The Pennsylvania Supreme Court reversed a recent lower-court ruling that two of the most important counties in the battleground state would not be allowed to discard mail-in votes with incorrect envelope dates.
In its ruling on Friday, the Pennsylvania Supreme Court said the Commonwealth Court of Pennsylvania “lacked subject matter jurisdiction to review the matter.”
The Supreme Court ruling means that mail-in votes that lack a date or have an incorrect date on the envelope cannot be counted.
While the decision was welcomed by the Republican Party, which knows that it is likely to improve Donald Trump’s chances in the key battleground state, groups including the American Civil Liberties Union have said they will pursue other legal options in an attempt to nullify the decision.
The Commonwealth Court had said that the discarding of undated and incorrectly dated ballots constitutes a violation of the right to vote. Around 16,000 mail-in ballots were disqualified for irregularities in April’s primary election in the state. Nearly half were disqualified because they lacked signatures or were incorrectly dated.
