James O’Keefe is teaming up with attorney Mike Yoder to sue the governor of Hawaii after a new provision prohibits journalists from investigating in the wake of the Maui wildfires.

“The first and most important thing is just so people in Hawaii and Lahaina understand that what we’re trying to do is ensure that the land that they are so sincere about and that they care so much about isn’t taken from them a second time,” Yoder explained to O’Keefe.

“If we don’t have freedom of the press, If we don’t have the freedom of speech and people are kept in the dark as to what the government is doing and what is going on, then there’s no way to ever have a people-led or people-controlled society.”

O’Keefe’s and Yoder’s lawsuit seeks to “invalidate the criminalization of protected First Amendment activity.”

The lawsuit pertains to a revised statute recently added to Hawaii’s legal code which grants the government “additional powers in an emergency period,” one of which is the power to “suspend electronic media transmission.”

The provision additionally allows the government to “quarantine” people, destroy property, suspend laws and adjust the hours for voting, all in the name of public safety.
