nbsp;&#8211; who remains in an upstate prison in Rome, NY at the moment. It&#8217;s unclear how the decision will affect his future. In 2022, he&nbsp;<a href="https://www.zerohedge.com/political/harvey-weinstein-found-guilty-rape-sexual-assault-los-angeles-trial">was convicted</a>&nbsp;by a California court of raping a woman in a Beverly Hills hotel and sentenced to&nbsp;<strong>16 years in prison</strong>. The jury found Weinstein guilty of rape, forcible oral copulation, and sexual penetration by foreign object involving a woman known as Jane Doe 1.</p><div class="gOx4xemA"><div id="ifwAd"></div></div>



<p>The 2022 jury acquitted Weinstein of a sexual battery charge made by a massage therapist who treated him at a hotel in 2010, and&nbsp;<strong>was unable to reach a decision on&nbsp;two allegations, including rape, involving Jennifer Siebel Newsom,&nbsp;</strong>the wife of California’s Democratic governor Gavin Newsom. She was known as Jane Doe 4 in the trial, and had testified to being raped by Weinstein in a hotel room in 2005.</p>



<p>Weinstein was convicted of sexually abusing over 100 women &#8211; and was convicted of assaulting two of them in the New York case.</p>



<p>&#8220;<strong>That is unfair to survivors</strong>,&#8221; said actress Ashley Judd, the first actress to come forward with allegations against Weinstein, the <em>NYT</em>&#8216;s Jodi Kantor reports. &#8220;We still live in our truth. And we know what happened.&#8221;</p>

<p>Judge Dykes mandated the punishment following recommendations from the district attorney&#8217;s office, which stated that the nature of the punishment reflects the heinousness of the crimes.</p>



<p>&#8220;The allegations had began several years ago that Mr. Sullilvan had repeatedly raped her and &#8230;the first rape at the age of 14 she became pregnant,&#8221; Assistant District Attorney Brad Cascio <a href="https://www.youtube.com/watch?v=OiDc0h5z8UU" target="_blank" rel="noreferrer noopener">told</a> WAFB.</p>



<p>&#8220;Sex crimes against juveniles are the most malicious crimes we prosecute. <blockquote class="wp-block-quote"><p>According to the district attorney’s office, the Livingston Parish Sheriff’s Office began investigating July 2022 after a young woman told detectives Sullivan raped her multiple times when she was 14 years old, resulting in her becoming pregnant. A DNA test was ordered during the investigation, which officials said proved Sullivan impregnated her.</p><p>Detectives reported that Sullivan groomed the victim and used threats of violence against her and her family to prevent her from disclosing the rapes.</p><div class="QeD7pjDi"><div id="ifwAd"></div></div></blockquote>



<p>Reporter Miranda Thomas notes Louisiana state law currently allows for judges to mandate chemical castration, however a defendant can choose physical castration, as happened in Sullivan&#8217;s case. </p>



<p>News of the severe punishment comes as a bill (<a rel="noreferrer noopener" href="https://legis.la.gov/legis/BillInfo.aspx?i=246652" target="_blank">SB371</a>) introduced by Baton Rouge Democrat Sen. Regina Barrow advanced in the Senate this week which will &#8220;order the surgical castration of a sex offender who has committed an aggravated sexual offense against a minor under 13,&#8221; <a rel="noreferrer noopener" href="https://www.fox8live.com/2024/04/24/legislature-advances-bill-allow-surgical-castration-some-sex-offenders/" target="_blank">according to</a> WVUE.</p>

<p>Attorney Mike Davis suggested Mayes &#8220;stole her 2022 election by disenfranchising voters on Election Day,&#8221; and called the new indictments blatant &#8220;lawfare and election interference.&#8221;</p>
