The United States Supreme Court on Tuesday ruled Title 42 border restrictions can remain in place until a February court challenge can be heard.
The Trump-era covid deportation policy allows the government to deport illegal immigrants crossing U.S. borders without allowing them to seek asylum.

The ruling is being celebrated as a victory for GOP-led states that fought to keep Title 42 in place.
Justices John Roberts, Samuel Alito, Brett Kavanaugh, Amy Coney Barrett and Clarence Thomas voted to uphold the decision in a 5-4 vote Tuesday.
As Rep. Jim Jordan (R-OHIO) pointed out on Twitter Tuesday, “We saw record illegal immigration in 2022. If Title 42 ends, it’s going to get even worse in 2023.”
“Thank God that Trump won in 2016 and we have the majority on the court. 4 Communists Justices voted in favor of our country being invaded,” wrote Republican Virginia congressional candidate Jarome Bell.
In his dissent, Judge Neil Gorsuch wrote, “Even the federal government acknowledges ‘that the end of the Title 42 orders will likely have disruptive consequences. But the current border crisis is not a COVID crisis. And courts should not be in the business of perpetuating administrative edicts designed for one emergency only because elected officials have failed to address a different emergency. We are a court of law, not policymakers of last resort.”
This is actually a fair point by Gorsuch but additionally, the United States shouldn’t need new laws and rules to deal with illegal immigration as the Constitution already addresses the issue and those who enter the country illegally should be deported as they are lawbreakers.
Rep. Lauren Boebert (R-CO) echoed this sentiment in a recent Twitter post, telling her followers we already have laws on the books that are deliberately being ignored by politicians.
Touching on Title 42 in a Monday social media post, Donald Trump wrote, “TITLE 42 is saving what’s left of our Country. Ending it, on top of our incredible, but now decimated, STAY IN MEXICO Policy, would greatly speed up the destruction of our Country. Both could have been put into the horrendous Mitch McConnell inspired ‘gift to the Democrats and China’ OMINOUS Bill. What a disaster this Administration, coupled with the almost as bad RINOS, is. JUST CAN’T GET ANY WORSE!”
White House press secretary Karine Jean-Pierre issued a statement Tuesday, saying the administration will comply with the Supreme Court’s order but that they are “advancing our preparations to manage the border in a secure, orderly, and humane way when Title 42 eventually lifts.”
The Biden administration will also continue expanding legal pathways for immigration.
“Title 42 is a public health measure, not an immigration enforcement measure, and it should not be extended indefinitely,” the statement reads. “To truly fix our broken immigration system, we need Congress to pass comprehensive immigration reform measures like the ones President Biden proposed on his first day in office. Today’s order gives Republicans in Congress plenty of time to move past political finger-pointing and join their Democratic colleagues in solving the challenge at our border by passing the comprehensive reform measures and delivering the additional funds for border security that President Biden has requested.”
“Title 42 is a public health measure, not an immigration enforcement measure, and it should not be extended indefinitely,” she added.
While this is a limited-time win, there are still millions of illegals pouring through the southern border and serious action must be taken whether Title 42 is in place or not.
