Would be first state to test “opt out” process

A new bill proposed in Nevada seeks to automatically enroll residents in the state’s organ donation program.

If passed, Senate Bill 134 would automatically opt-in Nevadans as organ donors when they apply for drivers licenses.

Residents would then need to check a box declaring they want to “opt out” of the program if they don’t want their organs harvested.

The proposal follows a similar opt-in program implemented in Nova Scotia, Canada earlier this year.

The bill “changes the existing system… in which a person must opt in to be a donor, to a system in which a person is a donor unless the person opts out of donation,” says the bill’s author St. Sen. James Ohrenschall.

The Nevada Osteopathic Medical Association wants the legislation to go forward, writing, “While no state currently uses the ‘opt out’ process, Nevada has the opportunity to lead the effort to increase organ donations nationally.”

Republican legislators, however, say constituents are concerned with the government having the authority to make decisions over their bodies.

“I’ve been getting some questions coming at me, from disparate sources, that have to do with the intersection between government and the use of our bodies without our consent,” Senate Government Affairs Committee member Sen. Keith Pickard (R-Clark) said, according to Nevada Current.

“The general consensus has been that the government can’t make choices over our bodies, over our personal autonomy. This (proposed bill) would seem to do violence to that.”

People in the comments on YouTube and Facebook blasted the automatic opt-in process.

“This is terrifying,” a top commenter on YouTube wrote, with another adding, “They should pay the family for harvested organs.”

Another person on Facebook commented the process would be a violation of medical ethics:

“That’s HORRIBLE!!! This is a violation of medical ethics and is VERY wrong. Organ donation is a highly personal decision and it should NEVER be assumed that it’s what the dying patient would have wanted. Vote NO on this heinous bill!”

Even organ donors chimed in, with a few calling the idea ridiculous.

“I am an organ donor by choice, MY choice and I do not agree with the opt-out idea, this should remain an opt-in choice made by individuals not the government,” one organ donor stated.

“I have been an organ donor since I was old enough to consent but this is so very wrong! Do lawmakers even consult with the people they represent? We can address that problem,” said another organ donor.

Alex Jones has warned against registering as an organ donor, recounting how people in the medical field have told him hospitals will let “organ donors” die on the operating room table in order to harvest their organs and sell them at a handsome profit.
