Federal authorities have arrested an illegal alien from Brazil who is suspected of raping a child on Martha’s Vineyard – after he was released into the U.S. by Border Patrol and served time for another offense in Massachusetts.

Immigration and Customs Enforcement (ICE) recently announced the apprehension of 24-year-old Warley Neto on the posh, ultra-liberal enclave off Cape Cod.

Neto was picked up by Border Patrol after illegally entering the U.S. near Paso Del Norte, Texas, on March 11, 2018.

He was issued a notice to appear before a federal immigration judge in the future and freed into the interior after 48 hours.

Neto was arrested on Martha’s Vineyard by Edgartown police in February of 2023 on charges of strangulation or suffocation, assault and battery on a family household member, and threatening to commit crime.

He was convicted of those crimes on June 8, 2023, and sentenced to 364 days in prison by Edgartown District Court, which then suspended all but 90 days of the sentence.

Edgartown authorities ignored an ICE detainer lodged against Neto and released him back to the streets of Martha’s Vineyard.

On January 12, 2024, Neto was arrested by police in Tisbury on a warrant for five counts of raping a child and five counts of enticing a minor under 16.

Neto was indicted on those charges four days later in Dukes County Superior Court.

On August 22, ICE Enforcement and Removal Operations (ERO) Boston issued a detainer against Neto that was honored by the Dukes County Sheriff’s Office, which transferred custody of the Brazilian to ICE the following day.

“Warley Neto allegedly repeatedly assaulted a Massachusetts child and represents a significant threat to the safety of our neighborhoods,” ERO Boston Field Office Director Todd M. Lyons said in a statement.

“We are grateful for the cooperation of the Dukes County Sheriff’s Office for prioritizing public safety and allowing Neto’s safe transfer of custody to ERO. Too often local jurisdictions refuse to honor immigration detainers and release dangerous offenders back into the community to reoffend.”

Authorities continue to catch dangerous foreign criminals illegally present in the U.S., many of whom have been previously released into the country by law enforcement agencies.
