Federal Judge Prevents Alabama Removing Noncitizens from Voter Rolls

The state of Alabama will have to restore voters purged from the rolls, including noncitizens

A federal judge has ordered Alabama’s Secretary of State to halt all efforts to remove noncitizens from the voter rolls.

Judge Anna Manasco of the Northern District of Alabama made the order on the basis that the state had violated a federal prohibition against altering the voter rolls within 90 days of an election.

“For decades, federal law has given states a hard deadline to complete systematic purges of ineligible persons from voter rolls: no later than ninety days before a federal election,” Judge Manasco wrote in her injunction.

“This year, Alabama Secretary of State Wes Allen… blew the deadline when he announced a purge program to begin eighty-four days before the 2024 general election.”

The order requires the Secretary of State to provide guidance to all of the state’s 67 counties so they can ensure anybody removed from the voter rolls during the so-called “Quiet Period” is restored and notified of their restoration.

On 13 August, Allen said the state had identified “3,251 individuals who are registered to vote in Alabama who have been issued noncitizen identification numbers by the Department of Homeland Security.” He said he would tell counties to “inactivate and initiate steps necessary to remove all individuals who are not United States citizens.”

The DoJ then sued Alabama in September, claiming it had violated the 90-day Quiet Period Provision in the National Voter Registration Act.

The District Court amalgamated the DoJ case within another suit brought by organizations including the Alabama Coalition for Immigrant Justice and League of Women Voters.

The Alabama lawsuits were two of many that have been filed as part of the 2024 election campaign. The Republican National Committee told The Epoch Times that it is currently involved in 130 lawsuits spanning 26 states, with a clear focus on ensuring election integrity across the nation.
