After nearly two years of prosecuting Trump in two separate cases, the special counsel leaves the DOJ without securing a single conviction against the President-elect.

Special Counsel Jack Smith has resigned from the Justice Department on Saturday, officially marking the end of his failed lawfare crusade against President-elect Donald Trump.

Smith submitted his resignation in a court filing submitted to Justice Aileen Cannon, also urging her not to extend a court order she issued last week blocking release of his final report of the criminal cases he brought against Trump, Politico first reported.

“The Special Counsel completed his work and submitted his final confidential report on January 7, 2025, and separated from the Department on January 10,” a footnote in the filing read.

After nearly two years of prosecuting Trump in two separate cases, Smith leaves the DOJ without securing a single conviction against the President-elect.

Smith dropped his January 6 “election interference” case against Trump days after his historic election win in November.

Judge Cannon dismissed Smith’s “classified documents” case against Trump in July, concluding that the special counsel was unlawfully appointed.

Smith was nevertheless poised to release his final report of his “classified documents” case against Trump, but Judge Cannon blocked the report from release this week.

The Eleventh Circuit Court of Appeals on Thursday declined to immediately overturn Judge Cannon’s temporary injunction, but instead ruled that the DOJ can file a separate appeal if they want to release the report earlier than this Sunday when Cannon’s injunction expires.

Smith’s decision to resign isn’t all that surprising given Trump was reportedly planning to fire him and his entire team at the DOJ upon taking office.

“President-elect Donald Trump plans to fire the entire team that worked with special counsel Jack Smith to pursue two federal prosecutions against the former president, including career attorneys typically protected from political retribution,” The Washington Post reported.
