Disgraced former FBI Deputy Director Andrew McCabe said Tuesday the underlying charges outlined in the Manhattan DA’s indictment of Donald Trump are a “disappointment.”
“If I had to characterize it, it’s disappointment,” McCabe told CNN anchor Jake Tapper. “I think everyone was hoping we’d see more about the direction that they intended to take this prosecution.”

The indictment revealed Trump was charged with 34 counts of falsifying business records in the first degree.
“What is the legal theory that ties that very solid 34-count misdemeanor case, to the intent to conceal another crime, which is what makes it a felony?” McCabe asked.
McCabe, who was fired over his key role in perpetuating the Russia collusion hoax, admitted that District Attorney Alvin Bragg’s indictment doesn’t actually lay out a crime.
“It simply isn’t there,” he admitted.
“It’s possible that the DA has an elaborate and solid theory that’s backed up by a lot of evidence and he’s just decided to continue to conceal that at this point. I think it’s a strange decision on his part.”
McCabe then said he wouldn’t be surprised if a jury was unconvinced by the case brought by the Manhattan DA’s office.
“At the end of the day, if all of our legal friends read this indictment and don’t see a way to a felony, it’s hard to imagine convincing a jury that they should get there,” he said.
McCabe is just another talking head on CNN that’s been lamenting about the weak underlying charges after the indictment was unsealed during Trump’s arraignment on Tuesday.
