Supreme Court Upholds Biden Ghost Gun Regulations

Conservatives call on Congress to draft legislation allowing citizen access to 'ghost gun' kits.

The United States Supreme Court on Wednesday upheld a Biden-era “ghost gun” restriction in a 7-2 ruling.

Conservative justices Samuel A. Alito Jr. and Clarence Thomas each filed dissenting votes while their fellow conservative Justice Neil M. Gorsuch wrote the majority opinion.

The court allowed 2022 Biden administration rules tightening access to ghost gun weapons kits, claiming the firearms are being used in violent crimes more frequently.

The regulations include, “requiring vendors and gun makers to be licensed to sell the kits, mandating serial numbers on the components so the guns could be tracked and adding background checks for would-be buyers.”

NPR explained, “They’re called ghost guns because unlike guns bought from a licensed dealer, these build-it-yourself gun kits have no serial numbers stamped on the assembled firearm, so the guns can’t be traced if found at a crime scene. And there are no background checks done on people who purchase the kits. The kits can be bought online without any background check, and without presenting identification. In fact, according to regulators, the kits can be bought anonymously with cryptocurrency, using a pre-paid debit card.”

Opponents of the ruling argue ghost guns don’t meet the definition of a firearm based on descriptions in the Gun Control Act of 1968 and that most guns used in criminal activities are “real” guns.

2nd Amendment activist and Texas gun store owner Michael Cargill called on Congress to take action and preserve citizen access to ghost gun kits, writing on 𝕏, “When I sat in the US Supreme Court during the Cargill Bump Stock case, I said that SCOTUS does not have the appetite to remove machine guns, suppressors, or SBRs from the NFA list, nor will they overturn Ghost guns. Stop asking questions you don’t want the answer to. Congress is our only hope.”

Perhaps, the Republican-controlled Congress will follow Cargill’s suggestion and create legislation addressing the ghost gun issue.
