A “We the People” petition posted to the official White House website is calling for the arrest of Republican frontrunner Donald Trump.
Entitled “Arrest and prosecute Donald J. Trump for incitement to violence. Legal precedent: Brandenburg v. Ohio.,” the petition at the time of publishing has gained more than 35,000 signatures.
Created by a person identifying as “P.M.” of Los Angeles, the petition argues that it is the government’s duty to charge the billionaire for allegedly inciting violence.
Donald J. Trump has been inciting violent acts amongst his supporters. He should be arrested and prosecuted for this,” the petition states.
“Legal precedent: Brandenburg v. Ohio. To wit, the Court held that government cannot punish inflammatory speech. UNLESS that speech is directed to inciting, and is likely to incite, imminent lawless action.”
Clearly, he is doing exactly that.
While supporters of the petition claim to be against such provocations, it is unlikely they will demand legal action against anti-Trump protesters who attacked police and unloaded firearms in Chicago last week.
Police in North Carolina are also debating whether to press charges against Trump following an incident in which one of his supporters sucker punched a protester at a campaign rally.
